From: Jim Hendryx, Economic and Development Services Director Subject: Downtown Advisory Review Subcommittee - Increases to Approved Grant and/or Loan Requests RECOMMENDATION: Accept Downtown Advisory Review Subcommittee Report BACKGROUND: On August 8, 2011, the Urban Renewal Agency Board approved Resolution 2011-05, authorizing the Downtown Advisory Review Subcommittee to allow increases to approved grant and/or loan requests when project costs rise above original estimates. The resolution requires that the Subcommittee's action appear on the Urban Renewal Agency Consent Agenda. Discussion The Downtown Advisory Review Subcommittee has been authorized to approve increases to approved grant and/or loan requests when project costs increase above original estimates. Two requests to increase grant amounts have been approved by the Subcommittee. The Subcommittee approved the following increases; 1. Urban Renewal Grant URG 201 1-1 1 (237 N Front Street - Martinez) increased the amount of the exterior grant from $3,500 to $6,347, an increase of $2,847. 2. URG 2011-05 165 W Hayes (Parra) increased the amount of the exterior grant from $3,125 up to $4,000, an increase of $875. Agenda Item Review: City Administrator _x City Attorney _x 2 Finance X Honorable Mayor and City Council January 9, 2012 Page 2 Financial Impacts No additional fiscal impacts as amounts were appropriated in current year budget. 3 January 9, 2012 To: Urban Renewal Agency Board From: Jim Hendryx, Economic and Development Services Director Subject: Grant and Loan Criteria Clarification RECOMMENDATION: In agreement with the Downtown Advisory Review Subcommittee, it is recommended that the Woodburn Urban Renewal Agency Board further clarify the Downtown Urban Renewal Grant and Loan criteria with the adoption of the attached resolution. BACKGROUND: The Agency Board, through Resolution 2011 -0 1, adopted the Downtown Urban Renewal Grant and Loan program in February 2011. The program has been operational for approximately one year and operating under guidelines that were subsequently modified this past June. Recently, questions regarding the qualifications for the program have arisen. The City has some latitude on the administration of this program, such as how much funding is available, and what the qualifications are for the Storefront Improvement Grant and Building Rehabilitation Loan programs. The Downtown Advisory Review Subcommittee discussed the criteria and recognized that further clarification was needed to ensure that program intent is met. The Downtown Advisory Review Subcommittee, which was appointed by the Urban Renewal Agency Board, includes three members; City Councilors Jim Cox and Pete McCallum, and Tom Romer, downtown business and property owner. The Subcommittee is charged with reviewing and recommending grants and loan applications to the Urban Renewal Agency Board. DISCUSSION The Downtown Advisory Review Subcommittee met on December 29, 2011 to evaluate a grant application and discuss possible modifications to the program guidelines. Councilors Cox and McCallum both attended the meeting and Agenda Item Review: City Administrator _x_ City Attorney _x Finance _x 4 Grant and Loan Criteria Clarification January 9, 2012 Page 2 recommended that the grant and loan criteria be modified to allow business and property owners to complete work themselves, without compensation. Romer did not participate in the meeting, since his grant application was also under consideration. Councilors Cox and McCallum discussed the question of allowing property and/or business owners to complete work identified in the grant application and suggested the following clarifications to the program criteria: 1. Can a business and/or property owner complete work without compensation, other than for the cost of materials? Yes. Business and/or property owners may complete work identified in the grant application. All work requiring permits are subject to the normal review and inspection process, and must be completed in the time limits specified in the Grant and loan program. The Agency's interests are protected since payment is not made until the work is complete and approved by the City. Grantee labor cannot be compensated as part of this program. Work completed by the business and/or property owner shall not be considered as part of the required grant match. FINANCIAL IMPACT None 5 URBAN RENEWAL RESOLUTION NO. 2012-01 A RESOLUTION AMENDING THE DOWNTOWN GRANT AND LOAN PROGRAM PROCEDURES AND REQUIREMENTS WHEREAS, with the adoption of Resolution 2011-01, the Urban Renewal Agency Board established the Downtown Grant and Loan Program in February 2011; and WHEREAS, the Downtown Grant and Loan Program includes procedures and requirements; and WHEREAS, the Urban Renewal Agency Board amended these procedures and requirements by Resolution 2011-04 in June 2011; WHEREAS, based upon the recommendation of the Downtown Advisory Review Subcommittee, the Urban Renewal Agency Board wants to further amend these procedures and guidelines; NOW, THEREFORE, THE WOODBURN URBAN RENEWAL AGENCY RESOLVES AS FOLLOWS: Section 1. The Downtown Grant and Loan Program Requirements are amended as specified in the attached Exhibit "A" (changes are in bold print) to provide further clarification on how business and/or property owners may complete work identified in the grant application and work completed by the business and/or property owner shall not be considered as part of the required grant match. Approved as to Form: City Attorney Date APPROVED: Kathryn Figley, Chair Passed by the Agency Submitted to the Chair Approved by the Chair ATTEST: Christina Shearer, City Recorder Page 1 - RESOLUTION NO. 2012-01 Exhibit "A" Woodburn Urban Renewal Agency Downtown Grant and Loan Requirements Program Requirements 1) Projects must be located within the Urban Renewal & Downtown Development and Conservation Districts as identified below. 2) The applicant, after meeting with staff to discuss the proposed project, shall submit a completed Downtown Grant and Loan application and all supplemental materials provided. 