Res 1571 - Grant Agrmt #17518 COUNCIL BILL NO. 2024 RESOLUTION NO. 1571 A RESOLUTION ENTERING INTO AMENDMENT NUMBER 1 TO GRANT AGREEMENT NO. 17518 WITH THE STATE OF OREGON AND AUTHORIZING THE MAYOR AND CITY RECORDER TO SIGN SUCH AGREEMENT. WHEREAS, the State of Oregon acting through the Oregon Transportation Commission is authorized to enter into agreements and disburse funds for the purpose of supporting public transportation pursuant to ORS 184.670 to 184.733, and WHEREAS, the City of Woodburn has applied for public transportation operating assistance funds for Fiscal Year 1999-2000 under Title 49, United States Code, Chapter 5311, Small City and Rural Areas Program and WHEREAS, the State of Oregon, Department of Transportation, has been designated to evaluate and select recipients of assistance from federal funds available under the Small City and Rural Areas Program, to coordinate grant applications and to administer the disbursement of the federal assistance and WHEREAS, the State of Oregon, Department of Transportation, has determined that the agreement shall be amended to increase operating expenses for the City of Woodburn to be used in support of public transportation and to add an additional federal requirement, NOW THEREFORE; THE CITY OF WOODBURN RESOLVES AS FOLLOWS: Section 1. That the City of Woodburn enter into Amendment No.1 to Grant Agreement No. 17518, which is affixed as Attachment "A" and by this reference incorporated herein, with the State of Oregon acting by and through its Department of Transportation to secure Federal funds through Title 49, United States Code, Chapter 5311 for the purpose of supporting public transportation. '.~--~"+'''--'''~~--'-'~ ODOT Agreement Number: 17518 Small City and Rural Areas (5311) Operating Public Transit Division Oregon Department of Transportation ATTACHMENT --iL- Page -L... of. ~~ ODOT GRANT AGREEMENT No: 17518 AMENDMENT NO.1 The State of Oregon, acting by and through its Department of Transportation, hereinafter referred to as STATE, and City of Woodburn, hereinafter referred to as RECIPIENT, entered into an agreement on September 15, 1999. Said Agreement is to secure financial assistance to complete the Capital project as put forth in the Project Description and Budget as shown in Exhibit B, Part I. It has now been determined by State and Recipient that the agreement referenced above, although remaining in full force and effect, shall be amended to increase the project amount of the grant. Page 1 of the Grant Agreement, which reads: Terms of Agreement I. Payment shall not exceed $35,204, as described in Exhibit B, Part 1, Project Description and Budget. Shall be amended to read: Terms of Agreement 1. Payment shall not exceed $38,162, as described in revised Exhibit B, Amendment No. I, Part I, Project Description and Budget. This amendment also adds the following requirement to Section I. Recipient Obligations, part C, Other Federal Requirements: 10. Recipient will comply with the applicable provisions of 49 CFR part 26 related to Disadvantaged Business Enterprise. Each contract the grantee signs with a contractor (and each subcontract the prime contractor signs with a subcontractor) must include the following assurance: "The contractor, sub recipient or subcontractor shall not discriminate on the basis of race, color, national origin, or sex in the performance of this contract. The contractor shall carry out applicable requirements of 49 CFR part 26 in the award and administration of ODOT -assisted contracts. Failure by the contractor to carry out these requirements is a material breach of this contract, which may result in the termination of this contract or such other remedy as the recipient deems appropriate." In the event of an extended absence, a designee may be authorized, in writing, to sign contracts on their behalf.
