Park and Recreation Board - 3 Fear terms
Position III Richard Hammond - To replace Darryl Kelly who requested to
not be re-appointed. Richard is the owner of Figaros Pizza here in Woodbum.
He and his wife live at 1655 Park Avenue, Woodburn. Richard has expressed a
real desire to become involved in community activities and a special interest in
our Recreation and Parks programs. I am convinced that he will work for the
benefit of the whole community and continue the vision that the board has
endorsed. His term will end December 31, 2003.
Planning Commission - 4 }~ear terms
Position II Carl D. Miller - To replace Alma Grijalva who requested
to not be re-appointed. Carl is retired after spending 30 years working with waste
management. He has been involved in mall development and also involved in growth
management in south and east Snohomish county and east King county in Washington
State. I have talked with Carl and am convinced that he will be a valuable asset to the
Planning Commission. His term will end December 31, 2004

Position At Large Donna Wood - To replace Scott Summers who has
requested to be re-assigned to represent Ward #5. Her term will expire December 31,
2003.
Position V. Scott Summers - Scott is a current member of the
Commission and is requesting re-assignment to represent Ward #5 replacing Wendy
Veliz, who no longer resides in said Ward. His term will expire December 31, 2002

Wetlands Enhancement Presentation

Paul Sedoruk, who represents the Luckey Company, has proposed to the Recreation and
Parks Department a mitigation that would enhance stream and wetland conditions within the
Mill Creek at Hermanson Park III. Hermanson Park III is located on Wilson Street between
Hermanson and Hawley. The Division of State Lands has required the Luckey Company to
mitigate wetland loss resulting from home construction in Woodbum.
Mr. Sedoruk presented a concept plan to the Recreation and Parks Board at an informal
meeting in October. The Board also conducted a workshop with neighbors in November
where neighbors expressed concems regarding flood control and neighborhood security.
Because of a scheduling conflict, Mr. Sedoruk was unable to attend the November meeting.
The Board is interested in convening anolher workshop with neighbors and the Luckey
Company. However, since the City has never used this approach to improve City park
pmparty, slaff and the Board are interested in the Coundrs opinions on the concept.
Mr. Secloruk has prepared a short presentation that will introduce the City Council to the
project. He will be on hand to answer any questions the Council may ask regarding the
potential project.
If the City Council is interested in pumuing the project further, ~ Recreation and Parks
Board can schedule another neighborhood workshop before preparing a recommendation for
City Council consideration.

OATH OF OFFICE. '
Mayor Jennings stated that Walt Nichols, newly elected Ward I Councilor, had taken the
Oath of Office at the December 4, 2000 special meeting since he had originally planned
on being out of town for this meeting. However, his plans have changed and he is in
attendance at this meeting. At this time, Richard Pugh stepped down from the Council
bench and Councilor Nichols took his place.
The Mayor also stated that Councilor Bjelland was not able to attend this meeting,
however, the City Recorder did administer the Oath of Office to Mr. Bjelland earlier
today since the Charter does state that the term of office for the Mayor and Council begin
with the first regular meeting in December.
The Oath of Office was taken by Councilor Sifuentez (Ward VI) and Mayor Jennings.

CERTIFICATION OF APPRECIATION TO RICHARD PUGH.
Mayor Jennings presented Richard Pugh with a plaque in recognition for his City service
as a City Councilor from 1994 to 2000.

ELECTION OF COUNCIL PRESIDENT.
In lieu of accepting nominations, Mayor Jennings distributed ballots with each
Councilor's name on it and he requested that each Councilor vote for the individual they
would like to have serve as Council President for the next two years. The ballots were

then collected and the final tally of votes resulted in the election of Kathy Figley as
Council President.
Councilor Figley accepted the position as Council President and thanked the Councilors

Mayor Jennings thanked Richard Pugh for his active participation on the Mid-Willamette
Valley Commission on Transportation over the last three years. Hopefully, one or more
of the projects he has worked on trying to get funding for will come to fruition.

A) City Office Closures:
Woodburn Public Library - closed December 24 and 25, 2000, and on January 1, 2001.

Mayor Jennings stated that he has not had an opportunity to interview all of the
individuals who had applied for the various boards and commissions, therefore, he is only
proposing re-appointments at this meeting. The individuals being re-appointed are as
follows:

Planning Commission: Claudio Lima, term expires December 31, 2004
Budeet Committee: David Vancil, term expires December 31, 2003

URBAN RENEWAL PLANNING COMMITTEE.
Mayor Jennings stated that the consultants have suggested that 2 Councilors be a part of
this planning committee, therefore, he is adding Councilor Sifuentez and Kilmurray to the
list of appointments.
Councilor Figley stated that she is a property owner in the proposed Urban Renewal Area
and, while the Ethics Commission advises her that she could participate on the planning
committee without crossing an ethical line, she has decided not to be a part of the
committee.

0350 PRESENTATION - MACLAREN YOUTH CORRECTION FACILITY.

Whit Thompson, representing MacLaren Youth Correction Facility, stated that the youth
participated in a project that was a fundraiser for the City's Parks & Recreation program
in an effort to give something back to the community. Raffle tickets for a trailer were
sold to the public at Coastal Farms, Roth's, Thriftway, and Wal-Mart stores.
Additionally, these businesses provided some sponsorship towards this project. Mr.
Thompson presented the Mayor with a check in the amount of $1,578.00.
Mayor Jennings stated that he had received the "big" check at their annual awards
program and he has obligated the funds to the future skate park. He also stated that he
has been volunteering time at MacLaren and he agreed that the youth are a part of the
community even though they are in a locked facility.
PRESENTATION - AWARD OF "PRIME TIME FAMII.Y RF~ADING TIME"
GRANT.
Mary Pan'a stated that the Woodbum Public Library was awarded this grant from the
National Endowment for the Humanities and the American Library Association. This
program involves a reading, discussion, and story-telling series based on childrens'
picture books and is designed specifically for underserved families with children age 6 to
10. The program helps low income, low literate families bond around the act of reading
and talking about books. This program is offered throughout the nation in the spring and
summer by 7 libraries and in the fall by an additional 7 libraries. Woodburn has been
selected as 1 of the 14 libraries throughout the nation to offer this program. It is
anticipated that the program will be offered in the fall of 2001 since their will be a special
OMSI traveling exhibit in March and April 2001 followed by the summer reading
program. The team involved with this reading program includes the Library Director,
Children's Librarian, Dr. Carol Long (Humanities Scholar from Willamette University),
Greg Harris (Storyteller), and Angela Reynolds (State representative from the Oregon

Library Association). This series will involve 22 families meeting once each week for 6
weeks.
Administrator Brown stated that this is a very competitive grant process and the City
received the grant as a result of Mary Parra's fine work in preparing the application. On
behalf of City administration, he thanked her for her efforts in securing this grant.

