0029 MINUTES.
MINARD/STEEN.... approve the Council and executive session minutes of
February 26, 1990; accept the Planning Commission minutes of February 22,
1990, the Library Board minutes of February 28, 1990, the RSVP Advisory
Council minutes of February 19, 1990, Downtown Association minutes of
February 20 and 27, 1990, and the Fire District minutes of January 3 and
9, 1990.
Councilor Sifuentez expressed concern regarding the incompleteness of the
names within the Planning Commission minutes.
Community Development Director Goeckritz stated that he would have the
minutes corrected. The motion passed unanimously.
0066 PRESENTATION - APPRECIATION FOR SERVICE ON THE LIBRARY BOARD.
Library Director expressed her appreciation to Gloria Predeek and Grace
Foltz for eight years of faithful service on the Library Board.
Council President Jennings presented Mrs. Predeek and Mrs. Foltz with
plaques in recognition of their service to the community.
0125 PLANNING COMMISSION REAPPOINTMENTS.
KYSER/MINARD... table the reappointments to the Planning Commission until
the Mayor reviews the recommendation from the Planning Department. The
motion passed unanimously.
0145 It was the consensus of the Council to hold a workshop with the Planning
Commission on Monday, March 26, 1990, at 6:30 p.m..
0160 MINARD/SIFUENTEZ... suspend Council rules and allow item 10 of the agenda
prior to the executive session. The motion passed unanimously.

0184 LETTER FROM CITY OF SILVERTON.
Administrator Quinn read a letter from Doug Robinson, Silverton City
Manager, expressing his Council's goal to establish closer ties to the
Cities of Woodburn and Mt. Angel. The Silverton City Council is
suggesting that Council members from each community meet at either a
luncheon or dinner meeting to become better acquainted and discuss ways
the communities can work together on projects that will benefit all.
It was the consensus of the Council to proceed with the concept suggested
by the City of Silverton.
0271 Lydia Salinas, Gladstone, submitted a proposal to the Council for a multi-
purpose cultural center to be located on the former Grace Village project
site. She suggested that the formation of a board consisting of
individuals representing various types of community organizations and
local businesses be appointed to put a comprehensive program together
which would meet the needs of may citizens of Woodburn.
Cleo Chavez, 1219 W. Lincoln #5, Woodburn High School Student Council Vice
President, requested that the Council consider the cultural center
proposal and expressed her opinion that the center would be a benefit to
the whole community.
0430 EXECUTIVE SESSION.
MINARD/SIFUENTEZ.... adjourn to executive session as allowed under ORS
192.660(1)(h) to discuss the disposition of the Grace Village property.
The motion passed unanimously.
The meeting adjourned to executive session at 7:48 p.m. and reconvened at
8:08 p.m..
0543 KYSER/STEEN... proceed with the sale and disposition of the Grace Village
property according to law and not participate in a project with the State.
Councilor Minard stated that the State has an opportunity to do what they
want with the property. He also expressed his views on the potential use
of the property which would provide bUilding space for various types of
activities at a central location.
Councilor Steen expressed his opinion that selling the property would
relieve the City of any long term responsibility under the block grant
program.
The vote on the motion was 4-2 with Councilors Minard and Sifuentez voting
nay.
0662 PUBLIC HEARING - LA LINDA'S TORTILLERIA 1990 OLCC LICENSE RENEWAL.
Council President Jennings declared the public hearing open at 8:12 p.m..
Chief Wright stated that in the staff report for each establishment, the
Oregon Administrative Rules and State Statutes were followed to determine
a recommendation of approval or denial.
The Chief reviewed the staff report for La Linda's along with the proposed
Compliance Action Plan. He stated that the licensees had been in contact
with concerned business owners located near the establishment and have

followed through with the agreed upon action plan as of this date. He
recommended that the 1990 license be renewed with the Compliance Action
Plan attached to the license.

