The Council met in regular session at 7:00 p.m. with Mayor Kirksey presiding. 0005 ROLL CALL. Councilor Figley stated that she had spoken with Mary Lee Brown, 2242 W. Hayes Street, regarding the parking proposal on W. Hayes Street and subsequently received a letter from her which Councilor Figley read into the record. Since Ms. Brown is making arrangements to hold a meeting with residents along the affected and adjacent area, Councilor Figley suggested that this issue be postponed until such time as the neighborhood is able to further discuss the issue and bring back a proposal to the Council. Mayor Kirksey also stated that, in the past, the Council has held over controversial issues until such time as there is a full Council present. The vote on the motion to remove items 16A and 11 G from the agenda passed unanimously. JENNINGS/FIGLEY.... approve the Council minutes of March 9, 1998; and accept the Planning Commission minutes of February 11 and 26,1998 and the Recreation and Park Board minutes of January 21, 1998. The motion passed unanimously. 0138 ANNOUNCEMENTS. A) Budget Committee Meeting - The 1998-99 City Budget will be presented to the Budget Committee on Tuesday, April 7, 1998,7:00 p.m., in the City Hall Council Chambers. Future meetings of the Committee will be set by the Committee at that meeting. B) 1997-98 Supplemental Budget Public Hearing - A public hearing on a proposed 1997-98 Supplemental Budget will be held before the City Council on Monday, April 13, 1998,7:00 p.m., in the City Hall Council Chambers. PRESENTATION OF BICYCLE TO WINNER OF TRAFFIC SAFETY POSTER CONTEST. Chief Wright introduced Sgt. Allen DeVault, Officer Bill Torres, and Lt. Paul Null who organized this event. Sgt. DeVault stated that the City has participated in mini-grant programs for seat belt protection since 1993 sponsored by the National Highway Traffic Safety Association and Oregon Department of Transportation. Within the last five years, the City has raised the seat belt compliance within the City to 84% which is 1 % less that the State compliance level. In an effort to reach children, a safety belt poster contest was developed in which 4th and 5th grade students within the Woodburn School District and St. Luke's School were invited to participate. Wal-mart donated a bicycle for the first place prize and they also donated a second place prize. K-Mart donated a prize for third place. Mayor Kirksey, along with representatives from Wal-Mart and K-Mart, selected the winners of this contest. He presented the winning posters to the Council and stated that the first place poster is being printed by Yes Graphics for distribution to the local schools and businesses. Officer Torres stated that the students were very enthusiastic about the contest. Mark Hansen was the first place winner and he was present at the meeting to accept his award. 0341 PROCLAMATION - NORMA COOK DAY. Mayor Kirksey read her proclamation declaring March 30, 1998 as Norma M. Cook Day within the City. She stated that Ms. Cook has been an active volunteer within the community for over 30 years which included 11 years for the Woodburn Public Library and she achieved the lifetime achievement award from the Library in 1997. Patrick Vance, representing the Chamber Board, brought the following items to the Council's attention: 1) A special Transportation Cornmittee meeting will be held on March 26th, 2:00 pm, at the Comfort Inn for the purpose of discussing with ODOT representatives the Highway 214/I-5 interchange; 2) On April 9th, Business After Hours will be held at the Comfort Inn at 4:00 p.m.; and 3) The Tulip Festival is underway with activities this week at Lennon Implement, tour of the Settlemier House, Llamas and Hot Air balloons at the tulip fields, and the Rotary plant sale at the Fire District headquarters station. 0476 CENTENNIAL PARK TASK FORCE REPORT. Councilor Figley provided a progress report on this project. She stated that the park property has been annexed and a tentative site plan application has been filed. The Task Force has contracted with David Kinney to assist in the land use process. The Task Force is also evaluating the financial situation and they feel comfortable with the amount of funds they currently have to get this project started and most of the work within Phase I should be accomplished. They are continuing to work on the final design and donations of time, money, and/or materials will be appreciated. The Task Force is also planning a trip to Grants Pass to view a park which is valued at approximately $9 million but cost approximately $1 million. 0562 WOODBURN DOWNTOWN ASSOCIATION REPORT. Dallas Figley, WDA Secretary, stated that they will be going before the Planning Commission on March 26th with their development plan and he encouraged residents and business owners of the affected neighborhood area to attend this meeting and offer their comments. On April 8t\ 6:00 p.m., they will hold their annual banquet at the Woodburn Elk's Lodge. 0622 Barbara Lucas, 214 E. Clackamas Cl, reminded the Council that April 15th has been designated as "Earth Day" to celebrate the environmental success on the poplar tree project. The theme of the program is "Cleaning Up the Pudding River" which is a timely subject when the State and Federal governments are looking at ways of cleaning up the rivers for salmon and steelhead. Regulations dealing with river cleanup now include pollution caused by logging, agriculture, and urbanized areas. A successful demonstration project is in place with our poplar tree plantation and she encouraged the Council and public to attend this program. 