A. Council Bill 2463 - Ordinance annexing into the City of 49
Woodburn 41.57 acres of property located on the east side of
Highway 99E approximately 1400 feet south of Cleveland Street
at 350 S. Pacific Highway; and granting a zone change from
Marion County CG (Commercial General) and IG (General
Industrial) zones to City of Woodburn IL (Light Industrial) zoning
district.
Recommended Action: Adopt the ordinance.
B. Council Bill 2464 - Ordinance relating to improvements of a 62
portion of West Lincoln Street between Cascade Drive and
Leasure Street, adopting the Local Improvement District,
directing the contract award, providing for payment of costs
through assessment of properties in the Local Improvement
District; and declaring an emergency
Recommended Action: Adopt the ordinance
C. Council Bill 2465 - Resolution initiating a Local Improvement 74
District project and directing the City Engineer to prepare an

NATIONAL NIGHT OUT 2003
WHEREAS, the National Association of Town Watch is sponsoring a unique,
nationwide crime, drug and violence prevention program on Tuesday, August 5th,
2003 called" National Night Out"; and
WHEREAS, the" 20th Annual National Night Out" provides a unique opportunity
for the City of Woodburn to join forces with thousands of other communities across
the country in promoting cooperative police-community crime, drug and violence
prevention efforts; and
WHEREAS, all citizens of Woodburn playa vital role in assisting the Woodburn
Police Department through joint crime, drug and violence prevention efforts in
Woodburn and is supporting "National Night Out 2003" locally;
WHEREAS, it is essential that all citizens of the City of Woodburn be aware of
the importance of crime prevention programs and the impact that their participation
can have on reducing crime, drug abuse and violence in Woodburn; and
WHEREAS, police-community partnerships and neighborhood safety and
awareness cooperation are important themes of the "National Night Out" program;
NOW, THEREFORE, I, MAYOR KATHY FIGLEY, do hereby call upon all citizens
of Woodburn to join the Woodburn Police Department and the National Association of

RECOMMENDATION:
As recommended by Recreation and Parks Department staff and the
Recreation and Parks Board, present Friend of the Parks Awards to the Marion
Soil & Water Conservation District and Dan Christensen.
BACKGROUND:
To continue the City's observance of National Recreation and Parks month, the
Recreation and Parks Department will present the annual Friends of the Parks
Awards at the July 14, 2003 City Council meeting. These awards recognize
organizations and individuals who throughout the previous year have assisted the
Recreation and Parks Department in our mission to help keep Woodburn healthy,
happy and safe.

DISCUSSION:
For 2003, the Department has nominated the following:
Dan Christensen - Dan is one of Woodburn's most active volunteers. He is a
regular coach in the City-sponsored baseball, basketball and junior football
programs. Dan's tireless commitment to youth sports has resulted in positive
recreational experiences for Woodburn's youth. Most recently, Dan has
made a commitment to making baseball a priority in Woodburn. He is the
Head Baseball coach at WHS and is Head Coach for Woodburn's American
Legion team.
Marion Soil and Water Conservation District - The Marion Soil and Water
Conservation District has emerged as an important agency in wise use and
development of Woodburn's Mill Creek Greenway system. Through the
efforts of the District's Monte Graham and Robin Straughan, the City has
secured Wildlife Habitat Incentives Program funding. They also offer
excellent technical advice in planning and implementing wildlife-friendly
environments in the Greenway. Staff and the Board look forward to working
with the District to plan and improve habitat on and around the Hermanson.

0047 ANNOUNCEMENTS.
A) Skate Park Temporary Closure: In order to complete final construction tasks, the
Skate Park will be closed June 25, 2003 through July 2, 2003.
B) Special Activities at the Library:
June 26, 2003 - 2:00 p.m.: Roland Smith, author, will give a talk and slide presentation
July 3, 2003 - 2:00 p.m.: Anne Louise Sterry, radio star, will sing and tell stories
July 10,2003 - 2:00 p.m.: Teen Group will do face painting & sidewalk art for kids
C) City Hall and Library will be closed on July 4th in observance of the holiday. The
Aquatic Center will be open for public swim.
D) Independence Day Celebration - July 4th:
Activities scheduled within the City on July 4th include the annual Chuck Wagon
breakfast at Legion Park from 7:00 a.m. until 11 :00 a.m.; Youth Parade at 1 :00 p.m.
beginning at Settlemier Park and concluding at Centennial Park; traditional 4th of July
activities at Centennial Park; Koral Jam Band and other musical talent will entertain the
crowd beginning at 6:00 p.m.; Cascade Surge soccer game at Legion Park beginning at
7:05 p.m.; and the Fireworks display will start after dusk.

on the Board and citizens interested in serving on this Board are urged to apply.
Mayor Figley also stated that the agenda included an item for appointments to the Sign

0313 PROCLAMATION: RELAY FOR LIFE.
Mayor Figley read the proclamation declaring the week of June 22 - 28, 2003 as the
American Cancer Relay for Life week and June 27 & 28th as Relay for Life Days within
the City, and urged citizens to recognize and participate in the fight against cancer.
She also stated that the City of Woodburn is a gold sponsor for the Relay for Life and all
contributions made to obtain this gold sponsorship were paid for by the City management
team, the City Council, and Mayor rather than using taxpayer dollars.
0484 PRESENTATION TO CITY EMPLOYEE - MATT GWYNN.
Mayor Figley stated that she had received a number of comments on how much better the
City parks look this year and, in particular, the landscaping around City Hall. Many extra
hours were put in by Street Superintendent Gwynn on his own time to beautify our park
areas. Mayor Figley introduced Matt Gwynn and expressed her appreciation for all of his
work in beautifying our City.
0564 CHAMBER OF COMMERCE REPORT.
Don Judson, representing the Chamber Board, stated that there were 25 teams
participating in the annual Chamber Golf Tournament and the two winning teams were
from Senior Estates. Upcoming Chamber events are as follows:
1) Grand Opening of Perfect Image Gift Shop on Thursday, June 26th, from 5:00 p.m. to
7:00 p.m.;
2) Grand Opening of the second Woodburn branch of Mid-Valley Bank on June 26lh;
3) Relay for Life event will be held on June 27th and June 28th; and
4) Drums of Fire event will be held on July 2nd at the Woodburn High School athletic
field. He stated that the Chamber is taking over this event from a group that has
organized the event for many years. Tickets are still available but they need to be
purchased at the Chamber office in advance of the event.