CHAMBER OF COMMERCE REPORT.
Mindy Mayer, representing the Chamber Board, provided the Council with a list of the
following upcoming events and activities:
1) Chamber Business After Hours - Thursday, December 14t~, 4:30 pm, at the Woodburn
Company Stores;
2) Chamber Forum - December 20th, 12:00 noon, at the Settlemier House. Due to limited
space, reservations are required and the cost is $10.00 per person. Additionally, the
Settlemier House is open to the public for tours on December 16, 17, & 23, 2000.
3) Festival of Lights is co-sponsored with the Woodburn Kiwanis. Entry forms are
available at various businesses and must be turned in by December 13th with the judging
to be held on December 15th.
4) the Chamber Board is offering their support for any improvements that can be made on
Highway 214 that passes not only by the high school but the full stretch of roadway
between I-5 and Hwy. 99E.

SERVICES TRUST NOTICE OF POTENTIAL WITHDRAWAL FROM
MEMBERSHIP IN THE SELF-INSURANCE POOL.
Council Bill 2279 was introduced by Councilor Chadwick. Recorder Tennant read the
bill by title only since there were no objections from the Council.
Mayor Jennings stated that annual notice of potential withdrawal from CIS gives the City
an opportunity to solicit bids from other insurance carriers for liability, auto, property,
and workers compensation coverage.
On roll call vote for final passage, the bill passed unanimously. Mayor Jennings declared
Council Bill 2279 duly passed.
COUNCIL BILL 2280 - RESOLUTION ESTABLISHING A PUBLIC HEARING
DATE FOR VACATION OF A PORTION OF OSWALD STREET AND
DIRECTING THE CITY RECORDER TO GIVE PUBLIC NOTICE.

Councilor Chadwick introduced Council Bill 2280. The bill was read by title only since
there were no objections from the Council.
Mayor Jennings stated that the City had received a request from Chemeketa Community
College to vacate a portion of Oswald for the purpose of expanding their facility on
Lincoln Street.
On roll call vote for final passage, the bill passed unanimously. Mayor Jennings declared
Council Bill 2280 duly passed.
The public hearing will be held on January 8, 2001.
COUNCIL BILL 2281 - RESOLUTION DIRECTING THAT STOP SIGNS BE
INSTALLED ON ARLINGTON AVENUE AT THE INTERSECTION OF
PATRIOT STREET.
Council Bill 2281 was introduced by Councilor Chadwick. Recorder Tennant read the
bill by title only since there were no objections from the Council.
Mayor Jennings stated that he had gone to the location to view the situation and he
questioned if there was enough traffic in the area to warrant the stop signs.
Public Works Manager Rohman stated that there are approximately 300 cars per day on
Patriot Street that pass through the intersection which is enough to warrant the stop signs
under the traffic code. The proposed installation of signs would require traffic on
Arlington to stop whereas Patriot Street would remain as a through street. Staff also
looked at the traffic volumes at the Patriot Street/Constitution Avenue intersection,
however, the volume was not high enough at this time to warrant stop signs.
Councilor Kilmurray requested clarification on the criteria used to determine if a stop
sign is warranted since other areas of concern have been brought to staff's attention but
no action has been taken to install stop signs at these intersections.
Public Works Manager Rohman stated that there are a number of items that are looked at

in the traffic control devices manual to determine the need for a stop sign. He stated that,
in this particular case, there were several factors taken into consideration to determine
with the result being that the stop signs were warranted.
On roll call vote for final passage, the bill passed unanimously. Mayor Jennings declared
the bill duly passed.

BID AWARD #21-05: HYDRAULIC PIPE CUTTER.
Bids for a hydraulic pipe cutter were received from the following vendors: Ackley Tool
Company, $6,035.00; Intermountain Sales, $6,575.00; and E.H. Wachs Company,
$6,685.00.
FIGLEY/NICHOLS... award bid #21-05 for a hydraulic pipe cutter to the low bidder,
Ackley Tool Company, in the amount of $6,035.00. The motion passed unanimously.

The only bid received for a used pick-up truck was submitted by Hubbard Chevrolet in
the amount of $13,000.00. Staff recommended that the bid be rejected since the vehicle
did not comply fully with the specifications in addition to being over the amount
budgeted for this purchase.

