On roll call vote, the motion passed unanimously. 0066 MEETING ANNOUNCEMENTS. The Wastewater Advisory Committee will meet on December 20, 1993, 7:00 p.m., in the City Hall Council Chambers. A special Council workshop has also been called for January 19, 1993, 7:00 p.m., City Hall Council Chambers, for the purpose of meeting with the Wastewater Advisory Committee to discuss options and goals. The December 15, 1993 Transportation Task Force meeting has been canceled due to the delay in receiving information from the State Transportation Department. 0125 CHAMBER OF COMMERCE REPORT. Patrick Vance, representing the Chamber Board, advised the Council that the 1994 Chamber President will be Greg Lundeen. He also informed the Council that the number of monthly visitors to the Chamber office has increased by as much as 100 per month since their move to the Fairway Plaza location. 0175 WOODBURN CO~BACK C]%MPAIGN. Councilor Figley encouraged citizen participation in the Love Santa project whether it be to donate food, clothing, or toys to needy families within our community. 0199 LETTER FROM TERRY WILL RE: TAX COORDINATION MEETING. Administrator Childs read the letter from Mr. Will advising the Council that he had also attended the Tax Coordination meeting called by Marion County, which, in his opinion, was a complete failure. He also endorsed the Administrator's change in the maximum levy amount to $5 million which would include the full amount of a swimming pool bond issue. 0250 LETTERS AND PETITIONS REGARDING pLaWNING COMMISSION APPOINTMENTS. The current Planning Commission members (Paul Johnson, Richard Pugh, JoAnn Bjelland, Maxie Nenkes, and Wesley Bauer) requested the Mayor to reappoint Lillian Warzynski to the Commission citing her experience with local and state land use laws as an asset to the Commission when almost half of the members are newly appointed. Petitions signed by approximately 125 individuals were also submitted to the Mayor and Council in support of re-appointing Mrs. Warzynski to the Commission. 0375 APPOINTMENTS TO PLANNING COMMISSION., Mayor Kelley appointed the following individuals to the Commission: Robert Finch, James Atkinson, Gary Kosikowski, and William Pyle. After a brief discussion, it was decided that public testimony would be taken on this issue before the Council takes a vote on the list of appointments. Nancy Kirksey, 1049 McKinley, expressed her opinion that dedicated volunteers should be reconsidered for reappointment especially when they have always had the best interests of the City at heart. She stated that she had submitted three of the petitions, however, she would have been able to obtain more signatures in support of Mrs. Warzynski's reappointment if she had more time available to gather signatures. Paul Johnson, Planning Commission member, spoke in support of the reappointment of Mrs. Warzynski citing her willingness to do a significant amount of work on Planning Commission issues outside of the established mee{ing dates. He also stated that the Commission needs to have consistency and not a start/stop Page 2 - Council Meeting Minutes, December 13, 1993 3A TAPE ~EADING 0671 1135 COUNCIL MEETING MINUTES December 13, 1993 situation where you are always changing too many members at one time. Continuity is an integral part of maintaining standards that will provide an orderly growth within Woodburn. JoAnne Bjelland, 888 Wilson, stated that Mrs. Warzynski has the interest of the City at heart and she is a dedicated volunteer. Wes Bauer, 1190 Randolph Rd., also encourage the Mayor and Council to consider the letter from the Commissioners and the petitions submitted before confirming the proposed appointments. He stated that she has dedicated her time and efforts on behalf of the Commission and the total City, is a very ethical person, and has been very impartial on issues before the Commission. He encouraged the Mayor to reconsider his appointments and to include her as a reappointment to the Commission. Councilor Mitchell suggested that the Mayor and Council should listen to the concerns of the Commissioners and the petitioners. Councilor Figley stated that she has known Mrs. Warzynski for many years and feels that her reappointment would be a benefit to the City. She also felt that a 50% turnover within the Commission during this growing period is not realistic and stated that she would not vote to confirm the appointments to the Planning Commission unless the current appointment list is modified to include Mrs. Warzynski. Councilor Jennings also requested the Mayor to reconsider his appointments and he suggested that whichever new individual is not appointed at this time be appointed to the Commission when the next vacancy occurs. Mayor Kelley stated that, in his opinion, Councilor Figley's statement that she would not vote affirmative on the appointments unless Mrs. Warzynski's name was on the list is a breach of the oath of office. He reiterated that he has asked for names of individuals interested in serving on various committees and boards, however, the Councilors have only provided him with one name for consideration. He felt that they should have provided him with names on a regular basis in advance so that this type of situation would not have occurred. Following further discussion on the issue, MITCHELL/FIGLEY... bring to a vote the four Planning Commission positions on page 4(A) of the agenda packet dated December 8, 1993. Attorney Shields stated that a aye vote would approve the appointments and a nay vote would disapprove the appointments. Councilor Jennings expressed his concern in the fact that the Council is forced to either approve or disapprove the whole slate of Commission appointees when only one position is being requested for reconsideration. APPOINTMENTS TO TRANSPORTATION PLANNING TASK FORCE. Mayor Kelley appointed the following individuals to the Transportation Planning Task Force: Betty Pierce and Chamber representative Dean O,Donnell with Jane Kanz as his alternate. JENNINGS/FIGLEY .... approve the appointments to the Transportation Task Force. The motion passed unanimously. PUBLIC HE~RING - p~I~%TR~/~SIT PLAN. Mayor Kelley declared the public hearing open at 7:47 p.m.. Public Works Manager Rohman stated that annual hearings are required on the Plan for compliance with the Americans with Disabilities Act (ADA) as it relates to service for disabled passengers. The current transit program consists of three components: 1) Fixed Route System, 2) Dial-a-Ride Van, and 3) Dial-a-Ride Volunteers. The Transportation rules utilize six service criteria to determine the comparability of the paratransit service to the regular service, those being 1) service area, 2) response time, 3) fares, 4) trip purposes, 5) hours and days of service, and 6) capacity constraints. He stated that the current plan is not in compliance with regulations pertaining to response time and hours and days of service. An option available to the City would be to submit an undue financial burden waiver to the Federal Transit Administration, however, with increased funding being distributed through operational assistance grants, the city. may be able to obtain some additional funds to comply with the service criteria. The City will be required to comply with all service criteria by January 1997 and some consideration should be given to provide an additional day of paratransit service in fiscal year 1994-95. No one in the audience submitted any comments to the Council regarding the Paratransit Plan. Mayor Kelley declared the public hearing closed at 7:59 p.m.. CONTINUATION OF PUBLIC wR~RING - D]tNGEROUS BUILDING ~T 347 N. FRONT ST. (SALUD BUILDING}. Mayor Kelley continued the public hearing at 8:00 p.m.. community Development Director Goeckritz reviewed the staff's memo and the letter from Triplett/Wellman Contractors recommending an updated engineer's report on the condition of the building. The staff suggested that some plan of action be established to measure what progress is being made on the building. A1 Nunez, Executive Director of Salud, stated that Structural Engineer Jerry Estoup has been retained to provide an updated report to Salud and the Council. He stated that Salud's primary concern is to maintain the integrity of the building. Page 4 - Council Meeting Minutes, December 13, 1993 3A