PUGH/FIGLEy.... adopt the regular and executive session Council minutes of August 25, 1997; accept the Planning commission minutes of August 14, 1997 and the Library Board minutes of August 27, 1997 as presented. The motion passed unanimously. PROCLAMATION - CONSTITUTION WEEK. SEPTEMBER 17-23. 1997. Mayor Kirksey stated that Constitution Week is a special week not only in our community but in the United States for bringing forth the meaning of the constitution and what the US flag stands for in our nation. This is the 210th anniversary of the signing of the constitution which guarantees independence to American citizens. She proclaimed the week of September 17-23, 1997 as Constitution Week within the City and urged all citizens to reflect on the benefits, privileges, and responsibilities of American citizenship. Blanche Pickering, representing the Daughters of the American Revolution organization, expressed her appreciation to the City for their support and suggested that all citizens take time to remember what the constitution has provided to our nation. She also reminded the public that the DAR room is located on the second floor of the Woodburn Library where registers are kept which list names of individuals who served during the Revolutionary War. A) PUBLIC HEARING - LUBA Remand of SPR 95-10 (LaPoint Texaco/Exxon): The hearing will be held before the City Council on Monday, September 22, 1997, 7:00 p.m. , in the City Hall Council Chambers. B) PUBLIC HEARING - APPEAL OF SIGN ORDINANCE: A public hearing before the City Council is scheduled for Monday, September 22, 1997, 7:00 pm, in the City Hall Council Chambers. C) WOODBURN PUBLIC LIBRARY SUNDAY HOURS: open on Sundays between September 1997 and pm to 5:00 pm. The Library will be May 1998 from 1:00 D) AQUATIC CENTER RE-OPENING: The Woodburn Aquatic Center will re-open on Monday, September 22, 1997. CHAMBER OF COMMERCE REPORT. Tina DeCamp, representing the Chamber Board, reminded the public of the upcoming events: 1) Chamber after Hours - September 11, 1997, 5:00 pm to 6:30 pm, at the Mullican Medical Center, 685 Evergreen Road; 2) Chamber Forum - September 17, 1997, 12:00 noon, Woodburn Medical Center, with the topic "School to Work Program - Preparing the Work Force for the 21st Century"; and 3) The Oktoberfest is September 11-14, 1997 in Mt. Angel and there will be a flow over from this event into Woodburn with a lot of the businesses welcoming those people passing through town. Barbara Lucas, 214 E. Clackamas Cl, informed the public that a town hall workshop will be held in the City Hall Council Chambers on October 14, 1997, 7:00 p.m., for the purpose of giving the citizens of the community an opportunity to know all about the ramifications of the proposed $.02 gas tax ballot measure. She invited the Council to attend, and participate, in this town hall workshop so that the public will have a better understanding of this measure. She stated that she hoped this town hall workshop would be televised live on our local cable TV. In addition, she will be organizing a volunteer group of citizens to help stuff envelopes with a non-partisan informational fact sheet which will be sent to all households within the City. She stated that she will let the Council know of the date(s) and time when the envelopes will be stuffed in case they are interested in helping with this project. Frank Connerton, 1427 Ten Oaks Lane, thanked the staff for the work done at the bridge crossing Senecal Creek. He questioned why the Hwy. 214/Settlemier Ave intersection has a 2-lane road merging into one-lane within a relatively short distance. In his opinion, the outside lanes should be a right-turn only lane in order to minimize accidents at that intersection. Councilor Pugh expressed his agreement with Mr. Connerton's statement since he has witnessed motorists speeding and/or cutting into the through traffic lane. Public Works Director Tiwari stated that Highway 214 is under the jurisdiction of the State Highway Department. The Highway 214 widening has been talked about by the City in the past and correspondence has been sent to the State to try and get this road widened from Hwy. 99E to the interchange. The City will continue to pursue this issue with the State. At one time, the State had started an environmental assessment but then it was dropped. The City will try to get the State to continue with this assessment. The City does not have the right to put up any signposts on Highway 214 and he will bring this issue up with the State Regional Traffic Engineer. Mr. Connerton also questioned the status of the traffic light on the east side of the 1-5 interchange. Mayor Kirksey stated that there is a staff report in this agenda packet which indicates that the light should be installed by the middle of October. TABLED BUSINESS. A) WDA Request for Removal of Trees on Front Street -- No action was taken by the Council to remove this item from the table. B) WDA Request for Parking Restrictions -- No action was taken by the Council to remove this item from the table. COUNCIL BILL 1823 - ORDINANCE AUTHORIZING CONTRACT WITH THE STATE FOR FINANCIAL ASSISTANCE FROM THE SPECIAL PUBLIC WORKS FUND FOR WOODLAND AVENUE INFRASTRUCTURE IMPROVEMENTS. Councilor Sifuentez introduced Council Bill 1823. City Recorder Tennant read the two readings of the bill by title only since there were no objections from the Council. On roll call vote for final passage, the bill passed unanimously. Mayor Kirksey declared Council Bill 1823 duly passed with the emergency clause. Council Bill 1824 was introduced by Councilor Sifuentez. The two readings of the bill were read by title only since there were no objections from the Council. On roll call vote for final passage, the bill passed unanimously. Mayor Kirksey declared Council Bill 1824 duly passed with the emergency clause. COUNCIL BILL 1825 - RESOLUTION ENTERING INTO AN AMENDMENT TO LOCAL AGENCY FUND