Res 1168 - Agmt 10,854 COUNCIL BILL NO .11159 RESOLUTION NO. 1168 A RESOLUTION ENTERING INTO AN AGREEMENT SUPPLEMENTING COOPERATIVE AGREEMENT NUMBER 10,854 CONCERNING IMPROVEMENTS TO HARDCASTLE AVENUE FROM ITS INTERSECTION WITH HIGHWAY 99E TO APPROXIMATELY 2900 FEET WEST AND AUTHORIZING THE MAYOR AND CITY RECORDER TO SIGN SUCH AGREEMENT. WHEREAS, ORS Chapter 366 authorizes cooperative agreements between the State and a City for performance of improvement projects, and WHEREAS, The Woodburn City Council approved Resolution 1099 on January 13, 1992 authorizing entering into Cooperative Agreement 10,854, and WHEREAS, The State of Oregon signed Cooperative Agreement 10,854 on February 12, 1992, and WHEREAS, It is in the best interest of the City to enter into a supplemental agreement to cost share overlay of that portion of Hardcastle Avenue affected by this project, NOW THEREFORE THE CITY OF WOODBURN RESOLVES AS FOLLOWS: Section 1. That the City of Woodburn enter into a supplemental agreement to Agreement 10,854 which is attached as Exhibit "A" and by this reference incorporated herein with the State of Oregon to overlay Hardcastle Avenue from its intersection with Pacific Highway East (Hwy 99E) to approximately 2900 feet west. Section 2. Contracts & Agreements No, 10,854 People: The State of Oregon, by and through its Department of Transportation (State), and the City of Woodburn, by and through its City Officials (City), entered into Cooperative Improvement Agreement No. 10,854 dated February 12, 1992, concerning improvements to Pacific Highway East from Woodburn's North City Limits to Lincoln Street, hereinafter referred to as "project". The project consists of widening and overlaying Pacific Highway East (99E) from Woodburn NCL to Lincoln Street; constructing shoulders for bike paths, curbs, sidewalks, a storm sewer system, and signal reconstruction at the intersections of Lincoln Street and 99E, Hardcastle Avenue and 99E, and Hillsboro-Silverton Highway and 99E, Location of project is approximately as shown on the sketch map attached hereto, marked Exhibit A, and by this reference made a part hereof, State and City have now determined that the aforementioned agreement, although remaining in full force and effect, should be supplemented by this agreement to include the paving of Hardcastle Avenue from Pacific Highway East (99E), to a point approximately 2900 feet west of 99E, This project supplement will be equally financed by City and State: $10,000 will corne from City funds, and $10,000 will corne from State funds. Total supplement costs are estimated at $20,000, State and City will be equally responsible for supplement costs above $20,000, if any there may be. Any further reference to Agreement No, 10854, dated February 12, 1992, shall be supplemented to include the following: State and City plan and propose to overlay Hardcastle Avenue from its intersection with Pacific Highway East (99E), to approximately 2900 feet west (Engineer's Station 71+00), which is the terminus of the newly installed storm sewer system in the roadbed of Hardcastle Avenue, Said overlay will be from curb to curb, B1291005 -l- ~-- .~-, ".^ ~-..._'--- , -1t-."",, ".~-"-,,"....
