It was noted for the rex~rd that the tape recorder normally used to record Council
meetings was not working and another recorder was being used that did not have a tape
counter.
Administrator Childs requested that item 10(O) (Council Bill to amend Ordinance 2187
relating to interim telecommunications facilities regulations) be added to the agenda.
Mayor Kirksey stated that she would include it as an agenda item.

PROCLAMATION- NATIONAL NIGHT OUT.
Mayor Kirksey read the proclamation designating Tuesday, August 5, 1997, as
NATIONAL NIGHT OUT in the City and urged local residents to participate in_
cooperative police-commUnity crime and drug prevention programs.
CHAMBER OF COMMERCE REPORT,
Dr. Jack Reeves, Chamber representative, reminded the Council of the following events:
1) Chamber at the Drags - July 23rd, 5:00 p.m.; and
2) Chamber Golf Tournament - August 8th at Tukwila.
Mayor Kirksey stated that Council President Jennings will participate in the race since
she will be out of town on July 23rd. She also stated that the cars are provided by
Hershberger Motors.
Tom Waggoner, 849 Woodland, requested City participation in a project to beautify the
median strip on Woodland Avenue by providing materials for an underground watering
system in addition to boring under the roadway in order to get water to the median strip.
He stated that a local resident in the area began maintaining the median strip about 15
years ago. He has since passed away and other local residents are willing to volunteer
their time on the upkeep of the strip, however, they would like to have water made
available in order to maintain healthy plants. He, along with a few other local residents,
are willing to install the watering system for the City.
During a brief discussion on this proposal, Mayor Kirksey stated that costs for the
materials and boring need to be determined before any decision is made on this project.
She also suggested that staff may be able to apply for grant funds to help offset costs
since City funds are limited.
Administrator Childs stated that this idea was brought up before the Council about 2
years ago. The major expense to the City would be boring under the roadway. He will
try to have a report back to the Council by the next meeting.
TABLED BUSINESS.
A) COUNCIL BILL 1758- ORDINANCE INCREASING LOCAL GAS TAX--
No action was taken by the Council to remove this item from the table.
Councilor Jennings stated that the State legislature took no action on a state-wide
transportation package, therefore, the City's proposed increase should be brought back to
the Council for some action within the near future. Since the Council had agreed to give
the public 30 days notice of when this issue would be brought up for consideration, he
suggested that the Council consider removing this item from the table on August 11,
1997.

Mayor Kirksey stated that copies of the draft ordinance have been given to the Council
and if the public has any questions or comments, they should contact herself or their
Councilor prior to the August 1 lth meeting date.
B) WOODBURN DOWNTOWN ASSOCIATION REQUEST FOR REMOVAL OF
TREES ON FRONT STREET- No action was taken to remove this item from the
table.
Mayor Kirksey stated that the trees in front of the Museum have been trimmed by
Museum volunteers and she stated that she will be pursuing this issue with other local
downtown business owners when she gets back from her vacation.
C) WOODBURN DOWNTOWN ASSOCIATION REQUEST FOR PARKING
RESTRICTIONS -- No action was taken by the Council to remove this item from the
table.

COUNCIL BILL 1811 - ORDINANCE AMENDING SECTION 5 OF ORDINANC~
1900 (DISCHARGE OF WEAPONS).
Council Bill 1811 was introduced by Councilor Hagenauer. The two readings of the bill
were read by title only since there were no objections from the Council.
Attorney Shields stated that this ordinance would allow for ceremonial discharges of
f'u'earms utilizing blank ammunition at funerals at cemeteries inside the City provided
that they are arranged through a state licensed funeral home and the Police Chief is
notified in advance of the service. All other requests for ceremonial discharges of a
firearm must follow a permit process and Council approval is necessary before a permit
is issued.
On roll call vote for final passage, the bill passed unanimously. Mayor Kirksey declared
Council Bill 1811 duly passed with the emergency clause.
COUNCIL BILL 1812 - RESOLUTION AUTHOItIZING INTERFUND
BORROWING OF FUNDS AT JUNE 30, 1997.
Council Bill 1812 was introduced by Councilor Hagenauer. Recorder Tennant read the
bill by title only since there were no objections from the Council.
Finance Director Gillespie stated that he had distributed copies of a revised bill to the
Council which increased the loan amount to RSVP from $23,000 to $28,000.
On roll call vote for final passage, the bill passed unanimously. Mayor Kirksey declared
Council Bill 1812 duly passed.
COUNCIL BILL 1813 - RESOLUTION AUTHORIZING INTERFUND
BORROWING OF FUNDS DURING FISCAL YEAR 199%98.
Councilor Hagenauer introduced Council Bill 1813. The bill was read by title only since
there were no objections from the Council. On roll call vote for final passage, the bill

Council Bill 1814 was introduced by Councilor Hagenauer. Recorder Tennant read the
bill by title only since there were no objections from the Council.
Councilor Jennings questioned the type of work the consultants would be performing.
Public Works Manager Rohman stated that painting the water reservoir involves
technical issues which requires assistance from professional engineers who specialize in
this field. Issues to be addressed in the final specifications include paint types, thickness
of paint, overspray issues, specific equipment to be used, and other related items.
On roll call vote for final passage, the bill passed unanimously. Mayor Kirksey declared

COUNCIL BILL 1815 - RFSOLUTION ENTERING INTO AN AGREEMENT
WITH PACIFIC NETCOM, INC. FOR TELECOMMUNICATIONS
CONSULTING SERVICES.
Council Bill 1815 was introduced by Councilor Hagenauer. The bill was read by title
only since there were no objections from the Council.
Administrator Childs stated that this agreement involves the engineering portion of
developing the specifications for a new telephone system. He stated that the telephone
system needs to be upgraded and, once the report is completed and estimated costs are
known, it may be feasible to begin the upgrades later this f~scal year. Funds have been
budgeted for the engineering along with some additional appropriations towards the
future purchase of a new system.
Councilor Pugh expressed his opinion that staff is premature in starting on this project
and he suggested a six to nine month wait since technological changes occur rapidly in
this area.
Mayor Kirksey expressed her opinion that the current telephone system is obsolete and
she is greatly concerned about a system crash in which parts will not be available in
order to repair the system.
Councilor Figley also expressed concern over a potential telephone system breakdown
and felt that completing the design of a new system now will give the City an
opportunity to rapidly move on an emergency purchase of a new system if that becomes
necessary.
Councilor Je]~nings also expressed his opinion that the current system needs to be
replaced and felt that the City should go ahead with the design phase.
On roll call vote for final passage, the Council Bill 1815 passed 5-1 with Councilor Pugh
voting nay. Mayor Kirksey declared the bill duly passed.

PAYMENT AUTHORIZ&TION FOR EMERGENCY REPAIR OF MILL CREEK
PUMP STATION//2.
A staff memo outlined the repairs that' were made to the pump case, drive shaft~ and
bearings on a pump that is located at one of the City's major pump stations.
JENNINGS/PUGtL.. authorize the payment of $9,382.67 to Stettler Supply Company
for repair of Mill Creek Pump//2. The motion passed unanimo~ly.
CONTRACT AWARD - DOWNTOWN ALLEY REHABILITATION PROJECT.
Bids for the downtown alley project were received from the following contractors:
Geico Construction, $159,459.75; and D & D Concrete Utilities, $165,227.50. The
engineer's estimate for this project was $144,725.00. Staff recommended acceptance of
the low bid since it was within 10% of the engineer's estimate.
JENNINGS/FIGLEY .... award the contract to the low bidder, Geico Construction, in
the amount of $159,459.75 for construction of the Alley Rehabilitation improvements
project. The motion passed unanimously.
ACCEPTANCE OF UTILITY EASEMENTS ON ASTOR WAY.
Staff recommended the acceptance of easements from J.D. Mitchoff and William &
Naomi Swanson which are necessary for the alignment of the sanitary sewer force main
and gravity sewer from W. Lincoln near Cascade to an existing line at Boones Ferry and
Goose Creek.
JENNINGS/FIGLEY .... accept the utility easements as recommended by staff.
The motion passed unanimously.
ACCEPTANCE OF WARRANTY DEED - BLOCK "A" IN FIRST ADDITION TO
MAUNA KAE PARK (MARCEL DRIVE).
Staff recommended the acceptance of a Warranty Deed from Shirley D. Rose for a one
foot by sixty foot spite strip which had been originally been intended to be given to the
City on the plat but never legally transferred.
JENNINGS/FIGLEY .... accept the staff recommendation and accept the warranty deed
from Shirley Rose for property located at the end of Marcel Drive which will become a
part of the Marcel Drive right-of-way. The motion passed unanimously.
ACCEPTANCE OF PUBLIC RIGHT-OF-WAY AND UTILITY EASEMENT
NORTH OF PROPOSED ROBIN AVENUE.
Staff recommended the acceptance of public right-of-way (warranty deed) and utility
easement from Robert Miles which is in conjunction with the Miles Chevrolet
development. The area north of the proposed Robin Avenue (between Woodland Ave
and Amey Rd) is a designated wetlands area and the fight-of-way is being conveyed for
drainage purposes while the utility easement is adjacent to Woodland Ave. and is being
conveyed for utility and sidewalk purposes.