General and General Industrial zones to City of Woodburn Light Industrial zone. The
Planning Commission heard the proposal at their May 22, 2003 meeting and they adopted
the final order recommending approval of the annexation and zone change at their June
12, 2003 meeting. The property is currently developed with a large warehouse and
distribution facility operated by Food Services of America. He stated that the applicant
proposes to annex this property in response to a requirement set by the City Council as a
condition of the City in continuing to provide public services to the property. The
application satisfies all of the approval criteria for an annexation and zone change.
1950 Steve Abel, attorney representing Food Services of America. expressed his appreciation
on the work done by City staff and the Planning Commission on this application. He
stated that they are in agreement with the Commission's final order.
No testimony was received in opposition to the annexation and zone change application.
Mayor Figley declared the public hearing closed at 7:33 p.m..

2152 PLANNING COMMISSION OR ADMINISTRATIVE LAND USE DECISIONS.
A) Conditional Use 03-03 and Design Review 03-04: The Planning Commission had
approved a request from the Woodburn School District to construct a 19,670 square foot
building for additional classrooms at Heritage Elementary School.
No action was taken by the Council on this issue.
2184 MAYOR AND COUNCIL REPORTS.
Councilor Veliz stated that he would be out of town the latter part of July and unable to
attend the July 28,2003 regular meeting.
Councilor McCallum thanked the Mayor for the Relay for Life proclamation and invited
the public to attend this event which begins on Friday, June 27th, at 6:00 p.m.. At 10:00
p.m., the luminary ceremony will be held to read the list of names of people who have
been lost to cancer and of those who have survived cancer. On Saturday, June 281h at
11 :30 a.m., the final lap and closing ceremonies will be held.
Councilor McCallum also stated that Todd Bowman will begin his term on the Woodburn
Rural Fire District Board and he will be replacing Phyllis McKean who has been on the
Board for approximately 16 years. The remodeling project for the fire district is moving
ahead and they hope to do groundbreaking ceremonies in August 2003.
Councilor Sifuentez also stated that she would not be attending the July 28th regular
meeting since she will be out of town.
Mayor Figley stated that she would be in attendance for the opening ceremonies of the
Relay for Life and will be walking in the Mayor's lap at the closing of the event. She also
plans on participating on a bi-partisan team that will include State Representative Zauner

A. Conditional Use 03-02. Desian Review 03-03, Variance 03-18 and Phasina Plan 03-01, request
to construct permanent classrooms at the Woodburn Hiah School, 1785 N. Front St.,
Woodburn School District, applicant.
Staff read the applicable ORS Statement and provided a presentation as reflected in the Staff Report. Staff
recommended approval of the applications based on the information in the report, the information provided
by the applicant and the applicable review criteria subject to the conditions of approval stated in the Staff
Report.
TESTIMONY BY THE APPLICANT
Ken Rasmussen. P.O. Box 110. Aumsville. OR 97325 reported the idea is to add classrooms as the student
population this year was 11,330 and the projection for next year is estimated at 12,040 with the full build out
being approximately 18,060 students. Mr. Rasmussen further indicated the position of the structure is where
the Woodburn School.District wanted to place it and in the future, if need dictates, they will add additional
parking spaces. He explained the reasoning behind the building orientation is because it is more economical
to get the utilities to the proper locations as far as electrical, storm and water and the sewer will have to go
out to Hazelnut. Mr. Rasmussen referred to page 35. Conditions of Approval and expressed concerns with
Item #2. He thought it should be changed to "prior to occupancy permit" rather than "prior to issuance of
building permits" because waiting for a final landscape and irrigation plan approval from the Community
Development Department could hinder getting up and going on the project. Additionally, he pointed to Item
#4 and entered into the record Exhibit "A" Access to Front Street and Hazelnut Dr. drawing. He stated he did
not know why 26 ft. is included in the condition when the addition to the High School was put in with the

additional parking which was constructed and approved at that time including the exit out to Hazelnut Dr. Mr.
Rasmussen further indicated he is looking for a little leniency as far as the exit on Hazelnut Dr. because
according to Staffs comments, the existing infrastructure is working. Moreover, he stated he did not have
to do a traffic impact analysis and pointed out there are three exits, one onto 214; one to Front St.; and one
to Hazelnut Dr. The Woodburn School District requested leniency on Front St. because there is a cost impact
to have to tear it out and make it 1 ft. wider when a boundary street can have 12 ft. lanes each way and it is
demonstrating that it is working. Additionally, he said the Woodburn Development Ordinance does not
address existing infrastructure and questioned, in his mind, whether you have to bring it up to the new WOO.
He had no problems with Condition of Approval Item #5 as long as it does not take long to get condition of
approval; Mr Rasmussen referred to Item #6 and questioned what time frame would we be looking at if there
were some exceptions to these approvals? Lastly, he expressed concerns with Condition of Approval Item
#8 and said he thought to stipulate an expiration of a phase is unfair to the School District. Moreover, he
indicated he is unaware of where that came from and did not believe there is anything in the WOO that states
that.
Commissioner Lonerqan referred to Condition of Approval Item #2 and questioned what is the problem in
submitting a plan in order to obtain a building permit?
Ken Rasmussen replied they want to fast tract the project. Additionally, the concern is once the plan is
submitted, how much time will approval take and will it be approved? Furthermore, if it is not approved, what
else will he have to do to get it approved in order to get the building permits?
Commissioner Lonerqan interjected he would think the applicant would want to submit the plan a long time
before that so it does not delay the occupancy.
Ken Rasmussen agreed with Commissioner Lonergan but also stated he does not want it to delay the building
permits so he could get started with the project.
Commissioner Lonerqan remarked historically he has not seen any problems with landscaping and irrigation
plans as they are pretty basic and said he would have a problem leaving that out. He requested input from
Staff regarding Condition of Approval Item #4.
Staff responded the problem is the code specifies a standard and the only way to get relief from the standard
is through a Variance process. Furthermore, the applicant did not submit a Variance for that and consequently
we do not have an option to just waive that requirement. Staff further explained the condition is put there and
the applicant has the option to come back at a later date to get a Variance from that specific standard if they
so choose.
Commissioner Bandelow commented it was her understanding that the City's view and the School's view is
that the back entrance is not to become an entry that the students use regularly in and out of parking lots and
that the other two entrances are to be used more.
Staff indicated he is not aware of the City Council, Planning Commission or Staff taking a position regarding
this issue. He noted Hazelnut Dr. is designated as an access street and it is certainly designated to carry
heavier traffic than a local street.
Vice Chairperson YounQ asked the applicant if any of his concerns were discussed with Staff prior to this
meeting?
Ken Rasmussen answered he did not discuss it with Staff as he felt that it was probably best just to bring it
to Planning Commission. He also stated he was unaware of the 26 ft. issue until he received the Staff Report
in the mail June 9th.