0949 REQUEST FOR CONTRIBUTION TO MACLAREN YOUTH CORRECTIONAl,
FACILITY.
Councilor Sifuentez stated that the youth have been making toys out of wood over the last
two years which are given back to the children in the community. In order to continue
this project, funds are necessary to purchase the wood and she requested Council'
consideration in contributing City funds towards this annual project. She reiterated that
the youth in the correctional facility do not benefit from these funds rather the finished
projects are given back to the community.
Administrator Brown stated that there is no formal Council policy regarding contributions
to organizations, however, funds could be allocated during the mid-year budget review
process.
Councilor Figley stated that she is a supporter of this program and will be giving a private
donation towards the program. She expressed concern regarding monetary donations by
the City since the general city policy would need to encompass more than just the
MacLaren Youth Correctional Facility.
Councilor Nichols agreed that it is a good program but feels that private donations should
be solicited since there are a lot of good programs provided by other groups that provide a
benefit to the community and giving out one contribution may lead to requests from other
groups. He stated that he is more than willing to contribute privately rather than

authorizing a contribution from City funds.
Councilor Kilmurray concurred with the above comments and expressed concern in how
the City would decide which organizations would be recipients of contributions.
Councilor Sifuentez reminded the Councilors that the youth do give back to the
community not only in the annual toy project but, for example, in their recent donation
towards Park programs which was presented to the City this evening. One difference
between this group and others within the City is that the youth in the facility are not
allowed to go out into the community to solicit funds for their projects thereby it limits
the number and type of fundraising activities they can do in order to raise funds for
materials.
Mayor Jennings suggested that a general policy on contributions be addressed during the
budget cycle.
NICHOLS/FIGLEY... do not fund from the City budget at this time but look at it during
the mid-term review. The motion passed unanimously.
1275 CANCELLATION OF SECOND REGULAR COUNCIL Mie~ETING IN
DECEMBER 2000.
With the next regular meeting scheduled for December 25, 2000, it was the consensus of
the Council to cancel the meeting since it falls on Christmas Day.

ADMINISTRATOR'S REPORT.
He informed the Council that the City has been contacted by Oregon Dept. of Transportation
(ODOT) that a meeting has been scheduled for Friday, December 15~, in which the Mayor
and Administrator have been asked to attend to represent the City along with representatives
from the School District and various other members of the community to talk about the
accident and potential solutions to this problem. Staff was also contacted by Rep. Hooley's
office who are also willing to assist in trying to improve the roadway conditions in the
vicinity of the high school. He will provide a report to the Council at the first meeting in
January.
Councilor Kilmurray questioned if it would be appropriate at this meeting to address the
same issue further east on Highway 214 at Park Avenue since many pedestrians cross
Highway 214 to reach the Salud Medical facility.
Mayor Jennings stated that he intends to bring this issue up since he feels it is more
dangerous than the high school area.

Councilor Nichols stated that it will be a pleasure to be a part of the Council over the next
several years.
Councilor Figley brought to the public' s attention that City Attorney Shields had been elected
as 2001 Treasurer of the Government Law Section of the Oregon State Bar. She

congratulated him on his recent election to this position.
She also thanked Richard Pugh for his service to the community over the past several years
and Woodburn was very lucky to have him as a Planning Commissioner and a City
Councilor.
Councilor Figley also thanked all the individuals involved in organizing a successful
Christmas Lighting program this past weekend.
Councilor Kilmurray also thanked Richard Pugh for his service and expressed her
appreciation to him for his openness, honesty, and willingness to talk about issues.
Councilor Sifuentez stated that the posada held last Saturday was just the beginning of the
posada's to be held over the next two weeks. A posada schedule was distributed to the
Council and the schedule will be available at City Hall for distribution to the public.
Councilor Chadwick also expressed her appreciation to Mr. Pugh for his community service
and hoped that he and his wife will enjoy their time together and remain in good health.
Richard Pugh stated that he appreciated the comments made by the Mayor and Councilors.
Many projects have been accomplished during his tenure however, he is very excited about
the Urban Renewal program which, in his opinion, is the key to making Woodburn a
beautiful City.
Councilor Sifuentez also thanked the Councilors for their private donations to the MacLaren
Youth Correction Facility for the toy project.
Mayor Jennings stated that, last Saturday afternoon, Jesse Settlemier's great grandson, who
had not been back in Woodburn for over 30 years, was visiting the Settlemier House and
telling numerous stories about his grandfathers.
Mayor Jennings also asked Councilor Nichols to thank Christine Jones for the work she s
did organizing the Christmas Music Festival, and to the choir directors of the various schools
that participated in the program.
The Mayor also mentioned that there is a possibility that a free right-turn lane' onto the
freeway is on the horizon and, if this is the case, Richard Pugh needs to be credited for his
hard work in getting this interchange improvement in the works.
The Mayor and Council each wished the citizens a Merry Christmas and Happy New Year.

Chemeketa. He stated even though she works at the main campus he thought there is a possibility of an

Chemeketa Community College; Dr. Cheryl Faulk, Dean of Regional Education; and Harvey Franklin,

Woodburn Campus Director. Mr. Deffenbaug indicated they would all be available for any questions.
Commissioner Griialva inquired how many more students will they serve with the additional facilities, what
will happen with the facility on Harrison St. and what programs will they bring that will enhance the facilities
so that students may obtain a two-year degree without having to travel to the Salem Campus?
Harvey Franklin, 3435 Drew Court NE, Salem, OR 97305 reported they intend to keep the Harrison St.
property because it is a very good property for educational purposes. He indicated that facility will be utilized
more for English as a Second Language and continue to use it for adult basic education. Mr. Franklin stated
the new building will be used to conduct ESL classes but there will be an expansion of general education.
He explained general education is the foundation upon what you build a two-year degree. This will enable
them to proceed moving towards one-year certificates and two-year degrees. Mr. Franklin also indicated
they will be able to eventually rotate with campus on an alternative year basis to provide the general
education degree. Additionally, the computer lab will be dedicated to Business Technology. Future plans
would be to expand that program toward a two-year degree. He also reported they will have a community
lab that will enable people to come in and use the lab to learn how to do e-mail etc. but will also be used to
increase their offerings in the technical area. Mr. Franklin stated they are currently in contact with 5,000+
students a year. He projects this number will grow towards 7,500 students once the facility is built.
Commissioner Bandelow asked what is the target date for completion of the project?
Lonnie Deffenbauq replied they are targeting September 2001 for completion of the project so that Fall
classes could begin at the facilities.
Commissioner Gdjalva questioned what will happen with the building that used to be a construction office
and the portable building? She also requested clarification regarding the fencing.
Lonnie Deffenbau.q responded those buildings will be removed. He clarified the fence with the slats will go
all the way down the edge of the existing perking lot that is close to the church then all the way down to
Oswald and up to the driveway. There will be a gate type of situation and then the fence comes around the
entire perimeter. Mr. Deffenbaug reported the chain link fence does not proceed along the westedy property
line beyond the pavement edge. Additionally, he indicated they intend to make a visual connection with the
downtown area on the other side.
Commissioner Gdjalva remarked she appreciates the project design connecting the downtown area.
Lonnie Deffenbau,q commented as the City develops the redevelopment plan for the downtown area they
would like to see a connection across the campus to the downtown.
Commissioner Gdjalva expressed her concerns regarding the maintenance of the Hardson St. building
because that building is another anchor for the downtown area.
Chairperson Young asked if the resurfacing of Lincoln St. will create problems for their project?
Lonnie Deffenbaug replied from a fiscal responsibility standpoint, digging is always more cost effective than
bodng but he understands the reason for that request in the Staff Report. He stated the storm/sewer
connection will be made at Lincoln St. and they do not have any issue with that. Mr. Deffenbaug said they
do not intend at the moment to use Lincoln St for water or fire line. In closing, Mr. Deffenbaug thanked
Staff for their help and suggestions throughout the process. He commented he does quite a bit of work in
three states and this was a very nice group to work with and they represented the City well.