The public hearing was declared closed at 8:16 p.m..
KySER/HAGENAUER.... approve the liquor license for La Linda Tortilleria
with the attached Action Compliance Plan. The motion passed unanimously.
0878 PUBLIC HEARING - CHUNG SING RESTAURANT 1990 OlCC LICENSE RENEWAL.
The public hearing was declared open at 8:18 p.m..
Police Chief Wright reviewed the staff report which recommended the
renewal of the license.
No one in the audience spoke either for or against the license renewal.
The Council President declared the hearing closed at 8:20 p.m..
KySER/SIFUENTEZ.... approve the OLCC license renewal for Chung Sing
Restaurant. The motion passed unanimously.
0532 PUBLIC HEARING - RAVEN INN TAVERN 1990 OlCC lICENSE RENEWAL.
Council President Jennings declared the public hearing open at 8:21 p.m..
Chief Wright read the staff report which outlined the various types of
calls for service in 1989. In addition, he briefly reviewed the action
taken by the department in response to complaints of drug trafficking at
the tavern. He stated that the department had employed a professional
drug agent, Mark Mathieson, to work undercover for a three month period to
identify persons involved in drug trafficking and the location of sales.
Agent Mathieson stated that numerous patrons of the tavern had approached
him at the tavern to ask him to purchase drugs.
Detective Sgt. Ron Antoine reviewed a chronological list of events,
beginning with June 23, 1989, which provided a description of the drug
activity at the tavern.
Chief Wright recommended denial of the liquor license renewal since the
drug trafficking and sales were very open at the tavern and the management
should have been able to control this type of activity.
1597 Ron McDonald, attorney representing owner Tina Wiltsey, stated that Ms.
Wiltsey had inherited the tavern from her deceased mother a few years ago
and, until recently, has spent little time at the tavern. He stated that
her first knowledge of the drug trafficking problem was on November 16,
1989. At which time, she began working with OLCC and eventually agreed to
a Compliance Building Plan with OLCC Inspector Kenneth Tew. Attorney
McDonald expressed his opinion that the change in management policy has
improved the establishment and requested Council approval of the renewal
license.
Chief Wright stated that he was made aware of the Compliance Building Plan
between Ms. Wiltsey and OLCC on February 15, 1990.
No one in the audience spoke in opposition to the license renewal.
The public hearing was declared closed at 8:50 p.m..
KySER/SIFUENTEZ.... recommend denial of the 1990 OLCC renewal based on the
staff report and testimony received at the hearing. The motion passed
unanimously.

1586 PUBLIC HEARING - OlCC CHANGE OF OWNERSHIP AND LI~UOR lICENSE RENEWAL FOR
THE NEW WOODBURNER.
Council President Jennings declared the public hearing open at 8:52 p.m..
The Police Chief reviewed his staff report along with a proposed Action
Compliance Plan. He recommended approval of the change of ownership
application and 1990 license renewal with the attachment of the compliance
plan to the license.
No one in the audience spoke either for or against the liquor license
application.
The public hearing was declared closed at 8:55 p.m..
KYSER/STEEN... approve the OLCC license transfer of ownership and license
renewal.
Council President Jennings stated that he would vote nay on the motion
since he had been contacted recently by citizens who have complained about
continued disturbances at the restaurant.
The motion to approve the license failed 2-4 with Councilors Minard,
Jennings, Hagenauer, and Sifuentez voting nay.
MINARD/SIFUENTEZ.... based on information within the staff report, Council
recommend denial of the OLCC license.
The vote was 4-2 with Councilors Kyser and Steen voting nay.
2442 LIOUOR LICENSE RENEWAL FOR DON JUAN'S MEXICAN CUISINE.
City Administrator Quinn read a memo from Chief Wright advising the
Council that, according to an OLCC representative, the restaurant was
operating under a temporary license which is not subject to the annual
renewal process.
Chief Wright stated that the licensee has had an OLCC hearing on the
recommendation to cancel the liquor license, however, as of this date, no
final decision on the license has been made by OLCC Hearings Division.
No action was taken by the Council on this issue.
2662 PUBLIC HEARING - 1990-91 CITY BUDGET.
Council President Jennings declared the public hearing open at 9:08 p.m..
City Administrator Quinn reviewed the proposed budget which had been
approved by the Budget Committee. The total proposed tax levy for fiscal
year 1990-91 is $2,286,719 which is an increase of $272,550 over the
current year's levy. He provided a brief overview of the major service
impacts in the budget and briefly reviewed the tax base proposal with the
tax increase limitation of 4% without voter approval which was proposed by
the Budget Committee.
No one in the audience spoke in favor of the proposed budget.
David Negrey, 2139 Camilla Way, co-chair of the Senior Estates Information
Committee, spoke in opposition to the budget proposal expressing concerns
on the level of salaries for city personnel. In addition, he suggested
that the 13% increase in property taxes was to high since most senior
citizens are on fixed incomes.
Bill Costine, 1740 Rainier, objected to how State Gas tax funds are
utilized by the City since no improvements have been made to city streets
over the last three years with these funds. He also felt that the City
was contributing more than there fair share of the 9-1-1 program since the

