ORDINANCE NO. 2036
AN ORDINANCE SUBMITTING TO THE VOTERS OF THE CITY OF WOODBURN A PROPOSAL
TO AMEND THE CHARTER BY ADDING A NEW SECTION RELATING TO A LIMITATION
ON THE COUNCIL'S AUTHORITY TO LEVY TAXES; PROVIDING FOR SUBMISSION
OF SAID CHARTER AMENDMENT TO THE ELECTORS OF THE CITY AT THE PRIMARY
ELECTION ON MAY 15, 1990; AND DECLARING AN EMERGENCY.
THE CITY OF WOODBURN ORDAINS AS FOLLOWS:
Section I. If the ballot measure establishing a new tax
base for the City of Woodburn, referred to the voters by Ordinance
No. 2035, is passed at the May 15, 1990 primary election, the following
is hereby added to the City of Woodburn Charter of 1982:
Section 41. Limiting Tax Base. Notwithstanding
Article XI, Section 11, of the Oregon Constitution,
commenci ng wi th the fi sca 1 yea r 1990-91, the
Council's authority to increase the City's tax
base shall be limited to four percent (4%). This
limitation shall not apply to a property tax: (a)
to retire bond principal or interest, (b) levied
serially for capital acquisition, construction,
reconstruction, maintenance, and general operations
speci fi ca 11 y authori zed by the voters, or (c) any
other property tax levy hereafter approved by the
voters.
Section 2. That the measure set forth in Exhibit A, attached
hereto and incorporated herein by reference, shall be submitted in
the manner prescribed in this ordinance to the legal voters of the
City of Woodburn, Oregon, at the primary election on May 15, 1990.
Section 3. This ordinance being necessary for the public
peace, health, and safety, an emergency is declared to exist and this
ordinance shall take effect immediately upon passage by the Council