DISCUSSION
Chairperson Young closed the public hearing and opened discussion from the Commission members.
Commissioner Griialva commented she is very much in favor of this project, likes the design and she likes
the applicant's openness to their role in the community.
Commissioner Bandelow concurred with Commissioner Grijalva's comments. She stated the design ties
beautifully to the downtown and is happy to see it go forward.
Chairperson Youn,q remarked the project is very well done and will be a tremendous asset for the downtown
area. He stated he is excited to have an expanded educational facility in the community and appreciates
the applicant's efforts to help us make our community better.
Commissioner Fletcher moved to approve Site Plan Review 00-27. Commissioner Griialva seconded the
motion. Motion unanimously carried.
FINAL ORDER

C._~. January Planning Commission Retreat
Staff requested input from the Commission as whether a retreat is something they would like to do. He
stated this would be a good opportunity to have an attorney come and go over conflict of interest and ex
parte communications issues as well as go over general responsibilities of a Planning Commissioner.
Additionally, he indicated this would provide the Commission an opportunity to ask questions about areas

that they would like to know more about.
Commissioner Grijalva commented one of the things that would have been helpful to her was an overview
of all the things that are in the department right now. She added that although the Commission receives the
Planning Project Tracking Sheet, they do not really know what is happening in the community i.e., Urban
Renewal project and the highway issues that relate to the work of the Planning Commission. Commissioner
Grijalva pointed out the Commission needs to have a snapshot of the issues within the community because
it all relates to planning.
Staff suggested a Planning Retreat once every quarter because it provides an opportunity to talk about
issues in general where the Commission may ask questions or concerns about specific issues in an
environment outside of this formal type of environment. Staff suggested the retreat be about four hours long
with the first two hours allotted to the attorney and the later two hours used to discuss Commissioner
responsibilities and general issues regarding what is going on in the City. He suggested a more definite
direction be obtain by the Commission at the first meeting in January as to how they want to do the retreat,
i.e. 8am - noon on a Saturday morning or break it up and do it two hours in an evening one night and two
hours another night.
It was a consensus amongst the Commissioners that the retreat be conducted on Saturday 8 am to noon.
Chairperson Younq requested Staff come up with a late January and early to mid February date that the
Commission can look at and determine what would be appropriate.
Staff requested the Commission provide Staff at the next meeting in January with suggestions or specific
topics they would like the attorney or Staff to address.

Chairperson Young thanked Staff for having the packets out eady. He commented it was great to have a

Staff responded at this point he expects it to go forward at their second meeting in January.

Commissioner Bandelow inquired whether any additional information has been received for the Kohl
Company project that was ruled incomplete as of November 21"?
Staff replied no further information has been received by the applicant. She indicated the applicant is
working on that and hopefully will obtain the information soon.
B_=. Building Activity for November 2000
Chairperson Youn(~ pointed out there were some very large projects that took place in 1998 and 1999. He
commented the 2000 figures represent a more normal growth pattem.
BUSINESS FROM THE COMMISSION
Chairperson Young stated there was discussion at the last Commission meeting regarding the Women's
Health Clinic where the Commission expressed their concerns regarding the traffic pattern and flow in that
area. At that time, is was decided that a letter of concern would be drafted by Chairperson Young and
Commissioner Mill for Mr. Brown.

Commissioner Bandelow pointed out the project is not located next to the Woodburn Family Clinic as stated
in the letter. She suggested the sentence stop after Glatt Circle. Commissioner Bandelow also suggested
a change of the landscaping on the curve that goes past the Cable Company because the shrubbery is quite
high on that corner and you can not see around that curve at all.
Commissioner Griialva interjected it would be best to have a stop sign or yield sign so that people know to
pause before they proceed.
Chairperson Younq indicated this will be addressed when the letter is completed and signed.
Commissioner Griialva thanked everyone for such a great year. She stated she will be involved in church
and the Urban Renewal project.
Commissioner Young commented Commissioner Grijalva's input has been greatly appreciated. He
mentioned it is unfortunate that she chose not to stay longer with the Commission but he understands she
wishes to continue on with other projects. He thanked her for her time and concern for the community.
Staff informed the Commission that the Mayor did reappoint Commissioner Lima to another four year term.
However, he did not make any appointments on any open seats and assumes the Mayor plans on doing
that at their first Council Meeting in January.
Commissioner Loner.qan stated the Commission has talked about the crossing from the High School in the
past. He commented it is important that we try to put pressure on all parties to try to come up with some
solution.
Staff reported Public Works, ODOT, School District and the City Administrator met today and his
understanding is that they had a very good meeting and they did come up with some potential solutions.
Commissioner Bandelow expressed her concerns that the other half of that problem will be forgotten. She
stated there is no place for the people to walk on the other side. She stated it does not only involve the high
school students but the people that live in the apartment complex and people just traveling down to the
store.
Commissioner Fletcher indicated that is a State highway rather than a City street.
Commissioner Bandelow questioned whether it would be the State's responsibility at the time that area was
improved to also continue sidewalk access under the overpass?
Staff explained the State would have to approve anything within the right-of-way.
Commissioner Loner,qan stated there was no High School when the State built the highway.
Chairperson Youn,q commented he could not understand the rationale that a State highway can't have a
crosswalk because there is a crosswalk at Seltlemier. Additionally, he added he does not understand why
it has to maintain 45 mph spccd limit there when most out of town traffic travels at a much higher rate than
that.
Commissioner Fletcher reported he will not be attending Commission meetings for the month of January
because he will be gone to Flodda.

