RECOMMENDATION: Approve the attached Revised Order of Procedure in Site Plan Review
Condition Modification Application No. 01-10.
BACKGROUND: The City Council, at its November 13,2001 public hearing adopted the
following order of procedure:
a. The public hearing will be continued until January 14,2002.
b. The next Staff Report is due on December 17, 200 I.
c. New evidence regarding the application may be submitted until January 4,2002.
d. The applicant extended the 120-day provision in ORS Chapter 227 until January
30,2002 at 5:00 p.m.
During the period following the November 13 meeting city staff extensively discussed this case
with the applicant in an effort to find a solution to the contested issues. The Revised Order of
Procedure, which has been agreed to by the applicant, adjusts the time frame to accommodate
the staff discussions. The City Council should be aware that the matter will still appear on the
January 14,2002 agenda for the purpose of continuing the public hearing until the agreed date of
January 28,2002.

Dear Sheriff Ramirez,
It is my understanding that your department is looking at several cost saving options to reduce
the Sheriffs Office budget by 1.5 million dollars. This causes great concern given the fact that
crime is on the rise in Marion County as police and jail services are on the decline. Any
reduction in the Sheriffs Office budget will have a negative impact on all law abiding citizens in
Marion County.
It is also my understanding that the closure ofWoodburnlMarion County Sheriffs Office sub-
station is being considered as a possible cost savings measure. As you know, the Woodburn
Police Department's patrol division is housed at the sub-station along with MCSO and Justice
Court. The majority of the 5,722 sq. ft. leased space by MCSO and WPD is shared commingled
space. In other words, there is no clear distinction between the space utilized by MCSO and
WPD other than private offices.
The closure of Woodburn Marion County Sheriffs Office sub-station would compel the City of
Woodburn to consider leasing the vacated space in order to continue to utilize the common
space. The unanticipated cost to the City of Woodburn would be about $100,000 over the life of
the existing lease agreement. The unexpected cost would certainly have an adverse impact on
the city's budget and it's ability to finance the additional expense. The cost savings proposal
would simply shift the financial burden from one level of government to another.
I am also concerned with how the termination of this agreement could impact future
intergovernmental agreements with Marion County. Intergovernmental agreements are
imperative for solid and responsible management of governmental services to our communities
and should be maintained to insure dependable delivery of those services.
I certainly empathize with you in the sometimes painful and complicated future decisions which
have to be made in an attempt to maintain basic police services. However, I would urge you to
consider the negative monetary and relational impacts these decisions have on, and with, other
governmental agencies.
