COUNCIL BILL NO, 1945
ORDINANCE NO. 2231
AN ORDINANCE AMENDING ORDINANCE 1807 (THE WOODBURN ZONING
ORDINANCE) TO PERMIT MUNICIPAL OR GOVERNMENT SERVICE BUILDINGS
IN THE DOWNTOWN DESIGN AND CONSERVATION DISTRICT AND DECLARING
AN EMERGENCY,
WHEREAS, Ordinance No, 1807 (the Woodburn Zoning Ordinance) established certain
land uses; and
WHEREAS, the Woodburn Planning Commission held a public hearing on proposed
amendment 98-01 to the Ordinance on November 12, 1998; and
WHEREAS, the Woodburn City Council conducted a public hearing on the proposed
amendment on January 11, 1999; and
WHEREAS, the Council believes that it is in the public interest to amend said ordinance
as provided herein, NOW, THEREFORE,
THE CITY OF WOODBURN ORDAINS AS FOLLOWS:
Section 1, Ordinance 1807 (the Woodburn Zoning Ordinance) is hereby amended to add
a new section, entitled Section 40.050 (i)(l), which shall read as follows:

(i) Government
(1) Municipal or government service building.
Section 2, This amendment is based upon the staff report and findings, which are
attached to this as Exhibit" N' and are by this reference incorporated herein,
Section 3, This ordinance being necessary for the immediate preservation of the public
peace, health, and safety, an emergency is declared to exist and this ordinance shall take effect
immediately upon passage by the City Council and approval by the Mayor,

DOWNTOWN DESIGN AND CONSERVATION DISTRICT
(DDCD)
INTRODUCTION:
Over a period of a few months a list of uses that would be allowed in the
DDeD were formulated through a series of public workshops in addition to
evaluating the boundaries of the original Downtown Historic District. Later date the
list of uses and boundary configuration were reviewed by the Woodburn Downtown
Association who recommended the district boundary be expanded and the list of
uses be modified. The changes as approved by the planning commission and
recommended to the City Council resulted in not only the elimination of some
permitted uses but also the expansion of the boundary to almost twice it's original
size. The boundary adopted by the City Council in June 1998 now incorporates the
City Hall, Library, Post Office and the Swim Center. This action resulted in these
governmental structures inadvertently being left out of the list of land uses allowed
within the district. To remedy this over site on planning staff's part the Planning
Commission has recommended the Council approve an amendment to Chapter 40
of the Woodburn Zoning Ordinance to incorporate municipal and governmental
buildings as a permitted use in the DDC District.
FINDINGS:
(1) Presently, municipal or government service buildings are not identified
as a permitted or conditional use in the DOC District.
(2) The existing government buildings are therefore considered
nonconforming or "grandfathered" uses within the DDC District.
(3) The lawful nonconforming use of a building may be continued although
if such use ceases for a continuance of one year the uses allowed
would have to conform to the zoning ordinance (Section 3.020).

(4) The Woodburn Comprehensive Plan Chapter IX Goals and Policies
(page 64) identifies business and government in the DDC District are
an integral linkage to the surrounding residential neighborhoods.
(5) The Woodburn Comp Plan Chapter IX Goals and Policies (page 64)
speaks to implementing the vision for the Downtown by involving both
private and public investments. The City by maintaining and placing
its governmental institutions in the Downtown show a commitment to
that purpose.
(6) The Comprehensive Plan (Chapter IX, page 68) encourages the
Downtown be the "City-Wide hub with government and public
buildings, arts and entertainment."