Updates. Committee approved and accepted the new design of letterhead, as
reflected on the agenda.
Theater Rental. The Bungalow Theater was utilized by the homeschooling group
for a Shakespearean Play. The performances were well-attended, according to Matt
Smith, who estimated over 200 people attended the performances. Smith also stated
that the visitors visited the museum and looked at the displays. They may be a good
group to invite for tours in the future.
Tree l_Agh~ Reception. The Bungalow Theater gift shop held a cocoa and
cookies reception after the Christmas tree lighting at Warzinski Plaza. Hazel Smith
and Cindy Thomas stated that there was a good mm-out at the reception with an
estimated crowd of 80 people.
Storage Area. The Committee agreed to allow the museum to use the Theater stage
area as "temporary" storage. Amber Velasco suggested that perhaps the high school
woodshop teacher, Gary Amt, might be amenable to involving his class in building
storage shelves for the museum.
Introduca'on o£tlie newMuseum Director. Matt Smith introduced Kezia Merwin
to the Committee. Mis. Merwin proceeded to inform the Committee of her museum
and public program experience. She also explained her ideas for the future of the
World's Berry Center Museum.
Donated Items. Hazel Smith gave the museum a blue Woodbum school hat
donated by Joanne Borschowa, retired school teacher. Mrs. Smith also brought in a
Mexican Fiesta Parade Grand Marshall trophy, 1998, received by then Mayor Nancy
Kirksey.

vacating requested portion of Oswald Street right-of-way, subject to the conditions outlined
below:

The existing sanitary sewer main within the area to be vacated that serves Chemeketa
property shall be rehabilitated for infiltration removal for continued use as a private line or
it shall be abandoned. A standard manhole shah be constructed over the existing main at
the west end.
The existing storm sewer inlets shall be relocated in the modified fight-of-way to provide
for proper drainage of the public right-of-way.
Agreements and or easements shah be provided to ah franchised utilities for service
arrangements, if needed. The petitioner shah relocate any utility in the vacated right-of-
way which may require relocation.
A traffic mm around facility acceptable to Public Works Department shah be provided at
the end Oswald Street..
BA~KGROUN~:
1. Findings of Fact:
Location: The proposed right-of-way to be vacated is the West 150 foot portion
located between Front Street and Doud Street. A location map is provided on
Exln'oit I. A legal description of the area to be vacated is provided on Exh'bit 2.
Jurisdiction: The City has jurisdiction over the right-of-way proposed to be
vacated.
Current land use and zoning: The majority of the property surrounding the area
to be vacated is zoned Commercial Retail (CR).
The surrounding land use and zoning ~ not change by vacating the proposed
portion of Amey Road.
Current use of dOt-of-way proposed for vacation: The right-of-way proposed
for vacation is unimproved with substandard gravel surface with no curb,
substandard drainage facilities and no pedestrian facilities

Transportation needs: By vacating this portion of the public right-of-way the
needs of the public will not be prejudiced. The fight-of-way currently ends at the
railroad fight-of-way and it would not be feasible to apply for railroad crossing
permit to connect to Front Street.
2. Applicable Statues
In accordance with ORS 271,080 a petition has been prepared by a person
interested in vacating a public fight-of-way. As required by the ORS the petition
contained the consem of all the adjacent property owners and two thirds of the
A petition on behalf of Chemeketa Community College has been filed with the City
Recorder requesting that a portion of Oswald Street be vacated. Staffhas reviewed
the petition and finds it is complete and substantially conforms with the
requirements of ORS 270.080.
In accordance with ORS 271.100, Action by the Council, Resolution No. 1610
was passed on December 11, 2000, which set a date, time and place for the public
hearing on the petition to vacate a portion of Oswald Street.
Notice of public hearing has been published in the local paper in accordance with
ORS 271.110. Notice ofthe hearing was also posted on-site at each end ofthe
proposed area to be vacated.

ORS 271.120 Hearing Determination, provides for the governing body to hear the
petition and objections filed, deternfine whether the consent of the owners of
the requisite area have been obtained, whether notice has been duly given
and whether the public interest will be prejudiced by the vacation of such
street, The criteria as stipulated above has been meet and as of the date of this
~ no written objections have been submitted to the city.
F. The vacation meets all other state and local guidelines concerning street vacation.
CONCLUSION:
1. The consent of majority of the owners of the requisite area has been obtained.
2. Notice of the public hearin8 has been duly 8iven in accordance with ORS 271.110.
3. As of this date, no objections have been filled by property owners within the affected area.

R~COMMENDATION:
It is being recommended that the City Council adopt the attached Ordinance amending Ordinance
No. 2273, levying final assessment &costs for the improvement of Alley.