Ken Rasmussen replied he believed it has been 25 ft. since the new addition and remodel was done to the
High School back in 1996 and has been adequate since then. He explained the Variance they were after was
the new WOO improvements to Front St. and the main issue there is that there are no sidewalks on the east
side paralleling the railroad tracts. Mr. Rasmussen further commented he believed it would be crazy to put
sidewalks on that side.
Vice Chairperson Younq referred to Mr. Rasmussen's concern regarding Condition of Approval #8 and
commented it is a fairly simple process to apply for an extension if it looked like the School District was unable
to meet the time criteria.
Staff explained the first phase falls under what the Development Ordinance allows for an approval, which
would be one year to obtain the building permit with a potential of a one year extension of time. For
subsequent phases, this condition builds in timing for when the building permit would need to be issued for
the second phase by the end of 2005. Therefore, if that is not complied with there would not be a potential
for an extension through Staff. The way to extend it would be to submit a new Phasing Plan to come before
the Planning Commission so a new Phasing Plan could be approved.
Commissioner Loneraan asked if all the phases will be accomplished under the one building permit?
Staff responded it would be up to the applicant. However, Staff assumes the applicant is going to submit
plans for the first phase at this point and the permit would only cover that first phase. He further reported the
applicant certainly may come in and obtain a permit for the entire project, however, then it would come under
the time line for expiration of building permits which would not give them this flexibility because the inspections
would have to be done within a certain period of time.
Commissioner Lonerqan inquired why is the applicant asking the Commission to approve the whole Design
Review now?
Ken Rasmussen answered because they paid $6,000 to get it approved and they spent the time to do it right
now and all he is looking for is a little flexibility for "what ifs" instead of having to go back and go through some
of the process again. He further requested expanding the first phase by 1,048 ft. and the ultimate building
would not change at all.
Staff stated he is comfortable with that under substantial conformance because he is not increasing the overall
square footage.
Chairperson Lima asked Staff if this can be approved through this hearing or does the applicant need to make
a request?
Staff stated he did not see that as any consequence as they are not modifying the approval which is based
on all three phases and there isn't anything that is tied specifically to the first phase that needs to be done as
a condition of approval with just the first phase.

Chairperson Lima closed the public hearing and opened for Commission discussion.
Commissioner Loneraan remarked the school needs additional space and it is a very good looking facility.
He also commented the Woodburn School District has done a very good job in keeping the design and

landscaping an asset. Additionally, he stated the Variance request makes sense to him as it is obvious a
sidewalk is not needed on the other side. However, he had issues with the phasing and with the applicant's
request regarding Condition of Approval Item #8 but he left it up to his fellow Commissioners to convince him
one way or the other. Furthermore, he also disagreed with the applicant's request to change Condition of
Approval Item #2 and felt it should be left as is. Commissioner Lonergan did indicate he agreed with the
applicant regarding Condition of Approval Item #4 however, a Variance is needed from the applicant.
Commissioner Vancil concurred with Commissioner Lonergan on Condition of Approval Item #8 and stated
he did not have a clear understanding. On the surface it seems rigid but he assumed there was some thinking
behind the wording of causing the expiration.
Staff made the Commission aware the date or timing granted by the Commission is flexible. The code
provides the factors that can be used in making a decision as to how much time you want to give per phase,
if any, as nothing states you have to give any additional time for a phase. Additionally, he indicated Staff went
with what the applicant proposed as their timing.
Commissioner Vancil reported he was on the facilities planning group that built the elementary, middle schools
and the remodeling of the High School back in 1996. At that time, they put all of the resources in the
elementary schools because the demographer reported that is were the increase in student population would
be. However, instead we are probably seven years ahead of their predictions in terms of growth of the High
School. Commissioner Vancil further remarked he did not see any reason why we should not allow more
flexibility if it is a reasonable site plan. He assumed that we would be looking at other sites for a second High
School once they get above 1,800 in the High School. He urged more flexibility in terms of the phasing.
Staff explained the reason you want to limit phasing is because you do not know what is going to happen in
the future and how codes may evolve in the next five to ten years. Additionally, you do not want to necessarily
lock yourself in or give somebody a vested right forever to do a project.
Ken Rasmussen clarified the School District wanted the ability to expand as need occurred. Staff required an
idea of dates that he could put in the Staff Report. A memo was then written by Mr. Bill Keys and was
included in the Commission packet as the best educated guess. Mr. Rasmussen further stated he did not
want the School District lose the flexibility if all of a sudden they do not grow and they want to put off for two
years doing phase 2 and have the ability to do it later. He said the statement in the condition pertaining to
dates was just coming off a memo that gave Staff an idea of when phasing might happen and to establish this
as the cut date based on an educated guess is not very flexible.
Chairperson Lima noted if there is no expiration date imposed, codes may change and things can happen and
he felt uncomfortable not having a time limit.
Ken Rasmussen conveyed as far as the building codes, they may change in the next phase as required to
meet that and if it caused the first phase to also meet that, anything over 20% construction could make the
first phase be remodeled. Moreover, there is not going to be much infrastructure and the only condition is if
they grow really quick and hit 1,860 student population the whole thing will be built and then they have to start
looking elsewhere or around the other side of the school. Mr. Rasmussen also commented you are looking
at a three or four year project to look for a new High School.
Commissioner Bandelow suggested the wording be changed to "building permits for Phase 2 and Phase 3
shall be issued by December 31,2007". That would eliminate 2005 and Phase 2 and Phase 3 can actually
be built together as late as 2007. You would then have another two year sliding period for Phase 2.
Ken Rasmussen interjected an additional year, 2008, would be ideal.
Staff stated combining Phase 2 and Phase 3 into the later date and change it to 2008, which in effect, allows
a five year period for the phasing which is a reasonable request.

Commissioner Lonerqan inquired whether there are currently any temporary classrooms at the High School
and wondered if these classrooms will be removed when the structure is built?
Ken Rasmussen replied there are currently temporary classrooms on the site and pointed to their location on
the map. He further indicated the only temporary structure to be removed will be the one on the north parking
lot.
Vice Chairperson Younq clarified we are striking the date for Phase 2, December 2005, and changing Phase
2 and Phase 3 to December 31,2008 on Condition of Approval Item #8. Although he had no problems with
the content of Condition of Approval Item #4, he did have issues with the manner in which it was presented
because it should have been a Variance.
Commissioner Lonerqan agreed with Vice Chairperson Young.
Commissioner Vancil asked what kind of a delay would we be talking about if we go through the Variance
process?
Staff replied there should not be a delay. The applicant will still have to show they meet the standards if they
want to obtain permits before the Variance is processed because it is the only way it will be approved. He
further explained if the Variance is granted before they complete the project, it is a matter of submitting the
revised site plan reflecting what the Variance approved and that becomes what they are held to at final
occupancy.
Commissioner Lonerqan inquired if there is a way around the applicant having to pay the additional Variance
fee of $1,174?
Staff answered the applicant may petition the City Council to waive the fee. However, the City Council by
policy has not done this in the past.
Chairperson Lima remarked he had no problems with the application and commended the applicant for their
presentation.
Commissioner Lonerqan moved to approve Conditional Use 03-02, Design Review 03-03, Phasing Plan 03-01
and Variance 03-18 with the inclusions and recommendations submitted by Staff including the alteration of
Condition of Approval Item #8 to read "Building permits for Phase 1 shall be issued within the time period
specified by City Ordinance (currently one year from the date of the final decision). Building permits for
Phases 2 and 3 shall be issued no later than December 31, 2008. The expiration of any phase will also cause
the expiration of any subsequent phase". Commissioner Bandelow seconded the motion, which unanimously
carried.