COUNCIL MEETING MINUTES December 13, 1993 TAPE READING The engineer's report will outline the need to either renovate or demolish the building to protect the public who do not enter the building. The report will also determine which direction Salud needs to proceed. He stated that he will be working with city staff to comply with the Council's directions. Councilor Mitchell questioned if a report from Farmer's Home Administration would be available for the first meeting in January. It was noted that the engineer's report will be available by the first meeting in January but it may take several weeks to have a report from Farmer's Home Administration. Councilor Jennings also expressed concern on the Council's inability to discuss the issue while the hearing is still open. Attorney Shields encouraged the Council to continue the hearing so that the structural engineer's report to be received by the city prior to the next Council meeting can be made a part of the record. Comments from the Council can still be made during the this type of a hearings process. Councilor Hagenauer expressed his opinion that a time frame should have be set as to when things would be completed rather than letting the federal government telling the city what they can or cannot do. Additionally, private property owners were forced to make changes within a shorter time period. Councilor Jennings concurred with Councilor Hagenauer's statement and added that it does take more time to make changes when the federal government is involved. He felt that all property owners, whether public or private, need to be treated equally. Mayor Kelley closed the public hearing at 8:12 p.m.. JENNINGS/HAGENAUER .... direct the staff to draft a Resolution to declare the building dangerous. After a brief discussion on the motion, the vote was 4-2 with Councilors Figley and Sifuentez voting nay. 1503 COUNCIL BILL 1503 - ORDIN]%NCE CREATING ~ HUMAN RIGHTS COMMISSION ~ REPEALING ORDINANCE 1865 (CITIZENS RU¥IEW COMMISSION). Council Bill 1503 was introduced by Councilor Hagenauer. Preston Tack, 2197 Camilla Way, expressed his opinion that the Council should receive more input from organized groups as to the merits of a citizens Review Commission versus a Human Rights Commission. Recorder Tennant read the two readings of the bill by title only since there were no objections from the Council. Councilor Mitchell questioned Attorney Shields regarding the inclusion of language' that would require staff to notify the Council 60-90 days prior to the expiration date of positions, and, in Section 2, the addition of sexual preference. Page 5 - Council Meeting Minutes, December 13, 1993 3A TAPE READING 2866 COUNCIL MEETING MINUTES December 13, 1993 Attorney Shields stated that he had drafted the ordinance based on the contents of the motion made by Councilor Figley, however, language could be added to the proposed ordinance that would address the Council's concerns. Discussion was also held on the sunset clause in Section 7 and the need for the Council to take some action at that time to continue the Commission. Councilor Jennings suggested that the expiration date of the ordinance be consistent with the three-year term appointment outlined in Section 1. JENNINGS/MITCHELL .... amend Section 7 to change to expiration date to December 31, 1996 and language be included which requires the matter to be brought before the Council 90 days prior to the expiration date of the ordinance. On roll call vote, the motion to amend passed unanimously. The Council unanimously passed Council Bill 1503 as amended by roll call vote. Mayor Kelley declared the bill duly passed with an emergency clause. COUNCIL BILL 1504 - ORDINANCE IMPOSING A 1.5~ PRIVILEGE TAX ON PORTLAND GENERAL ELECTRIC COMPANY WITH FUNDS RECEiveD TO BE DEDICATED TO TRANSPORTATION CAPITAL IMPROVEMENT PROJECTS. Randy Oliver, representing PGE, urged the Council not to adopt the proposed ordinance citing the financial impact on local residents and businesses. In his opinion, this type of tax was an inappropriate way of collecting additional funds to offset the impact of Measure 5. Brian Conroy, representing Conroy Packing, also spoke in opposition to the proposed fee since the fee is inequitable'to those businesses that are highly dependent upon electrical service. He felt that they will be penalized because of the nature of their business. Tape 2 Councilor Hagenauer introduced Council Bill 1504. The two readings of the bill were by title only since there were no objections from the Council. Councilor Jennings stated that the Transportation Task Force has held numerous hearings which included reviewing potential funding sources for transportation capital improvements. Other jurisdictions in Oregon have imposed this type of privilege tax in order to raise necessary revenues. The monies collected by this tax will be dedicated to transportation capital improvements rather than annual operating costs. Administrator Childs stated that he had also received a letter from the General Manager of Americold in opposition to the proposed tax. It was also noted that State Law allows a maximum of 5% of gross revenues to be collected which is a combination of 3.5% in franchise fees allowed by the Public Utility Commission and 1.5% in privilege tax. Council Bill 1505 was introduced by Hagenauer. Recorder Tennant read the bill by title only since there were no objections from the Council. On roll call vote for final passage, the bill passed unanimously. Mayor Kelley declared Council Bill 1505 duly passed. 0317 COUNCIL BILL 1506 - RESOLUTION DECLARING THE BUILDING LOCATED AT 199 N. FRONT STREET AS A DANGEROUS BUILDING AND PUBLIC NUISANCE.,. Councilor Hagenauer introduced Council Bill 1506. The bill was read by title only since there were no objections from the Council. Nora Fives, representing the property owner, stated that she and her brother have been working with an engineer, Mr. Pease, who is in the process of preparing a structural engineering report. Their intent is to proceed immediately with making the necessary improvements to the building. She expressed concern on potential problems they may encounter with contractors if the Council condemns the building. Director Goeckritz stated that the property owner can still repair the building even if the Resolution is passed or they can abate the building'if the costs to repair are too high. Councilo~ Figley stated that she would rather see the building repaired and did not object to tabling the bill if work was progressing in that direction. FIGLE¥/MITCHELL .... table Council Bill 1506. The motion passed 4-2 with Councilors Jennings and Hagenauer voting nay. 0504 COUNCIL BILL 1507 - RESOLUTION AUTHORIZING THE SALE OF CITY 0557 PARK PROPERTY TO THE WOODBURN SCHOOL DISTRICT. Council Bill 1507 was introduced by Councilor Hagenauer. Recorder Tennant read the bill by title only since there were no objections from the Council. On roll call vote for final passage, Council Bill 1507 passed unanimously. Mayor Kelley declared the bill duly passed. COUNCIL BILL 1508 - RESOLUTION ENTERING INTO AN AGREEMENT WITH MARION COUNTY FOR COMPLETION OF THE PUDDING RI~R BASIN AREA SERVICE PROVIDER STUDY PROJECT. Councilor Hagenauer introduced Council Bill 1508. The bill was read by title only since there were no objections from the Council. On roll call vote for final passage, the bill passed unanimously. Page 7 - Council Meeting Minutes, December 13, 1993 3A COUNCIL MEETING MINUTES December 13, 1993 TAPE READING 0583 COUNCIL BILL 1509 - ORDINANCE AUTHORIZING ACCEPTANCE OF .0825 ADDITIONAL FEDERAL EMERGENCY MANAGEMENT ADMINISTRATION GRANT FUNDS AND TRANSFERRING OPERATING CONTINGENCy FUNDS WITHIN THE PARK FUND AND GENERAL FUND. Council Bill 1509 was introduced by Councilor Hagenauer. Recorder Tennant read the two readings of the bill by title only since there were no objections from the Council. Administrator Childs briefly discussed the staff recommendation to transfer sufficient appropriations into the Park Facility Capital Outlay category for the purpose of constructing a Park maintenance office and utility building. The building formerly used for this purpose was damaged during the March 25, 1993 earthquake leaving it in an uninhabitable condition. It was noted that the proposed ordinance would only transfer appropriations and not a corresponding amount of resources from the General Fund. On roll call vote for final passage, the bill passed unanimously. Mayor Kelley declared Council Bill 1509 duly passed with the emergency clause. BID AWARD - PARK MAINTENANCE OFFICE AND UTILITY BUILDING. Bids for the construction of a building were received from the following contractors: Aljets Construction, $104,497; Paragon Construction, $112,998.00; Redding Construction, $124,000; Columbia Construction, $102,000.00; and Security Construction, $93,495.00. JENNINGS/FIGLEY .... award the bid to Security Construction in the amount of $93,495 less $8,000 in negotiated project reductions with the contractor for the replacement of the Park maintenance building. The motion passed unanimously. 