City does not receive cash value for the use of the basement to
accommodate the program.
Rudy Castille, 458 W. Cleveland, objected to the City's leaf pick-up
program and questioned if street funds were used to pay for street
cleaning.
Councilor Steen stated that the street sweeper is currently being repaired
and the new sweeper is on order with the delivery date scheduled for June.
Administrator Quinn stated that personnel services budget is the major
cost within the operating budgets. The Budget Committee has put a 3% COLA
growth along with step increases in the proposed budget. A decline in
non-property tax revenues require a 13% increase in property taxes to
balance the proposed budget. Historically, the City has used state gas
tax revenues for Street Fund operations and the local option gas tax will
be used for capital improvements. In regards to the 9-1-1 Fund, the City
Tape 2 uses the dispatch 64% of the time and the funds to be transferred to the
9-1-1 Fund reflects their share of the operating costs.
The public hearing was declared closed at 9:34 p.m..
Councilor Jennings stated that the Budget Committee had met with the 9-1-1
User Board to receive input on the proposed management changes to the
program.
Councilor Minard stated that Management personnel did not receive a COLA
or step increases during the current fiscal year.
The Council recessed at 9:37 p.m. and reconvened at 9:41 p.m..
0552 COUNCIL BILL 1199 - ORDINANCE CALLING FOR SPECIAL ELECTION ON 1990 TAX
BASE LEVY AND ELIMINATION OF CONTINUING SERIAL LEVIES.
Council Bill 1199 was introduced by Kyser. The two readings of the bill
were read by title only since there were no objections from the Council.
On roll call vote, the bill passed unanimously. Council President
Jennings declared the bill duly passed with the emergency clause.
0630 COUNCIL BILL 1200 - ORDINANCE CALL FOR SPECIAL ELECTION FOR CHARTER
AMENDMENT TO LIMIT TAX BASE GROWTH TO 4% PER YEAR.
Council Bill 1200 was introduced by Councilor Kyser. The two readings of
the bill were read by title only since there were no objections from the
Council. On roll call vote, Council Bill 1200 passed unanimously.
Council President Jennings declared the bill duly passed with the
emergency clause.
0690 COUNCIL BILL 1197 - ORDINANCE REGULATING STREET TREE CARE (SECOND
READING).
The second reading of the bill was read by title only since there were no
objections from the Council.
Councilor Minard objected to the proposed ordinance due to the
requirements placed on the property owner to maintain trees within the
public right-of-way and to pay for the costs of removal of trees in the
right-of-way.
On roll call vote, the bill failed 2-4 with Councilors Minard, Jennings,
Hagenauer, and Sifuentez voting nay.

0909 COUNCIL BILL 1201 - RESOLUTION AUTHORIZING INTERGOVERNMENTAL AGREEMENT FOR
FORFEITURE AND SEIZURE PROSECUTION THROUGH DISTRICT ATTORNEY'S OFFICE.
Councilor Kyser introduced Council Bill 1201. The bill was read by title
only since there were no objections from the Council. On roll call vote,
the bill passed unanimously. Council Bill 1201 was declared duly passed.
0936 COUNCIL BILL 1202 - RESOLUTION APPROVING UNIFORM FIRE CODE AND STANDARDS
TO BE ENFORCED WITHIN THE CITY BY THE WOODBURN FIRE DISTRICT.
Council Bill 1202 was introduced by Kyser. The bill was read by title
only since there were no objections from the Council. On roll call vote,
Council Bill 1202 passed unanimously. Council President Jennings declared

ANNEXATION OF CAROLYN'S ADDITION. BLOCK 1.

1040 COUNCIL BILL 1205 - RESOLUTION AUTHORIZING APPLICATION FOR CAPITAL
ASSISTANCE GRANT FOR THE TRANSIT DIVISION.
Council Bill 1205 was introduced by Kyser. Since there were no
objections, the bill was read by title only. On roll call vote for final
passage, Council Bill 1205 passed unanimously. The bill was declared duly
passed.
1117 OLCC RECOMMENDATION -- SENIOR ESTATES GOLF & COUNTRY CLUB.
KYSER/STEEN... approve the change of license as recommended by staff.
Chief Wright stated that the proposed license would allow the Country Club
to sell alcohol in containers which can be taken outside of the
establishment.
Councilor Hagenauer objected to the license since the Club is not open to
the public for purchase of alcoholic beverages.
Councilor Kyser stated that the Club applied for the package store license
for the purpose of allowing can or bottled beer/wine purchased at the
Country Club to be taken out onto the golf course.
The motion to approve the licenses passed unanimously.

1374 OlCC lICENSE RENEWALS FOR 1990.
KySER/SIFUENTEZ.... approve annual liquor license renewals for Pizza Hut,
Bi-Mart Corporation, Woodburn Chevron, and Gary's Market. The motion
passed unanimously.
1456 CLAIMS FOR THE MONTH OF FEBRUARY 1990.
SIFUENTEZ/HAGENAUER.... approve voucher checks #9236 - 9602 for the month
of February 1990. The motion passed unanimously.
1478 Councilor Sifuentez suggested that the Council assignments to each
department be rotated. It was the consensus of the Council to hold a
workshop in the near future and this topic be discussed at that time.
Council President Jennings suggested that the newspaper be contacted
regarding the time schedule for improving Cleveland Street.
1583 Attorney Shields provided the Council with a memo advising them that he
has filed for the position of Tigard Justice Court Judge in Washington
County. If elected to the position, he would take office in January 1991.
1627 Councilor Steen suggested that the Council reconsider a city-wide business
tax. Administrator Quinn stated that he had recently met with the Public
Affairs Committee of the Chamber and had reintroduced the business license
and motel/hotel tax proposals.
1729 Councilor Sifuentez suggested that the staff assist Maclaren School in
finding projects for students during the month of April as part of the
Mission Impossible program. Administrator Quinn stated that he has been
in contact with Ms. Youngman from the School and he will be meeting with
his department heads to prepare a list of potential projects.
1842 ADJOURNMENT.
