The Council met in regular session at 7:00 p.m. with Mayor Kyser presiding. 0012 ROLL CALL. JENNINGS/FIGLEy.... approve the Council special meeting minutes of February 6, 1992 and regular meeting minutes of February 10, 1992; and accept the Planning Commission minutes of February 13, 1992 as written. The motion passed unanimously. 0033 Community Development Director Goeckritz stated that the local newspaper had printed the wrong public hearing date in their article pertaining to the proposed annexation of property in the West Woodburn area. The public hearing will be held on Monday, March 9, 1992,7:00 p.m., during the regular meeting of the City Council. 0058 FRIENDS OF THE PARK AWARD. Larry Watson, Park Board Chairman, presented Pete McCallum with a Friends of the Park Award. Mr. McCallum has worked for the Woodburn School District since 1966 and has assisted the Park Department in various community projects and programs, and in the coordinated use of school district facilities for recreation programs. COUNCIL MEETING MINUTES February 24, 1992 TAPE READING 0148 A public meeting on the State Department of Transportation's Six-Year Transportation Plan will be held on Thursday, March 5th, 7:00 p.m., at the Salem Public Ubrary. Councilors and interested members within the community are encouraged to attend the meeting. 0181 ELECTION FILING PERIODS FOR CITY OFFICES. The election filing period for position of Mayor and Councilors of Ward I, II, and VI, will begin February 27, 1992 and end at 5:00 p.m. on August 24, 1992. Nomination petitions can be obtained from the City Recorder's office during regular business hours. 0187 CHAMBER OF COMMERCE REPORT. Dr. Scott Nehring, representing the Chamber of Commerce, stated that approximately 50 students participated in the Shadow program this year. He also reminded the Council of the upcoming Casino night, March 13, 1992, which is sponsored by the Chamber. Additionally, he stated that a representative of the Chamber Board will attend the March 5th Six-Year Transportation Plan meeting in Salem. 0235 COUNCIL BILL 1372 - ORDINANCE PROVIDING PROCEDURES FOR IMPOUNDING AND DISPOSING VEHICLES ABANDONED ON CITY STREETS. Council Bill 1372 was introduced by Hagenauer. The two readings of the bill were read by title only since there were no objections from the Council. On roll call vote for final passage, Council Bill 1372 passed unanimously. Mayor Kyser declared the bill duly passed with the emergency clause. 0267 COUNCIL BILL 1373 - RESOLUTION AMENDING RESOLUTION 1097 REGARDING WATER AND SEWER RATES FOR 1992. Council Bill 1373 was introduced by Councilor Hagenauer. Recorder Tennant read the bill by title only since there were no objections from the Council. On roll call vote for final passage, the bill passed unanimously. Mayor Kyser declared Council Bill 1373 duly passed. 0293 COUNCIL BILL 1374 - RESOLUTION AUTHORIZING INSTALLATION OF STOP SIGN ON WOODLAND AVENUE AT HIGHWAY 214. Councilor Hagenauer introduced Council Bill 1374. The bill was read by title only since there were no objections from the Council. Council Bill 1375 was introduced by Hagenauer. The bill was read by title only since there were no objections from the Council. On roll call vote for final passage, the bill passed unanimously. Mayor Kyser declared Council Bill 1375 duly passed. 0348 COUNCIL BILL 1376 - RESOLUTION AUTHORIZING INSTALLATION OF STOP SIGN ON CAROL STREET AT HARDCASTLE AVENUE. Council Bill 1376 was introduced by Councilor Hagenauer. The bill was read by title only since there were no objections from the Council. On roll call vote for final passage, the bill passed unanimously. The Mayor declared Council Bill 1376 duly passed. 0371 COUNCIL BILL 1377 - RESOLUTION ENTERING INTO A CONTRACT WITH CH2M HILL FOR LOAD LIMITS CALCULATIONS. Councilor Hagenauer introduced Council Bill 1377 which was read by title only since there were no objections from the Council. On roll call vote for final passage, the bill passed unanimously. Mayor Kyser declared Council Bill 1377 duly passed. 0400 REQUEST FOR I.NO PARKING.. SIGN INSTALLATION ALONG HIGHWAY 214 NEAR THE FIRE STATION. As stated within the staff report, the Fire District had requested the "No Parking" signs to allow adequate visual clearance for fire department apparatus and prevent dangerous situations with unattended vehicles parked in front of the station. The staff recommended approval of the request and advised the Council that the State Highway Department would do an independent study of the situation before signs could actually be installed. JENNINGS/FIGLEy.... recommendation to install"No Parking" signs along Hwy. 214 in front of the main Fire Station be approved. The motion passed unanimously. 