The motion passed unanimously. Councilor Jennings questioned the location of Site Plan Review Case//92-04 as discussed in the Planning Commission minutes. Director Goeckritz stated that the property is located near Gatch and Young Street adjacent to the Rosemont Apartments. PRESENTATION - LIBRARY EMPLOYEE OF THE YEAR. Library Director Sprauer presented Librarian Rebecca Dusek with the Employee of the Year Award. Mrs. Dusek has been employed by the City since 1987 and currently serves as Circulation Librarian. APPOINTMENTS. Mayor Kyser recommended the appointment of Richard Pugh to the Planning Commission to fill an unexpired term ending December 1994. The r~otion passed unanimously. .0133 MEETING ANNOUNCEMENTS. A Council workshop has been scheduled for Monday, April 20, 1992, 7:00 p.m., City Hall Council Chambers, to discuss wastewater issues. The Cable T.V. Advisory Board will hold their next meeting on Tuesday, April 21, 1992, 7:00 p.m., at City Hall. A Public Informational meeting will be held on Wednesday, April 15th, 2:00 p.m., City Hall, to provide interested citizens with information regarding the proposed tax base. 0154 CHAMBER OF COMMERCE REPORT. Joanne Beck, representing the Chamber Board, reminded the Council of the upcoming Chamber events: 1) General membership meeting at the Elks Lodge on Wednesday, April 15th, 12:00 noon, with guest speakers of Jose Castro and Paul Castro; and 2) Luncheon and Spring Fashion show will be held on Secretaries Day, April 22nd, 12:00 noon, at the United Methodist Church. 0216 Barbara Lucas, 214 E. Clackamas Circle, referred to a staff report within the Council packet which provides the Council with the Wal-Mart Access Road Construction schedule. She stated that at the January 30th Planning Commission meeting, the Commission recommended that the Council consider a cul-de-sac on West Hayes Street at the west end of Barclay Square Apts. Her concern is that the main road construction to access Wal-Mart will be completed prior to the completion of a transportation study and the road construction includes extension of West Hayes Street. Public Works Director Tiwari stated that the main access road to be constructed is Stacy Allison Road, however, Lawson Ave. and W. Hayes Street will experience some additional traffic once completed. The State Highway Division is preparing a traffic computer model to analyze potential traffic problems in this area and until this model is completed, which is scheduled for mid-June, the staff is delaying any modified recommendation to the Council on this issue. Councilor Jennings stated that their would be no further public hearings on this issue, however, the Council will review the Planning Commission's recommendation and computer model when the information becomes available. Page 2 - Council Meeting Minutes, April 13, 1992 COUNCIL MEETING MINUTES April 13, 1992 TAPE READING Ms. Lucas suggested that the Council not allow the paving of the extension of West Hayes Street until after the June 15th report to the Council. 0425 PUBLIC HEARING - 1992-93 CITY BUDGET. Mayor Kyser declared the public hearing open at 7:15 p.m.. Administrator Childs provided the Council with a staff report on the 1992-93 city budget, which includes the State Revenue Sharing Fund, as approved by the Budget Committee. The total proposed budget for all funds is $12,383,078 of which the Committee has recommended a total tax levy of $2,569,358. The proposed tax levy is 6% over the existing 1991-92 tax levy. A breakdown of the proposed levy is as follows: Library levy, $442,570; Park & Recreation levy, $549,368; and a proposed tax base of $1,577,420. The proposed tax base will be submitted to the voters on May 19th. No one in the audience spoke either for or against the proposed 1992-93 budget. Mayor Kyser declared the public hearing closed at 7:20 p.m.. 0570 COUNCIL BILL 1383 - ORDINANCE AMENDING URBAN GROVVTH BOUNDARY. ANNEXING 10.7 ACRES, AMENDING COMPREHENSIVE PLAN MAP, AMENDING WOODBURN ZONING MAP, AND APPROVING PRELIMINARY SUBDIVISION PLAT - SEVEN OAKS SUBDIVISION. Council Bill 1383 was introduced by Councilor Hagenauer. Recorder Tennant read the two readings of the bill by title only since there were no objections from the Council. Attorney Shields stated that he had just received a 5 page letter Attorney Wallace Lien, representing Patricia & Robert Payne, in opposition to Council Bill 1383. He requested that the Council take a 5 minute recess to allow him to review the letter and discuss the issue with Attorneys Lien and Kelley as to whether or not the letter should be included in the record. Councilor Jennings expressed concern regarding the title of the proposed ordinance since it did not include the conditions of the Council. Brief discussion was held regarding the motion that was made by Councilor Figley at the March 10th meeting addressing the Council's conditions and/or concerns. The Council recessed the meeting at 7:24 p.m. and reconvened at 7:35 p.m.. Attorney Shields stated that he had met with both attorneys and since the letter raises numerous arguments, it was his opinion that reading the letter into the record would require a new public hearing before the Council. If the ordinance is approved and the action is appealed to LUBA (Land Use Board of Appeals), the arguments could be raised by the opponents at that time. The motion passed 4-021 with Jennings abstaining. 