0860 CLAIMS FOR THE MONTH OF NOVEMBER 1993. SIFUENTEZ/GALVIN... approve claim numbers 20801 - 21079 for the month of November 1993. On roll call vote, the motion passed unanimously. 0893 Nancy Kirksey, 1049 McKinley, expressed her desire for the Mayor and Council to work together to appoint the most qualified individuals to the various Commissions, Committees, and Boards. 0983 Mayor Kelley stated that there have been some allegations and/or problems within the Retired Senior Volunteer program and he suggested that an impartial committee be appointed to look into these allegations and their findings be brought back to the Council. Councilors Galvin and Figley stated that they have confidence in Administrator Childs to resolve the issue. Councilor Jennings expressed his opinion that a meeting between the Mayor, Advisory Board Chairperson, and Page 8 - Council Meeting Minutes, December 13, 1993 3A TAPE READING 1346 1417 1555 1614 ATTEST COUNCIL MEETING MINUTES December 13, 1993 Administrator be held before any determination is made to appoint an ad hoc committee. Administrator Childs stated that he has been looking into issue but he requested that the meeting with the Mayor and Advisory Council chairperson be held closer to the next COuncil meeting date so that he can thoroughly investigate the situation. Following further discussion on the issue, Administrator Childs set the meeting date for January 3, 1994 at 3:00 p.m. to discuss his findings. STAFF REPORTS. Included in the packet were staff reports on the following subjects: 1) office closures during the Christmas/New Years holiday, 2) Report on County Tax Coordination meeting, 3) Building Activity report for November 1993, 4) Population estimate as of July 1, 1993; and 5) Grant application for hiring additional police officers. Councilor Jennin~s referred to the December 1, 1993 issue of the Independent in which an individual who lives on Oregon Way wrote a Letter to the Editor criticizing him for carrying on a former Mayor's agenda and not listening to his constituents. He stated that he does listen to the citizens he represents in Ward II and does not carry on anyone's agenda. Councilor Jennings also congratulated the Police Department for the professionalism displayed by 2 officers when they responded to a burglar call within 30 seconds and to the dispatcher who kept the victim on the line while the officers were enroute to the residence. EXECUTIVE SESSION. JENNINGS/FIGLEY .... adjourn to executive session under the authority of ORS 192.660(1) (i) to discuss the annual evaluation of the city Administrator as it relates to performance and compensation. The motion passed unanimously. Administrator Childs stated that he waives the right to a public meeting on this issue. The meeting adjourned to executive session at 9:26 p.m. and reconvened at 10:15 p.m.. Mayor Kelley stated that no decision was made in executive session, therefore, no action is necessary on the part of the Council. ADJOURNMENT. The meeting adjourned at 10:16 p.m.. COMMUNICATIONS: None PUBLIC HEARINGS: A. Variance #93-04 and Minor Partition #93-07 Staff read the statement necessary to begin the public hearing. Staff stated that the applicant had requested administrative approval to create 3 parcels and request a variance to the current private road standards. The applicant is Mike Hoge. Staff read the criteria applicable for approval of this proposal. Staff stated that the applicant was requesting approval of a variance to the current road standards, from 150' to 219'. The access to this flag lot which is 25' wide does not meet the standard which is 30' wide for a private street. The applicant is not able to purchase any other surrounding property to meet this standard. The site is zoned single family. The applicant is only requesting a partition at this time. Staff recommended approval with conditions listed in the staff report. Chairperson Johnson asked if the private street was being designated as a fire lane with no parking on either side with a sign erected on each side of the lane that is 30 feet wide. 3B Staff answered yes. Commissioner Warzynski asked if the existing 112 foot long land was previously approved by the Planning Commission at one time. Staff stated that it was approved prior to this Commission and staff's time. Chairperson Johnson asked about the fire hydrant placement. Staff stated that if there is no hydrant available, then each residence would have to be sprinkled. The developer would look to see which was more cost effective, bringing in a hydrant on a large line, or individual sprinkler systems. Commissioner Bauer stated that he felt the fire hydrant should be brought in closer to the homes. Staff stated that it could be made a condition of approval that the fire hydrant be brought in. The location would be determined by the fire department. They feel comfortable with either/or alternative. The Fire Department will work with the Water Department to locate the hydrant. Commissioner Henkes asked if there were any other flag lots back in this area that a fire hydrant would be close too. Staff stated not at this time. The applicant did not wish to add anything to the staff comments. Chairperson Johnson asked if there was anyone in the audience who wished' to speak for this proposal. There were none. He then asked if there was anyone who wished to speak against this proposal. There were none. He closed the public hearing. Commissioner Bauer made the motion to approve Variance #93-04 with the condition listed in the staff report and adding the condition of moving the fire hydrant closer to the proposed lots. Commissioner Warzynski seconded the motion. A vote was taken and the proposal passed unanimously. B. Zone Change #93-04 Plaza Motel PCM Dec. 10, 1993 SG:bw 3B Staff stated the applicant was requesting a zone map amendment to rezone property located behind the Plaza Motel. It is zoned Multi-family. They wish it rezoned to Commercial General in order to bring the property into compliance with the Comprehensive Plan. Staff read the applicable approval criteria. Staff stated that the applicant intends to build 11 more units after the zone amendment takes place. Gene Pfeifer, 1392 S. Water St., Silverton, stated that the applicants intentions were to build 11 units onto the Plaza Motel. At the present time a few changes have been made due to the cost of the SDC (System Development Charges). He stated that applicants wished to remodel the existing building and build an "L" shaped addition with access from Williams Street. Eldon Toll, 821 Stark, Woodburn, stated that he was a trustee for the property located to the northwest, Woodburn Church of Christ. The church has no objections to the zone change, but they are concerned about the trespassing problem they have. They hope that the entire property could be blocked off to head off the foot traffic. Staff stated that any commercial use property that abuts a residential property does require fencing. He stated that it would be a condition of approval for any proposal on this property. Chairperson Johnson asked if there was anyone who wished to speak for this proposal. There were none. He then asked if there was anyone who wished to speak against this proposal. There were none. Verna Bacon, Williams Street, stated that she was concerned about the heavy traffic on the corner of Williams and Hwy 99E at the present time and Williams Street was only a block long. She hoped something could be done to eliminate some of the traffic that might help eliminate some of the other things going on