RESOLUTION NO. 1673
A RESOLUTION APPOINTING N. ROBERT SHIELDS, CITY ATTORNEY, AS
TRUSTEE ON THE TRUST DEED GRANTED ON HOUSING REHABILITATION
LOAN NO. R-90-01 TO WALTER E. AND ELGIE G. ZENI AND DIRECTING THAT
THE REAL PROPERTY SECURED BY THE TRUST DEED BE RECONVEYED TO
THE GRANTORS.
WHEREAS, as part of the Housing Rehabilitation Program, a certain trust deed dated
January 29, 1991, was executed and delivered by Walter E. Zeni and Elgie G. Zeni, as grantors,
and recorded on March 5, 1991 on Reel 836, Page 500 of the Real Property Records of Marion
County, Oregon; and
WHEREAS, the City of Woodburn is the designated beneficiary on this trust deed but
no trustee was designated; and
WHEREAS, since the obligation secured by the trust deed has been paid and satisfied, it
is necessary to appoint a trustee to reconvey the property to the grantors; and
WHEREAS, N. Robert Shields, City Attorney, is legally qualified to serve as trustee;
NOW, THEREFORE,
THE CITY OF WOODBURN RESOLVES AS FOLLOWS:
Section 1. The City Council directs that N. Robert Shields, City Attorney, be appointed
as trustee on the trust deed granted by Walter E. Zeni and Elgie G. Zeni dated January 29, 1991
and recorded on March 5, 1991 on Ree1836, Page 500 of the Real Property Records of Marion
County, Oregon. This appointment is made as a condition ofN. Robert Shields' employment as
City Attorney and he shall serve as trustee in the course and scope of that employment.
Section 2. That N. Robert Shields, City Attorney, is further directed to reconvey the real
property subject to the trust deed to Walter E. Zeni and Elgie G. Zeni, grantors, after an
assurance that the amount due to the city has been fully paid and satisfied.
Section 3. That the City Administrator and City Attorney are hereby authorized to
execute the documents necessary to implement this resolution.

Records of Marion County, Oregon.
The City of Woodburn, as the present beneficiary under the trust deed hereby appoints N.
Robert Shields, Woodburn City Attorney, 270 Montgomery Street, Woodburn, Oregon 97071, as
trustee under the trust deed, effective immediately.

entitled thereto by the terms of the trust deed, the estate now held by you under the same.
All sums and other obligations secured by the trust deed have been fully paid and

DEED OF RECONVEYANCE
The undersigned trustee under that certain trust deed dated January 29, 1991, executed
and delivered by Walter E. Zeni and Elgie G. Zeni as grantors and recorded on March 5, 1991 on
Reel 836, Page 500 of the Real Property Records of Marion County, Oregon, conveying real
property in that county described as follows:
Lot 34, Block 35 Woodburn Senior Estates No.4, in Marion County, Oregon
having received from the beneficiary under the trust deed a written request to reconvey, reciting
that the obligation secured by the trust deed has been fully paid and performed, hereby does
grant, bargain, sell and convey, but without any covenant or warranty, express or implied, to the
person or persons legally entitled thereto, all of the estate held by the undersigned in and to the
described premises by virtue of the trust deed.
