0005 CONVENED. The Council met in regular session at 7:30 p.m. with Mayor
Kirksey presiding.

0020 MINUTES.
JENNINGS/MINARD.... approve the Council minutes of February 12, 1990;
accept the Planning Commission minutes of February 8, 1990, Recreation and
Park Board minutes of February 21, 1990, Downtown Association minutes of
February 6 and 13, 1990, and the Museum Advisory Committee minutes of
February 14, 1990. The motion passed unanimously.
0028 REAPPOINTMENTS - RECREATION AND PARK BOARD.
Mayor Kirksey recommended the reappointments of Kathy Figley and Ambrosio
Yanez Jr. to the Recreation and Park Board with terms to expire December
1992.
JENNINGS/SIFUENTEZ.... approve the reappointments as recommended. The
motion passed unanimously_
0041 Administrator Quinn stated that individuals interested in filing for city
office may do so beginning March 3, 1990.
0050 CENTENNIAL COMMITTEE - FINAL REPORT.
Patsy Antoine, Centennial Committee representative, provided the Council
with a final report of activities in which the Committee either sponsored
or participated in over the last three years. She expressed her
appreciation for financial support from the Council and community and for
their willingness to volunteer with Centennial projects. The Committee is
in the processing of closing their accounting records and it is
anticipated that approximately $5,000 will be returned to the City. The
Committee encouraged the Council to use the money towards continuation of
the museum. Patsy Antoine also acknowledged the work provided by the
following individuals during the entire 3 year period: Kathy Baldwin,
Delores Veldhuisen, Janice Wilcut, Marian Piper, Nancy Kirksey, and Elida Sifuentez.

0223 KySER/JENNINGS.... suspend Council rules and item 10 (Communications) be
considered next on the agenda. The motion passed unanimously.
0234 Bob Montgomery, developer of Rosemont Apts., requested Council
consideration to reinstitute the installment plan for payment of water and
sewer hook-up fees.
0272 PUBLIC HEARING - 1989-90 SUPPLEMENTAL BUDGET.
Mayor Kirksey declared the public hearing open at 7:40 p.m..
Administrator Quinn reviewed the proposed supplemental budget which
included increased appropriations for General Fund, W.E.L.L. Program Fund,
Park & Recreation Fund, and Sewer CIP Fund.
No one in the audience spoke either for or against the 1989-90
supplemental budget.
Mayor Kirksey declared the public hearing closed at 7:45 p.m..
0325 COUNCIL BILL 1196 - ORDINANCE ADOPTING SUPPLEMENTAL BUDGET FOR FISCAL YEAR
1989-90 AND AUTHORIZING AN INTERDEPARTMENTAL LOAN.
Council Bill 1196 was introduced by Kyser. The two readings of the bill
were read by title only since there were no objections from the Council.
On roll call vote for final passage, Council Bill 1196 passed unanimously.
Mayor Kirksey declared the bill duly passed with the emergency clause.
0369 COUNCIL BILL 1197 - ORDINANCE REGULATING STREET TREE CARE AND REPEALING
ORDINANCE 1908.
Council Bill 1197 was introduced by Councilor Kyser. The two readings of
the bill were read by title only since there were no objections from the
Council.
Councilor Minard questioned specific language in Sections 8, 15, and 19.
He expressed concern regarding the ability of the City to plant trees
within the public right-of-way without the property owner's permission.
Administrator Quinn stated that the majority of the language within the
Council Bill is the same as what currently is in effect with modifications
in the area of the Tort Claims Act and the subsidy program.
On roll call vote for final passage, the vote was 5-1 with Councilor
Minard voting nay.
Since the bill did not receive unanimous approval at the first meeting in
which it was introduced, the bill will be brought back before the Council
at the next regular meeting for a final vote.
0927 COUNCIL BILL 1198 - RESOLUTION ENTERING INTO A MEMORANDUM AGREEMENT WITH
POGOLOWITZ AND ASSOCIATES TO PROVIDE PROFESSIONAL SERVICES IN RENTAL
REHABILITATION GRANT.
Councilor Kyser introduced Council Bill 1198. The bill was read by title
only since there were no objections from the Council.
Administrator Quinn stated that a loan service fee will be charged to
recipients of this program to offset administration fees.
On roll call vote for final passage, Council Bill 1198 passed unanimously.
The Mayor declared Council Bill 1198 duly passed.