1083 Councilor Jennings expressed his concern regarding the conditions imposed by the Council and where, within the proposed ordinance or staff report, those conditions are specified. Following some discussion on this issue, Attorney Shields suggested that an amendment to the proposed ordinance be made which specifically addresses the waterline loop at the southerly end of the property. FIGLEY/JENNINGS .... amend Council Bill 1383 as follows: After Section 7, at the end of the existing line which says Exhibit B., the period be deleted, a comma be inserted, add language "and based as well on the condition that no development be allowed prior to the completion of waterline loop over southern portion of property as indicated on proposed plat.". The motion passed unanimously. 1110 1205 Attorney Shields also requested Council amendment of the bill to correct two technical issues regarding the Urban Growth Boundary Agreement: 1) amend the title by deleting "..declaring an emergency" and inserting "..setting an effective date".; and 2) Section 8 be replaced with the following language: "Section 8. This ordinance is effective upon formal approval of the above-described Urban Growth Boundary amendment by the Marion County Board of Commissioners pursuant to the terms of the Urban Growth Boundary Agreement signed by the City and adopted by Ordinance 2021.". JENNINGS/FIGLEY .... approve the amendments to Council Bill 1383 as read by City Attorney Shields. The motion passed unanimously. On roll call vote for final passage, Council Bill 1383, as amended, passed unanimously. Mayor Kyser declared the bill duly passed. 1219 LIQUOR LICENSE APPLICATION - CLUB CAFE. Chief Wright recommended the change of ownership Class A liquor license application request submitted by Juan and Aurora Ruiz for the business currently known as the Club Cafe. JENNINGS/FIGLEY .... recommend approval of the license to OLCC in accordance with the recommendation from the Police Chief. The motion passed unanimously. Page 4 - Council Meeting Minutes, April 13, 1992 COUNCIL MEETING MINUTES April 13, 1992 TAPE READING 1236 REQUEST FOR SIGNS DESIGNATING A 5 MPH SPEED AND CHILDREN PLAYING ON "A" COURT AND "A" ~REET. Residents of "A" Court and "A" Street have requested the above named signs to forewarn motorists of children playing in the area. The staff report recommended that the speed designation sign and children playing sign not be installed since it may give parents false security of their child's safety. However, the staff did recommend that a Dead End sign be placed on A Street north of Stark Street. JENNINGS/FIGLEY... follow the recommendation of the staff and deny the request for signs on "A" Street and "A" Court. The motion passed unanimously. 1282 REQUEST FOR "NO PARKING" SIGN ON CHERRY STREET. As stated within the staff report, a resident along Cherry Street had requested the installation of a "No Parking" sign on one side of Cherry Street since cars were parking on both sides of the street and blocking mailboxes. The staff recommended that the sign be installed on the south side of the street since the street is less than 30 feet in width and it is the City's policy to prohibit parking on the south and east sides of a street when parking is allowed only on one side of the street. JENNINGS/FIGLEY... approve the staff recommendation to install "No Parking" signs on Cherry Street. The motion passed unanimously. 1292 CLOSURE OF HARDCASTLE STREET FOR HIGHWAY 99E PROJECT. 1321 Page 5- The staff requested closure of Hardcastle Street to through traffic during the installation of a 30" storm drain line which is required in conjunction with the Highway 99E widening project. JENNINGS/FIGLEY .... approve the street closure as required during the construction period. The motion passed unanimously. Jerry Petzel, 509 Cherry Street, requested that the Council reconsider their motion to eliminate parking on the south side of Cherry Street. He stated that the mailman has not complained about vehicles parking in front of his mailbox and prohibiting parking in front of his house would eliminate 75% of the parking available to him. In addition, he has a small shop in his garage and it is necessary to have the parking in front of his house. Margie Brunner, 172 Cherry