at the property. Mr. Pfeifer stated that his firm was a design and build company. He stated that the proposal was strictly for the applicant who wished to improve their property. Chairperson Johnson closed the public hearing. Commissioner Bjelland asked if the concerns about the parking and traffic would be addressed at the site plan review. Staff answered yes. Lot Line Adjustment #93-08 Brocks Restaurant Staff stated that the applicant was requesting administrative approval of a lot line adjustment. The applicant wished to divide out the undeveloped piece of property which is to the north of the restaurant. Staff told the Commission they did not need to do anything other than to acknowledge the administrative approval. B. Partition #93-0 Staff stated that the applicant was requesting administrative approval of a three lot partition. It is located east of Hvvy 99E on the south side of Hardcastle. There was some discussion on the depth and size of the lots. Commissioner Bauer asked if there was an east/west connecting road. Staff stated that there was on the plat but it had not been built yet. Staff stated that their findings found no reason to not give administrative approval with conditions listed in the report. Planning Commission requested that to be consistent, the fire hydrant be brought in closer to the houses. C. By filling that demand the Plaza Motel will benefit the community by encouraging tourism in the area. Our proposal includes improvements to the existing building in conjunction with the construction of additional units. The installation of a new roof and the application of a fresh coat of paint to the existing structure, will enhance the esthetics of the building creating a better impression for motorists travelling along the gateway to the City. ROBERT SHIELDS, CITY ATTORNEY~,~/~ JANUARY 6, 1994 FOLLOW UP ON DANGEROUS BUILDING PROCEDURE Many positive developments have occurred since the city first began the dangerous building process in the wake of the March 1993 earthquake. While most of the structures have been repaired and "taken off of the List," the city is faced with increasingly difficult decisions on those that remain. As the City Council wrestles with the difficult balance between attempting to preserve historic 'buildings and maintain public safety, it is extremely important that it continues to follow the legal procedures previously outlined in my memo of April 8, 1993. A copy of the memo is attached for your reference. Public Hearings The Council has closed the public hearings on both buildings (the old bank and Salud Medical Clinic) remaining on the list. This means that all formal testimony on the buildings has concluded. The Council can, however, if it wishes, consider further communications regarding building status or disposition. Resolution Finding Dangerous Building/Order I;o Make Safe Having closed the public hearings, the Council has reached the next step of considering resolutions finding the structures to be dangerous and ordering their repair or demolition within a certain time. With the old bank building, such a resolution was submitted for Council consideration at the December 13, 1993 meeting and tabled. With Salud, Council directed staff to submit an equivalent resolution for consideration at the January 10, 1994 meeting. Each of these resolutions declares the involved structure to be a dangerous building, orders that it be repaired or demolished, and sets compliance deadline. Since the Council tabled the old bank building resolution (Council Bill No. 1506), action on the matter was deferred and no compliance deadline was set. The resolution to be submitted on Salud (Council Bill No. ), does not presently contain a compliance deadline. This will enable the Council itself to set an appropriate compliance deadline for Salud based on the existing circumstances. 9A MEMO: FOLLOW UP ON DANGEROUS BUILDING PROCEDURE JANUARY 6, 1994 Page 2 Abatement Once compliance deadlines are set, it is hoped that either repair or demolition efforts will commence within the allocated time. However, if the compliance deadlines are not met, the Council must consider taking action to abate the buildings. As stated in my previous memo, two major alternatives exist to accomplish this, either direct abatement or Circuit Court enforcement. ROBERT SHIELDS, CITY ATTORNEY I\' DATE: APRIL 8, 1993 SUBJECT: DANGEROUS BUILDING PROCEDURE UNDER ORDINANCE 1999 Introduction In response to the earthquake, the Building Department acted quickly to inspect and secure certain buildings damaged by seismic activity. Some structures were closed and posted. Where necessary, people were evacuated from the structures. In each case, an attempt was made by the city to contact the responsible party and request a structural engineer's report detailing building damage and the repairs required to make the building safe. It is my understanding that, despite the city's request, no structural engineering reports have been submitted on a majority of the properties and that no repairs have been undertaken on most of the buildings. While the Building Department should be commended for its quick action, it is my opinion that the city has a significant liability potential until the seriously damaged buildings are repaired or demolished. Since the city took initial action to secure these structures on a temporary basis, it is incumbent upon the city to "follow through" with the necessary procedures under Ordinance 1999, the "dangerous building" ordinance. This memo sets forth the necessary procedures under Ordinance 1999. To avoid civil liability, these procedures should be carefully followed. Initial Action by City Administrator Ordinance 1999 states that city officials shall report dangerous buildings to the City Council. A dangerous building is defined as follows: Dangerous Buildino. (a) A structure that, for lack of proper repairs or because of age and dilapidated condition or of poorly installed electrical wiring or equipment, defective chimney, gas connection or heating apparatus, or for any other reason, is liable to cause fire, and which is situated or occupied in a manner that endangers other property or human life. (b) A structure containing combustible or explosive materials or inflammable substances liable to cause fire or danger to the safety of the building, premises or to human life. 9A Memo: Dangerous Building April 8, 1993 Page 2 (c) A structure that is in a filthy or unsanitary condition liable to cause the spread of contagious or infectious disease. (d) A structure in such a weak, dilaoidated or deteriorated condition that it endangers a oerson or Drooertv because of the probability of oartial or entire collapse. (Emphasis added.) The ordinance requires that you, as City Administrator, report to the Council buildings you believe are dangerous. As I previously advised, it is also desirable to send a notification letter to all involved property owners, at this stage, advising them that the initial action will be taken and that their building will be reported to the Council. You have already accomplished this notification by obtaining basic title information on the properties and sending certified letters to each of the involved property owners. Res01ution Setting Public Hearings The next step is to present basic information to the Council at its next meeting that the involved buildings are dangerous. The Council then considers this information and sets a date for public hearings. Notice of Public Hearings The ordinance then requires that specific notice be given. The City Recorder must mail notices of hearing to the owners of record, by certified mail, return receipt requested. Also, copies of the notices must be affixed to the buildings themselves. Finally, notices should be published in the newspaper at least ten days before the public hearings occur. Additionally, the City Recorder can post notices of each hearing in three public places, although this posting is not strictly required if the newspaper publication is made. After the appropriate notice is given, the City Recorder should prepare an affidavit to this effect. Public Hearing At the public hearing stage, the Council must determine if each involved building is dangerous. A separate public hearing must be conducted concerning each building. The owner of record and any other interested parties have a right to appear at the public hearing and be heard. 