RECOMMENDATION:
In agreement with the Downtown Urban Renewal Advisory Committee, it is
recommended that the Woodburn Urban Renewal Agency Board approve the
Urban Renewal Exterior Grant for up $400.
BACKGROUND:
The Woodburn Urban Renewal Agency approved a comprehensive grant and
loan program on February 14, 2011 for properties within downtown Woodburn.
The program is designed to provide matching funds for exterior ($10,000) and
interior ($5,000) improvements to commercial properties located in the historic
downtown district. The program also provides loan funds ($25,000) to further
these same improvements.
The Downtown Urban Renewal Advisory Committee considered this request on
May 6, 2011 and recommended that the Board approve the grant for up to
$400.
Proposal
The applicant initially submitted an exterior grant application to make repairs to
the roof, install new windows and repaint the entire building located at 409 - 429
Front Street. Since submittal, the request has been narrowed to repairing and
repainting a portion of the building (429 Front Street), with the remainder of the
request to be submitted at a later date.
The Oregon Main Street Program offered one-time free design services to
interested communities as part of this program. Their design team met with Mr.

and Mrs. Gomez on April 19, 2011. The applicants want to wait and receive
their input before proceeding with the rest (roof repair and window
replacement) of the exterior grant proposal.
The exterior grant program is intended to improve the exterior of buildings
located downtown. The following list is not exhaustive, but covers the majority of
types of exterior projects that are eligible for grant funding:

Program Criteria:
Property Location & Ownership
The property is located at 429 North Front Street. Information from the Marion
County Department of Assessment and Taxation indicates the property is owned
by the Daniel and Bertha Gomez, the applicants.
• That the property is within the Urban Renewal &Downtown Development and
Conservation (DDC) District
The property is located at the northwest corner of Hayes and Front
Streets, within both the Urban Renewal and the Downtown
Development and Conservation District.
• That the proposal complies with the downtown architectural design standards
and signage standards
The applicant intends to make minor repairs and to repaint the
exterior of the building. Paint colors will be different from what
currently exists on the building (tan) and are appropriate to the
history of the building. Choosing from the "Kelly -Moore Historic
Lifestyles of the West paint booklet, the applicants picked Galleon
Blue paint for the body of the building, and Alhambra Cream for the
accent and trim.
• That the project encourages greater marketability of the downtown area
The proposed grant is intended to improve commercial properties
within downtown Woodburn. Repairing and repainting the exterior of
the building improves the overall appearance of the downtown area.
• That the proposal will complement the existing historic downtown core
Repairing and repainting the exterior of the building further improves
the character of the downtown. The building is in need of minor
exterior repair and repainting. The use of historic colors to repaint
the building will further improve the appearance of the building.

• That the project design works toward restoring the building as closely to its
original design as possible
The applicant intends to repair and repaint the exterior of the
building with colors appropriate to the time period of the building.
Choosing from the "Kelly -Moore Historic Lifestyles of the West:
Galleon Blue will be used for the body of the building, while
Alhambra Cream will be used for the accent and trim. The use of
historic colors to repaint the building will further improve the
appearance of the building.
• That building interiors are improved with a focus on addressing code -related
improvements
Not applicable.
• That the project is in the public interest
The Grant and Loan program is intended to assist property and
business owners in making improvements to properties within the
downtown area. Grant funds will be used for those purposes and are
in the public interest.
Summary and Conclusion
The Downtown Grant and Loan program is intended to encourage and assist business
and property owners to invest in the downtown. This particular grant application is
intended to assist the business owner to make improvements to their property by
removing the underground fuel oil tank. The request is consistent with the program
criteria.
Conditions of Approval
1. There is a 50/50 match requirement required for the Grant program. Invoices must
be submitted for reimbursement. No grant money will be disbursed until the project
is completed and is approved by the Agency.
2. Grant and loan funds cannot be used for any work commenced or completed prior to
project approval.
3. Grant and loan funds may be used for materials and services provided by licensed
contractors.
4. All necessary building, electrical, plumbing permits must be obtained and work
inspected and approved.