The applicable ORS Statement was read by Staff and a presentation was provided as reflected in the Staff
Report. Based on the information in the report, the information provided by the applicant and the applicable
review criteria, Staff recommended approval of the applications subject to the conditions of approval included
in the Staff Report.
Commissioner Lonerqan asked Staff if there is a need for this type of business?
Staff replied that is not part of the review criteria.
Commissioner Lonerqan also questioned if landscaping requirements are part of this application?
Staff responded this is only a Conditional Use permit and there is nothing, as far as the use, that would have

triggered upgrading parking or landscaping.
Vice Chairperson Younq asked why this particular use is listed as a conditional use and not a permitted use?
Staff answered under the previous ordinance that type of business was a permitted use in the Commercial
General (CG) zone and it was and still is a prohibited use in the downtown district. Additionally, he believed
the policy decision was made to not prohibit them outside of that district but to make it a Conditional Use.
Staff further explained there certainly are uses that have unique characteristics that could create adverse
impacts on surrounding uses that you would want to put a higher level of criteria applied to it. However, there
is nothing unique about this use that would create a worse impact than any other type of retail or office type
use.
TESTIMONY BY THE APPLICANT
Don Kelley. Attorney. 110 N. Second St., Silverton, OR 97381 represented the owners of the property, Mike
and Maria Samoilov and the applicant. Mexico Transfer. He also questioned why this application is a
Conditional Use and pointed out the application. in a lot of ways. resembles a small bank. Moreover, it is
right down the street from a larger bank that does not require a Conditional Use except that this particular use
serves one small portion of Woodburn's population, which should not be grounds for requiring a Conditional
Use permit. In closing, Mr. Kelley stated they have met all of the requirements and thanked Staff for their
courtesy and he also thanked the Commission.
Commissioner Bandelow inquired if there is a Mexico Transfer in town already?
Don Kelley answered this one was down the street and they moved which then triggered a contact by City
Staff who told them they had to get a permit to do business at this new location.
Chairperson Lima asked what will the hours of operation be?
Don Kelley replied the hours of operation are stated in the Staff Report and he believed they are 9 a.m. until
2 p.m. and 3:15 p.m. until 8:15 p.m. every day including Sundays.
Vice Chairperson Younq clarified there would be other types of businesses that would also fall under this
category that may not be as simple to review as Mr. Kelley's.

Staff reported the Coastal Farm application has been appealed to City Council and the applicant requested
continuance to July 14th.
BUSINESS FROM THE COMMISSION
Commissioner Vancil commented he brought up at the last meeting the appearance of the K-Mart property
and he reported the grass may now be a fire hazard and is certainly a blight at that end of town.
Staff will check into this issue.
Commissioner Bandelow announced she will not be attending the next Planning Commission meeting. She
also reported the marks have been made for the new arrows on the new paving on Hwy. 214 and they are
eliminating the problem of having two lanes that go down to one at the intersection of Boones Ferry Rd. and
the Highway. However, they have completely eliminated any right turn onto Boones Ferry if you are headed
west toward the freeway. Therefore, there is one left turn lane, one full lane going through and that is it.
Everyone wanting to make a right turn lane remains in the line with the rest of the them. She noted since they
have done it this way, the line at the corner when the light is red, goes all the way back to the High School with
every light change all day long and the people from the Glatt Circle area can not get out now.
Commissioner Vancil reported there is graffiti in every neighborhood and requested the graffiti ordinance be
enforced. Moreover, the buildings that have painted over the graffiti look almost as bad as the graffiti itself
because they could not find a less matching color, in many cases, or they painted over in the same design.
Chairperson Lima also added there are garage sales signs attached to regular street sign posts.
Commissioner Bandelow inquired how soon are the sign ordinance meetings starting?
Staff responded the Mayor announced during Monday night's Council meeting that she would have the focus
group appointed by the next Council meeting. He stated the group will probably start up in July.

5. Friends of the Parks nominees
Nominees for the 2003 Friends of the Parks award were: Marion
County Soil & Water Conservation District and Dan Christensen,

Certificates will be presented to the nominees at the next City
Council meeting, on July 16, 2003.
6. Business from the Director - bivision Reports
Recreation and Leisure Services - Brian Sjothun
Brian stated that the soccer seasons is half over, and County baseball
tournaments will be hosted at Centennial Park this weekend with 8 out
of town teams playing.
The Teen Centers are open for the summer and the average
attendance has been 25 - 30 kids daily.

Brian shared that August 8,2003, is the Mayors Cup Golf tournament
held at Senior Estates. He expects 144 players. Rob Hill from KATU
will do a live weather report after the game with participants from
the Recreation Department. Brian also stated that registration is
starting for the annual Walt's Run on August 9, 2003. He expects 100
participants this year.
Aquatic Center -
The Board reviewed WMAC revenue and attendance report. Randy
Westrick noted that the Aquatic Center is at 41.29% cost recovery,
and the attendance is about the same as last year.
4th of July Celebration
Randy shared that approximately 2000 people came to celebrate the
4th of July at Centennial Park. The activities and entertainment that
was scheduled seemed to be enjoyed by all. Randy stated that the
committee would meet in a couple of weeks and refine ideas for next
year.
Hermanson Park III
Randy shared that the work at Hermanson Park m to enhance the
wetlands while controlling the flood plain is now being done. Randy
will update the board at each meeting until the project is complete.
Community Center Task Force
Randy shared that a field trip for Task Force members was scheduled
for July 26, 2003. They would visit existing Community Centers in
Newport, Florence, Cottage Grove and Sweet Home. The bus will
leave at 5:30 am return at 7 pm. Randy also invited any Board
members that would like to participate.
7. Skate Park/Bicycle Issues
Randy shared that the Skate Park has gotten great reviews, but it was
not built for bicycle use. He stated that there were three factors; 1)
design was not built for bicycle use, 2) City Risk Management
recommended, no bicycles, 3) the cement would not hold up to bicycle
stunt equipment, and size of skate park was too small for bicycle use.
He stated to the Board that a need for a BMX track has been
expressed. He shared that there was a possible site at Centennial
Park that could be used for a temporary track, but that the
Centennial Master Plan would have to be looked at to include a
permanent structure.