0718 COUNCIL BILL. 1871 - RESOLUTION CALLING FOR PUBLIC HEARING ON ANNEXATION OF PROPERTY LOCATED NORTH OF VANDERBECK LANE AND WEST OF N. BOONES FERRY ROAD. Council Bill 1871 was introduced by Councilor Hagenauer. Recorder Tennant read the bill by title only since there were no objections from the Council. On roll call vote for final passage, the bill passed unanimously. Mayor Kirksey declared the bill duly passed. The public hearing will be held on Monday, April 13, 1998, at 7:00 p.m.. 0753 COUNCIL BILL 1872 - RESOLUTION AUTHORIZING THE EXECUTION OF A COLLECTIVE BARGAINING AGREEMENT WITH THE WOODBURN POLICE ASSOCIATION. Councilor Hagenauer introduced Council Bill 1872. The bill was read by title only since there were no objections from the Council. On roll call vote for final passage, Council Bill 1872 passed unanimously. The Mayor declared the bill duly passed. 0773 COUNCIL BILL 1873 - RESOLUTION ENTERING INTO AN AGREEMENT WITH WALDRON RESOURCES TO PERFORM EXECUTIVE SEARCH AND RECRUITMENT FOR A CITY ADMINISTRATOR. Council Bill 1873 was introduced by Councilor Hagenauer. Recorder Tennant read the bill by title only since there were no objections from the Council. On roll call vote for final passage, the bill passed unanimously. Mayor Kirksey declared Council Bill 1873 duly passed. 0798 COUNCIL BILL 1874 - RESOLUTION ESTABLISHING RATES AND CHARGES FOR AMBULANCE SERVICES IN ACCORDANCE WITH THE FRANCHISE GRANTED TO WOODBURN AMBULANCE. Council Bill 1874 was introduced by Councilor Hagenauer. The bill was read by title only since there were no objections from the Council. On roll call vote for final passage, the bill passed unanimously. Mayor Kirksey declared Council Bill 1874 duly passed. 0820 APPLICATION FOR FEDERAL SECTION 5311 OPERATING ASSISTANCE FUNDS FOR TRANSIT OPERATIONS. The City qualifies for these funds, however, the application must be signed by a representative of the Council. JENNINGSIFIGLEy.... authorize the Mayor to sign the City's application for operating assistance under the Federal Transit Act Section 5311 Small City and Rural operating assistance program. The motion passed unanimously. 0837 REOUEST FOR SOUND AMPLIFICATION PERMIT. Lupita Hernandez, 1740 Park Ave., requested a permit for sound amplification for Saturday, April 18th, between 5:00 pm and 9:00 pm for the purpose of having a live band at the Woodburn Community Center as part of a family gathering. In the Police Chiefs staff report, he recommended that the permit be denied since past Council actions have been to deny permits to private persons who sponsor a function in a residential area. JENNINGSIFIGLEy.... accept the recommendation of the Police Department to deny the request submitted by Lupita Hernandez for a sound amplification permit. The motion passed unanimously. 0854 ACCEPTANCE OF EASEMENT FOR MILL CREEK FORCE MAIN PROJECT. Staff recommended the acceptance of a utility easement from Frank & Emily Doss and John Hibbard who own property north ofHwy. 214 and east of the railroad. JENNINGSIFIGLEY... accept the easement from Frank & Emily Doss and John Hibbard for the construction of Mill Creek sewer force main with the terms, conditions, and payment outlined in the easement. The motion passed unanimously. 0863 SITE ACTION PLANS. A) Site Plan Review #97-19 - Willamette Industries Additions. No action was taken on this site plan which was approved by the Planning Commission with conditions at their March 12th meeting. B) Site Plan Review #97-16 - Shuck's Automotive. No action was taken by the Council on this site plan which was approved by the Planning Commission with conditions at their March 12th meeting. 0892 STAFF REPORTS. Award of Traffic Safety Grant to the Woodburn Police Department- Chief Wright stated that the City will be receiving a $7,650 grant for enforcement of DUll and seat belt laws. The Police Department will be putting on additional patrols between April 1 ,t and September 30th. This will include saturation patrols in the City and in the County. ADA Paratransit Update - The City had submitted a waiver to the Federal Transit Administration in 1996. As of this date, the Federal Region X office in Seattle has been assigned the task of developing a voluntary compliance agreement. It is anticipated that it will be later this summer before an agreement will be presented to the Council. 1 045 MAYOR AND COUNCIL REPORTS. Councilor Jennings stated that he had received numerous telephone calls regarding the Vanderbeck Lane issue and, since it is not a public hearing, he questioned the Mayor as to whether or not she will be allowing comments from the public on this issue. Mayor Kirksey stated that she would talk to Attorney Shields, however, she felt that the public should be able to express their opinions on this issue when it is brought before the Council. He also stated that the Mayor's Prayer Breakfast was very worthwhile and he commended the Mayor for her comments and he was proud to be serving on the Council with her as Mayor. Councilor Chadwick stated that she also enjoyed the Mayor's Prayer Breakfast. She also stated that she had taken a friend to the tulip fields and was impressed with the display of tulips. Mayor Kirksey stated that she had was not fully prepared for the Mayor's Prayer Breakfast, however, when she saw Mrs. Engle at the function she knew what her comments should focus on. 1178 EXECUTIVE SESSION. JENNINGSIFIGLEY... Council adjourn to executive session under the authority of ORS 1 92.660(1)(f), ORS 192.660(l)(h), and ORS 192.660(l)(e). The motion passed unanimously. The Council adjourned to executive session at 7:40 p.m. and reconvened at 8:02 p.m.. 1195 COUNCIL BILL 1875 - RESOLUTION ENTERING INTO AN AGREEMENT WITH D & D PAVING REGARDING PARR ROAD IMPROVEMENTS. Council Bill 1875 was introduced by Councilor Hagenauer. Recorder Tennant read the bill by title only since there were no objections from the Council. On roll call vote for final passage, the bill passed unanimously. Mayor Kirksey declared Council Bill 1875 duly passed. Councilor Figley commended the Public Works Director in negotiating an acceptable agreement.
