0020 MINUTES.
JENNINGS/SIFUENTEZ.... approve the Council workshop minutes of April 16
and 23, 1990, and the regular meeting minutes of April 23, 1990; accept
the Planning Commission minutes of April 26, 1990, the Library Board
minutes of April 25, 1990, Downtown Association minutes of April 17 and
24, 1990, and the RSVP Advisory Council minutes of April 9, 1990. The
motion passed unanimously.
0034 APPOINTMENTS - R.S.V.P. ADVISORY COUNCIL.
Mayor Kirksey recommended the appointments of Rev. Burl E. Yates and
Maxine Henkes to serve on the Advisory Council with their terms expiring
in March 1991.
SIFUENTEZ/KySER.... approve the appointments of Rev. Burl Yates and Maxine
Henkes to the RSVP Advisory Council. The motion passed unanimously.
0048 PROCLAMATAION - PUBLIC WORKS WEEK.
Mayor Kirksey read the proclamation declaring May 21-25, 1990 as Public
Works Week in Woodburn. She also expressed her appreciation of the
services provided by Public Works which are used daily by the citizens of
the community.
Public Works Director Tiwari reviewed the schedule of events for Public
Works Week which includes "Free Bus Ride" week, tours of Wastewater,
Water, and Street facilities, and the Employee Appreciation program.
0417 PROCLAMATION - SAFE KIDS WEEK.
The Mayor read her proclamation declaring May 14-20, 1990 as Safe Kids
Week in support of the goals and programs of the National Coalition to
Prevent Childhood Injury. The Mayor also stated that she would send a

copy of the proclamation to the State Highway Department since the repairs
to the fence surrounding the Maintenance Shop along McKinley Street have
not been made and it is an attractive nuisance for children.
0514 PROCLAMATION - NURSING HOME WEEK.
Mayor Kirksey read the proclamation declaring the week of May 13-19, 1990
as Nursing Home Week within the City in appreciation of the health care
professionals and volunteers who care for ill or infirm residents of long-
term care facilities.
0587 RESIGNATION FROM PLANNING COMMISSION.
A letter of resignation from Al Nunez was received by the Council since he
is moving outside of the City limits and no longer meets the residency
requirements.
0628 The Council was reminded of the Special Council Meeting scheduled for May
21, 1990t 7:30 p.m., to replace the regular meeting date of May 28th which
is a holiday.
0637 COURTESY INVOICE - UNITED DISPOSAL SERVICE.
United Disposal Service provided the Council with a courtesy invoice in
the amount of $10t695.00 representing the quantity of yard debris disposed
of during Clean-Up week as a donated service to the community.
0688 PUBLIC HEARING - ANNEXATION #89-01 RE: CAROLYN'S ADDITION.
Mayor Kirksey declared the public hearing open at 7:56 p.m..
Community Development Director Goeckritz stated that due to a technical
error in publication of the public hearing noticest the annexation was
resubmitted to the Council for their consideration. The property owner
has filed with the City a consent to annex letter and the Planning
Commission recommends the annexation of the property to the City.
No one in the audience spoke either for or against the proposed
annexation.
The Mayor declared the public hearing closed at 7:59 p.m..
0792 COUNCIL BILL 1219 - ORDINANCE ANNEXING AND RECLASSIFYING PROPERTY LOCATED
ON EAST SIDE OF HIGHWAY 99E NORTH OF LAUREL AVENUE FROM MARION COUNTY EFU
TO CITY RS CLASSIFICATION. AND REPEALS ORDINANCE 2037.
Council Bill 1219 was introduced by Kyser. The two readings of the bill
were read by title only since there were no objections from the Council.
On roll call vote for final passage, Council Bill 1219 passed unanimously.
Mayor Kirksey declared the bill duly passed with the emergency clause.
0852 COUNCIL BILL 1220 - RESOLUTION PROTESTING THE 1990 MARION COUNTY
ASSESSOR'S ADJUSTMENT OF SENIOR ESTATES PROPERTY EVALUATION.
Councilor Kyser introduced Council Bill 1220. The bill was read by title
only since there were no objections. According to information from the
County Assessor Ebnert he had increased the values of the Senior Estates
property by an additional 5% over other residential property since the

