Res 1470 - Auth City Share Cons COUNCIL BILL NO. 1870 RESOLUTION NO. 1470 A RESOLUTION AUTHORIZING CITY COST SHARING FOR THE CONSTRUCTION OF NEW SIDEWALKS AND DRIVEWAY APRONS WHEN IT IS IN THE PUBLIC INTEREST IN ORDER TO PROVIDE CONNECTIVITY AND SAFETY WHEREAS, the city has established standards regulating the construction, alteration and repair of city sidewalks and driveway aprons; and WHEREAS, in 1988 the City Council passed Resolution No. 891 creating a city cost sharing program for the repair and construction of new sidewalks,.cart1s, and driveways when it is in the public interest (the "sidewalk subsidy program"); and 1mended 3/9/98 WHEREAS, the policy established by Resolution No. 891 has been successful and should be extended to authorize cost sharing for the construction of new sidewalks~, and driveway aprons; NOW, THEREFORE, amended 3/9/98 THE CITY OF WOODBURN RESOLVES AS FOLLOWS: Section 1. When it is determined by the City Engineer that the public interest is served and that a segment of new sidewalk is needed to provide connectivity for the safe and efficient movement of pedestrians, the city may cost share in the repair and new construction of city sidewalks and driveway aprons according to the following formula: SIDEWALKS Construction Cost First $500 $500 to $1,500 Above $1,500 Benefitted Owners o 25% 33% ~ 100% 75% 67% DRIVEWAY APRONS Construction Cost First $500 Above $500 100% 75% o 25% The cost sharing subsidy for the construction of driveway aprons shall be limited to a maximum of Page I - COUNCIL BILL NO. 1870 RESOLUTION NO. 1470 ...'" .--r" " $500 and is applicable only when the driveway apron and sidewalk are constructed together in one project. Section 2. This resolution is not applicable to new residential and commercial subdivisions or developments since these are addressed in the city subdivision ordinance and development policies. Section 3. The cost sharing subsidy provided by this resolution shall be administered at the sole discretion of the city. Section 4. This resolution in no manner relieves or absolves a property owner adjacent to a sidewalk from the legal responsibility of repairing and maintaining a sidewalk or from the duty to indemnify and defend the city for damages to persons or property caused by the failure of the property owner to maintain a sidewalk. Section 5. The cost sharing subsidy provided by this resolution is based upon funding being available and the City Engineer is hereby authorized to make cost sharing decisions within the budget constraints and the limited resources available to the Public Works Department. When needed, the City Engineer is authorized to utilize public works crew and equipment to accomplish work in public rights-of-way or public easements.
