Community Development Director Goeckritz briefly reviewed his memo pertaining to the development of a transportation plan within the City. Under a new state rule. the City is required to develop a transportation plan which would encompass four established goals. The Planning Commission is willing to undertake the task which will take approximately two years to complete. SIFUENTEZ/GALVIN... Planning Commission take on the task of drafting a transportation program for City Council review. The motion passed unanimously. 0284 CLAIMS FOR THE MONTHS OF SEPTEMBER AND OCTOBER 1991. SIFUENTEZ/STEEN... approve voucher checks #11491 - 12050 for the month of September 1991, and voucher checks #11950 - 12378 for the month of October 1991. Several Councilors questioned the purchases included within checks #11681, 11851, and 12048. The staff will report back at the next meeting. On roll call vote, the motion passed unanimously. 0422 Councilor Sifuentez advised the Council that a Park Fundraising Committee has been formed and the group has expectations of doing a lot of work to raise funds for improving the City's park system. 0463 Councilor Sifuentez also expressed her appreciation to one of the City's Transit bus drivers who showed interest in a elderly rider's welfare when he sent her a get well card to the individual. 0490 ADJOURNMENT. He stated that it was his opinion if there was a bikeway, no parking and sidewalks on Hayes Street. people would not drive so fast. He stated that the sidewalk is partially the responsibility of the property owners. The property owners do not own the land up to the curb. They own almost 13 feet away from the curb. When the sidewalks are built they will be placed on public right-of-way not on private property. Mr. Tiwari stated that if there was an Local Improvement District it would need the vote of the people and it would have to meet the majority (over 50%). He stated that there is an ordinance which allows Council to order that sidewalks be constructed and paid for. He stated that there was two ways to have the sidewalks paid for, 1) paid right away or 2) have a payment plan. The Woodburn City Council minutes of October 14, 1991 were accepted as presented. pcmll-14.sgibw 1 11" .:5B- 3) BUSINESS FROM THE AUDIENCE: None 4) COMMUNICATIONS: Staff read in to record a letter from Patricia Hershberger Re: Hayes Street Project. 5) PUBLIC HEARINGS: Zoning Ordinance Amendment #91-07 Chapter 31, Central Business District Staff stated there was request to amend Chapter 31, Section 31.020 Prohibited Use, item (b) Churches, Synagogues, Temples and Missions to allow such uses as conditional under Section 31.025 Conditional Uses, item (b). Staff recommended that churches, synagogues, temples and missions be a conditional use in the CB District. After some discussion among the Commisson members and staff Vice President Vallieres closed the public hearing. Commissioner Warzynski made the motion to amend Zoning Ordinance, Chapter 31, Section 31.025 Conditional Uses to include item (b) churches, synagogues, temples and missions. Delete item (b) from Section 31.020 Prohibited Uses. The motion was seconded by Commissioner Guerra. The motion passed 4 - yes. 1 - no. 6) REPORTS: A. Senecal Estates Phase II - Dave Trapp and Associates Final Plat Presentation. Staff stated that all the conditions have been met. The Vice President needed to sign the final plat. Commissioner Guerra asked if the Planning Commission had a roll in deciding the nature of the names in as they reflect the community at large. Staff answered yes, if the Planning Commission wished to have a street or subdivision designated a certain name. they can do that at the preliminary proposal but not at the final plat. Commissioner Guerra stated that in the future he would like to see the Planning Commission take a more active part in screening out the names received in the future unless they reflect the community at large. Vice President Vallieres signed the final plat. B. Minor Partition #91-05. 1-5 Interchange Area, Robert and Shirley Jensen, Eugene Chrisman. Staff stated that the applicant wished to divide approximately 8.3 acres into three parcels containing approximately 1.72 acres, 2.43 acres and 4.1 acres. Staff recommended approval subject to the following conditions: 1) A Final Plat Map shall be recorded with Marion County and a copy provided the Woodburn Planning Department. Commissioner Bauer stated that he wished to inform the applicant so they are aware that the Commission would be seriously considering the traffic pattern and what the State says about Hwy 214 and any other attachment to the east/west road. C. Discussion Paper and Draft - Landscape Policies Staff presented the discussion paper to the Commission. There was some discussion about parking lot landscaping to improve the design and image of parking spaces. Staff went over the proposed landscape zoning regulations for Woodburn. 3 J~ D. Transportation Planning Update Staff stated that at the present time they were still in the inventory stage of the transportation model program. He stated that they were 3/4 through the inventory in regards to the various counts that are necessary to make the model work. They will then be sending the information to the State Highway Division, who will then put it in their computer system. Staff took this time to introduce the new City Administrator, Chris Childs, to the Planning Commission members. 