boundaries of Senior Estates create its own market influence due to its
homogenous neighborhood and special amenities/facilities.
On roll call vote for final passage, Council Bill 1220 passed unanimously.
The Mayor declared the bill duly passed.
0975 COUNCIL BILL 1221 - RESOLUTION ESTABLISHING DEPOSITORIES FOR CITY FUNDS.
AUTHORIZING WITHDRAWLS THEREFROM BY CERTAIN OFFICERS. AND REPEALING
RESOLUTION NO. 944.
Council Bill 1221 was introduced by Kyser. The bill was read by title
only since there were no objections from the Council. On roll call vote
for final passage, the bill passed unanimously. Mayor Kirksey declared
the bill duly passed.
1019 BOONES FERRY ROAD IMPROVEMENTS.
The staff recommended Council approval to share in the cost for the Boones
Ferry Rd. improvement between Highway 214 and the 3rd driveway of the
grade school. Under the proposal, the School District would pay 50% of
the total project cost (estimate $20,000), the State Highway Department
25% (estimate $10,000), and the City's portion is 25% (estimate $10,000).
JENNINGS/MINARD.... approve the staff's recommendation to share in the
cost of the improvement. The motion passed unanimously.
1035 MID-VALLEY ARTS COUNCIL.
A letter was received from the Arts Council advising the City of the
preparation of a new brochure to feature arts and cultural activities in
Marion, Polk & Yamhill Counties. If the City was interested in listing
our local art and cultural attractions, the Arts Council requested that
the City pay $400.00 towards the development and printing of the
brochures.
KySER/MINARD.... recommend denial of the funding request. The motion
passed unanimously.
1094 The staff informed the Council that a workshop would be scheduled for May
21st to review the Library space utilization report.
1105 DISCUSSION OF OPTIONS -- TELEPHONE FRANCHISE.
Administrator Quinn reviewed his memo regarding 1999 state legislation
(House Bill 3000) which modifies the method of computation of telephone
franchise taxes and the listing of the franchise tax as a separate line
item on the telephone bill. Currently, the City receives 3% from the
telephone company as the franchise tax. Under the new legislation, the
City would need to increase the tax to a minimum of 3.5% to receive a
similar amount of revenues as budgeted, however, we are allowed to raise
the tax to 7%. The Council will need to adopt an ordinance prior to July
1, 1990 if they decide to increase the franchise tax, otherwise, the next
opportunity for changing the tax would be in January 1995 when the
franchise agreement is up for renewal.
The Administrator recommended that the Council set the franchise tax at a
minimum level of 4% but also suggested consideration of setting the tax at
7% to offset future property taxes.

JENNINGS/SIFUENTEZ.... draft an ordinance establishing the franchise tax
at 5%. Following further discussion on the proposalt the Council
unanimously passed the motion.
1569 LEAGUE OF OREGON CITIES - REOUEST FOR FUNDING ASSISTANCE.
The League has hired an attorney to present arguments before the Public
Utilities Commission to help minimize the effect of House Bill 3000. In
additiont the League requested financial assistance from the City in the
amount of $ltOOO towards the legal defense fund.
The Council took no action on the League's request.
1650 Gilbert Flaughert 1352 Astor WaYt expressed his appreciation to the City
for the recent resurfacing of Astor Way.
1661 CLAIMS FOR THE MONTH OF APRIL 1990.
SIFUENTEZ/HAGENAUER...approve voucher checks #9949 - 10032 for the month
of April 1990. The motion passed unanimously.
1680 Councilor Jennings advised the Council that the owner of The Woodburner
restaurant has agreed to additional terms within the compliance plan
submitted to OLCC for the purpose of obtaining a favorable ruling from
OLCC on the renewal of the restaurant's Class A license.
JENNINGS/STEEN.... Council rescind the motion to recommend denial of the
liquor license to The Woodburner.
Lengthy discussions were held regarding Roberts Rules of Order and the
Council's past practice to vote on a reconsideration of the motion.
Police Chief Wright stated that OLCC will eventually approve the liquor
license since the City's investigative report contained insufficient
evidence to deny the license.
The vote on the motion was 3-3 with Councilors Hagenauert Sifuentezt and
Minard voting nay. Mayor Kirksey voted nay to defeat the motion.
Councilor Minard expressed his appreciation of the work done by Mr. Lee to
improve the situation at the restaurantt howevert he felt that actions
necessary to combat the problems should have been dealt with sooner by the
management.
2108 Councilor Minard suggested that Community Awards be given to United
Disposal Service and the Woodburn High School Band. He stated that the
band had earned sufficient funds to travel to Victoria B.C. last weekend
and play two concerts. It was the consensus of the Council to present the
awards at the May 21st Council meeting.
2203 EXECUTIVE SESSION.
JENNINGS/SIFUENTEZ.... adjourn to executive session to consult with
counsel on the Grace Village property as allowed under ORS 192.660 (l)(h)
and receive a status report on the labor negotiations as allowed under ORS
192.660 (l)(d). The motion passed unanimously.
The meeting adjourned to executive session at 8:40 p.m. and reconvened at
9: 19 p.m..

2212 Councilor Sifuentez read a note of appreciation from R.S.V.P. staff
members on the Council's support of their programs. In addition, R.S.V.P.
Recognition Day is scheduled for June 13, 1990, 2:00 p.m., at the
Community Center and the Council is invited to attend.
2264 Councilor Steen requested the City Administrator to pursue business
license requirements after the budget election.
2282 Councilor Minard suggested that the City purchase a large mulcher and
develop a program to mulch such items as grass and limbs for purpose of
recycling. The City could set aside a certain time period each week for
accepting the debris and use the mulch in the City parks.
Public Works Director Tiwari stated the City does have a chipper for
branches and the staff has discussed this concept internally over the past
few years.
2442 Councilor Jennings complimented Officer Jim Seeley in the way he handled a
situation involving an elderly lady had been severely beaten.
He expressed appreciation to the Public Works and Police Department in
their quick response to a report of a sink hole on Boones Ferry Road.
He also stated that he had attended the disaster exercise and felt that
Police and Fire Departments worked well together in the field. Lessons
were learned in the field by all who participated.
2619 The Council was reminded of the Chamber's Industrial Tour scheduled for
May 16th. Advance tickets can be purchased at the Chamber office at a
reduced price through May 15th.

City Administrator Quinn provided the Council with a status report the
disposition of the Grace Village property. In addition, he updated the
Council on the status of the labor negotiations with American Federation
of State, County, & Municipal (AFSCME) employees.