BACKGR0,UND:
The Downtown Alley project assessment district was based on the abutting properties to be
assessed at 50 percent of the project cost and the remaining 50 percent was absorbed by the city.
This was a reasonable approach since the resurfacing of streets is not assessed against the
properties and the alley in downtown did need major resurfacing upgrade.
Tax lot 92010-150 was incorrectly included in the district boundary for the Alley improvements
between Harrison and Hayes Street. The property is not contiguous to the Alley improvement,
does not benefit by the improvement in accordance with the method of assessment based on the
engineering report adopted by council on October 28,1996, and hence it should not have been
included in the assessment district. The property contiguous to the Alley and located east of this
property is included in the Local Improvement District and properly assessed.
Using the confusing tax assessor map information, the tax lot was thought to be 50 lineal feet of
the total 100 foot lineal frontage oftax lot 92010-160, the old city hall property owned by
Romelia Sanchez. Both tax lots, 92010-150 and 92010-160 were assessed for 50 lineal feet of
frontage, $2,275.00 each. However, only tax lot 92010-160 should have been included in the
assessment district and not the tax lot 92010-150 which does not abut the alley. This error
correction needs to be made promptly.
Therefore, it is recommended that Ordinance 2273 be amended to remove the assessment of
$2,275.00 from Tax Lot 92010-150. City funds would then be used to pay the amount ofthis
assessing. Correction of the error does increase the city share from 50°,4 to 54% of the total cost
of the project. It is advisable at this time not to open the public hearing process to redism~oute this
cost to the other property owner because of the added cost of the heating process and other
unforeseen issues thor may arise.
Alley improvement project lm not only improved the pavement it has improved the potable water
lines and reduced the storm water flow to the treatment facility due to separation of the storm
sewer system from the sanitary sewer system. Long term b~aefits have been achieved by the city
with the infrastrucm~ improvements, therefore it is recommended that the project be closed after

AN ORDINANCE AMENDING ORDINANCE NO. 2273 TO REMOVE AN
ASSESSMENT FROM A NON-BENEFITTED PROPERTY WITHIN THE LOCAL
IMPROVEMENT DISTRICT CREATED FOR THE IMPROVEMENT OF THE ALLEY
BETWEEN HARRISON AND WEST HAYES STREET; AUTHORIZING THE USE OF
CITY FUNDS TO PAY THE AMOUNT OF THIS ASSESSMENT; AND DECLARING
AN EMERGENCY.
WHEREAS, the City Council passed Ordinance No. 2194 forming a Local Improvement
District for the improvement of the alley between Harrison Street and West Hayes Street (the
"Alley LID"); and
WHEREAS, the funds received from the Alley LID were to pay for 50 per cent of the
total cost of the amount of this improvement and City funds were to be used to pay for the
remaining share; and
WHEREAS, the Council then passed Ordinance No. 2273 levying assessments within
the Alley LID; and
WHEREAS, it has now come to the Council's attention that, because of confusing tax
assessor's map, an assessment was inadvertently levied on Tax Lot 92010-150, a property which
does not benefit by the improvement in accordance with the method of assessment based on the
engineering report adopted by Council on October 28, 1996, and hence it should not have been
included in the assessment district; and
WHEREAS, the Council now wants to remove the assessment from Tax Lot 92010-150
and use City funds to pay for the amount of this assessment; NOW, THEREFORE,
THE CITY OF WOODBURN ORDAINS AS FOLLOWS:
Section 1. Section 2 of Ordinance No. 2273 is hereby amended to remove the
assessment of $2,275 from Tax Lot 92010-150.
Section 2. The Public Works Director is authorized to use City funds to pay the amount
of this assessment.
Section 3. The City Recorder is directed to remove any lien or potential lien against Tax
Lot 92010-150 as a result of the Alley LID.
Section 4. This ordinance being necessary for the immediate preservation of the public

Measure 7 Filing Fee

Recommendation: Approve the attached resolution setting a fee for filing a claim under Measure
7.
Background: On November 7, 2000 the voters of the State of Oregon approved Ballot Measure
7, amending the Oregon constitution to allow property owners to make a claim against a jurisdic-
tion that has restricted use of their property in a way that reduces its value.
Subsequently the City of Woodburn adopted an ordinance providing a claims processing proce-
dure for claims made based on Measure 7. Section 5 of the ordinance states:
A notice of claim must be accompanied by a fee to be paid in advance of acceptance for
filing to cover the costs of completeness review and application processing. This fee may
be established by resolution of the Council."
The attached resolution sets the fee at $3,000. It was constructed in a way intended to cover the
costs of a typical claim. The review process is similar to, although not identical to, an annexation
application, the fee for which is $1,354. It is intended to cover the costs of notification and re-
view. The ordinance does not require publication, but the cost of the appraisal must be covered.
The cost of the last six commercial appraisals commissioned by the City ranged from $1,200 to
$2,200. Interestingly the most expensive was an appraisal of bare land. The average cost was
$1,640.
The estimated total costs to be recovered is:

For convenience this is rounded to $3,000.
The resolution allows cost recovery when the cost of the City's appraisal is substantially above
the figure used to build the rate. In those situations the City Administrator "may add such
additional sums to the application fee as she/he deems necessary to compensate the City for the
actual costs."

Other jurisdictions in Oregon have authorized fees between $200 and $4,000, and the proposed
fee is within that range.
These preparations may all prove unnecessary. On December 6 Judge Paul Lipscomb of the
Marion county Circuit Court granted the League of Oregon Cities' request for a preliminary
injunction. The injunction temporarily stops the measure from taking effect until the Judge rules
on it constitutionality. Joining the League's suit are the cities of Ashland, Corvallis, Beaverton,
Eugene, Junction City, Portland, Tualatin, and Veneta as well as Benton Multnomah, and Wash-
ington Counties, Multnomah Commission Chair Bev Stein, and Portland Mayor Vera Katz.
Pending the Judge's decision, the future of the measure is uncertain. If the measure is found to
unconstitutional, claims filed previously would be nullified. There is the possibility of an appeal to
any decision that Judge Lipscomb might reach.
Woodburn's ordinance and the proposed fee resolution are efforts to be prepared in the event the
measure is found to be constitutional. Neither will be used unless circumstances require it.
Financial Implications: The fee is intended to simply cover the costs of processing the
application. It should neither generate excess revenue nor cost the taxpayers any additional
amount.