JENNINGS/FIGLEY .... accept staff recommendation and accept the warranty deeds for
public right-of-way and the utility easement from Robert Miles. The motion passed
unanimously.
APPROVAL OF CONNECTION TO CITY SERVICES - 1570 BLAINE STREET.
Councilor Jennings questioned if annexation of this property would make the current city
boundary zigzag in this area.
Public Works Director Tiwari stated that the request for connection is due to a potential
health hazard issue. Past policy has been to establish conditions for connection one of
which is annexation to the City. The property owner has signed the annexation
application and a non-remonstrance consent for improvements on the future extension of
E. Blain Street and Aztec Drive. The area proposed for annexation is located within the
Urban Growth Boundary but does not abut current City boundaries. He also stated that
there is a development being proposed in this area which is in the site plan review
process.
Councilor Jeonirtgs stated that he was concern regarding the property tax issues involved
with annexations now that Ballot Measure 47/50 has been passed by the voters.
Attorney Shields stated that he was in the process of preparing an informational item for
a future agenda packet on this issue, however, he would expedite his research since there
are Council concerns on property taxes assessed to annexed areas.

SOUND AMPIJlrICATION REQUF_~gT FOR FIESTA MErCiA
CELEBRATION.
The Woodburn Latin American Club requested permission to use sound amplification
equipment during their annual event which is held at Legion Park July 31, 1997 through
August 3, 1997. Staff recommended the approval of the request for the following dates
and times: July 31st, 6:00 pm to 10:00 pm; August 1st, 10:00 am to 11:00 pm; August
2nd, 10:00 am to 11:00 pm; and August 3rd, 10:00 am to 10:00 pm.
JENNINGS/FIGLEY .... request for a sound amplification permit submitted by the
Woodburn Latin American Club for the above dates and times be approved. The motion
passed unanimously.
SOUND AMPLIlrICATION PERMIT - CENTRO CRISTIANO A/G CHURCH.
The Centro Cristiano A/G Church submitted a request for sound amplification permits
for July 19th, 4:30 pm to 8:30 pm (Library Park) and July 20th, 4:30 pm to 8:30 pm
(church site located at 275 W. Lincoln St) for an outdoor service and celebration
following the renovation of their church building. Staff recommended issuance of the
sound amplification permit.

REOUEST TO GIVE POLICE CHIEF AUTHORITY TO AUTHORIZE
TEMPORARY STREET CLOSURES RE: NATIONAL NIGHT OUT.
Chief Wright requested authority to authorize street closures on Tuesday, August 5,
1997, from 6:00 pm to 10:00 pm, to accommodate citizens who request closure of their
sU'eets for the purpose of holding block parties in conjunction with the "14th Annual
National Night Out".
JENNINGS/HAGENAUER .... Police Chief be given authority to authorize street
closures for August 5, 1997 between the hours of 6:00 pm and 10:00 pm and encourage
all citizens to participate in the National Night Out event. The motion passed
unanimously.
COUNCIL BILL 1816 - ORDINANCE AMENDING ORDINANCE 2187 (INTERIM
TELECOMMUNICATIONS FACILITIES RF_~ATIONS) TO EXTEND TI-W,
REPEAL DATE.
Council Bill 1816 was introduced by Councilor Hagenauer. Recorder Tennant read the
two readings of the bill by title only. On roll call vote for f'mal passage, the bill passed
unanimously. Mayor Kirksey declared Council Bill 1816 duly passed with the
emergency clause.
SITE PLAN ACTIONS.
A) PLANNED UNIT DEVELOPMENT- STAGE H DESIGN REVIEW, GREENS AT
TUKW/LA -- The Planning Commission approved Phase I of this proposed subdivision,
with conditions, on June 26, 1997. No action was taken by the Council on this proposed
development.
STAFF REPORTS.
A) LAND USE BOARD OF APPEALS (LUBA) REMAND -- The City has received
notice from LUBA that Gary LaPoint's Texaco/Exxon site plan review has been
remanded back to the City for review. Director Goeclcritz stated that he will be
discussing this issue with our City Attorney and the applicant to as to how and when the
City should proceed with this application.
B) HOUSING REHABILITATION GRANT AWARD -- Councilor Figley informed the
public that the City has been awarded another $500,000 in housing rehabilitation grant
funds from the Oregon Department of Community Development. She stated that if a
qualified resident currently has an application on file, funds will soon be released for
upgrading their homes. She also urged other urged other local residents interested in
this program to contact the City for an application. With this recent grant award, the

City has been awarded approximately $2,000,000 from the state in housing grants that
have been used to upgrade approximately 140 dwellings within the City.
C) WATER SUPPLY TO CENTENNIAL PARK--- COUncilor Figley stated that the
City Administrator and staff followed up on the Committee's initial discussion on the
water supply issue. In summary, the water main along Parr Rd will be extended to
Centennial Park as part of the Parr Rd project which is currently underway. Public
Works and Parks will share equally in the costs. It is estimated that the Parks
Departments share will be $10,000 and Parks SDC funds will be used for this project.
In a memo from Administrator Childs, he updated the Council on the other infrastructure
components that are being researched and, hopefully, forthcoming in the near future.
D) AQUATIC CENTER UPDATE-- In a memo from Administrator Childs, he
informed the Council that the ratio of revenues to operation & maintenance has increased
from 39% to 50% in May and June 1997. Attendance has increased coupled with a
snack concession sales program which alone is clearing $60-$75 per day. Staff is also in
the process of finalizing an agreement with Image Resources for development of a
marketing plan for the Center.
E) UPDATE ON SUMMER WATER USE--- Public Works Manager Rohman stated
that July and August are peak months for water usage within the City. He emphasized
that there is no shortage of water for domestic use, however, he suggested that
customers try to conserve during these months. He reminded the public that the best
time to water yards and gardens is during the cooler part of the day, generally between
10:00 pm and 10:00 am. Reducing the amount of water used between 4:00 pm and
10:00 pm will reserve an adequate supply of water to meet both customer needs and
sufficient reserve capacity to meet potential fire needs.
F) BUILDING ACTIVITY REPORT FOR JUNE 1997.
ADMINIS~TOR'S REPORT.
Administrator Childs commended the organizers and other volunteers who worked to put
on the annual 4th of July picnic, breakfast, and fireworks display. He also commended
Dr. Reeves for his work in administering the school construction projects and he
expressed his appreciation to the Statesman Journal for theft recent news article on the
construction project along with their recognizing that good things are happening in
Woodburn.
MAYOR AND COUNCIL REPORTS.
Councilor Figley expressed her appreciation to Don Eubank and Vee Ott who are the
two key individuals that should be recognized for the job they do every year in
organizing the 4th of July picnic and fireworks. She also stated that the comments she

