Brown, City AdministratorYL/" Urban Renewal Planning Committee Appointments Recommendation: It is recommended the City Council endorse the Mayor's selections for the Urban Renewal Planning Committee. Background: In October 2000, the City Council accepted an urban renewal feasibility analysis, and directed staff to proceed with design work and to complete an urban renewal plan. Discussion: State Law requires public involvement in all phases of urban renewal plan preparation. Communities often assure public involvement by appointing a committee to participate in plan preparation. The consultant for this project recommended Woodburn appoint an urban renewal planning committee, to assist with plan preparation and in conducting community meetings related to design work for the downtown area. It was recommended the committee represent a broad spectrum of community interests, including taxing entities that may be affected by an urban renewal district. Last month a public notice, seeking applicants to serve on the urban renewal planning committee, was published in the Woodburn Independent (Attachment 1). Local agencies Including the school, college and fire districts, the City, and County have also been contacted to Identify representatives to serve on the committee. This listing, with two Council appointments provides for a 17-member planning committee that represents a diverse group of interests, with a strong desire to be involved in the implementation of an urban renewal district in Woodburn. JCB Attachment 1 3E An Opportunity to Participate in the Formation of an Urban Renewal District to Revitalize Downtown Woodburn, Sections of Pacific Highway, Young Street, and Other Areas in Woodburn The Woodburn City Council recently authorized community design work, and the preparation of the plan required by Oregon Revised Statutes section 457 for an Urban Renewal District. The district, as currently proposed, encompasses Downtown Woodburn, sections of Pacific Highway, Young Street, and other areas in Woodburn. A copy of the map showing possible boundaries of the proposed district is available for viewing in the City Administrator's Office, located in City Hall, at 270 Montgomery Street, Woodburn. To assure the citizen participation provisions of ORS 457 are satisfied, Mayor Jennings will appoint a limited number of individuals to a planning committee that will assist in developing an Urban Renewal Plan. The Committee will work with City staff and the City's consultant in developing the urban renewal plan, and will be responsible for providing citizen input on matters such as boundaries of the proposed district, improvement projects, programs, and activities to be funded by urban renewal, and the urban renewal financing plan. The Mayor will appoint a 1 5 to 1 8-member committee representing local agencies and some or all of the following interests: . Property Owners in the Proposed District . Downtown Businesses . You and your staff are faced with the difficult task of implementing the measure in a manner that limits damage to the city's environment and quality of life while at the same time limiting severe damage to your financial status and capability to fund essential services. We do not envy your position. A. Claims Receipt. Processing & Publici tv In response to Measure 7, many cities and counties are rapidly adopting ordinances to establish procedural requirements for the submission of a claim under Measure 7. We strongly support those efforts. The measure itself does not set forth a specific process for the submission and review of such claims, and the need for clearly established procedural requirements is obvious. Claims processing ordinances should provide for filing claims that include the following information: - Name and address of the claimants - The amount of compensation requested - A description (and if possible, citation) of the local and/or state laws giving rise to the claim - The date the claimant became the owner of the property Claims processing procedures should provide for public notice and hearings on the claims. In particular, any claims that may be satisfied by waivers of or variances from zoning or other regulations should be heard only after notice to all property owners, the value of whose property would be reduced if the waiver or variance were granted. B. Purported Waivers We are concerned however, that some cities and counties are including "waiver" provisions that purport to give to the governing body the substantive authority to waive the regulation that is the subject of the claim, even if that regulation is required by state law, administrative rule or Goal. 1 6A Furthermore, to presume that the voters intended to repeal, fully or selectively, state and local land use regulations is unwarranted. Those laws and rules were not on the ballot. All we know for sure is what they adopted: a measure requiring compensation. Cities, counties, special districts and regional governments do not have the authority under Measure 7 or any other law or Constitutional provision to waive, repeal or override state laws and state rules. The Director of the Department of Land Conservation and Development has