JENNINGS/MINARD... approve the Council minutes of January 8, 1990 and accept the Downtown Association minute. of January 9 and 16, 1990. The motion passed unanimously. 0041 Administrator Quinn reminded the Council that the Budget Committee will meet on January 23rd to review the 1989-90 supplemental budget. In addition, budget bearings for the 1990-91 budget will be held on January 25, February 1, February 6 and February 8 on an as needed basis. The meetings begin at 6:00 p.m. in the City Ball Council Chambers. 0050 Mayor Kirksey stated that she would appoint two members to tbe Park and Recreation Board at the next Council meeting. 0085 1988-89 UlUAL AUDI! UPOR' (CAn). Don Barris, representing Harris & lide, CPA, briefly reviewed tbe City's audit report for fiscal year ending June 30, 1989. He stated that his firm had provided a clean opinion on the City's financial statement. Be also commended tbe city staff in preparing the Comprehensive Annual Financial Report (CArR) which bas been submitted to the Government Finance Officers Association for a CAFR award. 0185 CER'l'IrICI.!1 or APPltBCIA,.IOII - NUll HA!S PROJEC'l'. Mayor Kirksey presented the Certificate of Appreciation to RSVP Director Jill Barvey. The project was initiated by Portland General Electric who had provided $90 towards the purchase of yarn. Marion County RSVP volunteers were asked to knit hats for the needy and, as of November, 900 hats had been completed of which 500 hats were knitted by Woodburn volunteers. Council Bill 1192 was introduced by title only. The bill was read by title only since there were no objections from the Council. Councilor Hagenauer stated that he would like to change his vote from the previous meeting on this issue and have the Council reconsider Council Bill 1188. Attorney Shields stated that the resolution before them at this time would grant the variance to the Van Valkenberg's. On roll call vote for final passage of Council Bill 1192, the vote was 1 - 5 with Councilors steen, Minard, Jennings, Hagenauer, and Sifuentes voting nay. 0396 HAGEIAUER/SIPUIKTEZ... reconsider Council Bill 1188 at this time. The vote was 5-1 with Kyser voting nay. 0470 MIIARD/SlrUENTEZ... Council take a 5 minute recess. The motion passed unanimously. The Council recessed at 7:50 p.m. and reconvened at 7:56 p.m. . 0481 CODICIL BILL 1188 - RESOLUTIOI DEllYIIG VHIDCE CASE '89-10. Council Bill 1188 was re-introduced with the findings attached as originally submitted with the bill. The bill was read by title only since there were no objections from the Council. On roll call vote for final passage, Council Bill 1188 passed 5-1 with Councilor Kyser voting nay. The motion passed unanimously. 0572 WOODBURI MUSEUM S'A1'US REPOR'. The staff provided the Council with a current status report regarding the expiration of the lease with the property owner and options available to the City regarding continuation of the museum at its present location. Administrator Quinn stated that purchase of the buildings may not be a feasible solution at this time since the Budget Committee is reviewing reductions in the property tax funds and the proposed 1990-91 budget does not include appropriations for the purchase of the buildings. Councilor Kyser suggested that the museum be relocated with the help of local service clubs. Councilor Jennings suggested that the museum remain at its present location and that the funds which will be returned to the City from the Centennial commission be used to extend the lease until December 31, 1990. 0921 Gene Stoller, 488 Montgomery, stated that his special interest in the museum is the Bungalow Theater. He stated that the theater was designed for multiple uses and is equipped to handle 8 mm, 16 mm, and 35 mm films. He strongly urged the Council to seek necessary local support to obtain the buildings. Emmett Boger, 950 Evergreen 1119, stated that, as a member of the French Prairie Historical Society, he is interested in retaining the museum since it is a valuable historical attraction to bring visitors to Woodburn. Tours to the Settlemier house have resulted in visitations to the Museum with favorable comments from visitors on the museum's displays. He urged the Council to look for available funding to keep the museum open. Attorney Shields stated that the City would need to have the buildings appraised before an offer to purchase is made. Discussion was held regarding options available to the City at this time. Several Councilors expressed interest in a lease/purchase option which would provide the City with several months in order to solicit donations to help offset the cost of the purchasing the buildings. HAGENAUER/STEEIt.... lease option on buildings to purchase for one year and staff proceed with the necessary steps to purchase the buildings within one year, and the lease payment to apply to the purchase price. The motion passed unanimously. PROPOSED S'l'REE'l' 'l'REE ORDIIIUCE MODIFICATIOIlS. The Council reviewed the staff report which outlined the street Tree Committees recommendations to fund a subsidy program for maintenance of trees within the City right-of-way. Additional subsidies would be available to households below a median income level. Park Director Holly stated that removal of a tree within the right-of-way would be at the property owner's expense. The tree care subsidy program would be cost sharing with the City paying 60% and the property owner 40% with an additional 20\ subsidy to property owners with below median income levels. Upon completion of a subsidy application, City staff would initially perform an analysis of tree(s). If an independent analysis is necessary, the property owner would be responsible for the expense. Community Development Director Goeckritz stated that the Tree Committee was sensitive to the financial concerns of the City in establishing the proposed policy. Currently, trees located within City right-of-way are maintained by property owners and authorization from the City is required before trees can be removed. Councilor Minard expressed concern regarding maintenance and removal costs of trees borne by property owners since the City has the authority to order removal at the owners expense or to plant trees within the right-of- way without the owne~'s permission. Staff members voiced concerns on tort liability to the City if the responsibility for tree maintenance or removal was shifted back to the City. Councilor Kyser left the meeting during the discussion portion of this issue. It was the consensus of the Council to hold a public hearing on the Street Tree Committee's proposal prior to consideration of an ordinance on the subsidy program. Police Chief Wright requested a Council workshop to review the Management Report from Bureau of Police Standards and Training. It was the consensus of the Council to meet on February 12, 1990, 6:30 p.m., to discuss the results of the study. WAS'lEIIA'lER 'l'REA'lMD'l MODIFlCA'l'IOIS UD WA'lER/SEIIER RA'l'E IICREASE PROPOSAL. Based on discussions held during the Council workshop, MINARD/JENNINGS... approve the permit modification from BOD to CBOD and accept the requirement of treatment plant modification schedule that is related to the establishment of TMDL's (Total maximum daily load). The motion passed unanimously (Kyser absent). Public Works Director Tiwari briefly discussed the proposed water and sewer rate increases. Councilor Jennings suggested that the 1991 increase be addressed by the Council next year rather than incorporating it into the proposed rate increase resolution. Director Tiwari stated that anticipated revenues in the 1990-91 Water and Wastewater budgets are based on the proposed increases to the basic rates. Following a brief discussion, JENNINGS/MINARD.... direct staff to draft a resolution with the rate increases as proposed. The motion passed unanimously.