0410 1992 LIQUOR LICENSE RENEWALS. Chief Wright provided a staff report which recommended the following liquor license renewals for 1992: AM PM Mini Mart, Bi Mart, Crossroads Grocery, Food Warehouse, Gary's Market, La Petite Deli, Lind's Plaza Market, Lind's Woodburn Market, OlCC Store #60, Payless Drug Store, Piper's Jewelry, Roth's IGA, Safeway, 7-11 Store, Westview Texaco, Woodburn Chevron, Young Street Market, Eagles, Woodburn Elks #2637, Abby's Pizza Inn, La Petite Deli, Izzy's Pizza, Pizza Hut, Senior Estates Country Club, Woodburn Lanes, la Linda's Tortilleria, Pub 99, Page 3 - Council Meeting Minutes, February 24, 1992 COUNCIL MEETING MINUTES February 24, 1992 TAPE READING Brack's Restaurant, Club Alley II and Cafe, Don Juan's Mexican Cuisine, and The Pier. He stated that Home Plate Market had recently been sold to Salvador Larios who is currently operating the bakery and specialty package store under a temporary OlCC permit. The Council will receive a recommendation on the new liquor license request at a later date. Chief Wright also briefly reviewed which establishments were on a compliance plan during 1991. He recommended that Crossroads and la Linda's not be required to operate under a compliance plan for 1992, however, Pub 99 should continue the existing compliance plan. He also recommended that a public hearing be scheduled for the next regular meeting to review the 1992 renewal of the Raven Inn. 0631 JENNINGS/FIGLEy.... approve the 1992 liquor licenses as shown in the February 8th staff memo, maintain the current compliance plan with Pub 99, and schedule a public hearing for the liquor license renewal for The Raven Inn. The motion passed unanimously. 0636 OREGON DEPT. OF TRANSPORTATION (ODOT) SIX-YEAR TRANSPORTATION IMPROVEMENT PROGRAM. Public Works Manager Rohman reviewed a staff memo pertaining to transportation programs which should be addressed at the State's public meeting on March 5th. The following construction projects should receive some specific comments from city officials towards inclusion on the six-year transportation plan: 1) Upgrade signal at Oregon Way/Country Club/Highway 214 along with the realignment of the intersection; 2) Proposed project to overlay Highway 211 east of Highway 99E should include drainage and curb improvements along portion of highway located within the City; 3) Projects relating to Development and Reconnaissance Sections for study of traffic flow along Highway 214; 4) Installation of traffic signal at Bi Mart/K Mart entrances should be encouraged since the developers have agreed to pay for the installation when the signal is warranted; and 5) the Transit and Dial-a-Ride services continue to receive support from the Transportation Department for operating and capital assistance. He encouraged Council representation at the public meeting to support necessary funding of projects which would affect the City. 0861 CONSTRUCTION COST REIMBURSEMENT - CODE ENFORCEMENT OFFICE. Administrator Childs stated that he could not locate any formal agreement regarding payment of costs incurred by Marion County in constructing the Code Enforcement office at the same time that they were building their own offices in the City Hall basement last summer. Therefore, he recommended that the City pay Page 4 - Council Meeting Minutes, February 24, 1992 - COUNCIL MEETING MINUTES February 24, 1992 TAPE READING $4,996.40 from the City Hall Construction Fund to reimburse the County for their construction costs of the Code Enforcement office based on verbal statements made by several city officials and county staff members. JENNINGS/FIGLEY... approve the recommendation to authorize the expenditure of $4,996.40 to reimburse Marion County. The motion passed unanimously. 0938 BID AWARD - PERISTALTIC PUMP REFRIGERATED SAMPLERS FOR WASTEWATER PLANT. Bids were received from the following vendors: Whitney Equipment Co., Inc., $11,010.57; Environmental & Process Instrumentation, $12,000; and American Sigma Corporation, $13,839. JENNINGS/FIGLEY... award the bid to Whitney Equipment Co., Inc., in the amount of $11,010.57. The motion passed unanimously. 0952 BID AWARD - SERVICE VAN WITH ALUMINUM CARGO BODY FOR WATER DIVISION. Bids were received from the following vendors: Trachsel Buick GMC, Steel Body qualification, $17,102.19; Capitol Chevrolet, Steel Body qualification, $17,379.46; and Trachsel Buick GMC, Aluminum body, $17,514.44. The staff recommended the acceptance of the bid from Trachsel Buick in the amount of $17,514.44 which was the only bid to match the bid specifications. JENNINGS/FIGLEy.... accept staff recommendation to award the bid to Trachsel Buick in the amount of $17, 514.44. The motion passed unanimously. 0973 CLAIMS FOR THE MONTH OF JANUARY 1992. SIFUENTEZ/GALVIN.... approve voucher checks #13257 through 13619 for the month of January 1992. The motion passed unanimously. 1002 EXECUTIVE SESSION. JENNINGS/FIGLEY.... adjourn to executive session under the authority of GRS 192.660 (1 )(h) to consult with legal counsel with regard to current litigation or litigation likely to be filed (Latin American Club v. City of Woodburn, HUD Complaint) and to conduct deliberations with persons designated by governing body to carry on real property negotiations under the authority of CRS 192.660 (1)(e). The motion passed unanimously. The Council adjourned to executive session at 7:30 p.m. and reconvened the meeting at 7:58 p.m.. The motion passed unanimously. 1040 Councilor Hagenauer expressed his appreciation to the local insurance agents for their monetary donation to purchase a video recorder and related equipment to be used by the Police Department within their DUll program. 1070 ADJOURNMENT.