also expressed concern over "the adoption by cities and counties of ordinances that authorize waiver of land use regulations in order to avoid compensation claims." See his December 1, 2000 Memorandum on Measure 7 to the Land Conservation and Development Commission, a copy of which is attached. It may be possible, as an alternative to adopting a broad waiver provision, to craft a legally defensible "variance" mechanism for purely local regulatory and zoning requirements so long as the adoption of such a mechanism follows proper procedural requirements such as notice, public hearings, opportunity to seek judicial review, etc. A variance provision that amends the manner in which land use regulations are applied would be subject to the post-acknowledgment process of ORS 197.610-626. But, once again, local jurisdictions can not legally grant a variance to state requirements. Our Board has authorized our Staff Attorneys to appeal any ordinances that purport to waive, or could be construed as waiving, state land use laws, goals or rules, directly or indirectly. Please ensure that this letter is made part of the record for any process that leads to the adoption of any ordinance dealing with the implementation of Measure 7 in your jurisdiction. Also, I request to receive Notice of any such proposed ordinances and of the Public Hearings or Meetings at which those proposed ordinances are to be considered. Effect on Existing-Law: Measure 7 did not repeal land use otenviroamentallaws, -IUles or local plans or land use regulations. EDforcement of Existing Law: Because existing laws rentain in effect, including laws that direct the agency to enforce the state's land use laws (ORS 197.090, 197.319, . 197.636), tho agency must continue to enforce those laws. The earliest and most .. significant enforcement problem likely to confront the agency is the adoption by cities and counties of otdiDances that authorize waiver of land use regulations in order to avoid co~on claims. These ~~12r.es may violate state land use laws to the extent the authorize waiver orland use regulations that derive from those laws. EmtlDg Programs '- Periodic Review: Many cities and counties (over 100) are working on periodic review. Each has a work program' with a number of work tasks. Some work tasks Call cities and counties to adopt or amend plans or land use regulations. Arguably, . some of these adoptions"or amendments would reduce the value of some affected - properties. Of course, cities and counties will be reluctant to take these actions. Nonetheless, state statutes on periodic review require them to take these actions so long as state planning law requires them. 6A - - Existing Programs - Grants: Some penodic review and technical assistai1ce grants have conditions that require, and offer grant assistance for, adoption of amendments to local land ~e regulations. Some of these amendments may reduce the value of some affected properties. If local governments decide not to adopt the amendments, the department will have to renegotiate the grant agreemep.ts. Rulemaking: The department advises the commission not adopt or amend rules ilia! may be interpreted to-reduce property values for the following reasons: (I)_to avoid exposing local governments or the sta~e to compensation claims; and (2) to avoid exposing existing niIes and ordinances"to claims by a new set of property owners who acquire(iproperty after the effective dates of the original rules. A) Special Council Meeting on December 4, 2000: Mayor Jennings stated that a special meeting will be held at 6:00 p.m., however, if quorum will be present at 5:30 pm, he requested that the meeting time be changed since he would like to attend the Holiday Music Festival at the high school at 7:00 pm on that evening. Councilor Kilmurray stated that she did not know if she could even attend the special meeting, however, Councilors Bjelland, Pugh, Sifuentez, and Chadwick stated that they would be able to be at the meeting by 5:30 pm. The Mayor also stated tha~ the Oath of Office will be given to incoming Councilor Nichols who will be unable to attend the December 11 th meeting since he will be out of town on that day. B) Holiday Music Festival: This event will be held on December 1,4, & 6, 2000, 7:00 pm, at the High School Lectorium. He encouraged citizens to attend this year's program. C) Downtown Tree Lighting: On December 9th, 7:00 pm, the tree located in Warzynski Plaza will be lit. Prior to this tree lighting event, the Settlemier House tree will be lit at 6:30 pm and Councilor Sifuentez is organizing a candlelight procession from the Settlemier House down to Warzynski Plaza. He encouraged the public to participate in this annual event. Mayor Jennings thanked Bob Engle and Ben Miller for the donation of the trees at Warzynski Plaza and in the City Hall entry. D) Reception and Oath of Office on December 11, 2000: At the regular Council meeting of December 11 th, the Oath of Office will be given to the Mayor and Councilors Bjelland and Sifuentez. F) City Holiday Closures: The Public Library will be closed on December 24 and 25, 2000 and on January 1, 200 1; City Hall will be closed beginning at 12:00 noon on December 22,2000 and will re-open on Tuesday, December 26,2000; City Hall will also be closed on Monday, January 1,2001; the Aquatic Center will be closed on December 25, 2000 and January 1, 2001. 