WHEREAS, the City Council passed Ordinance No. 2276 adopting a claims processing
procedure under the 2000 amendment to Article I, Section 18 of the Oregon Constitution (Ballot
Measure 7); and
WHEREAS, Section 5 of Ordinance No. 2276 provides that the City Council may
establish, by resolution, a claims processing fee for the submission of Ballot Measure 7 claims;
NOW, THEREFORE,
THE CITY OF WOODBURN RESOLVES AS FOLLOWS:
Section 1. Pursuant to Ordinance No. 2276, the claims processing fee for the submission
of claims under the 2000 amendment to Article I, Section 18 of the Oregon Constitution (Ballot
Measure 7) is hereby established at $3,000.
Section 2. In the event the actual costs incurred by the City associated with the
processing of the application (including the costs associated with the purchase of an independent
appraisal) are likely, in the opinion of the City Administrator, to be in excess of $3,000, the City

RECOMMENDATION: As a fulfillment of the prior agreed upon commitment, accept the
deeded strip of land, an easement for a visual clearance area, and the Parr Road
improvement assessment balance 0f $27,490.77 from Hope Lutheran Church.
BACKGROUND: The city council considered miscellaneous land transaction and payment
options from adjoining property owners during the Parr Road improvement process. The
bikeway construction that provided extra safety to children required additional right-of-way in
the vicinity of Hope Lutheran Church. According to new regulations, bikeways are required on
all arterial and collector streets. During the street improvement process, the city and the
church agreed on the transfer of a strip of land at a value of $13,745.38. In addition, as a
safety concerned property owner, the church also provided the city a large triangular visual
clearance easement for $1.00. The deeded land transaction agreement has reduced the
assessment amount to the church, for the Parr Road improvement, from $41,236.15 to
$27,490.77. The church has provided the city a warranty deed to the agreed strip of land, an
easement for a visual clearance area, and the remaining assessment balance of $27,490.77.
After acceptance of the land and the money, the church will not owe any assessment balance
for Parr Road improvements.
It is recommended that the council accept the land and $27,490.77 for Parr Road
improvements, which fulfills the entire obligation of Hope Lutheran Church.
Note: Public Works staff appreciates the pleasant working relationship that has developed
between the city and the church and this tone was set by the late Harold Eichsteadt.

Representing Cost Sharing of Parr Road Improvements
RECOMMENDATION: As a fulfillment of the prior agreed upon commitment, accept the
deeded strip of land parallel to Parr Road along with $9,802.23 from Mrs. Smith.
BACKGROUND: The City Council considered miscellaneous land transaction and payment
options from adjoining property owners during the Parr Road improvement process. The
properties located outside the city limits, having no city jurisdiction for street assessments,
were given special consideration so as to reach an agreement. The dedication of a strip of
land 10' wide and 393' long, along with $9,802.23, was agreed by the city and Mrs. Smith to
be a fair transaction. By accepting this offer, the city agrees that no assessments would be
levied against the property in the future for the costs associated with the recently completed
Parr Road improvement project. Mrs. Smith has provided the city a properly signed property
deed and has deposited $9,802.23 in the city's trust account.
The current action is in fulfillment of the already agreed upon decision on the part of the city
council and the property owner. Therefore, it is recommended that the city accept the
deeded strip of land and the deposited $9,802.23 from Mrs. Smith.

SUBJECT: Lighting at High School Entrance on Highway 214

RECOMMENDATION: Authorize staff to execute a contract with the Iow responsible
bidder to provide electrical power for lighting to be provided at the High School
entrance with Highway 214.
BACKGROUND: The city has been working with ODOT and the School District on the
installation of street lights at the entrance of the high school on Highway 214.
One of the proposed solutions is a lighted crosswalk area at the high school entrance
on Highway 214. The original plan proposed by the city was to provide two lights on
the north side of the roadway, one on each side of the driveway. ODOT safety
engineers felt the size of the lights proposed and their location would not provide
adequate lighting profiles for the raised median crosswalk proposed to be constructed
by ODOT in this area. They have required a light on each side in specific locations
with smaller wattage bulbs and this would require a bore under the highway to supply
power for the light on the south side.
The city, in consultation with Portland General Electric, had originally also planned to,
obtain power from near Meridian Drive and place it underground along the north side of
the state highway. Further discussions with ODOT and PGE have indicated that there
may be sufficient power available from a location on the high school property. This
may be the easiest way to obtain the needed power for these lights with the least
amount of delay.
Cost estimates for this revised configuration are still being obtained and coordination is
being completed with the School District on potential trenching across their property for
the power for these street lights and ODOT for the bore under the highway.
It is likely that the cost estimates for the required trenching and boring for electrical
power will not be available for council action at the regular meeting of January 8, 2001.
Staff is requesting authorization to enter into a contract with the contractor supplying
the Iow bid for required work to provide lights at the High School entrance to Highway
214. This will allow the work to commence without having to wait to obtain approval at
the January 22, 2001 council meeting.

November 20, 2000. The department has completed an extensive background and criminal
records investigation on the applicants. The following information was obtained.
Mr. Hector Fregoso has no criminal record and nothing of a questionable nature was
found in the background.
Mrs. Maria Fregoso drivers license was suspended on October 22, 2000 for failing a
blood alcohol breath test. Mrs. Fregoso has not been convicted of DUll as of this date
and has no criminal record and nothing of a questionable nature was found in the
background. If Mrs. Fergoso is found guilty on a DUII charge, OLCC may elect to
exclude her from operational activity of the restaurant.
Ms. Liduvina Fregoso has no criminal record and nothing of a questionable nature was
found in the background.

in the background.
Mr. Hector Fergoso was contacted during the course of the investigation in regards to the

a.m. to 9:00 p.m. Mr. Hector Fergoso advised they will only be selling beer and wine with
meals. He advised there will be no live or recorded music, no dancing, no pool tables, no dart
boards, and no lottery machines. Mr. Fergoso advised that Mafia Fregoso and Liduvina Fregoso
are only business partners in the corporation and will not be involved in the restaurant operation.
Taqueria Guadalarjara Restaurant has been established and located at Mall 99 since 1991. In
1998 the Woodburn City Council approved a liquor license application for this establishment.
The license was not denied by OLCC but was never issued due to incomplete applicant
information. A police records check of this business revealed the police department has
responded to this location seven times over the previous three years; all for minor incidents.

