RESOLUTION NO. 1165
A RESOLUTION ENTERING INTO AN INTERGOVERNMENTAL AGREEMENT WITH
MARION COUNTY FOR THE PURPOSE OF PROVIDING GAMING LAW ENFORCEMENT
AND AUTHORIZING A NEEDS ASSESSMENT STUDY.
WHEREAS, O,R,S, 461.546 provides for revenue sharing of funds generated
from the on-line video lottery operated by the Oregon State Lottery; and
WHEREAS, each county is required to enter an intergovernmental agreement
with each city located within its jurisdiction in order to provide gaming law
enforcement; and
WHEREAS, Marion County has agreed to authorize a needs assessment study
to determine the most appropriate use of the lottery revenues for gaming law
enforcement; NOW, THEREFORE,
THE CITY OF WOODBURN RESOLVES AS FOLLOWS:
Section 1. That the city enter into an intergovernmental agreement with
Marion County authorizing a needs assessment study to determine the most
appropriate use of lottery revenues for gaming law enforcement, the funding for said
study to be paid by Marion County, said funds not to exceed $15,000,
Section 2. That the Chief of Police, acting for and on behalf of the city, be
authorized to execute intergovernmental agreement, a copy of which is attached

INTERGOVERNMENTAL AGREEMENT
This agreement is entered into pursuant to the provlslons of ORS
Chapter 190 and ORS Chapter 461 by the following parties:

Gervais Police Department
Hubbard Police Department
Jefferson Police Department
Keizer Police Department
Marion County District Attorney's Office
Marion County Sheriff's Office
Mt. Angel Police Department
Oregon State Police
Salem Police Department
Silverton Police Department
Stayton Police Department
Turner Police Department
Woodburn Police Department
WHEREAS, ORS 461,546 established revenue sharing with Oregon
counties, said revenues to be generated from on-line video lottery
operated by the Oregon State Lottery; and
WHEREAS, lottery revenues distributed to each county are to be
expended solely for gaming law enforcement and community mental health
programs to treat gambling addiction; and
WHEREAS, each county is mandated to enter into intergovernmental
agreements with cities incorporated within its jurisdiction to provide
gaming law enforcement; and
WHEREAS, it is in the best interest of Marion County to ensure
that the expenditure of these funds is properly coordinated with and
supportive of existing needs for gaming law enforcement and activities
of federal, state and local agencies;
NOW, THEREFORE, the parties agree as follows:
(1) A needs assessment study will be conducted to determine the
most appropriate use of lottery revenues for gaming law enforcement in
Marion County,
(a) For purposes of the needs assessment study, funds will
be expended to hire, equip and supply two temporary employees, said
funds not to exceed $15,000, Said expenditures may include, but not be
limited to, capital outlay for the purchase of word processing and data
processing equipment,

(b) Richard Bracken will be hired at the rate of $21,82 per

(c) One clerical position will be hired at the rate of pay
not to exceed $10,23 per hour commensurate with experience. Duties
will be to provide clerical support to Richard Bracken for purposes of
the needs assessment and final report thereon.
(2) The needs assessment study will be completed by not later
than sixty days after the date of hiring of the person conducting the
needs 'assessment study,
(3) Findings from the needs assessment study will be
distributed by the District Attorney to the signers herein by not later
than 14 days after the final report is completed and presented to the
District Attorney, At time of distribution, the District Attorney will
suggest a meeting date for the signers herein to discuss the findings
contained within the final report,
(4) Upon receipt of the findings from the needs assessment study,
the parties will consider and develop a gaming law enforcement
procedure within Marion County and will draft additional
intergovernmental agreements or resolutions as needed to implement said
enforcement procedures, including a procedure for continued sharing of
revenue from the Oregon State Lottery.
(5) For purposes of the needs assessment study, persons hired
will be temporary employees of Marion County and will be acting under
the supervision of the Marion County District Attorney's Office,
(6) For purposes of the needs assessment study, Marion County
will administrate expenditures of lottery revenues in order to
effectuate this agreement. In consideration of its administrative
tasks, Marion County will be compensated at the rate of seven (7) per
cent of Marion County's expenditures for this needs assessment study,
(7) This agreement will remain in full force and effect until
completion of the needs assessment study and presentation of the
results of said study to the parties to this agreement,
