Ord 2277 - Downtown Alley Assmt COUNCIL BILL NO. 2282 ORDINANCE NO. 2277 AN ORDINANCE AMENDING ORDINANCE NO. 2273 TO REMOVE AN ASSESSMENT FROM A NON-BENEFITTED PROPERTY WITHIN THE LOCAL IMPROVEMENT DISTRICT CREATED FOR THE IMPROVEMENT OF THE ALLEY BETWEEN HARRISON AND WEST HAYES STREET; AUTHORIZING THE USE OF CITY FUNDS TO PAY THE AMOUNT OF THIS ASSESSMENT; AND DECLARING AN EMERGENCY. WHEREAS, the City Council passed Ordinance No. 2194 forming a Local Improvement District for the improvement of the alley between Harrison Street and West Hayes Street (the "Alley LID"); and WHEREAS, the funds received from the Alley LID were to pay for 50 per cent of the total cost of the amount of this improvement and City funds were to be used to pay for the remaining share; and WHEREAS, the Council then passed Ordinance No. 2273 levying assessments within the Alley LID; and WHEREAS, it has now come to the Council's attention that, because of confusing tax assessor's map, an assessment was inadvertently levied on Tax Lot 92010-150, a property which does not benefit by the improvement in accordance with the method of assessment based on the engineering report adopted by Council on October 28, 1996, and hence it should not have been included in the assessment district; and WHEREAS, the Council now wants to remove the assessment from Tax Lot 92010-150 and use City funds to pay for the amount of this assessment; NOW, THEREFORE, THE CITY OF WOODBURN ORDAINS AS FOLLOWS: Section 1. Section 2 of Ordinance No. 2273 is hereby amended to remove the assessment of$2,275 from Tax Lot 92010-150. Section 2. The Public Works Director is authorized to use City funds to pay the amount of this assessment. Section 3. The City Recorder is directed to remove any lien or potential lien against Tax Lot 92010-150 as a result of the Alley LID. Section 4.