9A Memo: Dangerous Building April 8, 1993 Page 3 Even if no one appears at the public hearing, a record should be created as to why, in the city's opinion, the building is dangerous. This will require testimony by the involved building officials as to what investigation was performed and how, based upon this investigation, it is their opinion that the building is dangerous. Photographs and any other exhibits can be considered by the Council at this time. Also, if the Council desires, it would be appropriate for them to view the building. Preparation of Resolution and Findings At the conclusion of each public hearing, the Council can request that an appropriate resolution and findings be prepared. This resolution can order the owner of record to take three alternative actions, based upon what the Council finds appropriate. The owner can be directed to: (1) do nothing since, in the Council's opinion the building is not dangerous, or (2) alter a portion of the building to make it safe, or (3) abate the building. The resolution should be supported by findings justifying the action of the Council and specifying a reasonable time for the owner to comply. Service of Resolution on Owner The resolution and findings must now be served on the owner of the property to allow for voluntary compliance. If the owner complies with the Council's order within the specified time, the process is concluded. However, if the owner fails to comply, the city must consider further action. Abatement If, after the specific compliance time has elapsed, the owner has not repaired or demolished the building, the Council must decide between two alternatives. First, the Council can direct city officials to abate the building and assess the necessary costs as a lien against the property. The advantage of this alternative is that abatement can be immediately accomplished. The disadvantage is that the city must bear the initial costs of the building's abatement. These costs would be substantial and could not be recovered until the sale of the property and payment of the city's lien. A second alternative is for the Council to authorize enforcement of its order through the Circuit Court. The advantage to this alternative would be that the city could eventually obtain a court order mandating abatement by the owner and initiate a judicial contempt proceeding if the court order were ignored. The disadvantage would 9A Memo: Dangerous Building April 8, 1993 Page 4 be the delay and expense incurred by having to proceed through the court system to enforce the Council's order. Conclusion I hope this memo provides a useful outline of the process under Ordinance 1999. Please keep me advised as to any new developments. To that end I met again with Ms. Juanita Santana the Executive Director of the Migrant and Indian Coalition. MIC operates the Migrant Head Start program in Oregon. Ms. Santana is still very interested in our old building because of the need for additional classroom space. She simply needs to know how much it will cost and when title could change hands. Both of those items are discussed in Mr. Wilson's letter of December 27th. As of this writing I am not in the position to give the council an accurate time lime for the disposition of the subject building However, my experience with commercial appraisals indicates that it Hon. After that another three to six months for MIC to obtain its financing for purchase and subsequent renovation. Within that time frame Salud should be in the position to have its existing FmHA mortgage transferred to its new site. Consulting Structural Engineers ORIGINAL SALUD.CLINIC BUILDING 347 NORTH FRONT STREET WOODBURN RESISTANCE TO WIND AND RAIN Dear Mr. Nunez: This will summarize a.conversation between ~yself and Mr. Eric Santiago of the clinic, held this afternoon, and during which we discussed the concern of others with the resistance to natural forces of wind and rain. RAIN PENETRATION INTO BUILDING SHELL Damaged portions of the north and south parapet walls from the Scotts Mill Earthquake in March of this year have been temporarily sealed with plywood and plastic. However, it will likely prove unfeasible to completely prevent the intrusion of moisture into the building. There is concern with the effect on the structure. I expressed the following thoughts concerning this matter. Short term affect..on the structural strenath of framing members will be nominal. Vertical load capacity'should not be greatly affected by wetting of the wood members, and so long as large amounts of water do not accumulate, there should be no danger from short term vertical loads. Structuralframing members can be expected to experience decay if cOntinued exposure to moisture persists for a few years. We would expect that the members pocketed into closely fitting cavities in the brick walls will be among the first to experience rot to their enclosed ends. Preservative treatment of accessible elements is feasible and may greatly extend the time before significant decay begins to reduce the strength of the wood members. We would not expect any previously undamaged members to experience a significant loss of capacity before a couple of years minimum even without the addition of preservative. S.W. The greatest and fastest of moisture damage is to architectural elements and finishes. If any significant amount of moisture has entered the building, those are probably already well advanced. Structural damage from moisture will come much more slowly from decay of wood members. The process of decay is very slow, and we would not expect it to be significant in the short term. LIMITATIONS The opinions expressed herein are based on the condition of the building when we observed and reported on it in April of 1993. We cannot be responsible for altered conditions subsequent to our last observation. Opinions concerning the probable capacity to resist wind and water damage are based on experience with many similar structures in my 29 years in this field. No specific analysis for wind force resistance of the existing building was performed, and the conclusions must therefore be treated as estimates or personal opinion. Finally, the only way to make the structure totally safe for natural forces is to either demolish it or structurally repair and strengthen it. We understand that you need time to consider the options available, and that the building is awaiting those actions. We do not believe that the present building represents a great public danger from wind or rain damage in the short term. The City Council is concerned that wind or rain could cause further damage to the building which could pose a public hazard. During my testimony on December 13th I explained that we would be receiving an opinion from a professional engineer which would address the public hazard issue. The Council however chose to instruct staff to prepare the condemnation order prior to receiving the engineers opinion, copies of the engineers letter, contractors letter and a letter from the City are enclosed for your review. I have been looking for a buyer who would purchase the building "as is," so Salud could use all its resources for a new building. The Migrant and Indian Coalition, Oregons Statewide Migrant Headstart Program, needs additional classrooms and is interested. This was also reported to the City Council and city staff several times. I suspect that in order for U.S. Public Health Service to allow the sale, the issue of the new building needs to be resolved prior to the release of its lien interest on the old building. Front Street Woodburn, Or. 97071 Dear Lucina, At the Woodburn City Council meeting of Monday, December 13th the council voted to start condemnation proceedings on Salud's Building at the referenced address. The city Council is concerned that wind or rain could cause further damage to the building which could pose a public 'hazard. During my testimony on December 13th I explained that we would be receiving an opinion from a professional engineer which would address the public hazard issue. The Council however chose to instruct staff to prepare the condemnation order prior to receiving the engineers opinion. Copies of the engineers letter, contractors letter and a letter from