Minutes - 01/11/1993 -'> .-" COUNCIL MEETING MINUTES January 11, 1993 DATE. COUNCIL CHAMBERS, CITY HALL, CITY OF WOODBURN, COUNTY OF MARION, STATE OF OREGON, JANUARY 11, 1993. (Due to a malfunction of the tape recorder an audio tape recording was not made of this meeting. These minutes were produced from the recollections of the city staff present at the meeting.) CONVENED. The Council met in regular session at 7:00 p.m. with Mayor Kelley presiding. JENNINGS moved to delete Council Bill 1447 (agreement with Kittelson & Associates) from the agenda on the basis that written commitment from other parties has not yet been received. The motion was seconded and passed unanimously. ROLL CALL. MINUTES. It was moved and seconded that the Council approve Council minutes of December 28, 1992 and accept Library Board minutes of December 16, 1992. The motion passed unanimously. CABLE TV COMMUNITY ACCESS ADVISORY COMMITTEE APPOINTMENTS. It was moved and seconded that David Higginbotham and Paul Castro be appointed to indefinite terms on the cable TV Community Access Advisory Committee. The motion passed unanimously. Discussion was had concerning Mayor Kelley's proposed appointments to the Budget Committee. Councilors indicated that they had no knowledge as to the qualifications of Virginia Williams. Councilor Hagenauer stated that Henry Jaeger had done a good job on the committee and was interested in being reappointed. Mayor Kelley reminded the Council that such appointments are the Mayor's prerogative under Ordinance 1971. Councilor Jennings stated that in the past information regarding potential appointees had been provided prior to the agenda packet. After further discussion, FIGLEY moved that the Council approve the appointment of Terry Will to a term on the Budget Committee, expiring 12/95. The motion was seconded and passed unanimously. FIGLEY moved to approve appointment of Virginia Williams to a term on the Budget Committee, expiring 12/95. The motion died for lack of second. Councilors urged Mayor Kelley to present more information regarding Ms. Williams at the next meeting and also to reconsider the possible reappointment of Henry Jaeger. Mayor Kelley stated that he would appreciate further information about Mr. Jaeger. PRESENTATION OF DONATIONS TOWARD CENTENNIAL PARK. Several donations were presented to the city for the benefit of Centennial Park and accepted on behalf of the city by Recreation & Parks Director Holly. These included Dr. Scott Nehring (adult mens' basketball league) - $875; Rob Mullins (adult softball association) - $1,000; J. D. Mitchoff and Dan Glennon ("ditch open" golf tournament) - $100. PRESENTATION OF SERVICE AWARD TO RSVP VOLUNTEER RICHARD MORRIS Police Chief Wright presented an appreciation plaque to RSVP volunteer Richard Morris for the many volunteer hours he had devoted to assisting the police department in transporting evidence, shuttling vehicles, etc. In accepting, Mr. Morris thanked the Chief and said that back problems prevented him from continuing this service. Chief Wright stated that it "may take three people to replace him (Morris)." CHAMBER OF COMMERCE REPORT. Dan Glennon, representing the Chamber, reminded the Council that the Chamber will hold its annual awards banquet on Feb. 10, 1993 at 7 p.m. Citizen of the Year awards in several categories will be presented at that time. COUNCIL MEETING MINUTES January 11, 1993 COUNCIL BILL 1446 - RESOLUTION ENTERING INTO AGREEMENT WITH THE STATE FOR PRELIMINARY ENGINEERING FOR COUNTRY CLUB ROAD/OREGON WAY REALIGNMENT. Council Bill 1446 was introduced by Councilor Hagenauer. The bill was read by title only since there were no objections from the Council. On roll call vote for final passage, Council Bill 1446 was passed unanimously. Mayor Kelley declared the bill duly passed. BID AWARD FOR DUMP TRUCK (WATER DIVISION) Staff report presented by Public Works Program Manager Rohman. He noted that the apparent low bidder, Northside Ford Truck Sales does not meet specifications in two respects; disc brakes on all four wheels and a second hydraulic control valve spool. The bidder has acknowledged these exceptions. Rohman recommended acceptance of second low bid (Diesel Service Unit) which does meet all specifications.' It was moved that the Council disqualify Northside Ford Truck Sales bid for not meeting all specifications and accept bid of Diesel Service Unit in the amount of $27,794. The motion was seconded and passed unanimously. CLAIMS FOR THE MONTH OF DECEMBER. 1992. It was moved and seconded that the Council approve payment of voucher checks #16856 - 17479 for the month of December, 1992. The motion passed unanimously. STAFF REPORTS. The following staff reports were provided to the Council for their information: 1) Miller Farm Subdivision lighting issues. 2) Building activity report for December, 1992. 3) Code Enforcement report for December, 1992. 4) City Administrator Memo on Goals and Accomplishments Commenting on the staff report concerning Miller Farm Subdivision lighting issues, Councilor Jennings expressed concerns as to the adequacy of the type of lighting contemplated by the developer as well as what kinds of precedent this matter presents to the city regarding future developments. Councilor Figley commended Administrator Childs on the "Goals and Accomplishments" report which he presented. Councilor Sifuentez suggested that the Council itself should meet to establish some goals, perhaps after the budget process is completed. Mayor Kelley Page 3 - Council Meeting Minutes, January 11, 1993 r -'. -., COUNCIL MEETING MINUTES January 11, 1993 stated that he would like to see some dialogue between Mayor and Councilors, regarding their respective goals and ideas, in the very near future. Following brief discussion, Mayor Kelley announced that he would scheduled a Council workshop session, for the purpose of exchanging ideas, for Monday, January 18, 1993, 7 p.m., Council Chambers. Councilor Jennings asked the Public Works Director to investigate the policy of shutting off meters on buildings being constructed as the labor to lock off and unlock these meters could be costly. The Public Works Director said he would investigate the procedure. ADJOURNMENT. The city Charter, City Ordinance 1971 and precedent, that had been set by the City Council, clearly states that it is the responsibility of the individual councilors to contact the Mayor prior to any meeting, at which the appointments are to be made public, with any comm~nts, objections, etc. that said councilor may wish to convey. In order to avoid possible embarrassment to the appointee. Proposed appointments will not be made public prior to approval at a properly convened council meeting. Mayor Kelley made it clear that no communications were made to him by any councilors in regard to any appointments he made. Mayor Kelley also reminded the Council of their refusal to his request of postponing appointments made at the November 23, 1992 meeting for the sole purpose of giving the Mayor Elect Kelley time to become acquainted with the appointees. Then Mayor Kelley commented that this certainly appears to be a double standard of which he will not condone or be a part of.