had made to the Woodburn Independent reporter regarding Public Works Director Tiwari
are absolutely tree and he deserves recognition for his work.
Councilor Jennings stated that the next "Let's Communicate" show will be on the
Community Action Vehicle (C.A.V.) on July 24th between 7:00 pm and 7:45 pm. He
has heard numerous positive comments from individuals who have seen the vehicle at
various events and/or locations within the City.
He also stated that his son had retired on July 3rd at a ceremony held on the USS
Missouri and the flag ceremony was an emotional moment.
Councilor Hagenauer questioned what, if anything, can be done to help the residents
who live on the north side of Cleveland Street just south of Gatch Street to obtain access
to their property.
Public Works Manager Rohman stated that the property owners need to work it out with
Willamette Valley Railroad. The property owners are granted access the tracks to get to
their property and, with the recent replacement of the tracks, it is the owners
responsibility to replace the crossing with either wood or asphalt.
Director Tiwari stated that there are two different types of railroad crossings - public and
private. The private crossings are at the mercy of the railroad and the property owner
needs to deal directly with the railroad in order to get permission to cross the railroad
tracks. He stated that at least two properties along the north side of Cleveland Street are
landlocked since there only access to their residence is by using Cleveland Street. He
stated that staff will continue to work with both the railroad and property owners to try
and solve this situation.
Councilor Hagenauer also questioned the status of the building on Lincoln Street near
Corby Street which is partially torn down.
Director Goeckritz stated that the owner has obtained a building permit which is good
for six months and can be extended for another six month period. It is his understanding
that the owner is completing a contract over at the coast and, once he is done with that
project, he will be back to complete his project on Lincoln Street. He stated that
nothing can be done as long as the proper permits are secured.
Concern was expressed regarding the present condition of the structure and property
which, in their opinions, could be classified as either a nuisance or dangerous building.
Councilor Sifuentez stated that she had received a call from a family who lives along N.
Front Street but is unable to park vehicles along Front Street due to the designated "No
Parking" area. She questioned if there could be limitations placed on the "No Parking"
area so that they could utilize the area on Sundays when they have family gatherings.
Director Tiwari stated that the area had been designated as "No Parking" in order to
provide kids an area in which they could walk safely to school. He suggested that the
property owner send a letter to his office requesting modification of the parking

restriction and staff will look into the traffic issue to see if there is an alternative
available.
Councilor Chadwick stated that she had attended the "Burning of the Mortgage"-at the
World's Berry Center Museum last Thursday and she was impressed with community
involvement in raising funds for the purchase of the building and maintenance of the
museum and volunteers to staff the museum.
Mayor Kirksey informed the public that the City has paid off the mortgage for the two
buildings which house the museum. Funds have been raised by dedicated community
volunteers to make the annual payments. She also stated that the museum is a recipient
of a $75,000 grant for a new roof.
Mayor Kirksey stated that she had attended the Mid Willamette Valley Transportation
Committee meeting last week and the City of Newberg has proposed a toll road from
Dundee to come across to McKay Rd then down along the Willamette River to connect
to I-5. The Committee objects to this proposal since it will increase traffic in other
areas of the county and it will take away many acres of farmland in order to build this
toll road.
Mayor Kirksey also stated that she had been approached by an individual who felt that
the City should have a 10-year plan for Legion Park which involves the removal of all
trees in the park since limbs could fall and hurt someone.
Mayor Kirksey stated that she will be out of town for 10 days traveling with her
grandson to Maine.
Councilor Jennings stated that he would be unable to attend the Open House at the North
Marion Resource Center on July 16th from 11:00 am to 1:30 pm.. Councilors Sifuentez
and Chadwick stated that they would try to attend the function.

The City Council provide a negative recommendation to the Oregon
Liquor Control Commission for liquor license approval of Mr. Ronald
Wiebe Jr.. This recommendation based upon factual information of
Mr. Wiebes' behavior and conduct prior to and during the application
process.
At the June 23rd, 1997 public hearing for transfer of ownership of the Raven Inn liquor
license it was revealed, through testimony, there may have been inaccuracies in the
information provided to the police department. As the police department relied upon this
information to provide a recommendation to the Council, it was requested the hearing remain
open and further investigation be completed. The applicant agreed to the continuation. The
Mayor has set the continuation hearing to be Monday, July 28, 1997. During the time
between June 23 and July 28, 1997 the police department has reviewed the testimony of the
June 23rd hearing, recontacted persons of involvement, verified and clarified statements that
were made.
Of Question were "incidents" that occurred at the Raven Inn and Last Chance. Upon review
of statements, recontacting witnesses and review of bar incident logs it is noted that, the
incidents did occur.

Of Question was whether or not Mr. Weibe was ordered to leave the Raven Inn and Last
Chance. Through recontacting witnesses it is noted that Mr. Weibe was ordered out of the
Raven Feb. 7, 1997, and owner Wiltsey did contact his father. Mr. Weibes father did relate
to Wiltsey that he, Mr. Weibe Jr. was taking lithium drug. It is noted that the incident
previously described at the Last Chance, that Mr. Weibe was not kicked out of the Last
Chance but left without disturbance.
Of Question was bartender Darlene Standridges' disappearance. Mr. Reed stated that Ms.
Standridge has disappeared after giving statements to the police. Upon recontacting Ms.
Standridge and questioning her again it is noted that she had discussed leaving the Raven to
work for another business and that she currently is working full time at a nursing home.
She, Standridge stands by her previous statements to police about the racial slurs and conduct
of Mr. Weibe on Feb. 7, 1997. It is interesting to note that on Feburary 6, 1997 Mr. Weibe
signed a initial orientation of OLCC laws that he knew he could not instruct or supervise
employees, nor could he go behind the bar when drinking alcohol. This would be as a
manager/owner. In statements made to Raven employees, Mr Weibe inferred that he was
buying the business and taking over. This would be in violation of OLCC rules, if he was
the owner/manager. Mr. Weibe signed this document the day before the incidents.
Upon reopening the Weibe liquor license investigation investigators obtained files from the
Addiction Counseling & Education Services Inc. The records revealed that Mr. Weibe
entered the program under court order stemming from the 1993 arrests involving the
domestic dispute. Mr. Weibe entered ACES Program in March 1994 and completed the
program in December 1994. During treatment it was noted that Weibe had allegedly
attempted to bribe the counselor on two different occasions, and that he had come to
counselling with alcohol on his breath. The final entry in the ACES's documents was that
Mr. Weibe should continue abstinence of alcohol and continue attendance of AA meetings.
At this time Mr. Weibe is not attending AA and from numerous witness statements Mr.
Weibe continues to drink alcohol.

incidents in February 1997 in which alcohol was a factor and
the reported medication affecting behavior. It is the
recommendation, the City Council provide a negative

The racist comments reportedly made by Wiebe Jr. along with
the alcohol abuse leads a reasonable person to believe that
Wiebe Jr. would not comply with laws and be not able to
control himself and responsibility of the business.

On 042197, I conducted a background investigation for a change
of ownership and liquor license for the businesp, "Raven Inn". The
business is located at 262 North Pacific Highway, Woodburn, Marion
County, Oregon. Information has been obtained regarding two
incidents at the business involving the Wiebe Jr that was not
provided at the time that initial report was completed.
On 062897, I re-opened the background investigation of the
above change of ownership and liquor license. I obtained a copy of
the recording made of the testimony that was given before the City.
of Woodburn Council meeting on June 26, 1997. Four persons,
Worster, Templeton, Barnett and Kamis, testified before the city
council regarding the above business change of ownership and liquor
license.
On 070197 I contacted Standridge, an ex-employee of the "Raven
Inn". Standridge stated all the information she had earlier
provided the Woodburn Police Department was the truth. Standridge
denied she just "disappeared" as stated by Wiebe Jr's attorney.
Standridge stated she had spoken with Wiltsey about quitting as she
had taken a position at a nursing home, and she was also managing
an apartment complex in Woodburn. Standridge stated the incident
involving the racial slur was separate from the incident involving
Wiebe Jr's verbal abuse of her. Standridge stated she was unaware
of the city council meeting and had she known would have been
present to state what had occurred. Standridge stated she did not
check Wiebe Jr and his female companion's identification as she did
not want him to become verbally abusive, and she knew he was over
the legal age limit. Standridge stated she became upset and began
to cry the night that Trevino came to the business, as Wiebe Jr
called her "stupid" and he was yelling at her for checking patrons
identification. Standridge stated when Wiebe Jr came into the
business when she was working, he would at first be very polite,
but that after he had consumed several alcoholic beverages he would
become verbally abusive to her. Standridge stated she had made an
earlier statement about Wiebe Jr being intoxicated. Standridge
stated she meant he was acting intoxicated due ~o his violent mood
swings, going from pleasant to verbally abusive. Standridge
reiterated her statement that Wiebe Jr did make a racial comment
the night of the boxing bout, Wiebe Jr stated "Turn down that
wetback music..."
On 070197, I contacted Wiltsey, the current owner of the
"Raven Inn". Wiltsey stated she had not changed her statement she
earlier had given to the Woodburn Police Department. Wiltsey stated
the incident that Standridge had called her, Standridge was crying
and she had contacted the manager/bartender of her other bar "The
Last Chance", to advised her of the incident at the "Raven Inn".
Wiltsey stated she spoke with Barnett, and stated Wiebe Jr had just
left the "Raven Inn" and he had made Standridge upset and that if
he came into "The Last Chance" to leave and not return until the
sale for the "Raven Inn" went through. Wiltsey stated she was told
by Wiebe Jr's father, when she spoke with him that night, Wiebe Jr

was not taking his lithium medication and that was the reason for
his behavior. Wiltsey stated again she had ordered Standridge to
"card everyone" as Wiltsey had heard bars were being checked by
O.L.C.C. for compliance. Wiltsey stated she was angry with Wiebe Jr
as he was telling her employees he had purchased the business and
ordering them about. Wiltse¥ stated she had called Wiebe Jr's
father to tell him to keep Wiebe Jr out of her bars until the sale
for the "Raven Inn" went through. Wiltsey stated when she advised
the Woodburn Police Department about the racial slur incident, she
was relaying what Standridge told her and she believed her
bartender. Wiltsey stated Wiebe Jr denied the incident and it
appears that Templeton was corroborating Wiebe Jr's assertion.
Wiltsey stated she had understood that Templeton was considering or
is considering taking a job as the bar manager for the "Raven Inn"
when Wiebe Jr became the owner.

