Res 981 - Uniform Fire Code Sta COUNCIL BILL NO. 1202 RESOLUTION NO. 981 A RESOLUTION APPROVING CERTAIN CODE AND STANDARDS KNOWN AS THE UNIFORM FIRE CODE AND UNIFORM FIRE CODE STANDARDS TO BE ENFORCED WITHIN THE CITY OF WOODBURN BY THE WOODBURN FIRE DISTRICT. WHEREAS, pursuant to the intergovernmental agreement between the City of Woodburn and the Woodburn Rural Fire Protection District dated February 13, 1984, enforcement of the Uniform Fire Code is the legal responsibility of the Woodburn Fire District; and WHEREAS, ORS 478.924 requi res that the governing body of any city within a rural fire protection district approve the fire code enforce- ment by the district within the boundaries of the city; NOW, THEREFORE, THE CITY OF WOODBURN RESOLVES AS FOLLOWS: Section 1. The City Council approves the Uniform Fi re Code and Uniform Fi re Code Standa rds, as amended and adopted by Woodburn Fi re District Ordinance 1990.1 (a copy of which is attached for reference), and authorizes their enforcement by the Woodburn Fire District within the boundaries of the City of Woodburn. BE IT ORDAINED by the Board of Directors of Woodburn Fire District, a district duly authorized under and pursuant to the provisions of Chapter 478, Oregon Revised Statutes, located In Marion County, Oregon as follows: Section 1. ADOPTION OF UNIFORM FIRE CODE. There is hereby adopted by the Board of Directors of Woodburn Fire District for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion, that certain codes and standards known as the Uniform Fire Code, as amended by the Oregon State Fire Marshal, including Appendix Chapters I-A, I-C, III-A, III-B, III-C, V-A, V-B, VI-A, VI-B, VI-C, and VI-D, and the Uniform Fire Code Stan- dards published by the Western Fire Chiefs Association and the International Conference of Building Officals, being particularly the 1988 editions thereof and the whole thereof, save and except such portions as are hereinafter deleted, modified or amended by Section 4 of this ordinance, one (1) copy of which Code and Standards shall be filed in the office of the State Fire Marshal of the State of Oregon, one (1) copy of which shall be posted at the Fire District Headquarters Office, 1776 Newberg Highway, Woodburn, Oregon 97071, and one (1) copy of which shall be posted in each Woodburn Fire District fire station, and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this ordinance shall take effect, the provisions thereof shall be controlling within the limits of Woodburn Fire District. Section z. ESTABLISHMENT AND DUTIES OF FIRE PREVENTION DIVISION. (a) The Uniform Fire Code shall be enforced by the Fire Prevention Division of the Woodburn Fire District which is hereby established and which shall be operated under the supervision of the Fire Marshal. (b) The Fire Marshal in charge of the Fire Prevention Division shall be appointed by the Chief of the Woodburn Fire District on the basis of examination to determine his qualifications. (c) The Chief of the fire department may detail such members of the fire department as inspectors as shall from time to time be necessary. The Chief of the fire department shall recommend to the Board of Directors of the Woodburn Fire District the employment of technical inspectors, who, when such authorization is made, shall be selected through an examination to determine their fitness for the position. Section 3_ DEFINITIONS (a) Wherever the word "jurisdiction" is used in the Uniform Fire Code, it shall be held to mean the area included within the boundaries of the Woodburn Fire District. AMENDMENTS MADE IN THE UNIFORM FIRE COOL The Uniform Fire Code, with Oregon amendments, is amended and changed In the following respects: 1) Section 11.201 (a) is deleted in its entirety. Subsequent paragraphs are renumbered "a", lib", and "C". 2) Section 10.301 (c) is amended with the addition of the following paragraphs, identified as "(3) and (4)"; (3) The Chief of the fire department may cause fire flows to be estimated for each new or remodeled building, groups of buildings, occupancy or addition in accord- ance with Appendix lII-A of this Code, Results of required fire flows will be applied as appropriate to insure that the firefighting capability of the district's fire department and the capability of Woodburn Fire District to provide adequate amounts of water for fire suppression purposes are not exceeded, This fire flow is presently stated as a maxi- mum of 3000 gallons per minute. Where potential fire flows in excess of 3000 gallons per minute may be required, considerations shall be given to structure separations, instal- lation of automatic fire extinguishing systems, fire walls or other recognized elements to reduce the maximum amount of required fire flow to 3000 gallons per minute, The installation and maintenance of fire walls and automatic fire extinguishing systems shall be accomplished in accordance with local building regulations. Where sufficient water supplies for fire flow requirements are not available or are prohibitively expensive, the Board