ORDINANCE NO. 2226
AN ORDINANCE ADOPTING A SCHEDULE OF FEES AND CHARGES FOR CITY
SERVICES; PROVIDING FOR REVIEW OF SAID FEE SCHEDULE ON AN ANNUAL
BASIS AND DECLARING AN EMERGENCY.
WHEREAS, the City of Woodburn has conducted an extensive and exhaustive analysis of
its services, the costs reasonable borne of providing those services, the beneficiaries of those
services, and the revenues produced by those paying fees and charges for special services; and
WHEREAS, the City wishes to comply with both the letter and the spirit of the Oregon
Constitution, applicable state statutes, and limit the growth of taxes; and
WHEREAS, the City desires to establish a policy of recovering the full costs reasonably
borne of providing services of a voluntary and limited nature, such that general taxes are not
diverted from general services of a broad nature and thereby utilized to subsidize unfairly and
inequitable such special services; and
WHEREAS, a schedule offees and charges to be paid by those requesting such special
services needs to be adopted so that the City might cany into effect its policies; and
WHEREAS, it is the intention of the City Council to develop a revised schedule offees
and charges based on the City's budgeted and projected costs reasonably borne and to review the
schedule on an annual basis, NOW, THEREFORE
THE CITY OF WOODBURN ORDAINS AS FOLLOWS:
Section 1. Repeal. All existing fees or charges which are inconsistent with those fees and
charges established by this Ordinance are hereby repealed.
Section 2. Fee Schedule Adoption. The City hereby adopts the Master Fee Schedule
affixed hereto as Attachment" A" listing applicable fees and charges which shall be charged and
collected for those services enumerated.
Section 3. Separate Fee For Additional Process. All fees set by this Ordinance are for
each identified process; additional fees shall be required for each additional process or service that
is requested or required. Where fees are indicated on a per unit of measurement basis, the fee is
for each identified unit or portion thereof within the indicated ranges of such units.

Section 4. Review. It is the intention of the City Council to review the fees and charges
adopted by this Ordinance on an annual basis based on the City's next annual budget and all the
City's costs reasonably borne as established at the time and, if warranted, to revise such fees and
charges based thereon.
Section 5. Emerl!encv Clause. This ordinance being necessary for the immediate
preservation of the public peace, health and safety, an emergency is declared to exist and this

the current fee is problematic.
~ The fee applies only on the: days the Library is open, and up to the cost of the item or $5.00, whichever is less. The fee is $1.00 a day for videos. The fee
was probably last updated in January 1979 when the newer portion of the libraJy was fmt opened to the public. Until then it was $0.03 per day.
, A regular, bar coded library card is issued to each patron upon registering as a borrower. A key ring card is optional, therefore we charge $1 eachforthem. If
a patron loses the original library card, a new one is issued, again with a $1 charge. If the card becomes worn, tom, and unusable, anew card mIIY be issued to the patron
without charge (staff judgement call).
. If the library borrows an item from another library for a patron and the lending library charges a fee, thatfee is passed on to the patron, aJOIl&with the amount
it cost the lending library for postage to send the item to this library. This was probably last reviewed at the time the automated librwy system came online (mid-80s), and
this was the fee already in place at the time.

CCRLS. throush a contract with the non-residents of the City o(Woodbum (but living within Marion COW1ty) were aeJVed without an additional fee to the patron since they
were paying (a small sum) for library service through CCRLS. The libraries were reimbursed by CCRLS per card issued. The fee remained in place specifically for those
residents of Clackamas COWlty who wanted to use the Woodburn Public Library instead of the library in their own COW'lty nearest their home. This results in one or two card
fees per year. There is a great controversy just now in several cities within the CCRLS area regarding the inequity between what residents and non-residents pay for libruy
sClVice through their property taxes. I believe this issue will not go away until or unless the amount non-residents pay is substantially increased to more equitably compare
to what the residents pay. It has not been an issue here (or even addressed openly by or with the City Council), but Salem. McMinnville. and Dallas are quite ready to
charge a fee additional to what the non-residents pay unless the Chemeketa Community College's task Force make a proposal which will mollify the City Cmmci.ls of those
Cities. Others, like Woodburn, arc basicaUy watching to see what direction the issue takes before committing themselves, I anticipate that if even two of those three
libraries institute an additional fcc, Woodbwn (3'" or 4'" library in size in CCRLS) would follow suit.

accommodate the general public. We do fingerprinting for the school district and charge $12.00 per person. This is done through an ORS 190 agreement. We have set-up.

[The fee] is specificalty addressed by ORS t97.380 which

In year 1997, the police department responded to "1 false, accidental, and
faulty alarms. Each alann response conunands the response of multiple
officers with emergency equipment activated. Each alann response will
average 10-30 minutes of multiple officers. False, accidental and faulty
alarms are because of employee error or lack of training. These types of
incidents are diverting valuable manpower from other tasks and
assigrunents and create a risk to life and property.
Other agencies in the inunediatearea charge $25-50 for the first response
and escalate charges in SSO increments for additional alarm responses.
This would be one fee the city would need to increase by ordinance update
rather than blanket ordinance. While the police encourage alarm
installation, we also need to demand responsible alann users.
These two fees are specifically addressed in Ordinance
#2055. To maintain the fees at the current levels, the
supporting methodology outlined in the ordinance must
remain intact. Therefore, the fees should be adjusted
within the context of the ordinance.