On 070197, I contacted Worster at her place of business.
Worster stated she was present with Wiebe Jr and she accompanied
him to the "Raven Inn". Worster stated she and Wiebe Jr had stopped
at "The Last Chance" before going on to the "Raven Inn". Worster
stated she and Wiebe Jr had one beer at "The Last Chance" and Wiebe
Jr was not ejected by the bartender/manager. Worster stated the
manager of the bar got mad when Wiebe Jr was passing out his
business card for his business in Albany, Oregon. Worster stated
when she and Wiebe Jr got to the "Raven Inn" it appeared to her
Standridge singled Wiebe Jr out, and she was rude to Wiebe Jr.
Worster stated she and Wiebe Jr did not have their identification
checked, but all the other patrons did. Worster stated Wiebe Jr had
consumed three (3) beers at the "Raven Inn". Worster stated at
first she felt that Standridge was just checking identification on
the orders of Wiltsey who was trying to ruin Wiebe Jr's business,
but she later decided the bartender was just doing it as she was
angry. Worster denied Wiebe Jr was verbally abusive with
Standridge. Worster did stated Standridge did telephone Wiltsey
about Wiebe Jr. Worster stated she "was a personal friend of Ron's"
and she had known him for sometime.
On 070197, I contacted Barnett at "The Last Chance". Barnett
was the manager of the business and is a bartender at the business.
Barnett stated she recalled being telephoned by Wiltsey regarding
an incident that occurred at the "Raven Inn". Barnett stated
Wiltsey advised her Wiebe Jr had been causing problems at the
"Raven Inn" and had made the on-duty bartender, Standridge, upset
and she began to cry. Barnett stated Wiltsey advised her if Wiebe
Jr came into the business, she was to tell him to leave the
business and not return until the sale of the "Raven Inn" was
completed. Barnett stated she told Wiltsey that Wiebe Jr had just
left the business. Barnett stated Wiltsey called her back less than
five minutes after Wiebe Jr left and stated Wiebe Jr had been
complaining about her, that she had been rude to him. Barnett
stated Wiebe Jr was acting arrogant and he had been passing out his
business cards to the other patrons. Barnett stated she overheard
Wiebe Jr telling the patron he had just bought the "Raven Inn" and
he was planning to get a hard liquor license and serve steaks at
the bar. Barnett stated Wiebe Jr was offering discounts on
electronic equipment at his business in Albany, Oregon and telling

the patrons to come to see him at the "Raven Inn". Barnett stated
Wiebe Jr had a female companion with him and Wiebe Jr ordered and
consumed one (1) beer. Barnett stated she has been employed as a
bartender for over fifteen (15) years, and that based upon her
experience and the odor of an alcoholic beverag9 emanating from
Wiebe Jr's breath it was evident to her that Wiebe Jr had been
consuming alcoholic beverages. Barnett stated Wiebe Jr asked her to
make a telephone call for him. Barnett refused and told W£ebe Jr
use the pay telephone in the bar. Barnett stated Wiebe Jr told to
her that she had a telephone right behind her. Barnett stated she
told Wiebe Jr "You may have bought the Raven, but you didn't buy
this bar." Barnett stated Wiebe Jr later made a comment that she
would never work for him, and Barnett stated she retorted "You
couldn't pay me enough to work for you." Barnett stated Wiebe Jr
and his female companion then got up and left the bar. Barnett
stated Wiebe Jr came into the business one other time that she was
present and just spoke a few minutes with Wiltse¥ and left.
On 070297, I contacted Tucker. Tucker stated she was present
at the "Raven Inn" on the night that Wiebe Jr appeared to become
upset and caused Standridge to lose her composure. Tucker stated
she did not see Wiebe Jr come into the bar. Tucker stated she
noticed Wiebe Jr walked behind the bar counter. Tucker stated no
patron is allowed behind the bar counter, but Wiebe Jr just walked
behind the counter and began to have an argument with Standridge.
Tucker stated Wiebe Jr appeared to be visibly upset and he was
waving his arms around, pacing and shaking his finger at
Standridge. Tucker stated she could not hear the entire
conversation as the music in the bar was very loud. Tucker did
state Wiebe Jr was upset with Standridge about Standridge checking
the identification of two patrons. Tucker stated Standridge later
told her that Wiebe Jr was buying the bar and he was giving her
orders that were in direct conflict with what the current owner
told her to do.
On 070297, I contacted Trevino. Trevino is a bartender at the
above business. Trevino stated she received a telephone call one
night from Wiltsey directing her to go to the "Raven Inn" and
ascertain what was going on. Trevino stated Wiltsey told her
Standridge was upset and crying. Trevino stated she went to the
"Raven Inn" and Standridge was upset and crying. Trevino stated
Wiebe Jr was in the business at a table drinking alcoholic
beverages with Templeton and a female adult. Trevino stated
Standridge told her that Wiebe Jr had yelled at her and called her
stupid. Trevino stated while she was present trying to calm
Standridge down she observed Wiebe Jr consume one or two budweiser
beers~ Trevino-stated Wiebe Jr was sitting at a table with a female
adult and Templeton. Trevino stated Wiebe Jr has come into the
business while she was working on several other occasions and had
consumed two or three beers each time. Trevino stated the only time
that Wiebe Jr wouldn't drink was when he was with his father, Wiebe
on 070297 at 1748 hrs I left a message for Kamis to contact me
at the Woodburn Police Department. On 071197 at 1328 hrs I again
attempted to contact Kamis, but no one was at home. As of this

date/time Kamis has made no effort to contact me.
On 071097 at 1346 hrs I contacted Wiebe Jr at the Woodburn
Police Department. Wiebe Jr stated he did not yell or become upset
at Standridge in the business. Wiebe Jr denied he was intoxicated,
but stated that he had consumed up to three (3)' beers that night at
the Raven Inn. Wiebe Jr stated the alleged incident involving a
racial slur did not occur. Wiebe Jr stated he was at the bar that
night and Templeton was present in the business. Wiebe Jr stated he
just wanted Standridge to turn the volume on the television up as
there was boxing bout on, and turn the volume down on the juke box.
Wiebe Jr stated he did not demand free beer, but that he requested
to run a tab and pay for his bill at the end of the evening. Wiebe
Jr stated he consumed three to four beers that night. Wiebe Jr
stated he has no current plans to obtain a hard liquor license for
the business, but after renovating the business, that he may
consider attempting to obtain a hard liquor license for the
business. Wiebe Jr signed an authorization for the City of Woodburn
to obtain a copy of his treatment records from his alcohol
treatment in 1994.
On 071097 at 1557 hrs I contacted Templeton. Templeton stated
he was present the night of the boxing match. Templeton stated
Standridge and Wiebe Jr did not have a yelling or shouting match.
Templeton stated Wiebe Jr did not make any racial comments at that
time or any other time that Templeton was in the bar with Wiebe Jr.
Templeton stated the night of the boxing match that he observed
Wiebe Jr consume three beers. Templeton stated he did hear Wiebe Jr
refer to Standridge as a "bitch". Templeton stated each time that
he was in the "Raven Inn", and Wiebe Jr was present that he
observed Wiebe Jr consume between three and four beers. Templeton
stated he and Wiebe Jr had discussed a managers position at the
business, but Templeton declined as the salary was too low.
On 071097 I submitted a copy Wiebe Jr's signed authorization
to the A.C.E.S. treatment facility in Corvallis, Oregon requesting
a copy of Wiebe Jr's treatment records.
On 071497 at 1544 hrs I received a fax from A.C.E.S. regarding
the treatment and prognosis on Wiebe Jr. I have reviewed the
documents, on 033094 and intake appointment shows that Wiebe Jr
admitted to consuming three (3) to six (6) beers two to four times
weekly. During the interview after Wiebe Jr was advised his
treatment would be eighteen (18) weeks, Wiebe Jr brought up the
subject of bribing the counselors to shorten his treatment program.
On 062994 Wiebe Jr again attempted several times to "bribe" the
counselors to relive him of the treatment program goals with offers
of money. The attempts at bribery are noted at two different
locations within the treatment documentation. On 080194 and 080294
two different counselors detected an odor of an alcoholic beverage
on Wiebe Jr's breath at the treatment facility. On 080194 Wiebe Jr
admitted to consuming "one beer fifteen minutes prior to leaving"
for the treatment facility. When confronted by the counselor
regarding his disregard for violating his court ordered diversion
agreement, by drinking and driving, Wiebe Jr denied any wrong
doing. On 080594 the staff recommended Wiebe Jr begin anabuse