AUDIENCE COMMENTS
Billy Clover and Jeremy Martin spoke to the board on behalf of 8
young adults present, about the need for a BMX dirt jump track in
Woodburn. They assured the Board that they were organized and
willing to put the time and effort in to get one constructed in
Woodburn. They had preliminary sketches of a dirt jump track and
had planned volunteer man-hours, donated vegetation and trees and a
smaller jump track for the younger youth. They invited the Board and
Director on a field trip to look at a completed track in Salem that was
done with all volunteer help. Their whole focus to the Board was to
make a safe place to practice their sport, and share it with the
community with organized events. Herb Mittmann, Chair thanked the
youth for their presentation and explained to them that this is how
the process gets started, but projects like this will not happen over
night. He assured them, that it is possible, but they would have to
commit their time to the project.
8. National Park Service Rivers cl Trails Application Letter
Randy shared with the Board an application he submitted to the
National Park Service to develop Mill Creek's 6 mile Greenway
corridor. It seeks to develop a comprehensive Greenway Master Plan
that connects City parks, schools, neighborhoods and a downtown
business district.

system. As additional data is gathered over the next few months we will be able to

BACKGROUND:
The National Night Out celebration in Woodburn continues to grow and has become
an annual event that many residents look forward to every year. This year we join over
10420 other communities from all 50 States, the US territories, US Military installations, and
Canadian cites to celebrate the 20th annual National Night Out "America's Night Out
Against Crime and Drugs." Over 32.1 million people are expected to participate with
us.
DISCUSSION:
National Night Out is designed to:(l) heighten crime and drug prevention
awareness: (2) Generate support and participation in local anti-crime efforts; (3)
strengthen neighborhood spirit and police community relations:(4) Send a
message to criminals letting them know neighborhoods, businesses, and the
police department are organized and fighting back.
From 7:00 p.m. to 10:00 p.m. on August 5th, 2003 residents in neighborhoods
throughout Woodburn and across the nation are asked to lock their homes, turn
on outside lights, and spend the evening outside with their neighbors, police and
local officials. Many neighborhoods throughout Woodburn will be hosting a
variety of special events such as block parties, cookouts, ice cream socials,
organized flashlight walks and visits with police and McGruff the Crime Fighting
Dog.

I. PURPOSE:
To establish a solid partnership with the citizens of Woodburn in our effort to
create a safe and secure community. The Woodburn Police Department actively
participates in National Night Out, and endeavors to include all citizens with
special emphasis placed on Neighborhood Watch groups.
II. Goals:
To heighten community awareness; to generate support and participation in local
anti-crime efforts; Strengthen neighborhood spirit and police-community
relations; and to send the message that neighborhoods are organized and
fighting back against crime.
To bring citizens out of their homes and into the street to interact and get to
know the people in their neighborhoods.
To afford the community an opportunity to meet and interact with members of the
Police Department.
III. Action Steps:
April 1st
o Register with National Night Out Prior to January 1, so the promotional materials
will be sent to the police department for NNO.
o Obtain complete NNO packet information. Order needed event information and
hand outs pamphlets.
o Contact Local Media organizations: Radio, Cable TV Station and News Papers;
Prepare needed PSA's and obtain needed news releases. (Purchase prepared
PSA's from NNO). These should be run 1 week at a time every month until the
middle of July. In July PSA's should be run daily.
May 1 st
o Contact all neighbor hood watch captains, apartment managers I owners,
downtown association, Woodburn School District and the Woodburn Outlet Mall.
Distribute basic information on NNO and order forms for event support items.
Contact with these group should be done again on July 1 st, to remind them of
the up coming NNO activities in the city and confirm their participation.
o A continuously updated participation list will be maintain for the those persons
who wish to participate in NNO as organizer. The persons on the list will be given
the distributed banners and posters when they arrive. This list will help us in

keeping track of the specific areas throughout the city that will be participating
and the estimated amount of citizens who will be joining the NNO celebration.
June 1st
o Contact Chamber of Commerce to have event publicized. In news letter contact
in June so it will be in July news letter. Attend July after hours meeting.
o Obtain list of businesses who have reader boards. Contact businesses and ask
them to use reader board week prior to NNO, to remind people of event.
o Make phone contact with people who call in to advise that they are hosting an
event. Advise that an officer will try to contact their group during the evening.
o Check schedule to determine patrol strength for the evening and schedule extra
officers if needed. Accomplish this prior to July 1st.
July 1st
o Contact Wal Mart to ascertain if they are going to contribute candy as they have
in the past. Complete in early July.
o Realize that most of the hosts will not contact you until the two weeks prior to the
actual date of the event.
o Coordinate with ESP/CRO to involve apartment complexes. Contact
Stonehedge Apts early so they will participate. (Large turn out)
o Staff report and Proclamation ready for City Counsel meeting on July 8th, 2003.
o Offer to City Counselors opportunity to ride along with officers and meet
constituents in their ward.
o Coordinate with NORCOM to allow PR person to ride along with an officer.
o Contact Woodburn Independent arrange for an article in paper just after the 4th
of July.

On Tuesday, August 5th , 2002, neighborhoods throughout Woodburn area will be invited to join forces with
thousands of communities nationwide for the "20th Annual National Niaht Out" crime/drug prevention event.
National Night Out, which is sponsored by the National Association of Town Watch (NATW) and co-sponsored
locally by Woodburn Police Department, will involve over 10,420 communities from all 50 states, U.S. territories,
Canadian cities and military bases around the world. In all, over 32.1 million people participated in NNO 2002.
The upcoming "20th Annual National Night Out" is expected to be the largest ever!
National Night Out is designed to: (1) Heighten crime and drug prevention awareness; (2) Generate support and
participation in local anti-crime efforts; (3) Strengthen neighborhood spirit and police-community relations; and (4)
Send a message to criminals letting them know neighborhoods are organized and fighting back.

National Project Coordinator, Matt Peskin said, "National Night Out is an ideal opportunity to build
neighborhood 'unity and strengthen police-community partnerships in our fight for a safer America." On
August 5th , 2003, millions of citizens nationwide will join forces to Give Crime And Druas A Goina Awav Party.
National Night Out has proven to be an effective and enjoyable program to promote neighborhood spirit and city-
wide unity. The benefits our community gains from National Night Out, will most certainly extend well beyond the
one night. Therefore, we are encouraging residents, block and social clubs, local businesses, community groups,
etc. to get in touch with the Woodburn Police Department to coordinate activities, programs and events. Let's
make this year's National Night Out a special one and the largest ever. Don't delay, register your block, club,
business, or group today! So, Let the party begin. Enclosed is the 20th Annual National Night Out 2003
registration form. Registration forms must be completed and received by the Woodburn Police Department no later
than July 31st, 2003.