3) Projects assisted by this program are to be rehabilitation and renovation projects showing significant improvement to the property and must be compatible with the downtown streetscape. 4) Exterior projects shall: • Comply with the City of Woodburn Downtown Architectural Design and Signage Standards. • Shall work towards restoring the building as closely to its original design as possible. • Shall be designed, constructed, and maintained to compliment and accept the architectural features of the building. All accessories, signs, awnings, etc. shall likewise compliment the overall character of the building. 5) Grants are available for up to $10,000 for exterior renovation and up to $5,000 for interior renovation. 6) Loans are available to property owners in amounts up to $25,000 and are secured by a Trust Deed in the amount of the loan. 7) Applications may be made for a combination of grant and loan funds. Eligible Projects: The following list is not exhaustive, but covers the majority of types of exterior projects that are eligible: _ADA accessibility .Awnings/canopies _Code deficiencies _Cornices _Design & architectural services (up to $1,000) _Electrical _Energy efficient upgrades (some restrictions apply) _Environmental remediation _Exterior lighting _Exterior painting and cleaning _Gutters & downspouts HVAC 7 _Permits _Plumbing _Seismic _Storefronts —Re -pointing _Replacement of missing decorative features _Removal of non -historic materials or additions _Roofing Windows Ineligible Activities: _Administrative costs or payments to borrower for direct labor costs _Building acquisition _Improvements to non-public faces of buildings _Inventory or other working capital _Landscape improvements _ Property maintenance _ Work (wages) not performed by a licensed contractor 8) There is a 50/50 match requirement required for the Grant program. Invoices must be submitted for reimbursement. No grant money will be disbursed until the project is completed and is approved by the Agency. 9) Grant and loan funds cannot be used for any work commenced or completed prior to project approval. 10) Grant and loan funds may be used for materials and services provided by licensed contractors. 11) All necessary building, electrical, plumbing permits must be obtained and work inspected and approved. 12) Grants and loans are dependent upon the availability of funds and must be reviewed and approved by the Downtown Advisory Review Subcommittee and the Urban Renewal Agency Board. 13) Projects shall be completed within one year of approval in order to be eligible for reimbursement. Grants provide for a single payment after receipts are provided and all completed work is accepted by the City. 14) The Urban Renewal Agency Board may grant one 6 month extension for work to be completed under this program. The applicant must submit a written request for the extension and provide justification for the Board's consideration. 15) Business and/or property owners may complete work identified in the grant application. All work requiring permits are subject to the normal review and inspection processes, and must be completed in the time limits specified in the program. Grantee labor cannot be compensated as part of this program. Work completed by the business and/or property owner shall not be considered as part of the required grant match. 16) All work done by licensed contractors in excess of $2,500 requires three bids 17) Eligible business and/or property owners may apply for grant and/or loan funds until the maximum amount specified in the Program Requirements 9 has been awarded. After the maximum amount specified in the Program Requirements has been awarded to benefit a particular property, reapplication for additional grant and/or loan funds for that property shall not be permitted until a period of 12 months has elapsed since the date of the last award. 18) Grant and loan funds are limited to physical improvements to the downtown buildings themselves. BACKGROUND: The Woodburn Urban Renewal Agency approved a comprehensive Grant and Loan program on February 14, 2011 for properties within downtown Woodburn. The program is designed to provide matching funds for exterior ($10,000) and interior ($5,000) improvements to commercial properties located in the historic downtown district. The program also provides loan funds ($25,000) to further these same improvements. The Downtown Advisory Review Subcommittee, which was appointed by the Urban Renewal Agency Board, includes three members; City Councilors Jim Cox and Pete McCallum, and Tom Romer, downtown business and property owner. The Subcommittee is charged with reviewing and recommending grants and loan applications to the Urban Renewal Agency Board. Tom Romer, the applicant for this grant application, wishes to make roof repairs on the property at 607 N. Front Street, which is within the downtown area. Given the conflict of interest, Tom Romer did not participate or attend the Subcommittee meeting where his grant application was considered. The Subcommittee met on December 29, 2011 to consider the grant application. Councilors Cox and McCallum, representing a majority of the Subcommittee, recommended approval of the grant application. Information from the Marion County Department of Assessment and Taxation indicates the property is owned by KESTER SCHULER LLC., a business entity whose sole member and registered agent is Tom Romer. Tom Romer is also the operator of Romer Furniture & Appliance, located at 607 N. Front Street. • That the property is within the Urban Renewal & Downtown Development and Conservation (DDC) District The property is within the Urban Renewal and Downtown Development and Conservation (DDC) District. • That the proposal complies with the downtown architectural design standards and signage standards The exterior grant is intended to repair the existing roof, which is not visible to the public. This request does not impact the appearance of the building nor signage. • That the project encourages greater marketability of the downtown area The proposed grant is intended to improve commercial properties within downtown Woodburn. Investment in downtown properties improves the overall marketability of the downtown. • That the proposal will complement the existing historic downtown core The grant is intended to repair the existing roof, which is not visible to the public. This particular grant application is intended to assist the business owners to make improvements to their property by repairing the roof. The request is consistent with the program criteria. Conditions of Approval 1. There is a 50/50 match requirement required for the Grant program. Invoices must be submitted for reimbursement. No grant money will be disbursed until the project is completed and is approved by the Agency. 