treatments immediately and to extend his treatment. On 080894 Wiebe
Jr was informed of the staff decision, and Wiebe Jr stated he would
refuse anabuse or a treatment extension. Wiebe Jr stated A.C.E.S.
had no proof, he was still consuming alcoholic beverages and
violating his court ordered diversion agreement. Wiebe Jr was
advised the extension and anabuse treatment wasj based upon his
admission and observations of two counselors. Wiebe Jr stated he
would deny admitting to consuming alcoholic beverages and would so
state in a court of law. As Wiebe Jr left the meeting he stated
"Fuck You". On 081794 Wiebe Jr had a meeting with a manager at
A.C.E.S. regarding his refusal to start anabuse treatment and have
his treatment extended. When asked by the manager why Wiebe Jr did
not want to take the anabuse Wiebe Jr stated "Because I don't want
tol~" On 122894 Wiebe Jr stated he was "a little bit" of an
alcoholic. On 122894 Wiebe Jr signed a document called an
AFTERCARE PLAN, which was consigned by a counselor, stating he
agreed to long term abstinence.
On 071897 I obtained a copy of Wiebe Jr's service permit from
O.L.C.C. investigator Forbes. The service permit was issued on
041897. Prior to the service permit being issued on 020697, Wiebe
Jr, signed a document called INITIAL ORIENTATION OF OLCC LAWS AND
RULES. The document lists a section on prohibited conduct which
includes section "A" drinking on duty. Investigator Forbes stated
she went over a booklet called Law Orientation with Wiebe Jr on
020697 and specifically drew his attention to the O.L.C.C.
definition of Drinking on Duty. This definition states in part "A
work shift that involves the sale and service of alcoholic
beverages" includes supervising those who sell or serve, check
identification or control the premises.
On 072197 at 1725 hrs I again contacted Wiebe Jr regarding the
incident on 020797 at the "Raven Inn" with Standridge. Wiebe Jr
stated he did not go behind the bar counter. Wiebe Jr stated he was
not acting in a owner or manager capacity when he was telling
Standridge, she should not check identification of all patrons
altering being told to check identification of all patrons by the
current owner Wiltsey. Wiebe Jr stated he recalled Investigator
Forbes of O.L.C.C. going over the Initial Orientation of O.L.C.C.
Laws and Rules on 020697, and he signed the form acknowledging the
O.L.C.C. rules were explained by Investigator Forbes.

STATEMENT
My name is Darlene Faye Standridge. My date of birth is 05-30-
SS. I live at 367 Nest Clevel&nd Street #6, Woo4burn, Oregon. My
telephone number is (503) 982-7434. I am giving this statement
freely and voluntarily to Detective C.A. Cunninghamof the Noodburn
Police Department.
In February 1997, I was working as a bartender at the Raven
Inn. I was working the evening shift at the bar. I was the only
employee on the premises. A man came into the bar and I asked to
see his i.d. Tina, the owner told me to ask everyone for their i.d.
I was just doing what I was told. The guy said "I don't have to
show you i.d. I own the fucking place!!" The man was very angry
when I asked for his i.d. Another bartender, Noe Trevino, came in
later and she told me that I should just let the incident go,
because the guy was the new owner.
The guy was drinking beer. The guy was drinking 16 ounce
beers. The guy had two beers and he seemed okay, and then he had
another one and he just got angry and started yelling obscenities.
I carded an woman that came in and she didn't have i.d. I told her
that if she didn't have i.d. she had to leave. Then the guy jumped
up and ran over to the woman and brought her back in. The guy said
I didn't have to ask her for her i.d. I told him that that was
Tina's policy, and he said "I'm fucking owner, and what I say
goes!!" I told him that he would have to take it all up with Tina.
The guy pulled out his cellular telephone and called up Tina.
Tina got mad and she ended up coming down to the bar that
night. The guy had been demanding more beer. The guy had four
beers, and he wanted more. The guy wanted me to put the beer on a
tab. I told him that he would have to pay for the beer, as he
bought it. The guy said "I'm the owner and what I say goes!!" I
said that Tina was the owner, and he should take it up with her.
Tina came into the bar and she started to yell at the man. The
guy was yelling at Tina. Tina said to me "If he can't handle it,
then don't sell him anymore." Tina told me that he was not the
owner, but that the guy was in the process of trying to buy the
place. Tina ended up calling the guys father and the guys father
called him and told him to leave the bar, and to leave the workers
at the bar'alone. The guy got mad and wanted to know who called his
father. Tina left and I wouldn't sell the guy anymore beer, he was
mad that I wouldn't sell him anymore beer.

MEMORANDUM OPINION NO. 97-03

ANNEXATIONS UNDER BALLOT MEASURE 50
DATE: JULY 21, 1997
BACKGROUND:
At the last City Council meeting, an agenda item was considered that involved a proposed future
annexation of property. After a brief discussion by the Council, this matter was tabled until a
legal opinion could be obtained.
Specifically, I was asked to research what impacts the recently passed Ballot Measure 50 would
have on city annexations. Since the matter is important to the Council and time-sensitive because
of the tabled agenda item, I have expedited this opinion.
Ballot Measure 47
Ballot Measure 47 was passed by the voters in November 1996, by initiative petition. It changed
the Oregon property tax system to focus upon individual tax bills for specific properties. It also
superseded the tax uniformity provisions contained in the Oregon Constitution so that the
property tax that could legally be collected on newly annexed property would normally be less
than what would have been collected under the city's tax rate. Although there was an exception
contained in the ballot measure for property improvements, the overall effect of Ballot Measure
47 (possibly unintended by its drafters) was to make certain annexations fiscally unattractive to
cities.
Ballot Measure 50
Ballot Measure 50 was crafted by the Oregon Legislature, in an extremely political atmosphere,
for the announced purpose of clearing up the wording contained in Ballot Measure 47. Ballot
Measure 50 contains some provisions that are identical to Ballot Measure 47, some provisions
that are similar to but different from Ballot Measure 47, and some entirely new provisions. To
further complicate matters, the legislature has enacted an involved statute (Senate Bill 1215) for
the purpose of implementing Ballot Measure 50.

Annexations Under Ballot Measure 50
As to annexations, Ballot Measure 50 contains none of the problematic language of Ballot
Measure 47. In fact, Ballot Measure 50 does not address annexations at all. What is clear,
however, is that upon the passage of Ballot Measure 50, all of the problematic language of Ballot
Measure 47 was repealed.
Simply stated, city. annexation law under Ballot Measure 50 exists as it was prior to the original
passage of Ballot Measure 47. When an annexation occurs, the city's existing tax rate is applied
to the newly annexed property. Moreover, the implementing statute passed by the legislature
(Senate Bill 1215) is consistent with this procedure.
CONCLUSION:
While it was certainly prudent for the City Council to request a legal opinion on this important
topic, I can find nothing in Ballot Measure 50 nor its implementing legislation, that creates a legal
problem for the city in applying the city's tax rate to newly annexed property.

