As a follow-up to our telephone conversation this date, the City considers our Urban Renewal Plan as a
"new plan" with an effective of March 12,2002 (date the plan was approved by the voters). Therefore, no
changes will be made the our UR-50 form which was submitted to your office on July 15, 2003.

as we are concerned, we need to let the County know that we will be going forward as a "new plan".

Information is correct - I assume that we are waiting for a response from Jeannette Lohner and no action

Hi John,
Hard to believe they're just giving you the choice of new plan or window
plan, because Jeannette was clear that the plan's effective date is
after the election, making it a new plan. In any case, there were no
local options in place in FY 2002/2003 and I didn't project any to be in
place in the future. However, if one were to be adopted, in my view and
in my projections, it would not be divided for or produce any revenue
for urban renewal.
I'm taking the liberty of forwarding your message and my response to
Jeannette for her review.

Jeff. Thanks for the warning. Seeing as how I won't be able to ask you
this for two weeks, I'll ask now.
The filing of our UR-50 form with Marion County generated an
interesting exchange as to the effective date of our plan. Per
Jeannette Lohner's advice, we view our effective date as that on which
the voters approved the plan - March 2002, not the date the Council
originally adopted it, August 2001. We filed our UR-50 as a "new" plan,
rather than a "window" plan - based on our understanding of the
effective date. Apparently, January 2002 statutory changes created the
difference between new and window plans. The County initially
questioned our choice of plan, and tried to require a correction - they
viewed the effective date as the date the ordinance was adopted by
Council. We challenged that interpretation. They contacted the State
Department of Revenue, who told them we could take our choice of either.
As they explain it, the main difference is that under the window plan,
we will receive a piece of any local option levies approved after
January 2002. Under the new plan we would not.
We believe it is most appropriate, given the advice we have sought and
received on the matter, to consider ourselves a new plan. We are also
against taking a piece of the local option levies of various agencies
who need all the money they are going out to bond for. In the dim
recesses of my memory, I can almost recall having talked with you about
some of this subject matter already - if so, forgive me for bringing it
up again.
Now, to the question: Are your calculations of revenue flow are based
on a March 2002 effective date? And, do they assume any projected
revenue from local option levies that might be passed during the life of
the plan?