5. Projects shall be completed within one year of approval in order to be eligible for
reimbursement. Grants provide for a single payment after receipts are provided and
all completed work is accepted by the City.
6. All work will be done by licensed contractors and the applicant needs to provide at
least three bids for every aspect of work greater than $2,500.
7. Business registration is required for any person engaging in business within the City
of Woodburn.

by Mary Parra. The applicant and property owner are one and the same.

The property is located at 165 W Hayes Street and is located within the
Urban Renewal and Downtown Development and Conservation (DDC)
District.
• That the proposal complies with the downtown architectural design standards
and signage standards
The request includes repairing the existing flat commercial roof.
This portion of the request does not affect building design or
appearance, nor does it affect signage.
The second aspect of the request involves replacing materials used
on the underside of the existing metal awning with similar materials.
The present materials are rusted and sagging. The request improves
the existing appearance of the building.
• That the project encourages greater marketability of the downtown area
The proposed grant is intended to improve commercial property
within downtown Woodburn. The existing roof and awning are in
need of repair, and replacing both of these features will result in
improvements to the building, thereby improving marketability of the
downtown.

The request involves replacing the existing commercial roof on the
building and making repairs to the metal awning that extends over
the sidewalk.

commonly used throughout the downtown and are appropriate.

RECOMMENDATION:
In agreement with the Downtown Urban Renewal Advisory Committee, it is
recommended that the Woodburn Urban Renewal Agency Board approve the
Urban Renewal Exterior Grant application from the Old Woodburn Hospital for
up to $10,000.
BACKGROUND:
The Woodburn Urban Renewal Agency Board approved a comprehensive grant
and loan program on February 14, 2011 for properties within downtown
Woodburn. The program is designed to provide matching funds for exterior
($10,000) and interior ($5,000) improvements to commercial properties located
in the historic downtown district. The program also provides loan funds ($25,000)
to further these same improvements.
The Downtown Urban Renewal Advisory Committee considered this request on
May 6, 2011 and recommended that the Board approve the grant for up to
$10,000.
Proposal
The applicant, Markla LLC, initially requested grant funds to remove an old
heating oil tank and the surrounding impacted soil, at the office building
located at 397 N. First St. The applicant states that the project prepares the
property for further improvements and that the proposed removal will not
negatively affect the present appearance of the property. This is an
environmental remediation project which is the public's best interest.

Subsequently, an amended application was submitted to repaint the building
with paint colors similar to those that exist today. The total of both projects will
cost up to $20,000, with the grant request providing 500 of the funding.

Program Criteria
• Property Ownership
The property is located at 397 North First Street. Information from the Marion
County Department of Assessment and Taxation indicates the property is owned
by Markla, LLC, in Woodburn, Oregon.
The applicant and property owner are one and the same. Verification has
been received stating that the property owner authorizes this improvement.
• That the property is within the Urban Renewal &Downtown Development and
Conservation (DDC) District
The property is located at the southwest corner of Hayes and First
Streets, within both the Urban Renewal and the Downtown
Development and Conservation District.
• That the proposal complies with the downtown architectural design standards
and signage standards
Removal of an underground heating oil fuel tank does not impact the
exterior of the building.
The applicant also intends to make minor repairs and to repaint the
exterior of the building. Paint colors are similar to what currently
exists and are appropriate to the history of the building. Choosing
from the "Miller Historic Colour Collection"; Jewett White will be
used for the body of the building, while Burnt Umber will be used for
accent and trim.
• That the project encourages greater marketability of the downtown area
The proposed grant is intended to improve commercial properties
within downtown Woodburn. Removal of an underground heating oil
tank improves the marketability of the property, while addressing
any environmental problems associated with the underground fuel
tank. Repairing and repainting the exterior of the building improves
the overall appearance of the downtown area.

