Ord 2208 - Amend Sp PW Fina AssiCOUNCIL BILL NO. 1854 ORDINANCE NO. 2208 A ORDINANCE AUTHORIZING AMENDMENT NUMBER 1 TO A SPECIAL PUBLIC WORKS FUND FINANCIAL ASSISTANCE AWARD CONTRACT; AUTHORIZING THE MAYOR TO SIGN SAID AMENDMENT; AND DECLARING AN EMERGENCY. WHEREAS, Ordinance 2199 authorized entering into a Special Public Works Fund Financial Assistance Award Contract to obtain financial assistance to make Woodland Avenue infrastructure improvements, and WHEREAS, The City of Woodburn requested modification of the contract to allow additional extension of a water line installed as part of the Woodland Avenue infrastructure project, and WHEREAS, The State of Oregon Economic Development Department has approved the request and provided amendment number 1 to add the water line extension to the project budget; NOW THEREFORE THE CITY OF WOODBURN ORDAINS AS FOLLOWS: Section 1. The mayor is authorized to execute amendment number 1 which is affixed as Attachment "A" and by this referenced incorporated herein of a Special Public Works Fund Financial Assistance Award Contract for Woodland Avenue infrastructure improvements. Section 2. This ordinance being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist and this ordinance shall take effect immediately upon passage by the Council and approval by the Mayor. (✓) the following: This amendment adds "Highway 219 Water Line Tie-in" to the activities section of the project budget. The project's estimated total will remain the same with $44,000 of Special Public Works Fund dollars taken from contingencies and placed in the new activity line. The amended project budget is attached to this form and labeled as Exhibit B'. It is understood that this amendment does not alter, remove or modify any other section of the original contract, as amended. The water line on the Woodland Avenue extension was installed as part of this nroiect. A diagram of the water line extension is enclosed. The reason of this requested extension is twofold. First the line extension would result in a looped extension for the city's water distribution system. This will enhance the safety, in terms of public health, of the city's water system. Second is that the line extension will enhance fire flows in the area of the Waremart Warehouse. The second phase of the Waremart Warehouse complex is currently under construction. The city has received an estimate from the Woodland Avenue project contractor of $43,667.50 for the extension of the water line. The city estimates that there will be sufficient funds in the total project budget to include this line extension. If the project does cause the project budget to be exceeded the city will be responsible for any excess costs.