the City are enclosed for your review. I have been looking for a buyer who would purchase the building "as is," so Salud could use all its resources for a new building. The Migrant and Indian Coalition, Oregons Statewide Migrant Headstart Program, needs additional classrooms and is interested. This was also reported to the City Council and City staff several times. I suspect that in order for U.S. Public Health Service to allow the sale, the issue of the new building needs to be resolved prior to the release of its lien interest on the old building. I explained this to the City Council and City staff. This letter addresses a possible sale of the building and requests our position on the release of the Government's lien on that property. In order to consider any release of the mortgage, Farmers Home Administration (FmHA) must first know what is the present market value of the real property. This would be the "as is" value, considering required improvements to meet City occupancy requirements. If necessary, we could authorize the use of FmHA reserve account funds to pay for an appraisal. If a sale was consummated prior to construction of the new proposed facility, it may be possible to require the execution of a replacement mortgage as a condition of the new loan request. This matter is currently being i~Vestigated with the RDA National Office. Meanwhile, Jerry Sheridan and I would be available to attend the next Woodburn City Council meeting with you if you so desire. Please keep us advised. The Bond figure is based on a pool project valued at $1,968,000.00. The cost of the projected Bond is based on the following computation: Pool Construction Cost Less FEMA Allotment and local match $1,968,000 (260,000) PROJECT TOTAL $1,708,000 Associated costs including Bond Counsel and Financial Consultant 47,000 TOTAL NOT TO EXCEED BOND: $1,755,000 Whether to sell the bonds on a 10 year, 15 year or 20 year payback is a decision made at the time the bonds are sold. The cost of this project, based on a 15 year term, for example, is estimated at $.35 per thousand of assessed value for the first year. The estimated payoff over the length of the bond is estimated at $28.79 per thousand of assessed value. We are all aware of the circumstances which led to the City of Woodbum choosing the option of developing a new pool. The passage of this bonding measure will allow the City to construct a 25 meter by 25 yard indoor aquatic center. You are familiar with the plan which has been developed through the schematic phase. The minimum life span of this facility should be between 20 and 25 years. The plan has been developed with the guidance of Pool Consultant Don Carey and Associates. The planned development has had much public attention and has intentionally invited public input during each phase of development. In addition to regular Council presentations as each development phase has occurred, we have had numerous pool committee meetings, 2 community input meetings, a Council/Pool Committee workshop, several newspaper articles and two television interviews. Besides the Council endorsement, the plan has been endorsed by the Pool Committee, the Woodburn Recreation and Parks Board and the Woodburn Together Group. The current timetable for construction would allow for a completed project within one year of the bond passage. The construction timetable depends on several decisions which would need to be made at the time the Bond passes, including whether or not to open War Memodal Pool for the summer of 1994. The next phase of architectural and engineering document preparation is the design development phase. In order to not expend any further contract dollars until we have voter consensus, we will hold off the Design Development Document preparation until after the election. The project as currently presented includes as a offset to the bonding cost, the FEMA reimbursement dollars (including local matching share) which are $260,000.00. The Pool Committee is dedicated to continue its efforts in fund raising. Any funds realized will offset the ultimate cost to the taxpayers. The Pool Committee is currently awaiting the response from one corporate donor. Pool Consultant Don Carey has indicated he has several grant applications which are currently being prepared. The Pool Committee, in addition to its continued fund raising efforts, plans to promote the passage of the March 22nd Pool Bond Election. Any additional funds identified pdor to the actual bond sale can be used to reduce the total amount of bonds that will need to be sold. The passage of tonight's resolution authorizes a General Obligation Bond Election only. If the measure passes, the City is authorized to sell the municipal bonds not to exceed the established level. The actual cost of the bonds will depend on the actual interest and terms of the bond sale established at the time of sale. A decision must also then be made as to the payoff schedule of bonds. Referenced in this report are pay off ratios on a 15 year payment plan. The interest rates on bond sales are currently running less than 5%. However, conservative estimates have been used for the March election. Bonding experts have expressed that this is an excellent time to sell municipal bonds because of current Iow interest rates and changes in tax brackets for wealthier investors. The City Council needs to make a decision tonight in order to meet filing deadlines for the March 22, 1994 election ballot. We recommend passage of the accompanying resolution to place this issue before the city's electorate for their decision on a matter of significant impact on the City's future. lOB COUNCIL BILL NO. 1511 RESOLUTION NO. BACKGROUND: The city has annually applied for and received operating assistance for its transit system from funds provided under Section 18 of the Federal Transit Act of 1994 which provides for such assistance in nonurbanized areas. The amount of funding has remained constant during the past four years despite indications from the state that decreases were possible. State appropriated dollars have in the past been utilized to supplement available federal funds (in FY 92-93 the $16,700 grant was comprised of $9,800 federal and $6,900 state dollars). Congress recently increased the amount of money in the Section 18 program by a significant amount but the city will not likely see increased operating assistance due to elimination of state funding. The current agreement for your consideration is comprised of $16,700 in federal funds with no state contribution. This grant contributes to the operation of the transit system and staff recommends that the resolution authorizing the mayor and city recorder to sign the agreement be approved. 10C COUNCIL BILL NO. NOTE: This purchase would be made with funds budgeted under the 911 Development Fund. These are dollars received from the state for explicit use in carrying forth the provision of 911 services to the communities for which the center has been designated as the Public Safety Answering Point. Expenditure of funds for this acquisition has been approved by the 911 User Board. BACKGROUND: City of Woodburn bid number 94-11, for a 24 channel, digital voice logging recorder with rerecord capabilities and automatic labeling, was opened at 1:00 pm on December 30, 1993 and was publicly read. Bid specifications had been sent to six manufacturers/vendors. Two bids were received, one of which complied with all requested specifications without modifications. The bid results were: Bi dder : Amount Dictaphone Corp. Magnasync Corp. $28. 