0300 Mayor Jennings stated that the pages in the packet were misnumbered and the materials for the Recreation and Parks SDC issue are numbered as lIB but should be lIe. Mayor Jennings also reminded the public that there are Board and Commission openings for which he is accepting applications and he encouraged interested citizens to apply. He plans on making appointments at the December 11 th Council meeting. Additionally, applications are being accepted for the newly created Urban Renewal Planning Committee which will consist of approximately 18 members of which 9 of the positions will be open to the public. 0424 CHAMBER OF COMMERCE REPORT. Cindy Vetter, representing the Chamber, updated the public on the upcoming Chamber events: 1) Business After Hours will be held on December 14th, 4:30 pm, at the Woodburn Company Stores; 2) Chamber Forum will be held on Wednesday, December 20th, 12:00 noon at the Settlemier House. Advance reservations are required for this event. 3) Settlemier House will be open to the public on December 10, 16, 17, 19,23 and 30, 2000. Admission fee is $5 and it will include hot wassil and cookies. 4) Annual Festival of Lights is co-sponsored by the Chamber and the Kiwanis. Entries for the lighting contest must be filed by December 13th and judging will take place on December 15th. 0540 COMMUNICATIONS: LETTER FROM OREGON DEPT. OF TRANSPORTATION. Mayor Jennings stated that he had received a letter from Dave Bishop, ODOT, informing the City that the sign bridge project is now on the STIP and is scheduled for construction in the summer of 200 1. The project will be put out for bid in June 200 1. Councilor Pugh expressed his dissatisfaction with the delay on this project since it was his understanding that the developer had already paid his share of the cost. The City will pay their 1/3 share once the project is completed and the developer will also pay the difference between his share and engineering costs once the project is completed. 0665 CONSENT AGENDA. PUGHlSIFUENTEZ... accept the consent agenda in its present form. The motion passed unanimously. 0692 PUBLIC BEARING: LOCAL LAW ENFORCEMENT BLOCK GRANT. Mayor Jennings stated that, following this hearing, the Council only needs to pass a motion to reflect their decision on this grant. Mayor Jennings declared the public hearing open at 7:15 p.m.. Police Chief Null stated that the Police Department was awarded a local law enforcement block grant from the Department of Justice in the amount of $11~144. This amount, coupled with a required City match of $1,238, brings the total funding allocation to $12,382. As part of the grant conditions prior to release of these grant funds, a local advisory board must make a recommendation as to the proposed use of these funds and a public hearing must be held for the purpose of receiving public comment on the use of grant funds. The Advisory Board met on October 31~ 2000 to review proposed uses of the funds and they recommended that the funds be used towards the purchase of a Mobile Computer System with a back-up proposal being an enhancement to the Bicycle Patrol Program. He stated that the Mobile Computer System proposal will cost approximately $200,000 of which $90,000 has already be set aside by the Budget Committee and an additional $60,000 to $80,000 will need to be allocated over the next 24 months in order to purchase the equipment and software. The City has 24 months in which to expend the grant funds. No one in the audience commented on the proposed use of the Block Grant funds. Mayor Jennings stated that the condition being modified is the requirement of a deep gravity sewer line to a sewer lift station. On roll call vote for final passage, the bill passed unanimously. Mayor Jennings declared Council Bill 2275 duly passed with the emergency clause. .1304 AMENDMENT TO AGREEMENT FOR URBAN RENEWAL CONSULTING SERVICES. Administrator Brown stated that the City has an existing contract with Spencer and Kupper which provided for 3 elements of work, one of which is the feasibility study presented in October 2000, the second and third being a design and visioning process for the downtown area and the compilation of the urban renewal plan. The consultants had intended to sub-contract out the design and visioning portion of the contract to an architect, however, the governor's office is interested in this project and have offered the City some money to expand the visioning process to make it more bi-lingual and user friendly to spanish-speaking individuals. This creates more administrative workload for the consultant and they have proposed to take that portion of the activity out of their contract. The amendment before the Council takes out the second element with a reduction in price on the contract. This will require a separate contract with the design consultant which has not been done as of this date. There will be some additional cost to this project, a portion of which will be offset from grant funds. In the