SUBJECT: Ordinance to Approve Annexation 03-01 and Zone Change 03-
01 (Food Services of America)
RECOMMENDATION:
It is recommended that the City Council adopt the attached ordinance
approving Annexation 03-01 and Zone Change 03-01.
BACKGROUND:
The City Council, at its June 23, 2003 meeting, conducted a public hearing
concerning the above referenced applications. At the conclusion of that
hearing, the Council directed staff to prepare an ordinance to adopt findings in
support of approval of Annexation 03-01 and Zone Change 03-01. That
ordinance is attached.

FINANCIAL IMPACT:
Annexation of the subject property will result in additional property tax revenues
of approximately $64,000 to the City of Woodburn in FY 2004-05.

(LIGHT INDUSTRIAL) ZONING DISTRICT.
WHEREAS, the applicant, Food Services of America, submitted the following
applications: Annexation 03-01 and Zone Change 03-01; and
WHEREAS, the Woodburn Comprehensive Plan and Zoning Map have established
certain land uses within the City of Woodburn's Urban Growth Boundary; and
WHEREAS, the Woodburn City Council has reviewed the record pertaining to said
applications and heard all public testimony presented on said applications; NOW,
THEREFORE,
THE CITY OF WOODBURN ORDAINS AS FOLLOWS:
Section 1. That the subject property is owned by Food Services of America and is
legally described in Exhibit "A" which is affixed hereto and by this reference incorporated
herein.
Section 2. That the subject property is depicted on the Exhibit Map for Annexation
which is affixed hereto as Exhibit "B" and is by this reference incorporated herein.
Section 3. That based upon the Findings in Support, which is affixed hereto as Exhibit
"C" and is by this reference incorporated herein, the subject property is hereby annexed to the
City of Woodburn.

Section 4. That the Woodburn Zoning Map is hereby amended as to the property
described in Exhibit "A" to this Ordinance from Marion County CG (Commercial General) and
IG (General Industrial) Zones to City of Woodburn IL (Light Industrial) Zoning District based

II. NATURE OF APPLICATION:
The applicant proposes to annex 41.57 acres of land into the City of Woodburn
and change the zoning of the property from Marion County CG (Commercial
General) and IG (General Industrial) Zones to City of Woodburn IL (Light
Industrial) Zoning District.
III. RELEVANT FACTS:
The subject property is located on the east side of Highway 99E approximately
1400 feet south of Cleveland Street at 350 S. Pacific Highway, further described
on Marion County Assessor Maps as Township 5 South, Range 2 West, Section
17C, Tax Lot 701. The site is located outside of Woodburn's city limits but within
the City of Woodburn Urban Growth Boundary. Marion County zoning currently
applies to the subject property which is designated as Marion County CG
(Commercial General) and IG (General Industrial) Zones. The property is
designated as Industrial on the City of Woodburn Comprehensive Plan Map and
is proposed to be zoned IL (Light Industrial) at the time of annexation.
The subject property is currently developed with a large warehouse and
distribution facility operated by Food Services of America. The property is
relatively flat and 41.57 acres in size. No wetlands or floodplains have been
identified on the property. The subject property has two separate street
frontages on Highway 99E and is contiguous to Woodburn's city limits along the
property's northerly highway frontage.

Adjacent property on all sides of the subject property, except property across
from the property's northerly highway frontage, is also located outside of the City.
These adjacent properties are zoned Marion County CG (Commercial General),
IG (General Industrial), and UTF (Urban Transition Farm), and are designated as
Industrial on the Woodburn Comprehensive Plan Map, except the property
located across from the subject property's southerly highway frontage which is
designated as "Residential>12 units per acre". The property located across from
the subject property's northerly highway frontage is located within the City of
Woodburn, is zoned RM (Medium Density Residential) and designated as
"Residential>12 units per acre" on the Woodburn Comprehensive Plan Map.
Surrounding land uses consist of industrial development to the north, a service
station to the west and vacant land to the south and east.
The applicant proposes to annex the subject property to satisfy a City Council
decision to reqUire annexation as a condition of the City of Woodburn providing
city public facilities to the property.

This approval criterion is satisfied.
b. Territory to be annexed
1) Shall be contiguous to the City of Woodburn; and
2) Shall either:
a) Link to master plan public facilities with
adequate capacity to serve development of
the uses and densities indicated by the
Woodburn Comprehensive Plan; or
b) Guarantee the facility linkages with
adequate capacity, financed by the
applicant.
FINDING: The territory to be annexed is contiguous to the City of
Woodburn at the subject property's northerly highway frontage which is
separated from the Woodburn city limits only by a public right of way
(Highway 99E). The subject property is currently provided with public
facilities with adequate capacity to serve the existing development. This
approval criterion is satisfied.
c. Annexations shall show a demonstrated community
need for additional territory and development based on
the following considerations:
1) Lands designated for residential and community
uses should demonstrate substantial
conformance to: a), b), and e) and at least one of
c) or d), as stated below; and
2) Lands designated for commercial, industrial and
other uses should demonstrate substantial
conformance to: h) and either f) or g), as stated
below:

a) Infil!. The territory to be annexed should be
contiguous to the City on two or more
sides;
FINDING: This criterion is not applicable to an industrial development.
b) Residential Buildable land Inventory. The
territory to be annexed should not increase
the inventory of buildable land designated
on the Comprehensive Plan as low or High
Density Residential within the City to more
than a 5-year supply;
FINDING: This criterion is not applicable to an industrial development.
c) Street Connectivity. It is feasible for
development of the site to either:
(i) Complete or extend the
arterial/collector street pattern as
depicted on the Woodburn
Transportation System Plan; or
(ii) Connect existing stub streets, or
other discontinuous streets, with
another public street.
FINDING: This criterion is not applicable to an industrial development.
d) Community Need. The proposed
development in the area to be annexed
fulfills a substantial unmet community
need, that has been identified by the City
Council after a public hearing. Examples of
community needs include park space and
conservation of significant natural or
historic resources.
FINDING: This criterion is not applicable to an industrial development.
e) Reinforcement of Public Investment. The
territory proposed for annexation should
reflect the City's goals for directing growth
by using public facility capacity that has

It is recommended that the City Council adopt the attached Ordinance
ordering improvements to the unimproved portion of West Lincoln Street and
adopting the Local Improvement District for said improvements.
BACKGROUND:
The City Council directed staff to prepare an Ordinance for Council action
ordering improvements to the unimproved portion of West Lincoln Street and
adopting the Local Improvement District (LID). The decision by the City Council
was made after receiving input from the affected property owners, as required
bylaw.
DISCUSSION:
During the public input process, Councils desire to make certain adjustment for
the wetland area identified in local wetland inventory was understood by the
staff. Therefore staff has made modifications to and adjusted individual property
area assessments impacted by wetlands shown on the map of record. In section
nine of this ordinance, an adjustment reflecting 0.15 acres of reduced area has
been made to the property located at 1 790 West Lincoln, thus the assessment
for this property has been reduced by $1,147.92. This reduction will not change
any other property assessment since this amount has been taken out from the
estimated contingency.
The analysis performed by the staff and presented to the City Council in it's last
regular meeting indicates that the summation of written remonstrances is not
sufficient to suspend the project and all legal requirements have been met,
therefore staff is recommending option 1 outlined below Le. adoption of the
ordinance as presented.

