ORDINANCE NO. 2063
AN ORDINANCE VACATING AN EXISTING PUBLIC RIGHT-OF-WAY, A PORTION OF
WEST HAYES IN EXCHANGE FOR THE DEDICATION OF A PUBLIC RIGHT-OF-WAY
REALIGNED IN A NORTH-SOUTH DIRECTION AND THE ACCEPTANCE OF A 50-FOOT
UTILITY EASEMENT THAT PORTION TO BE VACATED.
WHEREAS, the Woodburn City Council held a public hearing on May 28, 1991, and
WHEREAS, the deputy city recorder has issued a certificate stating that all city liens and
taxes have been paid on the easement and right-of-way to be vacated, and
WHEREAS, the Woodburn City Council found that the public right-of-way in its present
location serves no public interest and the dedication of the proposed right-of-way better
serves future transportation needs, and
WHEREAS, the acceptance of the easement for utility purposes would benefit the city,
NOW, THEREFORE,
THE CITY OF WOODBURN ORDAINS AS FOLLOWS:
Section 1. The City of Woodburn hereby accepts the dedication of the following
described drainage easement:
An easement for utility purposes described as follows:
Beginning at a point on the South right-of-way line of West Hayes Street which bears
North 89019'20" West 50.00 feet and North 88052'10" West 869.95 feet from the Northwest
corner of Lot 1, Block 69, WOODBURN SENIOR ESTATES NO.7, as recorded in Volume
22, Page 42 Book of Town Plats for Marion County, Oregon; thence North 88052'10" West
452.46 feet to the western terminus of said street; thence North 11007'25" East 60.92 feet;
thence South 88052'10" East 441.89 feet; thence South 1007'50" West 60.00 feet to the point
of beginning.
Section 2. The City of Woodburn hereby vacates the following right-of-way effective
upon receipt of the fully executed deed for the right-of-way dedicated to the city as per the
condition of approval for the Partition Case #91-04.

Section 3. The Deputy City Recorder is hereby directed to file the deeds with the
county clerk and a certified copy of the ordinance with the county clerk and county
assessor.
Section 4. This ordinance being necessary for the immediate preservation of the
public peace, health, and safety, an emergency is declared to exist and this ordinance shall
take effect immediately upon passage by the city council and approval by the Mayor.