staff memo, it was recommended that the discount for Parks and Recreation Systems Development charges be removed since the parks and community facilities bond issue did not pass at the November 'J'h election and the methodology originally adopted in November 1999 included a credit to offset potential property taxes paid by new development assuming the passage of the bond measure. A) Economic Opportunities Analysis Contract with ECO Northwest: Administrator stated that the final details of the contract are being worked out in order to keep within the $60,000 cost range and still provide information required by the City and State. It is anticipated that the contract will be let on Thursday and the contractor will begin their work on this study. B) League of Oregon Cities Time Capsule: Administrator Brown stated that LOC is putting together a time capsule as part of their 7sm anniversary celebration. Cities are invited to send a small item which is representative of the City today which can be shared with people when it is opened in 100 years. The item needs to be submitted by December 31 It and he asked the Council and/or public for ideas of what to forward to the League. C) Memorandum Opinion No. 2000-03: In Hubenthal v. City, LUBA case No. 2000- 050, LUBA remanded the case to the City to address the 24d1, 2sm, and 2(ft assignments of error and sustained a portion of the 33M and 34d1 assignments of error in part. Inorder for the City to proceed with this case, the applicant must submit a written request to: proceed with the remand, a public hearing scheduled before the Council with the scope of the hearing limited to the assignments of error sustained by LUBA, and Council determination as to whether the two relevant portions of the Zoning Ordinance have been adequately addressed. D) Memorandum Opinion No. 2000-04 (Ballot Measure No. 7): City Attorney Shields distributed copies of his memorandum opinion to the Council for discussion purposes since a proposed ordinance will be considered by the Council at the December 4d1 Special Council meeting. He stated that the implementation date for Ballot Measure 7 is December 7, 2000 and, if the Council decides to adopt an implementation ordinance, it needs to be adopted prior to that date. He stated that there is no model ordinance emerging from local government staff members, however, the Attorney General's opinion is expected very shortly. The two model types being considered by attorneys involve a land use model and a claims process model. After reviewing these two model types, he feels that the claims process model would be most appropriate and the draft ordinance in the agenda packet follows this type of model. Another major point is whether or not the local government has the option to decide in the face of the constitutional provision if compensation is due either to pay an amount or to elect not to apply this regulation. He also stated that claims filed under this ballot measure would not be covered by our insurance and settlements made would be paid for through the City's General Fund. In any event, there will be Ballot Measure 7 litigation pending on this issue for some time and until those issues are decided by the courts it is unknown as to what impact the measure will have on the City. 3109 Further discussion was held with the Council on the notice of claims process, retroactivity of claims as provided for in the measure, how federal and state requirements imposed by the City onto affected property may impact the City, and claim settlement. It was also noted that amendments to the ordinance can be adopted in the future once future court rulings and legislative actions have been addressed by the respective parties. 5134 MAYOR AND COUNCIL REPORTS. Councilor Chadwick thanked the public for their cards, telephone calls, best wishes, flowers and prayers over the last 3 months while recovering from her illness. Councilor Sifuentez commended the Mayor for organizing several the holiday activities within our community. statements have been finalized, and the City's auditors, Boldt, Carlisle, & Smith, have issued an unqualified opinion on them. As required by statute the financial statements and the opinion will be filed with the Secretary of State before December 31, 2000. The auditors stated: In our opinion, the general purpose fmancial statements referred to above present fairly, in all material respects, the fmancial position of the CITY of WOODBURN, Oregon as of June 30, 2000, and the results of its operations . . . for the year then ended. . . They also wrote: We noted no matters involving the internal control over financial reporting and its operation that we consider to be material weaknesses. Copies of the document and their transmittaIletter are available for review in the Finance Office. The report did note two items that are out of the ordinary: expenditures in excess of appropri- ations and deficit Fund Balances. Expenditures exceeded budget in the General Fund-Building Maintenance ($48), the Bonded Debt Service Fund-Fees ($363), the IS Fund-Materials and Services ($3,166), the Economic Development Fund-Capital Outlay ($4,000), and the Wastewater Capital Improvement Fund-{$28,508). 