2. Grant and loan funds cannot be used for any work commenced or completed prior to project approval. 3. Grant and loan funds may be used for materials and services provided by licensed contractors. 4. The request shall be approved unless significant changes have occurred to this ordinance or the use is no longer allowed as originally approved. In making a decision to grant the extension, the Director shall consider if there is a need to modify the decision or conditions of approval to meet standards in affect at the time of the extension request. 4.102.06 Interpretation A. Interpretations, Generally 1. An ambiguous term in the Woodburn Development Ordinance may be interpreted in the final decision of any Type II, III or IV application or by a request for a formal interpretation by the City Council. A request for a formal interpretation may be initiated by the Director when, in the administration of the Code, the Director deems it appropriate that a question as to the intent of the Woodburn Development Ordinance be formally rather than administratively resolved. Alternatively, any person, upon application, may request a formal interpretation. 2. The purpose of a formal interpretation is to clarify the intent of the Woodburn Development Ordinance and its application in particular circumstances. The Council shall not, by interpretation, vary or modify any clear and unambiguous provisions of this ordinance. Formal interpretations shall be processed as a Type IV application. 3. Formal interpretations made by the Council shall control future administration and enforcement of the Woodburn Development Ordinance until vacated or superseded by Council or incorporated as an amendment of the Woodburn Development Ordinance. 4. The Director shall keep a log of all formal interpretations. B. Interpretation and Application of Code Language 1. The terms or words used in this Code shall be interpreted as follows where the context demands: words in the present tense include the future; the singular number includes the plural and the plural number includes the singular; the word "shall" is mandatory and not discretionary; the word "may" is permissive; the term "should" is discretionary, the masculine gender includes the feminine and neuter; the term "this Code" shall be deemed to include the text of this Code, the accompanying Official Zoning Map and all amendments made hereafter to either; the term "standard" indicates a mandatory requirement; the term "guideline" indicates a norm that is accepted in the community but which is not a mandatory requirement. 2. The Director shall have the initial authority and responsibility to interpret all terms, provisions and requirements of this Code. The City Council shall have the final authority to interpret all terms, provisions and requirements of this Code. 3. The Code shall be read literally. Regulations are not more or less strict than as stated. 4. Proposals for uses where the code is silent or where the rules of the Code do not provide a basis for concluding that the use is allowed, are prohibited. Section 4.102 Page 4.1-17 1 and transcript fee within the appeal period is a jurisdictional defect and will result in an automatic rejection. If an appellant prevails at hearing or on appeal, the transcript fee shall be refunded. C. Notice of the Appeal Hearing: The Director shall issue notice of the appeal hearing to all parties who signed in or participated, either orally or in writing, before the close of the public record. Notice of the appeal hearing shall contain the following information: 1. The file number and date of the decision being appealed; 2. The time, date and location of the public hearing; 3. The name of the applicant, owner and appellant (if different); 4. The street address or other easily understood location of the subject property; 5. A description of the permit requested and the applicant's development proposal; 6. A brief summary of the decision being appealed and the grounds for appeal listed in the notice of appeal; 7. A statement that the appeal hearing is confined to the issues raised in the notice of appeal; and 8. A general explanation of the requirements for participation and the City's hearing procedures. 4.102.02 Call -Up Review by the City Council: Type II and III Decisions A. Authority: Whether or not an appeal is filed, the City Council may, by majority vote, initiate a review of a Type II or III decision. B. Procedures: 1. A summary of all Type II and III decisions shall be forwarded to the City Council as an information item by the Director at the time the decision is mailed to the applicant. 2. Review under this Section shall be initiated before the adjournment of the first regular City Council meeting, following the date the City Council receives notification of the decision. 3. Review shall replace a filed appeal of the decision. The appellants of any appeal filed before a City Council call for review, shall receive a full refund of the filing fee. 4. The City Recorder will set the hearing date for the City Council review, considering the 120 -day rule. 5. The notice, hearing and decision procedures for a City Council review shall follow the provisions of the Woodburn Development Ordinance provided for appeals. 4.102.03 Enforcement A.