WHEREAS, the City Council considers the improvement of the unimproved portion of
West Lincoln Street between Cascade Drive and Leasure Street to be necessary and beneficial;
and
WHEREAS, The City Council has authority to initiate the Local Improvement District
improvement and procedure process as per Ordinance No. 2105, and
WHEREAS, The City Council instructed the City Engineer to prepare the engineering
report for the improvements; and
WHEREAS, the City Council reviewed and approved the engineering report on the
improvement of West Lincoln Street on April 14, 2003; and
WHEREAS, the City Council by Resolution No. 1722, declared its intent to improve
West Lincoln through a Local Improvement District process, adopted the method of assessment,
established a date for the public hearing; and
WHEREAS, the Public Hearing was held on June 9, 2003 to receive input from affected
property owners and insufficient remonstrance were received to suspend such improvement: and
WHEREAS, the City Council based on public input, requested that individual property
area assessments be adjusted if impacted by existing wetlands, staff has incorporated the
adjustments within the Ordinance; NOW, THEREFORE
THE CITY OF WOODBURN ORDAINS AS FOLLOWS:
SECTION 1.
INTENT TO IMPROVE
The City Council deems it necessary and hereby declares its intention to order the
following improvements. The unimproved portion of West Lincoln is to be improved in
accordance with the W oodbum Transportation Plan (TSP) as a Local Residential Street.
This cross section as identified in the TSP provides two travel lanes, on-street parking and
sidewalks both sides. The improvement will be complete with curbs, drainage

improvements and street lighting. Attached is Exhibit 1, which depicts the proposed
typical street cross-section.

PROPOSED METHOD OF FUNDING:
The funding mechanism to accomplish this project includes the following:

Budgeted approved funds for improvement of gravel streets
B. ASSESSMENT AGAINST BENEFITING PROPERTIES:
Limited to the cost associated with a 34-foot wide local residential street adjacent
to the current unimproved portion of West Lincoln.

SUBJECT: Project initiation and Authorization to Prepare Engineering Report on
the South Alley
RECOMMENDATION:
It is being recommended that the City Council approve the attached Resolution
initiating a Local Improvement District Project and directing the City Engineer to
prepare an engineering report for improvements to the Alley between Garfield
Street and Cleveland Street, West of Front Street.
BACKGROUND:
The South Alley between Cleveland and Garfield is currently unimproved. The
existing alley surface is in poor condition, a combination of both asphalt and
gravel. The alley will be reconstructed, designed similar to previous
improvements made to the alley between West Hayes and Harrison. This
provides an improved travel lane for vehicular traffic and improvements to both
the subsurface and surface drainage facilities. The Alley is identified in the
capital improvement program for funding during the fiscal year 2003/04 and
2004/05.
DISCUSSION:
Ordinance No. 2105 outlines the procedures for local improvements and special
assessments. The ordinance stipulates improvements can be initiated by the City
Council when the Council considers it necessary to require the improvements.
The procedure requires that upon initiation of the local improvement district
project. the Council shall direct the City Engineer to make a survey of the
improvement and present a written report.

The resolution being presented will initiate the local improvement district project
and will direct the staff to prepare an engineering report in accordance with
Ordinance No. 2105. The report will include the district boundary; preliminary
plans and estimates, including estimated legal and administrative costs and the
proposed method of cost distribution.
If after review of the engineering report, if council elects to proceed with the
improvement, the resolution of intent to construct the project would set a public

operate the lounge portion. The application is for adding the Bowers' as
partners.
The Police Department responded to 25 calls for service at this location in the
last 12 months. There were no reported liquor violations.
The restaurant will operate 7 days per week, between the hours of 11 :00 AM and
9:00 PM Monday thru Thursday, 11 :00 AM to 10:00 PM Fridays, 5:00 PM to 10:00
PM Saturdays, and 5:00 PM to 9:00 PM Sundays. There will be no entertainment.
The police department has received no communication from the public or
surrounding businesses in support of or against the change of ownership.
DISCUSSION:
The police department has completed a limited background investigation on
the applicant business and found nothing of a questionable nature. An in-
depth investigation was completed on owner/managers and no offenses that
would preclude a license being issued or items of a questionable nature were
located.

BACKGROUND: The water treatment project is the second largest project undertaken
by the city. The need for aesthetic improvements to the city's drinking water have long
been identified and development of the water treatment project began with development
of the Water Master Plan in 1995. Staff has given this project careful attention to
ensure that the proper public input was received, that a funding program was developed
which resulted in low interest rate loans being procured, and that the technical
requirements of the complex project were thoroughly reviewed for efficiency and
effectiveness.
DISCUSSION: The results and recommendations for Council action from the Water
Treatment Project Package 3 bid process are outlined in the attached Public Works
Program Manager Memo. After the bids were received, a meeting was held with Public
Works staff and the city's professional engineering consultant resulting in the following
conclusions:
· Good bids were received for all three Water Treatment Plant Project
Package 3 schedules.
. This major contract portion of the water treatment project is within
established value criteria and meets the funding and time criteria
developed for treatment of the city's drinking water supply.
. The low responsible bidder for each of the three bid schedules are known
to Public Works staff or to the consultant and all have received very
favorable references from their prior clients.
RECOMMENDATION:
I recommend actions as outlined in the attached Public Works Program Manager's
Memo to award contracts for each low responsible bidder on City of Woodburn Water
Treatment Package 3.