7. BUSINESS FROM THE COMMISSION: None 8. SECRETARY'S REPORT: The monthly Board minutes of October 23, 1991 were approved as submitted. DIRECTOR'S REPORT: Monthly Statistics: The monthly statistics were self-explanatory. Circulation statistics continue to show an increase. Activities: A list of activities was distributed to the Board. The library will be closed Thursday and Friday, November 28 and 29 for Thanksgiving, then open as usual on Saturday. Book Detection System: The bid opening for the book detection system will close November 20. New Book Drop: The larger new book drop has been received, but a cement slab needs to be poured for it. The old book drop will be moved to the east entrance. OLD BUSINESS: None NEW BUSINESS: Bud~et: Linda discussed the library's budget proposal for fiscal year 1992-1993. Board Member Moving: Jan Zyryanoff asked if it would be necessary for her to resign from the Library Board because she will be moving out of the city limits this summer. BACKGROUND: United Disposal has requested a 17% rate increase (see attached material). This is similar to the increases presently being requested of most other cities in Marion County. Half of the increase is to offset an approximately 23% increase in disposal fees charged by Marion County (raised from $55/Ton to $67.45/Ton). The other half of the increase is intended to offset increased operating costs. This equates to a 12.9% increase in the general operating portion of the company's budget. This rate increase will raise the cost of 11-can" service from $9.55 to $11.15 per month. Other rates are outlined in the attached rate schedule. In an effort to compensate for the increase, the company is also introducing a 20-gallon "mini-can", priced at $9.50/mo. This would primarily benefit those who generate very little trash or those who do significant amounts of recycling. Included in the total 17% increase, United Disposal has agreed to increase the franchise fee paid to the city from 2% to 3% (an increased franchise fee was also incorporated into the rate increase granted in the Salem area). Added annual revenue to the City of Woodburn will be about $20,000. This franchise fee has stood at 2% since the inception of the agreement in 1979. The maximum allowable franchise fee that can be charged by a city is 5%. Most of Woodburn's other utility franchises are operating at 3%. In addition, United will continue to provide free community-oriented services (see list) that they estimate to be valued at some $18,000 (almost another full one percent of total gross revenues). The portion of the increase necessary to offset the higher disposal costs appears correct. Also, the company's comments regarding the Consumer Price Index seem to be accurate. Conversely, we question the company's contention that a 10% operating margin is necessarily an industry norm and disagree with the company's method of calculating the operating margin. Staff's calculations show the company to be already operating at or near a 10% margin. It must also be pointed out that the "confidential" financial reports submitted are unaudited. SUMMARY: The requested rate increase is consistent with other rate increases in the Marion County area. The company's contention that there has been no rate increase since 1984, except for "pass-through" of disposal costs, is essentially correct. The City of Woodburn will realize additional franchise fee revenues as described. RECOMMENDATION: That Council pass the Resolution (Council Bill 1353) granting the requested rate increase along with the Ordinance (Council Bill 1354) amending the Solid Waste franchise fee from 2% to 3%. 104 ESTLE HARLAN CONSULTANT HARLAN BUSINESS CONSULTANTS, INC. 2202 S.E. Rate History The last over-all rate increase for this company for costs of operation other than disposal was in 1984. Subsequent rate increases have been only for a pass-through of the increased cost of disposal at the Marion County Burner. The last disposal fee pass-through was effective October I, 1989. II. Rate Request We are requesting a total increase in rates of 17%. Marion County has computed that 8.5% of this increase would be directly for a pass-through of the increased cost of disposal at the burner, effective January I, 1992. The other 8.5% of the requested adjustment is to cover your franchisee's increased costs of operation since 1984. Their gross cost increases have well exceeded this 8.5%. However, the company has developed internal efficiencies that have bought down the need for a greater rate adjustment. These efficiencies include: -Cart service at the curb that can be collected by an automated or semi-automated system. This saves on both truck and labor time and expense. Not all customers use carts, but a sufficient number have availed themselves of this service to result in efficiency savings to the company. -Facilities for sorting and storing recyclable materials so they can be marketed in volume for a higher revenue flow. Recycling still has a net cost to this company well in excess of the revenue received. But the loss is not as great as for most companies that do not have the facilities and market capabilities of United Disposal Service. III. Rate Adjustment Justification We have provided the City with confidential Income Statements that show your franchisee is currently operating at well below a 10% Operating Margin. We also have included projections for 1992 and 1993 that show that even with the requested rate adjustment, the Operating Margin will remain somewhat below 10%. A 10% Operating Margin for solid waste collection companies is an industry norm which allows appropriate maintenance and replacement of equipment to meet changing laws and technologies. IDA Page - 2 The Consumer Price Index (CPI-U) will have increased 23.5% from the date of the last over-all increase in 1984 to the effective date of this requested rate adjustment. Our proposed adjustment of only 8.5% over-all increase for operating costs other than disposal is a further indicator of the internal efficiencies utilized by your franchisee and the benefit that has been to its customers. The rates in your City will remain very fair and reasonable for the good service that is being provided, if you grant this rate adjustment. WHEREAS, under Ordinance 1641, United Disposal Service, Inc, has an exclusive franchise for solid waste management in the city of Woodburn, and WHEREAS, under that franchise said firm pays to the city a franchise fee in consideration of said franchise, and WHEREAS, the franchisee has consented to an increase of 1 % in the franchise fee paid to the city, NOW, THEREFORE, THE CITY OF WOODBURN ORDAINS AS FOllOWS: