Ord 2386 - Supp Budget 04-05 COUNCIL BILL NO. 2573 ORDINANCE NO. 2386 AN ORDINANCE ADOPTING A SUPPLEMENTAL BUDGET FOR FISCAL YEAR 2004-05 AND DECLARING AN EMERGENCY. WHEREAS, Oregon State Statute 294.480 allows for the adoption of a supplemental budget during a fiscal year to meet changes in financial planning, and WHEREAS, the Notice of Supplemental Budget Hearing and Financial Summary was published in the Woodburn Independent on June 8, 2005 as required under State budget law; and WHEREAS, the City Council held a public hearing on June 13,2005 to give citizens an opportunity to comment on the proposed 2004-2005 supplemental budget, now, therefore, THE CITY OF WOODBURN ORDAINS AS FOLLOWS: Section 1. That the supplemental budget for fiscal year 2004-2005 is hereby adopted as set forth below. Section 2. That if any clause, sentence, paragraph, section or portion of this ordinance for any reason shall be adjudged invalid by a court of competent jurisdiction, such judgment shall be confined in its operation to the clause, sentence, paragraph, section or portion of this ordinance directly involved in the controversy in which such judgment is rendered. Section 4. This ordinance being necessary for the public peace, health and safety, an emergency is declared to exist in that appropriation adjustments are necessary to meet estimated expenditures during the 2004-05 fiscal year which concludes on June 30, 2005 and this ordinance shall take effect immediately upon passage by the Council and approval by the Mayor.