Street, stated that she lives on the same side of the street as Mr. Petzel, however, she does have a problem with people parking on both sides of the street. She stated that she did not object to allowing parking in front of Mr. Petzel's house which is located further west of Front Street. Council Meeting Minutes, April 13, 1992 COUNCIL MEETING MINUTES April 13, 1992 TAPE READING 1480 A letter from Laura Asper, 208 Cherry Street, was also submitted to the Council expressing her desire to instaIlihg "No Parking" signs on the hydrant side of the street (north side) and a speed sign designating 20 MPH. Mayor Kyser stated that the staff will further investigate the concerns of the residents and will get back to the property owners within the next week. STAFF REPORTS. The Council received staff reports on the following items: 1) Traffic issues - OSHD federal aid construction projects and Wal-Mart access road construction schedule; 2) Wastewater issues - Meeting with Gervais Council regarding sewage treatment issues, DEQ statewide project list for loan program, and Mill Creek pump station limitations; 3) Law Enforcement - Traffic Safety grant of $3,360; 4) Building activity report; and 5) Code Enforcement report. 1500 Councilor Figley stated that she and Councilor Sifuentez had attended a meeting last Friday evening which involved parents, school district officials, and the Police Department. The meeting focused on problems associated with students who have nothing to do after school. It was the consensus of the parents attending the meeting that the community provide more things for the students to do after school hours and that parents take some responsibility for the actions of their children. 1575 Councilor Sifuentez informed the Council that she had recently learned that the Eugene School District brings their students to Woodburn for an annual field trip as part of their cultural learning program. 1619 Administrator Childs advised the Council that the League of Oregon Cities will be holding a regional workshop in Corvallis on Monday, April 20th. Councilors are welcome to attend the workshop, however, individual names must be forwarded to the League office no later than April 14th. 1670 ADJOURNMENT. The meeting adjourned at 8:05 p.m.. BUSINESS FROM THE AUDIENCE: None COMMUNICATIONS: Staff read a letter from a concerned citizen about the lack of landscaping at the Bi-Mart, Shop-n-Kart shopping center. Staff sent a reply with a Landscape Policy enclosed. The concerned citizen replied thanking staff and the Commission for the newly adopted Landscape Policy. s) PUBLIC HEARINGS: Site Plan Review #92-04 Apartment Complex/Wes Torah 758 Young St., Woodburn This hearing was continued from the March 12, 1992 meeting. Staff stated that after speaking with the (~ity Attorney it has been found that the applicant has enough sq. footage to build the five units. There will be no parking allowed in the driveway access. Conditions would need to be established to make allowance for this development to occur. These conditions are listed in thestaff report. Commissioner Warzynski asked about the sewer connection from Gatch Street. She recalled that Mr. Toran wished to connect to Young Street. Staff answered that he had to connect to Gatch Street. Commissioner Warzynski asked about the parking spaces. She stated that there were eight shown, she thought he had to have ten spaces. Staff answered yes, Mr. Toran did have ten spaces. He would have to designate two of them as handicap. Commissioner Guerra asked if the recommendation was being made assuming that the total lot was sharing the roadway. Staff answered yes. There was some discussion about the tax share of the roadway and concern over the five instead of four units. Concern about the area for landscaping was also discussed. Staff stated that with the amount of sq. footage being counted, by todays standards there was room for five units. Todays standards for landscaping could also be met. There being no further discussion, Vice President Vallieres closed the hearing. Commissioner Warzynski made the motion to accept the Site Plan Review #92-04 with the conditions listed. REPORTS: Site Plan Review #92-06 Woodburn School District, Lincoln Elementary School. Staff stated that the applicant was in need of a temporary double classroom modular unit. It is needed to help meet the growth demand on the school district. Staff stated that it is zoned Public Educational Facilities and any expansion is allowed. The classroom will be 1848 sq. feet in area and will be placed 20 ft from the main building. Staff recommended approval with conditions listed in staff report. There was no action needed from the Commission. Lot Line Adiustment #92-06 Senecal Estates/Craig Munson Staff stated that it was being requested that the 24 ft. setback be adjusted