OLCC representative advised the applicants have since made operational changes at the
establishment to correct the problem. A police rescords check of the E1 Mayor Restaurant show
three complaints in 2000 for loud music. The applicant advised they have installed "sound
boards" to mitigate the noise problems.

RELEVANT FACTS: The site is located at 693 Glatt Circle, further described on Marion

The property to the south and east of the subject site is zoned CO and designated on
the Comprehensive Plan Map as Commercial. Existing offices are located on both of
these properties. The property to the west of the subject site, located in Marion County,
is zoned Urban Transition (UT) and designated on the Woodburn Comprehensive Plan
as Commercial. Residentially used property to the north of the subject site is zoned
Single Family Residential (RS) and designated Iow density residential in the
Comprehensive Plan.
The applicant is proposing to place the 21,000 square foot, two story medical office
building on the CO zoned portion of the site (Tax Lot #3400) and provide additional
parking for the proposed use on the CR zoned portion of the site (Tax Lot #2500). The
proposed building will contain medical offices, an education center, and a "wellness
center". The applicant indicated that the education center would be used for community
meetings, which would occur primarily in the evenings. The education center would be

Arby's restaurant on the west side of Interstate 5. It is addressed at 255 Arney Road,

The size of the property is 0.95 acres. The designated zoning is Interchange District
(ID). All surrounding properties are within the same district, with the exception of the

There was recently a Minor Partition made on the property between the subject site and
Arby's. As part of this partition, a reciprocal access and parking agreement was made

property. Arby's and the subject site each have one driveway onto the access
easement, and each would have reciprocal access to the other under the said

The property is relatively flat with an earth berm along the east property line. It is
partially covered with mowed grass. Part of the existing parking lot extends across the
Arby's property line onto the subject site. As part of this proposal, additional parking

NATURE OF APPLICATION: The applicant is requesting administrative approval to
adjust a property line between two large parcels along the east side of I-5. The request
is being made to conform to existing zone district boundaries as well as the layout of
public streets being constructed as part of the Montebello I Subdivision. One of the
affected properties is virtually landlocked, and the proposed adjustment would make
public street access readily available to this property. In addition, this proposal would
provide for future development of the land section zoned Multiple-Family (RM) District
located on the southwest corner of West Hayes Street and Evergreen Road.
RELEVANT FACTS: There are two parcels which would be affected by this property
line adjustment. They are located on the east side of Interstate 5, south of Wal-Mart,
north of Parr Road and west of Senior Estates No. 7. These parcels can be identified
on Marion County Assessor Maps as Township 5 South, Range 2 West, Section 13 Tax
Lot 200 and Township 5 South, Range 2 West, Section 14 Tax Lot 100.
The property line to be adjusted is approximately 2800 feet (1/2 mile) to the southwest
of the West Hayes/Evergreen intersection. The subject property line extends

approximately 1220 feet east from the Interstate right-of-way and then approximately
250 feet south. For purposes of this report, the parcel to the north of the existing
property line will be referred to as Tax Lot 200, and the parcel to the south as Tax Lot
100. Once the property line is adjusted as proposed, it would match the RM zone
boundary of the land section on the southwest corner of W. Hayes and Evergreen. This
section of land will be referred to as proposed Parcel 1, and the remainder of the land to
the southwest as proposed Parcel 2
Tax Lots 100 and 200 are currently designated with the Single-Family Residential (RS),
Multi-Family Residential (RM) and Commercial General (CG) zoning districts. Proposed
Parcel 1 will encompass the RM zone only, and Parcel 2 will still be made up of all three
of these districts and will be considerably larger than Parcel 1.
The subject properties make up a piece of land which is virtually flat and is mostly
undeveloped. The east section of Tax Lot 200 is currently under construction for the
Montebello Phase I Subdivision. Once Phases I and II of this development are
recorded, they will be separate properties. Tax Lot 200 is approximately 126 acres in
size, and Tax Lot 100 approximately 48 acres. Proposed Parcel I will be 7.32 acres,
and Parcel 2 approximately 167 acres. Parcel 2 will be reduced in size by about 30
acres upon recordation of both Montebello Subdivision phases.

NATURE OF APPLICATION: The applicant requested administrative site plan
approval to remodel the Public Works vehicle maintenance shop. The building is
currently in need of repair and remodeling, and the Public Works Department requires
the facility to be improved in order to better service its vehicles. The project will include
raising the roof 4.7 feet, replacing the entire roof of the structure (with the exception of
the 800 square foot extension to the rear) and adding a vehicle hoist and lubrication pit
in the two large bays on the south side of the building. There is also to be the removal
and addition of interior walls.
RELEVANT FACTS: The site is located at 105 "A" Street, on the northwest corner of
"A" Street and Broadway Street, further described on Marion County Tax Assessor
Maps as Township 5 South, Range 1 West, Section 18AB Tax Lot 12200. The site is
zoned Public Service (PS) District and Light Industrial (IL) District and is surrounded by
properties designated as Light Industrial. The use on this site is for public service, and
the building to be remodeled is on the PS portion of the property. The zone boundary is

along a pre-existing property line which runs parallel to the building approximately 25
feet to its rear (5 feet behind the 800 square foot extension).
The square footage of the building will not change as part of this project, nor would the
use of the property. The size of the existing building is approximately 4,000 square feet,
and the portion to be raised in height is approximately 1,900 square feet of the building.
This is not counting the 800 square foot extension to the rear which is a separate space
leased to the Willamette Valley Railroad. This building space is not included as part of
this project.
The site is 0.29 acres in size and is paved around the building except for a small portion
on the southwest side. There is no landscaping on the property, and the rear portion
has a chain-link fence (un-slatted) along its property lines.
