Res 1095 - PH Vacate Ease Ind P COUNCIL BILL NO. 1352 RESOLUTION NO. 1095 A RESOLUTION SETTING A TIME AND PLACE FOR A PUBLIC HEARING ON THE QUESTION OF WHETHER TO VACATE UTILITY EASEMENTS IN THE INDUSTRIAL PARK ADDITION NO.3. WHEREAS, The City Council has decided, pursuant to ORS 271.130, to consider vacation of two utility easements in the Industrial Park Addition No.3, and WHEREAS, the City council seeks the input of affected property owners, and WHEREAS, a public hearing should be set, now, therefore, THE CITY OF WOODBURN RESOLVES AS FOLLOWS: Section 1. The properties to be considered for vacation are as follows: 1) Vacate that portion of the 20 feet wide utility easement as shown on Partition Plat No. 91-38, the centerline of which is described as follows: Beginning at a point near the Easterly right-of-way of Progress Way, said point being 172 feet, more or less North 1051'59" East from the intersection with the North line of Mt. Hood Avenue and 20 feet South 88005'00" East; thence South 88005'00" East 721.6 feet to a point 172 feet North 1055'00" East from the North right-of-way of Mt. Hood Avenue; Thence South 1055' West 157 feet, more or less to an existing easement (Reel 28, Page 1827) situated in Lots 4 and 5, Wallilale Home Tracts in the North 1/2 of Section 8, Township 5 South, Range 1 West Willamette Meridian, Marion County, Oregon. 2) Vacate the North 17 feet of the 32 feet wide utility easement as shown on Partition Plat No. 91-38 and described as follows: Beginning at the intersection of the North line of the 32 feet wide utility easement and the West line of the 16 feet wide utility easement; Thence South 1051'45" West 17 feet; Thence North 88005'00" West parallel to and South 17 feet from the North line of the easement across Lots 3, 4, and 5 to a point 0.17 feet South 1055'00" West from an angle in the North line of the 15 feet easement; Thence North 1 055'00" East 17 feet to the angle on the West end of the 32 feet wide easement; Thence South 88005' East 536.92 feet, more or less to the point of beginning, situated in Lots 3, 4, and 5 Wallilale Home Tracts in the North 1/2 of Section 8, Township 5 South, Range 1 West, Willamette Meridian, Marion County, Oregon. That the Woodburn City Council set a public hearing for January 13, 1992, in the Woodburn City Council Chambers, 270 Montgomery Street, Woodburn, Oregon, on whether the utility easements in the Industrial Park Addition No.3 should be vacated. Section 3. The City Recorder is directed to provide notice of said hearing in the manner required by Oregon Revised Statute 271 .110.