960.50 31, 1 75.00 Dictaphone bid a 24 channel, self contained unit wi th dual transports for redundancy. The system is menu driven, with all operating functions being controlled from the front panel of the unit. Page 2 IOE Magnasync bid a 24 channel unit, which utilizes a 96 hour hard drive for redundancy and which is operated and controlled through a separate PC terminal. The current voice logging recorder was manufactured by Dictaphone, and is a model 5000. It is a large, free standing, double reel-to- reel, analog recorder, with 20 channel recording capability. It is 12 years old and has a current market value of less than $500. We are currently paying $2,169.00 annually for a service contract to maintain this piece of equipment. The recorder is nearing the end of it's life expectancy and the quality of recording has greatly diminished over the years. Dictaphone's digital voice logger will provide years of reliable service and is highly cost effective. The recording media is less expensive than the replacement costs of our present reel tapes, and can last years. Storage is minimal, and reduced staff time spent changing and reproducing tapes will result in savings of $2,000.00- $3,000. O0 annually. As well as being the lowest bid, the Dictaphone equipment is compatible with the digital call checks, which are in place at each calitaker/dispatch position. Dictaphone has an exceptional reputation, a competitive warranty program, and the center has had a satisfying relationship with the company for more than 12 years. Front St, Woodburn Applicant: La Linda's Incorporated Applicants:Carbajal, Xavier Carbajal, Evlalia Garza, Teodora Valdivia, Lydia The Police Department has received and completed the background investigation for a Retail Malt Beverage (RMB) Liquor License at La Linda's, 293 N. Front St. On Thursday, January 6, I met with the corporate owners and their attorney. Also present was Mr. K. Rank, Attorney for the Corporation and OLCC representatives. The reason for this application is the formation of a corporation in the name of the business. At our meeting we review activities of the restaurant for the past two years. It was noted that in 1991 the business worked with the police department and OLCC with a special compliance plan. That in the year of 1992 the police department was called to the business on 55 occasions and this last year the police responded to the location on only 28 occasions showing a substantial decrease in calls for service to the police. Although the "new" corporation is essentially the same persons operating the business I requested to the corporation that we identify a one year compliance plan between the licensee and the police department. The licensee was very receptive to this and a compliance plan was worked out. This compliance plan is very similar to the previous 1991 plan and is acceptable to the OLCC. *see attached compliance plan. 1OF I should be noted that when the original La Linda's license was issued in 1983 a restriction of operations was attached to the license. This restriction is acceptable to the new corporation and will also be attached. The days and hours of live music are: Friday, Saturday, Sunday and Holidays 9pm to 2am. This license and compliance plan will allow the operation of the business as it has since 1983. RECOMMENDATION: It is recommended that the license for La Linda's Incorporated, 293 N. Front St., Woodburn be endorsed for approval by the City Council. Note, that approval by the council will also be approval for the year 1994. I have reviewed the council policy establishing guidelines and procedures regarding liquor licenses recommendations by the City Council with the applicants. 2 1OF o o o o o o 11. LA LINDA'S COMPLIANCE ACTION PLAN EFFECTIVE JANUARY 6, 1994 Will schedule a compliance plan class for all employees within 60 days of Council approval, and will hold semi-monthly meetings with employees to cover the laws, house policies, and patrons involved in drug or other unlawful activity. Will post warning signs against drug activity and patrons leaving premises twice. Signs will be posted at premise entrances and in restrooms. Will keep a daily patron incident log on customer activity. Will log any barred customers, any customers who cause a disturbance, suspected of drug activity or who enter the premises intoxicated. Will permanently bar any patrons suspected of drug involvement, causing fights/disturbances, trespassing, involved in the promotion of prostitution, or entering the premises intoxicated. Employees will sign citizen arrest forms when police are called for fights, disturbances, trespassing patrons, and will notify police of any suspected drug activity. Employees who violate house policies, O.L.C.C. laws and administrative rules, state statutes in the course of business, will be terminated. Will hold meetings with Woodbum Police Department command staff to monitor progress on an as needed basis. The Police Department staff will provide calls for service to date. Will offer, through 12:00 a.m., buffet food items such as nachos, enchiladas, corndogs, etc. on Friday, Saturday and Sunday nights to discourage over consumption of alcoholic beverages. Will check restrooms on a regular basis to prevent drug activity and use. Will thoroughly screen all new hire employees by checking their background as follows: Check with previous employer, check with Woodburn Police Department, and check with Department of Motor Vehicles for driving record. Will continue to provide security to monitor activity on sidewalks of Front Street between SALUD Clinis to Mays Furniture and Garfield Street from Front Street to the alley, the security will dissuade illegal activity, educate the public and call police as needed. The security will not be an extension of the Woodburn Police Department. 1OF 12. 13. Will continue to provide for cleanliness of sidewalks and curb areas of Front and Garfield streets. Sweep sidewalks by 7:00 a.m. on Saturday, Sunday, Monday, and legal Holidays. Will continue to contact neighboring businesses and attempt to identify problems and negotiate remedies to identified problems. Will develop a plan to work with affected businesses. 14. The U.S. Currency was placed in the city asset forfeiture fund account #32 and the Plymouth Van has been sitting in the Hubbard Police impound lot. In the spirit of interagency cooperation I would request the Councils permission to transfer the Plymouth Van to the Hubbard Police Department. Within the state of Oregon Forfeiture Law the Hubbard Police would continue to utilize the Van and or Proceeds for drug law enforcement. I have spoken with Acting Chief D. Dryden regarding the Van 'and we agree this would be an equitable settlement. RECOMMENDED ACTION: The Woodburn City Council Authorize the Transfer of the Plymouth Van Oregon License QCD-583, to the Hubbard Police Department to be used for drug law enforcement purposes under the Oregon Forfeiture Law. cc. Tech II1~ McKinley Street NO PARKING request January 5, 1994 RECOMMENDATION: It is recommended that NO PARKING signs be installed on both sides of McKinley Street for a distance of 100 feet from the intersection of Hwy. 99E to increase safety and accessibility to the street at this intersection. BACKGROUND: Residents along McKinley Street have expressed safety concerns regarding the intersection of McKinley with Hwy. 99E caused by vehicles parked on both sides of the street near the intersection and difficulty turning off the Hwy. onto the street interfering with cars wanting to access HWY. 99E at the same time. McKinley Street has a 40 ft. right-of-way with a 30 ft. paved width. The Transportation and Traffic Engineering Handbook suggests that streets with a paved width of 30 ft. or less should restrict parking on one side of the street. This is a residential area and the major problem with on street parking is at the intersection. Therefore, to increase safety and accessibility it is recommended to install NO PARKING signs on both sides of McKinley for a distance of 100 ft. from the intersection of Hwy. 99E. This will prevent interference for vehicles wanting to enter McKinley St. from the Highway or exit McKinley to the Hwy. NOTE: Adjoining property owners have been notified of this request. Public Works Directo~ ~" ~ Important Issues for Council/ Wastewater Advisory Committee Workshop scheduled for January 19, 1994 January 6, 1994 Since last August Wastewater Advisory Committee has been meeting regularly. In my opinion, this active group understands the issues well and is therefore wanting to have interaction with the governing body to understand their vision of Woodburn for the next 20 to 25 years. After intellectual discussion, the items would need to be brought down to some specifics. Some of these specifics are outlined below: 1. Population Projection Comprehensive plan projection may be considered somewhat outdated and it is limited to the year 2008. The committee is wanting to plan for a wastewater treatment facility that will serve this community until the year 2020 and beyond. The population projections used to develop capital improvement program by engineers in 1987 will be brought to the attention of council and committee again. 