RECOMMENDATION: It is being recommended that the city council approve the request for
connection to city service, domestic water and sanitary sewer service to property currently
located outside the city boundary, at 1570 East Blaine Street. The approval is subject to the
following conditions.
l.The property be annexed into the city, the process is to begin prior to service being
provided ( see attachment "A", the properly signed annexation application ).
2. Sign non-remonstrance consent form for improvements on the future extension on East Blame
Street( which is currently a private drive but may be public in the future) and Aztec Drive.
3. The existing subsurface sewage disposal system and domestic well shall be abandoned in
accordance with state regulations.
4. At such time service can be provided from East Blame Street, the connection being allowed
from Aztec Drive shall be removed and installed from East Blaine at the owner's expense.
5. All applicable fees be paid by the property owner.
BACKGROUND: The owner of the existing residence located at 1570 East Blaine Street has
requested to be allowed to connect to city water and sanitary service. The property is currently
not located within the city boundary and is now supplied water service by an existing on-site
private well, sanitary service is being provided by an on-site subsurface sewage disposal system
which has failed and may have contaminated the existing well.
At this time, the city has no facility to provide either requested service from East Lincoln Street
currently operating as a private access. The configuration of the property does allow however the
existing structure to be provided service from Aztec Drive. See attachment "B".
For council's information, in addition to the annexation application provided, the owner has also
made application to develop, partition separate parcels for single family residential use, this
however is being reviewed through the site plan review procedures and process.
Due to the length of time required, this is being brought before the council prior to the
completion of the annexation, so that the connection can be made and eliminate the potential
health hazard.

WHEREAS, the City/County Insurance Services Trust (CIS)
offers pooled self-insurance offering cost stability and the potential
for long-term savings, and
WHEREAS, CIS is sponsored by the League of Oregon Cities and
the Association of Oregon Counties as a service to Oregon cities and
counties, and
WHEREAS, the City of Woodburn finds that membership in CIS is
of benefit in managing the risks involved in providing services to its
citizens, and
WHEREAS, the City of Woodburn has been provided with an
opportunity to review the Trust Agreement, Bylaws, and Rules of CIS,
and
WHEREAS, the City of Woodburn has submitted the Trust
Agreement, Bylaws, and Rules to its legal counsel to review for
compliance with the Charter and Ordinances of the City of Woodburn,
now, therefore
THE CITY OF WOODBURN RESOLVES AS FOLLOWS:
Section 1. That the City of Woodburn does hereby enter into
a contract with CIS and becomes a member of the CIS Trust for General
Liability and Automobile Liability for a three-year period commencing
July 1, 1997 and agrees to abide by the terms of the Trust Agreement,

RECOMMENDATION: Approve accompanying Council Bill (Resolution) authorizing
amendment to Chemeketa Cooperative Regional Library Service (CCRLS) contract.
BACKGROUND: Please refer to attached memorandum from Linda Cochrane,
CCRLS Coordinator.
The City annually approves a contract amendment of this nature to reflect the
CCRLS budgetary circumstances for the given year. Last year the entire contract was
updated and re-approved by each participating city.
As noted in Ms. Cochrane's memo, the amendment involves two changes. The
first, the 6% increase in use-based reimbursement, will be of direct benefit to the
City. The second change described will probably not benefit Woodburn, as we have
gradually become what would be termed a "net borrower" from other participating
libraries.
The balance of Ms. Cochrane's memo describes the prospect of a subsequent
contract amendment possibly next fall. The Library Director and myself will be asking
that a council workshop be scheduled at some point so that the issues involved can
be fully explained and discussed.
Staff recommends approval of this resolution.

Attached is your intergovernmental agreement contract amendment for FY 1997-98 with
Chemeketa Community College for Chemeketa Cooperative Regional Library Service. There are
two changes in the contract. Both have been approved by Polk, Yamhill and Marion (PYM)
librarians as well as the CCRLS advisory committee.
The first change is a six percent increase in the use-based reimbursement for serving non-city
patrons. The total budget available to be paid to the eighteen participating libraries increases
from $588,300 to $623,598.
The second change is implementation of a new payment for lending materials to patrons at other
libraries. Cities will be reimbursed if they lend more materials than they borrow. Forty-five
thousand dollars has been earmarked for this payment.
In the autumn you should expect an additional amendment to this Intergovernmental Agreement
Contract. This amendment will reflect policy changes being discussed by the CCRLS advisory
committee, a CCRLS equity task force, PYM librarians, and the Chemeketa College Board. The
changes affect service to those CCRLS district residents outside the 17 cities participating in
CCRLS. (Holding these changes until the fall allows cities time to request permission of voters
for fees, if they wish, and to notify patrons in advance of change of services.) At its June 20
meeting, the CCRLS advisory committee moved for adoption of the following concepts:
The 1997-98 CCRLS contract with member cities/districts/contracting entities
will include wording defining a basic level of service provided at no additional
registration change to residents outside contracting entities. This level would

allow one check-out and one hold per person at a time, utilizing individual rather
than household cards.
The 1997-98 CCRLS contract will have wording that cities/districts/contracting
entities will abide by the (yet to be determined) policy of the CCRLS advisory
committee regarding geographic designation of service areas within the CCRLS
district.
The 1997-98 CCRLS contract will have wording that cities/districts/contracting
entities will abide by the (yet to be determined) policy of the CCRLS advisory
committee regarding phase in of optional fees for service above the basic level. If
a city decides to charge for service above the basic level .the recommended fee is
$15.00 per household. Each contracting entity shall notify each current non-
resident card holder within its geographic zone at least 30 days prior to
instituting a fee for service above the basic level.
Representatives of interested parties will work through the summer to develop pertinent
recommendations to be submitted to the CCRLS advisory committee. Please contact me or any

INTERGOVERNMENTAL AGREEMENT CONTRACT AMENDMENT
This amendment is made and entered into the day of July, 1997, by and
between CHEMEKETA COMMUNITY COLLEGE hereinafter called COLLEGE and
WOODBURN, OREGON, an Oregon municipal corporation, hereinafter called the CITY.
Addendum number one (1) to odginal contract number 08997.
The contract entered into on November 13, 1996, between the COLLEGE and
CITY shall be amended as follows:
2.0 COMPENSATION, point 2.1 is changed to read as follows:
The COLLEGE will make the following payments to the CITY as compensation
for the CITY providing nonresident library service for the residents of the
COLLEGE District. Payments in 1997-98 shall be based on circulation and
renewals of CITY materials as counted by the CCRL$ automated integrated
library system. CITY shall be reimbursed for each circulation and renewal of its
materials to district residents outside its CITY boundaries, but within the
COLLEGE district. Of the $623,598.00 designated for reimbursement among
CCRLS libraries in 1997-98, $155,899.50 shall be paid each quarter. CITY'S
share of each quarter's reimbursement shall be computed based upon its
percentage of the total circulations and renewals made that quarter by CCRLS
libraries to district residents.
2.0 COMPENSATION, subsection point 2.2 is added which reads as follows:
The COLLEGE shall pay the CITY for each net loan provided, i.e., the difference
between the number of CITY items loaned to and checked out in another library
and the number of items owned by other libraries borrowed and checked out by
the CITY library. Tabulation of net loans shall be provided by the CCRLS
automated integrated library system.
A budget of $45,000 shall be designated for this program for 1997-98 with
$11,250 budgeted each quarter. The CITY shall be paid its pro rata share on a
quarterly basis.
In pedorming the above, it is understood and agreed that all other terms and
conditions of the original contract are still in effect.

not be effective until approved by the appropriate representative of the parties hereto.

I~ECOMMENDATION: Approve accompanying Council Bill (resolution) establishing
1997-98 non-union employee compensation, including salary and benefit adjustment.
BACKGROUND: Every June or July a resolution is presented for council approval
which outlines the compensation for the above-referenced employee groups during the
ensuing fiscal year.
The accompanying resolution formalizes the decisions made in motion form by
the city council at the regular June 9, 1997 meeting, in respect to management,
supervisory and full-time non-union employee compensation.
Modifications to the part-time employee schedules reflect the continuing series
of incremental increases in the state minimum wage. Some of these positions (bus
drivers, etc.) also reflect the 3% cost-of-living adjustment that was applied to the full-
time, employee matrix.