EXCHANGE AGREEMENT #13836 FOR FUND EXCHANGE FROM THE CLEVELAND STREET WIDENING PROJECT TO THE REALIGNMENT OF FRONT STREET AND SETTLEMIER AVENUE. Council Bill 1825 was introduced by Councilor Sifuentez. Recorder Tennant read the bill by title only since there were no objections from the Council. On roll call vote for final passage, Council Bill 1825 passed unanimously. Mayor Kirksey declared the bill duly passed. COUNCIL BILL 1826 - RESOLUTION ENTERING INTO LOCAL AGENCY FUND AGREEMENT NO. 15232 WITH THE STATE FOR FUND EXCHANGE TO BE UTILIZED TO REALIGN FRONT STREET AND SETTLEMIER AVENUE. Councilor Sifuentez introduced Council Bill 1826. The bill was read by title only since there were no objections from the Council. On roll call vote for final passage, the bill passed unanimously. Mayor Kirksey declared Council Bill 1826 duly passed. CONTRACT AWARD - MILL CREEK PUMP STATION REPAIR. Bids for the removal, rebuilding, reinstallation, and testing of the Mill Creek Pump #3 were received from the following contractors: Stettler Supply Co, $7,315.00; and Ericksen Pump Co., $7,468.00. Staff recommended that the contract be awarded to the low bidder. FIGLEY/PUGH... award the contract to Stettler Supply Co. in the amount of $7,315.00. The motion passed unanimously. REQUEST FOR SOUND AMPLIFICATION PERMIT AND DOWNTOWN PARKING LOT CLOSURE. Salud Medical Center requested permission to use sound amplification equipment on September 13th between 10:00 am and 6:00 pm at their office located at 2225 N Pacific Highway, and on September 14th between 10:00 am and 6:00 pm at 347 N Front Street (downtown parking lot) in conjunction with their 3rd Annual Health Fair. A public dance will be offered as part of the September 14th activities. Salud also requested that the downtown parking lot be closed on September 14th between 10:00 am and 6:00 pm. COUNCIL MEETING MINUTES September 8, 1997 TAPE READING for a parade permit for Saturday, September 13th, 7:00 am, at which time a Fun Run has been scheduled, and for a public dance permit for September 14th. FIGLEy/SIFUENTEZ.... approve the closure of the downtown parking lot on September 14, 1997, between 10:00 am and 6:00 pm, and sound amplification permits for September 13 and 14, 1997 between 10:00 am and 6:00 pm as requested. The motion passed unanimously. 0720 STAFF REPORTS. A) NORTH WILLAMETTE TELECOM APPLICATION FOR COMPETITIVE ACCESS PROVIDER STATUS/LOCAL EXCHANGE SERVICE -- In a memo from Administrator Childs, the Council was advised of the formal request filed by North Willamette Telecom to provide telephone service within the City. Staff will further investigate this request and report back to the Council at a later date. B) LIBRARY GRANT APPLICATION FOR "READY TO READ" GRANT -- Staff has applied to the State Library for a grant in the amount of $2,400 which will be used towards improving children's programs during fiscal year 1997-98. C) WOODLAND AVENUE NORTH ISLAND IRRIGATION -- The staff report briefly outlined costs for installation of the meter ($500.41), backflow prevention device ($100.00) and irrigation permit ($120.00). It was also noted that the cost for the water used would need to be paid by the City, the homeowner's association, or a service group. Costs for the irrigation piping, fixtures, and controls would be in addition to the above stated costs. D) I-5 NORTHBOUND TRAFFIC SIGNAL STATUS REPORT -- Public Works Manager Rohman stated that the contractor anticipates the project start date of September 17th, however, the contractor is still waiting for the poles to be delivered. If the work starts as planned, the signal should be operational by October 30th. Councilor Pugh stated that the barriers recently put into place on the east side of the ramp is creating more of a backup of traffic onto the freeway. Public Works Manager Rohman stated that the contractor placed the barriers at that location since it is necessary to keep the workers safe and the portion of the project requiring the barriers should be done within 10 days once the project is started. 0837 ADMINISTRATOR'S REPORT. Administrator Childs stated that staff had reserved a block of rooms for the League of Oregon Cities conference in Eugene, Page 5 - Council Meeting Minutes, September 8, 1997 ~l COUNCIL MEETING MINUTES September 8, 1997 TAPE READING November 7-9, 1997. He requested that the Councilors let him know if they plan on attending since the rooms can be held or released. He also requested that he be given the names of which Councilors who will be working with him on the hiring of a Park & Recreation Director. 0901 MAYOR AND COUNCIL REPORTS. Councilor Chadwick stated that she had read an interesting article in the Oregonian that listed how many miles of State, County, and City roads/highways that need repair and the lack of funds to do those repairs. Councilor Pugh questioned the activity going on the west side of the freeway. He suggested that the Woodburn Independent cover these activities a little more closely since it is exciting and yet concern is raised especially in the area of traffic. He also complimented Public Works Manager Rohman, along with Director Tiwari, for their competency in guiding the City through this growth period. He expressed his appreciation to the public for their willingness to try and make Woodburn as nice a community as can be done and he reiterated that concerned citizens, such as Barbara Lucas who is willing to assist in getting information out to the public on the gas tax, makes him proud of our community. Councilor Figley thanked the Public Works staff for their work in getting the traffic signal on the east side of I-5 and traffic congestion during the Oktoberfest celebration should be minimized in future years. Mayor Kirksey stated that recent gas prices in West Yellowstone were $1.569 per gallon compared to the Texaco station on the west side of I-5 which charges a similar price. 1005 ADJOURNMENT.