2. Other Population'Considerations in Planning for a Treatment Facility a. Temporary population b. Trailer parks and health hazard areas c. McLaren School 3. Industrial/Commercial Population Equivalent This is an important area from the treatment facilities planning prospective. The city may wish to encourage or discourage certain types of growth because of its impact on the treatment plant. But the cost of impact on the community will need to be understood. In addition, Woodburn may want to establish its place and proper role among the surrounding communities. 15A Regional Services Issues A cooperative study that is funded by 13 communities in the Pudding River Basin has been established and is moving forward. Septage treatment Plant Location and Sizing No decision on this topic can be made until some understanding of the community's growth issues have been developed and technical analysis has been made. Other than in passing remarks, no serious discussion can be expected in the meeting of January 19 on this topic. Box 751 Portland, OR 97207-0751 JULY 1, 1993 PRELIMINARY POPULATION ESTIMATE FOR THE CITY OF WOODBURN Dear Dr. Wineberg: In correspondence of December 7, 1993 it was conveyed that city staff would provide additional data for your review that relates to the size of Woodburn's population. After securing additional information staff found it necessary to revise its original population estimate provided your office on December 7, 1993. Incorporated in this staff report is Attachment I which consists of what is believed to be an accurate count on the number of housing units within the city limits of Woodburn. You will notice a household size of 2.72 rather than 2.69 was used in calculating total populatf°n. This average household size was extrapolated from the 1990 census. The census shows the. city had 4,922 units and a total population-of 13,404. This average household size (2.72) would be even greater (2.80) if the vacancy rate factor identified in the 1990 census of 1.45 was calculated into this formula. When a household size of 2.72 is used as a multiplier tothe 5,953 units accounted for by city staff, a population total of 16,192 is realized. On another point, when reviewing the 1990 census data relating to the number of multi-family units to what was observed in our field surveys and CAD system counts there is some discrepancy. The 1990 census identifies a total of 896 units that range in size from 2 units (duplex) to 10 or more units. Dr. Wineberg December 27, 1993 page 2 15B Attachment I identifies that city has 1,581 multi-familyunits plus 94 duplexes. Of that number 296 units have been built since 1989. Therefore in 1989 there should have been 1,285 units not 896 as identified in the census (Attachment IA) this represents a variance of 389 units. Attachment II is a list of all multi-family (3 or more) units within Woodburn's city limits. This list identifies the name, address and n,,mher of units. A third observation I wish you to consider is the city's 1987-1991 crime index (Attachment III) provided by Woodburn's Police Department. As you can see the chart identifies cities of populations between 11,000 and 18,000. Woodburn's figures show an occurrence of crimes that reflect a community with a population base higher than 14,000. It is understood our cultural mix may raise the statistic although a large portion of our population base consists of Senior Estates which is virtually crime free. Lastly I bring to your attention counts that have been developed by the Marion County Migrant Task Force iht heir point in time census. As you will observe (Attachment IV) in just one year from June 1992 to June 1993 there has been a 64% increase in this segment of our population. It is interesting to note that the June 1992 population during peak agricultural productivity is not noticeably higher than that in November 1993 when agricultural activity is at its lowest. In closing I c~nnot attest to the absolute accuracy of our figures'~ but there are rstrong indicators that Woodburn's population is noticeably greater that stated in the July 1, 1993 estimate. Your consideration of our findings would be appreciated. If there are ways that can be implemented to check the census figures the city would be willing to discuss those alternative(s) with you. Blaine Street January 5, 1994 The City currently provides water service to the house located at 1490 E. Blaine Street, which is outside the city limits. The meter is located along Hvvy 99E and the water line crosses private property to reach the house and the owner, Lester Marks, does not have easements for this line. The line has been in place for approximately 40 years and is now leaking. The private property owners will not allow the line to be reinstalled in its current location. The property owner has negotiated with a property owner on Aztec Way for an easement for his private water line from Aztec Drive. The easement has been surveyed and the owner is willing to grant the easement if the city will provide water to the property line. There is water available along Aztec Drive. As can be seen on the attached map, there is a reserve strip along the north side of Aztec Drive. This was the result of an improvement reimbursement agreement between the city and the developer of Paulines Addition, Woodburn State Bank, that was approved by Council on April 23, 1984 and became effective on May 21, 1984. Basically the agreement stated that developments to the north of this strip would have to reimburse the developer, Woodburn State Bank, for water, sewer and street improvements that they had made. This agreement was to be in effect for a period of 10 years. In order to cross the reserve strip the city would have to obtain permission from Bank of America, who purchased Woodburn State Bank, or wait until the reimbursement agreement expires on May 21, 1994. Attached are a map of the properties involved, a letter from the property owner granting the easement and the surveyed description of the easement. Staff has determined that the water meter should be located from Hwy 99E to the edge of the proposed easement on Aztec Drive and that water be supplied to the 15C City Council through City Administrator January 6, 1994 page 2 house at 1490 E. Blaine Street. The home owner will be responsible for putting in the line from the meter to the house at that address. Prior to the tree falling the Maintenance Division had posted the park as closed due to the high winds. About 5:00pm the 170' tree fell directly on the center of our picnic shelter. The main storage and utility area of the structure was destroyed. A gentleman was sitting on a picnic table at the time the tree came down and fell just a few feet from him. Luckily, he was uninjured. He was however, a bit shaken up. The building has a recorded value of $13,000.00. Within the building there was much storage including the Kiwanis cooking stoves, a 50 gallon coffee pot and a large refrigerator. The large logs that remained have been sold for logging and could bdng in as much as $1,000. This will cover the City's $1,000 deductible. An insurance assessor from the City's Insurance Carrier has visited the site and we are in the process of negotiating a settlement so construction and repairs can begin. There have been two public forums on gangs and now are six citizen committees that are working on projects that will be brought to the councils attention in the coming weeks and months. The last documents are graphs showing the age and sex breakdown of gang members and associates that the Woodburn Police Gang Enforcement Team have documented. As you can see the gang membership ranges from 12yrs through age 30. It is a sad commentary that a gang can accommodate such wide age group. One of the calls involved an 18th Street'er who was arrested for carrying a concealed weapon, this same individual was assaulted by rival gang members later in the month. Also while responding to a report of a possible vandalism, the suspect at the scene observed the police and started running. The subject, a known 18th Street'er, was ordered to stop, but did not. The officer pursued the suspect, on foot, and caught him.