• That the proposal will complement the existing historic downtown core
Removal of the underground fuel tank demonstrates continued
investment in the downtown district. Having environmental issues
remediated further improves the downtown.
As noted by the applicant, the building formally housed the
Woodburn Hospital. Repairing and repainting the exterior of the
building further improves the character of the downtown. The
building is in need of minor exterior repair and repainting. The use
of historic colors to repaint the building will further improve the
appearance of the building.
• That the project design works toward restoring the building as closely to its
original design as possible
This standard is not applicable to removal of the underground oil
fuel tank, since it does not impact the exterior of the building.
The applicant intends to repair and repaint the exterior of the
building with colors appropriate the time period of the building.
Choosing from the "Miller Historic Colour Collection"; Jewett White
will be used for the body of the building, while Burnt Umber will be
used for accent and trim. The use of historic colors to repaint the
building will further improve the appearance of the building.
• That building interiors are improved with a focus on addressing code -related
improvements
This standard is not applicable to this since the request does not

• That the project is in the public interest
The Grant and Loan program is intended to assist property and
business owners in making improvements to properties within the
downtown area. Grant funds will be used for those purposes and are
in the public interest.

Summary and Conclusion
The Downtown Grant and Loan Program is intended to encourage and assist business
and property owners to invest in the downtown area. This particular grant application is
intended to assist the business owners to make improvements to their property by
removing the underground fuel oil tank. The request is consistent with the program
criteria.
Conditions of Approval
1. There is a 50/50 match requirement required for the Grant program. Invoices must
be submitted for reimbursement. No grant money will be disbursed until the project
is completed and is approved by the Agency.
2. Grant and loan funds cannot be used for any work commenced or completed prior to
project approval.
3. Grant and loan funds may be used for materials and services provided by licensed
contractors.
4. All necessary building, electrical, plumbing permits must be obtained and work
inspected and approved.
5. Projects shall be completed within one year of approval in order to be eligible for
reimbursement. Grants provide for a single payment after receipts are provided and
all completed work is accepted by the City.
6. All work will be done by licensed contractors and the applicant needs to provide at
least three bids for every aspect of work greater than $2,500.
7. Business registration is required for any person engaging in business within the City
of Woodburn.

Genera! Terms and.Conditions
I . This estimate shall remain effective for a period of 20 days from the date it is signed by Xavier, as set forth below.
2. Subsurface conditions, including but not limited to the presence of groundwater, may require additional work beyond
the scope of work described above. In such an event, Xavier will prepare and submit to client a revised Service
Agreement. Client shall have 48 hours in which to accept such revised Service Agreement. Client further agrees to
compensate Xavier for reasonable value of the work performed under this Service. Agreement on a time and
materials basis plus 10% profit.
3. Xavier shall not be responsible for damage to concrete, landscape or owner installed utilities unle.;s specifically
noted otherwise..
4. Upon acceptance by Client, Xavier agrees to start and diligently pursue work through to completion, but shall not be
responsible for any of the following: issuance of necessary permits, acts of neglect- or omission of C€lent or Client's
agents, inclement weather, strikes, lockouts, boycotts, or other labor union activities, extra work ordered by Client,
acts of public enemy, riots or civil commotion, failure of Client to make payments when due, or delays caused by
inspections or changes ordered by inspectors or governmental bodies, or other causes reasonable beyond Xavier's
control.
5. This estimate does not become a binding agreement until signed by both Xavier and Client. This Service Agreement
is made and shall be governed by the laws of the state of Oregon,
f. Unless payment is to be made through escrow at closing, the terms of payment are 50% deposit of the
minimum price before commencement of work, with payment in full due upon completion of work.
If payment is to be made through escrow at closing, Client shall advise Xavier of the title company,
title officer and fax number so that Xavier may provide its invoice for work prior to closing. In
consideration of Xavier's agreement to be paid from escrow, in accepting this Service Agreement,
Client irrevocably authorizes the title company named below to pay Xavier at closing the entire
amount billed by Xavier for the scope of work described herein.
7. If any suit., dispute, or action shall arise from or in connection with this Service Agreement, or the ;services to be
provided hereunder, the prevailing party shall be entitled to recover all reasonable: attorney's fees, costs and
expenses incurred, whether at arbitration, trial, on appeal or in bankruptcy proceedings.
8. This Service Agreement: constitutes the complete agreement between the parties for -the work described herein, and
there are no representations, guarantees or warranties other than those expressly: incorporated herein, nor are there
any agreements collateral hereto. No subsequent agreement relating hereto shall be binding upon Xavier or Client
unless in writing and signed by the party being bound,
