COUNCIL BILL NO. 1907
ORDINANCE NO. 2221
AN ORDINANCE REPEALING ORDINANCE NO. 2151 (ADDRESSING TOWING AND
IMPOUNDMENT OF MOTOR VEmCLES OPERATED BY UNINSURED
MOTORISTS) AND DECLARING AN EMERGENCY.
WHEREAS, Oregon state law previously provided legal authority for police officers to
impound motor vehicles of uninsured motorists only in communities where the Urban Growth
Boundary has a population of at least 40,000 people; and
WHEREAS, it was necessary for the City of Woodburn, by virtue of its home rule
authority, to adopt Ordinance No. 2151, authorizing the towing and impoundment of motor
vehicles operated by uninsured motorists and establishing the necessary procedures; and
WHEREAS, recent legislation (SB 780) changed the Oregon state law to provide broader
legal authority for all police officers to impound motor vehicles when they have probable cause to
believe that certain offenses have been committed; and
WHEREAS, it is now necessary to repeal Ordinance No. 2151 so that the City of
Woodburn can effectively utilize the state law provisions; NOW, THEREFORE,
THE CITY OF WOODBURN ORDAINS AS FOLLOWS:
Section 1. Ordinance No. 2151 (authorizing the towing and impoundment of motor
vehicles operated by uninsured motorists) is hereby repealed.
Section 2. This ordinance being necessary for the immediate preservation of the public
peace, health, and safety, an emergency is declared to exist and this ordinance shall take effect
immediately upon passage by the Council ap by the Mayor.