DISCUSSION:
Water Treatment Package 3 is the major component of implementation of the water
treatment objectives of the Water Treatment Master Plan. It has also been Council's
goal to improve the aesthetic quality of the city's drinking water supply. The water
treatment plants will remove iron and manganese from the city's water supply to
improve the aesthetics of the water. The project will also reduce the amounts of
arsenic and radon in the water to comply with existing and anticipated federal water
quality regulations. Available water storage will be increased to meet fire storage,
emergency storage and seasonal increased use requirements.
The water treatment plant construction project was divided into three bid packages.
Council has previously awarded contracts for the first two packages, which included
water wells, well houses and a control center. The third package, which is the subject
of this bid award included three schedules, A for water treatment plant construction and
site work, B for water storage reservoirs and backwash tanks and C for water
transmission lines. The water treatment plants and additional storage will be
constructed on Parr Road near Centennial Park, on Country Club Road at an existing
well site and on National Way at an existing well site. The plants are scheduled to be
fully operational by the end of summer 2005.

The city's contracted design engineer, Kennedy/Jenks Consultants has reviewed the
bids received and recommended in the letter included as attachment A that the bids be
awarded to the low responsible bidders. The engineers estimate for the projects were:
Schedule A: $9,994,000.00
Schedule B: $2,890,000.00
Schedule C: $ 630,000.00
All bids received are under engineer's estimates with the combined bids being 20%
below the total estimate. The bidding was competitive and the range of bids was
indicative of the competitiveness with the maximum high to low difference being 17%.
Staff is recommending award to the low responsible bidder on all three schedules.
FINANCIAL IMPACT:
The water treatment package is funded by a combination of loans, water sales revenue
and system development charges previously approved by Council after completion of a
public input process. The council has previously entered into three separate loan
agreements with the Oregon Economic and Community Development for a total of
$16.4 million. Costs not covered by the loans will be paid from accumulated water
system development charge revenues and water sale revenues. The loans will be
repaid over a 20 year time period through a combination of water sales revenues and
system development charges.

separate contractors for Schedules A, B, and C of Package 3 of the City of Woodburn's Water
Treatment and Storage Project.
The bid prices for each of the three schedules appear to be reasonable and within the City's
budget for the project. In addition, the three contractors have met the qualification requirements
established for this Bid Package.
Kennedy/Jenks Consultants recommendation, based on bids received by the City, is that the
City award contracts to the following contractors.

A summary of the lowest bids received and the engineer's estimate of probable construction
costs appears on the attached table. The estimates have a targeted accuracy range of +5%/-
15%. Bids for both Slayden Construction and Kerr Construction came in within the targeted
accuracy range. The bid for BMT Northwest came in less than the targeted accuracy range.
However, Kennedy/Jenks has reviewed the bids for BMT Northwest and the other Schedule B
bidders and finds the bid to be both reasonable and very acceptable.
Kennedy/Jenks Consultants, in conjunction with the City, conducted an extensive pre-
qualification process for contractors bidding on Schedules A and B. The low bidders for these
two schedules came highly recommended by clients that had similar size and complexity of
projects constructed by these firms. Both of these firms have a proven record of quality
performance of construction contacts.

It is being recommended that the City Council accept the attached Public
Improvement/ Watercourse easement as described on Attachment One
BACKGROUND:
The easement is being conveyed by Mr. & Mrs. Lenhardt as a condition of Land
Use Approval in conjunction with Property Line Adjustment case file 02-06, 03-01
and 03-03. The subject property is located along Mill Creek between Young
Street and Lincoln Street. The conveyance is provided in accordance with the
Woodburn Development Ordinance. The easement is for future maintenance of
the published 1 OO-year floodway.
DISCUSSION:
Section 3.102.04, subsection C of the Woodburn Development Ordinance
requires the following in conjunction with applicable land use decisions, "Public
improvement and maintenance easements shall be dedicated along all creeks
and other water courses. On streams and waterways where development is
regulated based on Federal Emergency Management Administration flood
hazard delineation, the Minimum width shall be adequate to accommodate
the 100 year floodway" .

KNOW ALL MEN BY THESE PRESENTS, that FLOYD R. LENHARDT Jr. and GLADYS R.
LENHARDT, for the consideration of One Dollar ($1.00) and other valuable considerations to them
paid, the receipt whereof hereby is acknowledged, hereby do forever grant unto the CITY OF
WOODBURN, a Municipal Corporation of Marion County, Oregon referred to herein as the CITY, a
pennanent right-of-way and easement over and along the full width and length of the premises
described as follows, to wit:

RECOMMENDATION:
Staff recommend that the City Council act by motion to continue the public
hearing on Design Review 02-12 and Variance 03-01 to the City Council meeting
of August 11, 2003 pursuant to the applicant's request.
BACKGROUND:
At their hearing of April 24,2003, the Planning Commission considered a request
by Coastal Farm Supply to construct a 10,250 square foot addition to an existing
28,500 square foot retail building occupied by Coastal Farm Supply in the
Commercial General (CG) zoning district. In addition, the applicant requested
a variance from the Woodburn Development Ordinance Section 2.1 06.05.C.2
which requires a solid brick or architectural wall adjacent to an RS, RIS, or RM
zone. The applicant proposed to substitute an existing berm, chain link fence
with slats, and landscaping for the required wall.
On May 8, 2003, the Planning Commission approved a final order approving
Design Review 02-12 and denying Variance 03-01. The Planning Commission's
decision was subsequently appealed by Coastal Farm Supply. This public
hearing is to consider that appeal and has been noticed as a de novo hearing
which allows new evidence and testimony to be presented by any party.
DISCUSSION:
The applicant'is requesting another continuance of the public hearing for the
appeal of Design Review 02-12 and Variance 03-01 "Coastal Farm Supply
Expansion" from July 14,2003 to August 11,2003. The applicant has granted an

On June 26, 2003 the Planning Commission adopted a final order approving the
applicant's request to operate a money/cash transfer business at 1165 N. Pacific
Highway. The property is zoned General Commercial (CG). Cash transfer operations
require a Conditional Use Permit in the CG zone. The subject property is approximately
1.63 acres in size and is zoned Commercial General (CG) on the front two thirds of the
property and Single Family Residential on the back one third of the property. The whole
property is designated Commercial on the Woodburn Comprehensive Plan Map.

BACKGROUND:

development of a 26,188 square foot building for additional classrooms at the
Woodburn High School. A Variance was also approved to allow a reduction in the right
of way width on Front Street and to allow the applicant to not construct a sidewalk on
the east side of Front Street along the train tracks. The subject property is 55 acres in
size and located at 1785 North Front Street. It can be identified specifically on Marion
County Assessor Map T5S, R1W, Section 7A, Tax Lots # 300,400, 500, 600 and T5S,
R1W, Section 8BC, Tax Lot 300. The property is zoned Public/Semi-Public (P/SP) and
designated as Public Use on the Woodburn Comprehensive Plan Map.

Drive. The applicant intends to blend the new structure with the existing school
buildings. A mix of groundcover, shrubs and trees surrounding the proposed building
will improve the appearance of the site. Landscaping and pedestrian access has been
planned to show compliance with the WOO in the interim period between development
phases.