RESOLUTION NO.
A RESOLUTION ESTABLISHING 1997-98 NON-UNION EMPLOYEE COMPENSATION,
INCLUDING SALARY AND BENEFIT ADJUSTMENT.
WHEREAS, the 1997-98 budget for the City of Woodburn has
been appropriated per Ordinance No. 2195, and
WHEREAS, the City Council has reviewed the pay plan and
benefit compensation recommendation of the City Administrator as
required by Rule 9 of the City's Personnel Policy and Procedure
Manual; and
WHEREAS, the City Council is obligated per Section 11 of
the Woodburn City Charter to establish compensation for each City
officer and employee; NOW, THEREFORE,
THE CITY OF WOODBURN RESOLVES AS FOLLOWS:
Section 1. The salary range schedules for all
management/non-union employees attached hereto as attachment "A" is
hereby adopted effective July 1, 1997.
Section 2. The salary range schedules for all non-union
(part-time and seasonal) employees attached hereto as Attachment
"B" are hereby adopted effective January 1, 1998.
Section 3. During fiscal year 1997-98, full-time
management/non-union positions are subject to the following
conditions as previously adopted by the City Council on June 9,
1997:
A) A 3% Cost of Living Adjustment (COLA), effective July 1,
1997, shall be applied to the range/step schedule
("matrix") previously approved by the City Council on
November 12, 1996.
B) The salary of any affected employee who received a salary
adjusting correction November 12, 1996 that exceeded 4%
over what they had been receiving prior to that date
("budgeted amount") shall be frozen at its current amount
("redlined") for Fiscal Year 1997-98.
C) For the duration of Fiscal Year 1997-98, no employee's
salary shall move into the established "Merit Range"
portion of the revised range/step schedule.
D) The preceding considerations shall apply to all full-time
city employees who fall within the group traditionally
categorized as "Management & Non-Union".
Section 4. Step increases for full-time management/non-
union positions included in the Competency/Merit Salary Structure
will be held in abeyance during Fiscal Year 1997-98.

Section 5. Compensation benefits including, but not
limited to, medical premium coverage (LOC Plan V/S100 deductible),
dental premium coverage (LOC Plan II), long term disability, life
insurance, retirement, deferred compensation, leave allowances, and
incentive adjustments are hereby maintained at current service
levels adjusted for premium increases or decreases in accordance
with agreed upon distributions as contained within the fiscal
appropriations of the City of Woodburn.

applicants, proposed manager and the business. Mendoza's currently have another business
in Hillsboro similar to the Woodburn store. The department has checked with OLCC and
Hillsboro Police regarding the Hillsboro store finding no significant reports.
Recommendation
In the absence of negative information regarding the applicants the police department
reconunends applicants receive a positive endorsement from the City Council for a package
store liquor license, new outlet.

1. Criminal History:
R. Mendoza had four arrests in Oregon, beginning in 1979 and
the last arrest is in 1989. R. Mendoza was arrested in 1979
for Assault IV, but no complaint was filed. R. Mendoza was
arrested in 1983 for Driving Under the Influence of
Intoxicants, was convicted and placed on two years bench
probation. R. Mendoza was arrested in 1984 for probation
violation, he was incarcerated for two days and probation was
extended for two years. R. Mendoza was arrested in 1989 for
Driving Under the Influence of Intoxicants and harassment. R.
Mendoza was convicted of the D.U.I.I. charge and the

R.Mendoza has a valid Oregon operator's license. R. Mendoza
was involved in a collision in 1987. The records for that
collision were purged by Oregon Department of Motor Vehicles.
R. Mendoza was suspended in October and November of 1989 for
D.U.I.I. and refusing a breath test. R. Mendoza was required
to have an ignition interlock device installed from 1990 to
1991. R. Mendoza license was suspended in 1992 by D.M.V. for
fail to furnish proof of financial liability, the license was
reinstated on 112492. R. Mendoza's license shows a six (6)
conviction for a traffic violations. The only convictions for
over @$50.00 that could be located are in Municipal Court-
N~wb~rg in 1993, for violation of basic rule in the amount of
@$100.00. In Municipal Court-Hillsboro of the two listed
convictions in 1992 & 1994 no record exists. In the conviction
in District Court Umatilla County in 1991, no record exists.

business. I located a total of two hundred and sixty six (266)
incidents that the Woodburn Police Department responded too in
the area surrounding the new business. The incidents include
a total of fifty (50) illegal controlled substances possession
and sales, a total of twenty four (24) assaults, seven (7)
disorderly conducts incidents, eighty one (81) suspicious
persons/vehicles, sixty two (62) disturbances, twelve (12)
fights, twenty five (25) incidents involving liquor law
violations, three (3) incidents involving weapons and two (2)
robberies.
SUMMARY:
On 061897, I completed a background investigation for a liquor
license for the business "Su Casa Imports". The business has moved
from 583 North Front Street to the new location of 297 North Front
Street. When the business was located at 583 North Front Street,
no liquor license was requested and no sales of alcoholic beverages
occurred. The business address of 293 North Front Street is the
address used by the business "La Linda's Restaurant & Bar". The new
location of "Su Casa Imports" is the same building as the old
business "La Linda's Restaurant & Bar" was in, however the new
owners are using an address of 297 North Front Street.
The new business location of "Su Casa Imports" at 297 North
Front Street is located in an area designated as the Downtown
Historic District. I have attached a copy of the Woodburn city

ordinance governing that use of that area.

I located the above listed calls for the service that the Woodburn
Police Department responded at the business and in the area
surrounding the new business.
I contacted I. Mendoza, she stated that the business manager
will be Aguilar. I. Mendoza stated that no inside seating will be
available. I. Mendoza stated that no consumption of alcoholic
beverages on the premises will be allowed. I. Mendoza stated that
the times the business will be open is 9:00 am to 8:00 pm. I.
Mendoza stated that no entertainment will be offered. I. Mendoza
stated that she or R. Mendoza will be coming down to the business
two to three times a week, and meet with Aguilar.
I checked the attached personal history documents submitted by
I. Mendoza and Aguilar and they appear to be in order. I located
the above information regarding I.Mendoza and Aguilar. I checked
the business documents that were submitted by I. Mendoza and R.
Mendoza regarding the above business and they appear to be in
order.
The personal history document submitted by R. Mendoza did not
list his last arrest for D.U.I.I. & Harassment in 1989, the arrest
in 1979 for Assault IV, the arrest in 1984 for probation violation,
nor did it list as required any traffic violations that resulted in
a fine of over @$50.00. R. Mendoza's Oregon operator's license
shows six separate convictions for various traffic infractions. I
was advised by I. Mendoza that R. Mendoza was currently in
California, therefore I requested that when R. Mendoza returned
that I. Mendoza advised him that a supplemental to his personal
history would need to be completed.
On July 1, 1997 I sent a letter to R. Mendoza regarding a
request for further information and documentation of the D.U.I.I.
arrests and traffic violations. On July 2, 1997 the Woodburn Police
Department received a copy of a document submitted to Investigator
Forbes of the O.L.C.C. regarding the above information. R. Mendoza
stated that it was negligence on his part for not listing the
required information. R. Mendoza did not address the traffic
violations as requested in my letter and a letter submitted to R.
Mendoza by Investigator Forbes.
On July 7, 1997 I contacted I. Mendoza, she stated that had
received my letter and demanded to know if I had received copies of
the information that she had provided to Investigator Forbes. I
stated that I had received that information on 070297. I requested
that R. Mendoza just attempt to provide additional information
regarding the traffic violations that a fine of over @$50.00 was
imposed. I. Mendoza stated that she would attempt to obtain that
information and get a copy to the Woodburn Police Department as
soon as possible.
I contacted the listed agencies in regards to I. Mendoza, R.
Mendoza, Aguilar and the Su Casa Imports corporation and the above

The Woodburn City Council provide a favorable recommendation for the New
Outlet Class "C" liquor license to the Oregon Liquor Control Commission for
the business of Lupita's, Mr. Martin Ochoa with the described and agreed to
Compliance Action Plan provided by applicant Ochoa.
Applicant Ochoa begin the application process in December 1996. Since that time there have
been numerous conferences between applicant the OLCC and Woodbum Police. A Class
"C" license is described as one that there is no bar. All alcohol will be stored, mixed and
served from the kitchen area.
The police department has completed an extensive background investigation of both the
applicant, Ochoa and proposed Manager Armando Ochoa. No criminal histories were
located. The Hillsboro Police, Washington County Sheriff and Oregon Liquor Control
Commission were also contacted regarding Ochoas. No incidents or criminal investigations
were mentioned.
As Mr. Ochoa has no prior experience with a liquor by the drink license, and as the
downtown area which the license is proposed has a history of drinking in public, drag
violations, noise and disorderly violations.