to 21 ft. to accompany their 27 X 66 foot manufactured home. Staff felt that this would not be detrimental to the area and granted the 2 ft. variance. Traffic Volumes and Projections - Selected Streets in Woodburn Staff stated that staff was working on traffic counts of City streets, County roads and State highways. State Highway Division will be able to complete the model and the results of the model in late May. He stated that in the packet was a comparison of traffic on State Highways, City streets and County Roads from 1976 to projected 2000. PCM4-9-92,SG/BW 3 7) 8) Staff stated that the county was willing to help with land uses in the future to avoid blocking future road development. Staff went over the reports that would be taken to City Council in the near future. The signal at Evergreen and the realignment of Country Club Road and Oregon Way. Staff also went over areas that need improvement right away, i.e. Front Street and the. entrance to the school. Staff stated that Lawson off of Hwy 214 would be proposed as a one way street. Front Street next to the interchange has a dangerous access point to Highway 214. Staff stated that maybe this should be closed off or made a one-way so traffic would not be interrupted going East or West. Stacy Allison would proceed South to intersect with the Parr Road interchange to the south. BUSINESS FROM THE COMMISSION: Commissioner Warzynski stated that the landscaping at the Bi-Mart, Shop- n-Kart center is bad, She asked if it was not a condition when this was approved that a small strip of trees was to be planted by Shop-n-Kart. Staff stated that in the spring they were going to build a store beside Shop- n-Kart and it would connect to Shop-n-Kart. This is the reason they have been waiting to put in the trees and additional landscaping. There was some discussion on the size of trees that were to be planted. City of Woodburn On January 28, 1992, the Office of Fair Housing and Equal Opportunity (FHEO), U.S. Department of Housing and Urban Development (HUD), received a complaint of discrimination based on national'origin from the Woodburn Latin American Club (WLAC) against the City of Woodburn, Oregon. The complainant alleges that the City of woodburn refused to negotiate and approve a planned development aimed at providing services for Hispanics. FHEO is responsible for determining compliance with Title VI of the Civil Rights Act of 1964, which provides that, no person in the United States shall, on the ground of race, color or national origin be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under any program or activity receiving Federal financial assistance. As a recipient of Federal financial assistance, the City of Woodburn has agreed to comply with the Act and the HUD implementing regulations Part 1 of Subtitle A of 24 CFR. FHEO is also responsible for determining compliance with Section 109 of the Housing and Community Development Act of 1974. Section 109(a) states, in part, "No person in the United States shall on the ground of race, color, national origin or sex be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity funded in whole or in part with funds made available under this title." 2 We have completed the investigation of the allegations and have determined the City of Woodburn's status in regard to the issues under investigation'in this complaint. The issues and evidence upon which FHEO's findings are based are summarized below: Issue 1: Whether respondent refused to negotiate and approve a planned development aimed at providing services for Hispanics. Review of the documentation and interviews with respondent's staff indicate that the respondent and the respondent's staff were following the guidelines and written procedures concerning the disposition of the Grace Village site in accordance with the State of Oregon Department of Economic Development. The evidence shows that the complainant was given an equal opportunity to bid on the subject property and declined to do so. Therefore, the City of Woodburn is found in compliance with 24 CFR 1.4 (a), (b) (1) (i) and 24 CFR Part 8 § 8.4 (a). The findings with respect to the issues raised in.this complaint apply only to the allegations raised and do not apply to other complaints or matters of compliance which may be pending with FHEO. You may request a review of this determination. If you make such a request, it must be limited to our findings on the allegations contained in the original complaint. To request a review, mail or deliver a written statement of the reasons why the letter of findings should be modified in light of supplementary information, to the Office of Fair Housing and Equal Opportunity, Washington, D.C. 20410, within thirty (30) days of your receipt of this letter. The obligations of FHEO under the Freedom of Information Act may require that