0993 AUTHORIZATION TO SCHEDULE PUBLIC HEARING ON PROPOSED WEED ABATEMENT LIENS.
Administrator Quinn reviewed his memo advising the Council that four
property owners have not paid the weed abatement fees from services
provided in 1989. The staff recommended that a public hearing be
scheduled to provide the property owners an opportunity to object to the
fees.
JENNINGS/MINARD.... set a public hearing date on the earliest date allowed
by law. The motion passed unanimously.
1050 OREGON LIOUOR CONTROL COMMISSION (OLCC) RECOMMENDATIONS - ANNUAL LICENSE
RENEWALS.
Police Chief Wright recommended the annual license renewals for the
following establishments: Westview Texaco, AM-PM Mini Mart, lind/s
Woodburn Market, lind/s Plaza Market, O.l.C.C. Store #60, Piper's Jewelry,
Payless Drug Store, Roth/s IGA, Safeway Stores, Inc., 7-11 Store, Young
Street Market, Food Warehouse, Short Stuff Store-N-Deli (also known as
Crossroads Market & Deli), Home Plate Market, Eagle/s Hall, Woodburn Elks
#2637, la Petite Deli, Pietro/s Pizza, Abby/s Pizza Inn, Woodburn lanes,
Brack/s Restaurant, Club Alley II and Cafe, and The Pier. He stated that
the liquor application for Senior Estates Golf & Country Club would be on
the next meeting/s agenda since they are requesting a change in the type
of license.
Chief Wright also recommended that public hearings be scheduled on the
license renewals for the following establishments: la linda/s
Tortilleria, The Raven, Chung Sing/s Restaurant, The New Woodburner, and
Don Juan/s Mexican Cuisine.
JENNINGS/KySER.... add Pizza Hut to the list of license approvals. The
motion passed unanimously.
JENNINGS/SIFUENTEZ.... approve the liquor license renewals as recommended
by Chief Wright. The motion passed unanimously.
KySER/JENNINGS.... set a public hearing date for the five businesses as
recommended. The motion passed unanimously.
Following discussion on dates in which to hold the public hearing,
1209 MINARD/KySER.... hold the public hearing on March 12th for the OlCC
licenses and the hearing for obnoxious vegetation on March 26th. The
motion passed unanimously.
1261 EXECUTIVE SESSION.
JENNINGS/SIFUENTEZ.... adjourn to executive session to discuss pending
litigation as authorizing under ORS 192.660 (1)(h). The motion passed
unanimously.
The meeting adjourned to executive session at 8:14 p.m. and reconvened at
9:18 p.m..
1271 Following the Executive Session, the public was informed that no final
action is being taken by the Council at this time.
JENNINGS/SIFUENTEZ.... allow the City Attorney to contract with Attorney
Jim Carter to represent the City on the Pacific Northwest Development Co.
lawsuit rather than Mr. Engle.

Councilor Jennings stated that Mr. Engle withdrew from the appointment
since one or more of his clients would not give him the required conflict
of interest release.
The motion passed unanimously.
1365 Councilor Steen questioned if the downtown parking lot behind the drug
store would be closed earlier in the evenings.
Chief Wright stated that the Downtown Association will meet this spring to
re-evaluate the parking lot closure hours.
Councilor Steen also questioned if there was a curfew law in effect.
Chief Wright stated that the state statutes address curfew for individuals
under the age of 16t howevert certain criteria must be met before a
violation occurs.
1481 Councilor Minard commended the Mayor on the employee's banquet and service
award program.
1513 Mayor Kirksey stated that she would be leaving for Maine on February 27th
and will return on March 12th.
1528 ADJOURNMENT.
The meeting adjourned at 9:27 p.m..