It was requested that applicant provide a Compliance Plan showing that the applicant will
take extra measures to assure the safety and security of the citizens and patrons.
Mr. Ochoa has provided a nine (9) point compliance plan which would limit alcohol
consumption of patrons, not allow live band music and limit the hours of service. Applicant
has been cooperative with both the Woodburn Police and OLCC throughout this process. *
· Note: The Oregon. Liquor Control Commission cannot attach this compliance plan as
restrictions to the issued license.
Within the last two years two liquor licenses in the downtown area have been either canceled
or turned in. La Linda's was canceled by the OLCC and El Nopal turned in their license
because the business burnt down. The issuance of a liquor license to Lupita's would provide
a third licensed establishment in the downtown area. With the controls volunteered by
applicant it is the recommendation of the police department that the license requested be
provided a favorable recommendation.

I completed a background investigation for a liquor license
for Lupita's Restaurant Taqueria located at 311 N Front St.
Woodburn Oregon. The new business is located in the downtown
hlstorlc district.

thoughts regarding Lupita's selllng alcoholic beverages wlth
food.
i contacted Martin Ochoa who advised me he was going to be
the manager of LupLta's and would be on the premises during all
buslness hours. He stated he wanted to obtain a Llquor Llcense
in order to sell alcoholic beverages ulth hls customers meals.
Martin Ochoa advised me that from time to time he was planning on
conducting private parties for occasions such as baptisms, Flrst
Communions and Oulnce Aneras. He stated that he would never
serve alcohol in excess because he does not want to cause
problems. He advlsed he was only looklng to please hls customers
due to the fact he has received so many requests for drinks wlth
food.
During the background investigation of Martin Ochoa I found that
he had at one time been a partner wlth hls brother Carlos Ochoa
in a lunch truck operation out of Hillsboro Oregon by the name of
Taquerla Ochoa. Martin Ochoa advised me he had glven hi$ brother
Carlos Ochoa his lnterest in the buslness when his brother gave
hlm the loan of $20,000 for the new restaurant (Lupita's).
I conducted a criminal background on both Martin Ochoa and his
brother Carlos Ochoa, nothing was found. Z contacted Hlllsboro
Pollce Department Record Divislon and found no record of elther
subject havlng been contacted by pollce.
Since Taqueria Ochoa was a joint-run Business with Martin Ochoa
and his brother Carlos Ochoa, I checked with the Hillsboro Health
Department for any complaints or incidents. Agaln nothlng was
found.
I conducted a records scan for incidents that the Woodburn Police
Department responded to or initiated, for the area surrounding
Luplta's Restaurant Taquerla. I located a total of sixty-one

Parr Road improvement had been divided into two contacts so that the walkway to the school
could be completed prior to its opening.
CONTRACT "A" ( Storm Sewer Work)
The Construction on the Parr Road Street Improvement project was started in June, with the
contract award of the storm sewer main, SeharffBros. the contractor awarded the contract is
installing the storm sewer and has completed all but the west 250 feet. This section is being
delayed due to utility grade conflicts. The contractor will be allowed several extra days to
complete the installation and make the proper utility adjustments, the extended time will not delay
the completion of the street surface improvements.
CONTRACT "B" ( Street Work, Including Sidewalk and Bikepaths)
The contract for the remaining portion of the project, street, sidewalk and bike path
improvements was awarded to D & D Paving the end of June. The construction started the first
week of July with clearing and grading and relocation of franchised utilities. The construction has
been delayed with problems encountered with the relocation of some of the utilities. ~Jhg. ggh.iI
appears difficult_, staffexp_ ects that the sidewalk network to be completed prior to the School
opening on August 18.
The entire project is not intended to be completed prior to the end of October, 1997.

Impact of Developments on Proposed Irrigation of Woodland Avenue
Landscaped Median

At the July 14, 1997 council meeting a request was made by an area resident to
explore means of providing water to support an increased level of landscaping on the
Woodland Avenue median just north of its intersection with Highway 219.
There is a considerable amount of proposed development activity in the northwest
quadrant of the I-5 interchange that will probably have an effect on the section of
Woodland Avenue just north of Highway 219. Hershberger Motors has proposed an
automobile dealership along Arney Road. The developer of the factory outlet mall has
started earthwork on the site of this development located directly north of the
proposed auto dealership.
ODOT has stated that traffic from these developments will utilize Woodland as the
primary access point and that Woodland's intersection with Highway 219 would
require signalization. The existing Arney Road may have access restrictions placed
on its intersection with Highway 219. With improvements required of Waremart and
Hillyer's Ford along Highway 219 there will be a five lane section between Woodland
and the interstate. This would dictate that there be dual left turn lanes from
Woodland onto Highway 219. These facts indicate that with the development
occurring and resulting increased traffic loads there will be changes required to the
configuration of the Woodland Avenue median and potentially the roadway itself prior
to the opening of these two commercial developments.
Although water could be supplied to the median, the proper time to address median
landscaping issues would be after staff, in cooperation with ODOT and the
developers, have developed final roadway plans.

RECOMMENDATION: That the city council, authorize by motion, pursuant to city
ordinance, solicitation activities and waiver of permit fees for fundraising by United
states Mission of Portland, Oregon.
BACKGROUND; Today I received a telephone call, followed by a fax, from Brian
Jones, Administrator of the United States Mission (see attached) notifying the city of
that organization's intent to conduct soliciting activities in Woodburn.
Ordinance 1187, Section 2(e), requires that religious, non-profit and similar
organizations apply to the city council for waiver of established solicitor's license
investigation and permit fees. Such requests have periodically forwarded to the
council from organizations such as OSPIRG and others. United States Mission
apparently contacted the city in 1995 in a similar regard, but due to an administrative
mixup it appears that the request may not have gone to the city council. It is equally
unclear as to whether the group did, in fact, actually conduct solicitation activities at
that time.
Due to a mid-1980's Supreme Court case, "Purcell v. Hillsboro", the city has
taken a position of simply acknowledging contacts by such organizations when they
are clearly religious in nature. It was unclear from the material submitted whether
United States Mission is in fact a religious organization. However, upon contacting
the Department of Justice this afternoon, we were advised that this organization is
exempt from registering with the Department because they are classified as religious
in nature. Also, since they are not registered, the Department does not track
complaints that may be made against this organization.
As noted in the attachment, solicitation activities will be confined to two
individuals. Requested solicitation hours are 2-8 p.m. Monday - Friday and 1-7 p.m.
on Saturdays.

Pro_oosed Workshop on Ballot Measure Priorities

In my capacity as Interim Recreation & Parks Director, I am sympathetic to the
desire of the community to bring Centennial Park to reality. In spite of everyone's
best intentions, however, we are still plagued by the same problem that has always
impeded significant progress with the park ..... lack of adequate funds. The price
tag for a fully constructed Centennial Park was pegged several years ago at $1.2
Million. As costs go up, this figure has likely increased in the intervening years.
I have researched the possibility of a General Obligation bond issue to finance
the construction of the park. Due to the city's rapid growth and increasing value over
the past several years, I was pleasantly surprised at the numbers. For example: A
$1.5 Million bond issue, repayable over 15 years at current bond interest rates,
factored against the post-Measure 50 assessed value results in a bonded debt tax rate
of some 26.9 cents per $1,000. This means that the approximate total annual cos1;
to the owner of a $75,000 house would be $20.14. The cost to the owner of a
$140,000 house would be $37.60 and the owner of a $300,000 commercial
establishment would pay $80.55.
I am requesting and have tentatively scheduled a special workshop for Monday,
August 4, 1997 to review possible measures to be placed on the November ballot.
Because the Mayor has been on vacation, I was unable to discuss this matter with her
beforehand. The workshop would be an opportunity for the council to discuss the
possible Centennial Park ballot title along with the other potential ballot measures
(local option fuel tax and city fee increase) that have been discussed by the council
at some length at previous meetings.
The deadline for filing measures with the county Elections Department for the
November election is September 4, 1997. There is always a considerable body of
work in preparation of appropriate ballot title(s) and associated ordinance calling for
the election. There are only two regular council meeting dates (Aug. 11 and Aug. 25)
following the workshop and prior to the filing deadline.
The workshop would provide the opportunity to clearly prioritize each of the
ballot measure possibilities and identify whether any of them complements (or
conflicts with) the others. Other strategic considerations could also be a factor, such
as the timing of increasing the Traffic Impact Fees as desired by the council. The
latter does not require a vote, but could impact the city's ability, either positively or
negatively, to promote some other unrelated ballot measure with the voters.