we release this letter and related information up request by a member of the public. April 23, 1992 At their public hearing of March 12, 1992 the Woodburn Planning Commission approved to amend specific sections of the Woodburn Zoning Ordinance. The commission recommends the Woodburn City Council approve the following draft amendments. The council may take any of the following recommendations: A. Approve the recommendations as written B. Approve but revise the recommended amendments C. Deny the Woodburn Planning Commission's recommendation City staff will prepare an ordinance regarding council actions for the next regularly scheduled meeting. /Ig ZONAMEND.CC DRAFT STAFF REPORT ZONING ORDINANCE AMENDMENTS 92-01. As staff works with the City's Zoning Ordinance, over the years, it becomes apparent that various sections are in need of clarification. It therefore becomes necessary for staff to submit recommendations periodically to the Commission and Council for amendments to the document, amendments that better clarify the City's intent. Staff often refers to these amendments as "house cleaning procedures". What follows are proposed amendments, additions, or deletions of language from the City's Zoning Ordinance that staff believes would clarify the City's standards. The Commission may approve the proposed amendments as written, modify them or reject them. The following suggestions identify the chapters and sections the Commission and Council may wish to modify. AMEND TO RATIONALE: CHAPTER I DEFINITIONS Section 1.300 Kennel. Any lot or premises on which four or more dogs and/or cats over the age of four months are kept for sale, lease, boarding or racing. Section 1.300 Kennel. A lot or premises on which four or more dogs over the age of four months are kept. a) b) c) Remove cats from this section due to the fact they are not licensed like dogs; therefore, it would be difficult to determine how many exist per household. A maximum of three dogs appears to be the average number allowed by most zoning ordinances; therefore, the City is not establishing a precedence. The purpose is to limit the number of dogs in residential areas. More than three dogs could be allowed but only in commercial areas such as veterinary clinics. DRAFT CHAPTER 5 PERMITS AND ENFORCEMENT ADD Section 5.060 Obstructing Code Enforcement Officer or authorized personnel. No person shall, by use of violence, force, physical interference or obstacle, intentionally, obstruct, impair or hinder the enforcement of the law by an officer acting within the scope of the officer's official authority. Such infraction constitutes a violation and may be dealt with according to the procedures established by Ordinance 1998. RATIONALE: a) Ordinance 1998 addresses civil infractions an fines established by the municipal court. b) This establishes penalties if the officer is physically obstructed from carrying out his duties. CHAPTER 10 OFF-STREET PARKING, LOADING AND DRIVEWAY STANDARDS ADD RATIONALE: Section 10.075 Single Family Dwellinq Driveway Standards. All off street driveway and parking areas for single family dwellings shall be developed and maintained as follows: All new single family dwellings shall construct a driveway of asphalt or concrete with a minimum width of 12 feet for a single car and 18 feet for a double car garage. A minimum length of 20 feet from the front or side property line of a corner lot or the pavement shall be from the street to an existing garage. b) An existing residence that realizes a 20% increase in floor area of the main building that does not have an exiSting asphalt or concrete driveway shall meet the standard in subsection (a). c) An existing residence that secures a permit to build a garage or carport shall meet the standard in subsection (a). a) b) c) To insure off street parking'for vehicles. To improve the aesthetics of the property. To create uniformity with existing standards. DRAFT CHAPTER 11 SITE PLAN REVIEW Add Section 11.085 Time Limitation. At the time of final approval the applicant has six months to initiate construction. If construction has not begun within this time frame, the applicant can request, in writing, a six-month extension. The site plan becomes void one year after final approval; therefore, the applicant would have to re-apply after that time period. RATIONALE: a) b) c) The City has several site plans, some of which are two-five years old. This backlog of unconstructed buildings should be voided since many of them no longer meet present site plan review standards. Public Works infrastructure standards, such as water and sewer service lines, can change over the years as development proceeds around an affected site. Site plan and building permit standards are now similar in their time frame for beginning construction. CHAPTER 22 RS SINGLE FAMILY RESIDENTIAL DISTRICT AMEND AMEND TO SECTION 22.030 (d) (4) 4) That the lot be paved in conformity with Section 10.070 or graveled and maintained in a dust free condition at all times. 