8F The over run in the General Fund was due to a charge that should have been recorded against the Parks Maintenance Budget; the error was not discovered until after the financial statements had been finalized. The $363 deficit in the Debt Service Fund was the fees paid to US Bank for managing the Pool Bonds. This item was omitted from the 1999-2000 budget; it has been included in the current budget. Although Materials and Services were overspent in the IS Fund, Capital was underspent, and the Fund in total was not over expended. The shift in actual expenditures reflect management's decision to postpone capital purchases in favor of operating solutions. The expense in the Economic Development Fund was the release of retainage from a prior year's project. In the Wastewater Capital Improvement Fund the over run was the result of the repayment of a conditional grant that was triggered by development of benefitted property. The land development was not foreseen when the budget was developed. Three funds had negative Fund Balances as of June 30, 1999: Housing Rehabilitation Special Assessment Parks Capital Improvement $(111 ,730) $(212,236) $( 72,946) The Housing Rehabilitation deficit occurred due to the grant operating on a reimbursement basis with the City required to expend the funds prior to requesting reimbursement. As of June 30, 2000 the City had made expenditures of $263,014 and was awaiting reimbursement from the State. A Special Assessment Fund by its very nature will have a negative fund balance. This type of fund is used to account for the issuance of debt to pay for local improvements. Until the debt is paid off, this fund will be negative. The Parks Capital Improvement deficit occurred due to expenditures for Centennial Park which were supported by a loan from the General Operating Reserve Fund. The repayment of the loan will be provided by system development charges to be collected in future years.. Traffic counts were taken at each of the locations requested to determine the amount of traffic entering the intersection from all directions. After analyzing the traffic count data it is apparent that the intersection of Patriot and Arlington should have stop signs installed. The other intersections did not meet warrants for the installation of stop signs. The Manual on Uniform Traffic Control Devices (MUTCD) states that stop signs can be warranted at the intersection of a less important road with a main road where the normal right-of-way rule is unduly hazardous. At the intersection of Patriot Street & Arlington Avenue it is recommended that stop signs be installed on Arlington Ave. because Patriot St. is the main access road into the subdivision off of Country Club Road. And also, because of the close proximity of Arlington Ave. to Country Club Road, which is approximately 100 feet. BACKGROUND: City of Woodburn bid number 21-05 for a hydraulically self-driven pipe cutter and was opened and read at 2:00 P.M. on December 5, 2000. Results were: Bidder Amount Ackley Tool Company Intermountain Sales E. H. Wachs Company $ 6,035.00 $ 6,575.00 $ 6,685.00 The hydraulically self-driven pipe cutter utilizes a diamond blade and is attached to the pipe and moves slowly around the ductile iron water pipe. This will replace the utilization of a hand held multi-purpose saw which required a large area around the pipe to be excavated. Use of the hand held saw is difficult and hard on the equipment and the saw operator. This saw will provide quick accurate circular cuts and reduce the time required to make pipe repairs. The approved Water Division Administration budget includes $6,500 for this item. Background: The Holiday Committee at Maclaren Youth Correctional Facility solicits and uses donations to purchase gift items for those students who do not receive gifts from their own families. The State of Oregon does not provide funds for that purpose, so the Facility must rely on contributions from the local community. Two years ago, the City Council contributed $200 to the Holiday Committee, in recognition of the community service projects Maclaren students had participated in during 1998. last year, Councilors chose to donate privately, rather than to support a contribution from City funds. Discussion: Attached is request from Maclaren Youth Correctional Facility for a contribution to its Holiday Committee for this holiday season. You are respectfully requested to determine whether you believe it is appropriate to make a contribution to the committee for 2000, and if so, how much you would like to contribute. Financial Impact: Funds to support a contribution are not currently budgeted. Each PRIME TIME series will take place once a week for six weeks. Reading and discussion leaders will conduct 90-minute meetings at publiC libraries for parents or guardians and their children, aged 6-10. At each session, a storyteller will dramatically present stories and model reading aloud. A humanities scholar will serve as the discussion leader. The library representative will introduce families to library resources and services. Younger siblings, aged 3 to 5, will participate in separate pre-reading activities.
