The Council met in a regular session at 7:30 p.m. with Mayor Kirksey presiding. 0010 ROLL CALL. JENNINGS/KySER.... approve the Council minutes of May 21, 1990; accept the Planning Commission minutes of May 10, 1990, the Library Board minutes of May 23, 1990, the Downtown Association minutes of May 15 & 22, 1990, and the RSVP Advisory Council minutes of May 14, 1990. The motion passed unanimously. 0028 Mayor Kirksey stated that she had received a letter from Fire Chief Woodley advising the City that he would be continuing his position on the 9-1-1 User Board. 0061 PUBLIC HEARING - PROPOSED CLEVELAND STREET ASSESSMENT. Mayor Kirksey declared the public hearing open at 7:33 p.m.. Public Works Director Tiwari reviewed the history of the establishment of the local improvement district which included the appointment of a committee in July 1985 to assist in gathering information on funding alternatives. In September 1988, the local improvement district boundary was formed. The ordinance provided a formula to determine the cost to each property owner which included a flat rate for a buildable lot, dwelling, and the assessed valuation. The Director stated that the purpose of this public hearing was to receive comments from affected property regarding the specific amount of their proposed assessments. Any changes to the established boundary or the formula amounts would require a new engineering report and hearings process. The estimated cost of the improvement project is $700,000 of which the LID will generate approximately $225,000 and the remaining balance of the project to be paid from FAU funds, State Revenue Sharing funds, and the local Gas tax funds. Page 1 - Council Meeting Minutes, June 11, 1990 ~ COUNCIL MEETING MINUTES June lIt 1990 TAPE READING 0502 Al Sprauert 245 Marshallt stated that he was a member of the committee appointed in 1985 and his committee met with property owners to find a funding method which would be agreeable to those within the proposed district. At the time of the committee's meetings and during the hearings process, very few property owners objected to the assessment district or method of assessment. Don Woodley, 840 Hermansont stated that he was willing to pay his share of the assessmentt however, he questioned the effective date used to determine what the assessed valuation of the property was for calculation of that portion of the formula. Administrator Quinn stated that ordinance states that the current assessed valuation is utilized which is the amount listed on the January 1, 1989 tax rolls. Al Ringo, 490 Hermansont spoke in favor of the assessment district and expressed his appreciation to the Council in their effort to move forward with the project. 0721 Sam Thompson, 310 Stark Ct., stated that he moved into the area in August 1988 and was not informed of the LID from the previous property owner. He felt that the improvement project should have been placed before the voters of the City for funding rather than a portion of the cost being placed on property owners within the established boundary. He felt the assessment would place an undue hardship on his financial situation. Ben Shevchenko, 334 Settlemier, stated that he owned a lot on Payne Street which is an unimproved street. There are no homes on the street and he feels the lot is unbuildablet therefore, reducing his proposed assessment by $325.00. Rudy Sonnen, 888 Brown St., stated that one of his lots is only partially within the City limits and he questioned if it could be excluded from the assessment district. Director Tiwari stated that his staff would research the concerns of the property owners and would make any adjustments necessary. Clint Livingston, 455 Bradley St., questioned if the Railroad Company would be paying for any portion of the assessment. Administrator Quinn stated that the Public Utility Commission has ruled that railroad companies do not have to pay in a local improvement district. Letters of objection from Brice & Nancy Baker and Sonja Patzer were read into the record by the Deputy Recorder. Mayor Kirksey declared the public hearing closed at 8:14 p.m.. Following a brief discussion, JENNINGS/KySER.... direct staff to draft an ordinance to levy the assessments to the benefitted property owners within the Cleveland Street local improvement district and sell the bonds. The motion passed unanimously. 1451 ACCEPTANCE OF MAY 15TH ELECTION RESULTS. The motion passed unanimously. 1472 REOUEST FOR TEMPORARY CLOSURE OF ALEXANDRA COURT. A petition was received from residents of Alexandra Court requesting temporary closure of their street on July 4, 1990 between 10:00 a.m. and 7:00 p.m. for the purpose of a neighborhood party. KySER/JENNINGS.... approve the request for the temporary street closure on July 4th. The motion passed unanimously. 1489 ACCEPTANCE OF UTILITY EASEMENTS ALONG EAST CLEVELAND STREET. The staff recommended the acceptance of 18-inch utility easements from the following property owners: Robert & Gladys Fogerson, Inez Pillsbury, James & Margaret McClain, and Roger & Georgia Midura. JENNINGS/SIFUENTEZ.... accept the easements as recommended by staff. The motion passed unanimously. 1504 REPLACEMENT OF AERATORS AT THE WASTEWATER TREATMENT PLANT. Public Works Director Tiwari reviewed the bids for the replacement of 5 aerators at the plant which are 10 years old. The staff recommended the acceptance of the low bid from Copenhagen Inc. of Tualatin. KySER/HAGENAUER.... approve the low bid from Copenhagen Inc. in the amount of $73,737.00 for 5 new aerators. The motion passed unanimously. 1536 REQUEST FOR USE OF LOUD SPEAKERS DURING 1990 HEALTH FAIR. A request was made by Salud Medical Center for the use sound equipment during their 1990 Health Fair on August 11, 1990 between the hours of 3:00 p.m. and 6:00 p.m.. The Health Fair will be held in the city parking lot behind the Clinic. JENNINGS/KySER.... approve the use of the loud speakers on August 11th as requested. The motion passed unanimously. 1649 CLAIMS FOR THE MONTH OF MAY 1990. SIFUENTEZ/HAGENAUER.... approve voucher checks #1001 - 1418 in the amount of $587,820.80 for the month of May 1990. The motion passed unanimously. 1672 Councilor Jennings requested that the site action plans contain a short summary of the proposed project in addition to the information currently being provided by the staff. 1739 Councilor Kyser stated that the ballots have been mailed to the voters and passage of the operating levy is crucial to maintain current operating standards. The PAC is distributing flyers, putting up signs, and placing information in the County voters pamphlet and local newspaper.