of Directors of Woodburn Fire District may establish Board Policy allowing substitution of approved fire detection and reporting systems in lieu of the required water supply. (4) An approved water supply system capable of supplying the required fire flow for fire protection shall be provided to all premises upon which buildings or portions of buildings are hereafter constructed. When any portion of the building protected is in excess of 150 feet from a water supply on a public street, as measured by an approved route around the exterior of the building, there shall be provided, when required by the Chief, on-site fire hydrants and mains capable of supplying the requIred fire flow. Water supply may consist of reservoirs, pressure tanks, elevated tanks, water mainS with fire hydrants or other fixed systems capable of providing the required fire flow. In setting requirements for fire flow, the Chief may be guided by the provision In Appendix III-A of this code. The location, number and type of fire hydrants connected to a water supply capable of delivering the required fire flow shall be provided on the public street or on the site of the premises to be protected as required and approved by the Chief. All hydrants shall be accessible to the fire department apparatus by roadways meeting the requirements of Section 10.207 and district standards. 3) Section 14.406 (a) is deleted and the following language will be substituted for the paragraph. All required fire alarm and detection systems shall be inspected, tested, and maintained as least annually (more often when circumstances dictate) by a qualified technician. The technician will then certify such inspection, testing, and m'aintenance has been accomplished by attaching a tag or certi ficate to the system control panel indicating 1) what was done, 2) when it was done, and 3) who accomplished the work. All inspections, testing and maintenance shall be as set forth in this article, U.F.C. Standard No. 14-1, N.F .P.A. Standard 72E, and other nationally recognized standards. 4) Section 79.115 IS deleted in its entirety. 5) The following sections, deleted in the State of Oregon amendments, are adopted as contained in the original 1988 U.F.C.: 10.207 10.208 10.209 10.304 11.203 (b) 11.302 25.102 Article 77, Divisions II, III, IV 87,103 (b) and (c) Section 5. APPEALS Whenever the Chief disapproves an application or refuses to grant a permit where applied for, or when it is claimed that provisions of the code do not apply, or that the true intent and meaning of the code have been misconstrued or wrongly interpreted, the appli- cant may appeal from the decision of the Chief to the Board of Appeals within thirty (30) days from the date of the decision appealed. Section 6. PENAL TIES (a) Any person who shall violate any of the provisions of this Code or Standard hereby adopted or fail to comply therewith, or who shall violate or fail to comply with any order made thereunder, or who shall build in violation of any detailed statement of speci fic- ations or plans submitted and approved thereunder, or any certificate or permit issued thereunder, and from which no appeal has been taken, or who shall fail to comply with such an order as affirmed or modified by the Board of Directors of Woodburn Fire District or by a court of competent jurisdiction, within the time fixed herein, shall severally for each and every such violation and noncompliance, respectively, be guilty of a mis- demeanor, punishable by a fine of not less than $10.00 nor more than $50.00 for each day's neglect as provided by ORS 479.990 (4). The imposition of one penalty for any violation shall not excuse the violation or permit it to continue; and all such persons shall be required to correct or remedy such violations or defects within a reasonable time; and when not otherwise specified, each day that prohibited conditions are maintained shall constitute a separate offense. (b) The applications of the above penalty shall not be held to prevent the enforced removal of prohibited conditions. r ......_, --'-,._-~.._-_... "".--. . Ordinance 1990.1 Page 4 Section 7. REPEAL OF CONFLICTING ORDINANCES. All former Drdinances Dr parts thereDf cDnflicting or inconsistent with the provIsions of this ordinance or of the CDde or Standards hereby adopted are hereby repealed. Section 8. VALIDITY The BDard of Directors of the Woodburn Fire District hereby declare that should this section, paragraph, sentence or word of this ordinance or of the Code Dr Standards hereby adopted be declared for any reason to be invalid, it is the intent of that board that it wDuld have passed all other portions Df this ordinance independent of the elimination here from Df any such portions as may be declared invalid. Section 9. DATE OF EFFECT This Drdinance shall take effect and be in force from and after approved by the BDard Df DirectDrs of the WODdburn Fire District and after approval by the CDunty CDmmis- sioners of Marion County, City CDuncils of Gervais and Woodburn, or thirty days whichever is later.