4) The lot be paved in conformity with Section 10.075 (5). The parking of vehicles on any portion of landscaped front or side yards is prohibited. MEMO TO: FROM: SUBJECT: DATE: City Council through City Administrator Public Works Program Manager Engineer's Report on Special Assessment for Sidewalks along 99E Widening Project April 20, 1992 RECOMMENDATION: Approve the attached resolution directing an engineer's report be prepared regarding a special assessment for installation of new sidewalks along the Hwy 99E widening project. BACKGROUND: The Woodburn City Council entered into an agreement with the State of Oregon to provide for the widening of Hwy 99E from Lincoln Street to the north city limits. One of the city obligations under this agreement was to pay for the total cost of new sidewalks associated with the project. The cost is restricted to installation of new sidewalks where none existed before. Existing sidewalks which will require removal and replacement will be included as a state project expense. Current estimated cost for this portion of the project is $63,000. This will be firmed up after project bids are opened on May 28, 1992. Inclusion of new sidewalks where none existed are a requirement of the project and are beneficial to the property owners along the highway. The special assessment is an equitable method of financing the construction of these new sidewalks. SIDEWK99.CC COUNCIL BILL NO. RESOLUTION NO. The intent is to provide for temporary classroom space to meet the growth demands of our student population in this area. Each classroom will be wired into the fire alarm system of the main building and will be equipped with ramps for handicap access. (Jerry) Schwab, Research Associate with the Northwest Regional Educational Laboratory (NWREL), has asked the Woodburn Public Library participate in a project funded with a Library Services and Construction Act (LSCA) grant. These are funds from the Federal Department of Education which are distributed through the Oregon State Library to enhance and improve local public library services. The purpose of the project called "Opening the Preschool Door to Learning" is twofold. First is to determine what services for young children, their parents and caregivers are available throughout the state. An analysis of data collected as part of a State Library survey will be conducted by NWREL staff. Summary data specific to children's services will indicate patterns within the state pertaining to children's services staff; volunteer hours; percentage of public service area dedicated to children's services; funding sources and amounts earmarked to preschool programs; types of programs provided; and types of materials for preschoolers/parents/caregivers. Second is to support the improvement of public library services in their role as community information and referral centers for preschool children, parents and caregivers. To accomplish the second task, especially, it will be necessary to determine if the services currently provided meet the needs of the target group. To assess this, the Project Coordinators feel the need to ask the various constituent groups what they think of current services, what they feel young children need most, and what role the public library can play in meeting those needs. These discussions will be most useful if anchored to specific contexts and communities, therefore they are conducting case studies of individual libraries or branches. Woodburn Public Library has been asked to be one of the six sites for these case studies, along with the Woodstock Branch of Multnomah County Library, Medford Headquarters Branch of Jackson County Library, Beaverton, Toledo and Hermiston Public Libraries. We look forward to this assessment of our services in the community and hope the outcome will be useful in improving our program as well as being useful to other libraries throughout the State. The permit will be used when the World Berry Museum Board of Directors approves a rental of the Bungalow Theater, or the rental of any other area within the Museum to an outside group. The Museum saw a need for such a form to be adopted for use as further Museum development has allowed for expanded uses of the Museum. The form was designed to have the operational authority remain with the Woodburn World Berry Museum Board of Directors. There are however, certain legal inclusions which provide for limited liability to both the Woodburn World Berry Museum and the City of Woodburn. The Museum Board of Directors and the volunteers which make up the Woodburn World Berry Museum continue to do an excellent job in operating the Woodbum World Berry Museum.