Section 1. Section 6 of Ordinance 1641 is hereby amended to read as follows: "Section 6. Franchise Fee. In consideration of the franchise granted by the ordinance, the franchisee shall pay to the city of Woodburn, Oregon, 3 percent of the gross receipts collected each year by the franchisee for service within the corporate limits of the city of Woodburn, for solid waste service or sale of recycled materials, for the rights, privilege and franchise granted by this ordinance. The first payment shall be for the period of April 1, 1978, to March 31, 1979. The first payment shall be paid by June 30, 1979. For subsequent years under the franchise, the payment for each twelve-month period ending March 31 shall likewise be paid by June 30 of each year. Each annual payment shall be accompanied by a complete statement setting forth the gross receipts collected for the twelve months. II Section 2. This ordinance being necessary for the preservation of the public peace, health, and safety, an emergency is declared to exist and this ordinance shall take effect on January 1, 1992, after passage by the Council and approval by the Mayor . (NOTE: The applicable load limits and conditions outlined on city permit number 003-90 signed by the City Engineer on May 22, 1990 be allowed to continue, with the minor change of maximum daily flow limits to be 0.160 mgd and the average flow limits to be 0.080 mgd to somewhat correspond with 1990 flows.) BACKGROUND INFORMATION: It appears that the North Marion Fruit Company is in the process of changing ownership of the building, therefore, a request has been made to the city to provide the conditions of wastewater discharge limitation for the new owner. North Marion Fruit Processing Company has operated in the city for more than 30 years. In the late fifties or early sixties, the plant operation was moved from downtown area to the southwest section of town. To my understanding, the legal requirements for shifting the operation from downtown to the new location were met. The business has always paid its water and sewer bills and has served the community well. The following facts have been considered prior to making the decision on the. recommendation: 1. The building in question has been used for fruit processing business ever since it was constructed. 2. This company is changing ownership but is not requesting a building permit for expansion. 3. Based on the newly approved systems development charge resolution, a fruit processing company having North Marion's average flow capacity needs would be required to pay a water systems development charge of approximately $280,000 and a sewer systems development charge of approximately $360,000. 4. The treatment facility, in general, is more suited in the agriculture area rather than residential area. The following items are of concern to us: 1. As required by DEQ, the City of Woodburn has installed test wells in the vicinity of the lagoon to monitor the ground water pollution. The residential development, with possible domestic water wells, make it practically impossible to determine the source of pollution. 2. The odor and vector complaints from the newly constructed housing units in the vicinity of our plant will increase the cost of operation drastically. Due to the above technical reasons, Public Works Department has opposed residential development in the proximity of Woodburn's wastewater facility. The letter sent to the hearings officer of Marion County is attached for your review. We hope that the city council agrees with our action. (Frank) Tiwari, being first sworn upon oath, offer the following testimony. I am the City Engineer and Public Works Director of Woodburn, Oregon and have occupied these positions since 1975. From a technical point of view, the City of Woodburn is opposed to any further residential, commercial, or industrial growth in and around the area between Carol Road and Molalla Road and east of Highway 99E that uses any form of subsurface sewage disposal. The ground water in this area has nitrate contamination at the thirty-five foot depth. This contamination presents a potential hazard for the lower ground water aquifer. A related concern is that the contamination could potentially use one of the existing wells in the area as a vertical conduit to the lower aquifers. If this were to happen the lower aquifers, where drinking water is pumped, could become contaminated with nitrates and be undrinkable. Contamination at the thirty-five foot level can cause operational problems for the City's treatment plant. The contamination has the potential of interfering with the operation of the treatment plant lagoon. There are monitoring wells around the lagoon that monitor any leakage from the lagoon. There are three monitoring wells down gradient of the lagoon and a monitoring well up gradient of the lagoon. If outside contamination interferes with the monitoring well, the City would not be able to tell if the lagoon is leaking. Page 1 - SWORN TESTIMONY OF G. S. (FRANK) TIWARI ~ /5/1. Finally, the City shares many of the same concerns expressed in other testimony that the proposed use is generally incompatible with existing uses. Attendant odors and vectors generated by the area's farm related uses are likely to be offensive to owners of residential property. More importantly, encroachment and enlargement of non-farm dwellings into this area has a negative impact upon maintaining the existing farm related uses. At that time, staff conveyed to council that we would confirm this expenditure after checking the pay voucher. Review of the voucher shows that it was housing grant funds used to purchase paint in August, 1991 for a house which in turn was painted by young adults hired by the Willamette Valley Jobs Council. This program has been in effect over the entire period of the housing rehabilitation program. The positive aspect of it is the fact that considerable dollars are saved by using persons paid by the job council while the housing program merely absorbs the cost of the paint. SG/lg RHABEXPN
