August 14, 2017 minutes COUNCIL MEETING MINUTES AUGUST 14, 2017 0:00 DATE COUNCIL CHAMBERS, CITY HALL, CITY OF WOODBURN, COUNTY OF MARION, STATE OF OREGON, AUGUST 14, 2017 CONVENED The meeting convened at 7:00 p.m. with Mayor Figley presiding. ROLL CALL Mayor Figley Present Councilor Carney Present Councilor Lonergan Present Councilor Schaub Absent Councilor Morris Present Councilor Ellsworth Present Councilor Serratos Absent Staff Present: City Administrator Derickson, City Attorney Shields, Economic Development Director Johnk, Community Development Director Kerr, Police Lieutenant Millican, Police Sergeant Shadrin, Code Enforcement Officer Weathermon, Assistant City Attorney Granum, Communications Coordinator Horton, Community Relations Manager Gutierrez-Gomez, City Recorder Pierson 0:00 ANNOUNCEMENT City Hall will be closed August 21, 2017 and the Library will be open from noon to 5:00 p.m. Public Safety Services will still be available. Councilor Lonergan added that garbage service will be on a holiday schedule due to the eclipse. The City Council meeting scheduled for August 28, 2017 has been cancelled. The next Council meeting will take place September 11, 2017. City Hall, the Library and transit service will be closed September 4, 2017 in observance of Labor Day. The Aquatic Center will be open normal hours. 0:04 BUSINESS FROM THE PUBLIC Mayor Figley announced to the audience that if they are here to discuss Woodland Crossing or other development applications that is not something the City can legally handle as a citizen complaint. There will be a hearing on Woodland Crossing sometime in September or October and it will be more appropriate to express your concerns during these hearings. Shantelle Naeve,788 Ogle St., stated that she received a citation for her chicken pen not being covered and that she was shocked by this because she has not had an issue before. She added she now has a neighbor that does not like her chickens and it seems the ordinance is being interpreted differently now than when she first got her chickens. She added that she was told the citation was the wrong procedure for this issue and was given a letter stating that she was in violation of Ordinance 2434 which says she needs to enclose and put a roof on her chickens. City Attorney Shields stated that this is something that will be in front of the Municipal Court Judge and not for the City Council to decide. Kara Romero, 1340 W. Hayes, stated that she believes backyard food raising is a right and that the regulations of how a chicken coop should be designed can be a financial burden to some people which seems unfair. She added that the more we regulate down to the fine details of how we are supposed to behave it prevents people talking to people. 1:21 CONSENT AGENDA A. The motion passed unanimously. 1:22 COUNCIL BILL NO. 3038 - A RESOLUTION AUTHORIZING EXECUTION OF A COLLECTIVE BARGAINING AGREEMENT BETWEEN THE CITY OF WOODBURN AND THE AMERICAN FEDERATION OF STATE COUNTY AND MUNICIPAL EMPLOYEES AFSCME LOCAL 642 FOR A CONTRACT BEGINNING JULY 1, 2017 AND ENDING JUNE 303 2019 .Lonergan introduced Council Bill No. 3038. Recorder Pierson read the bill by title only since there were no objections from the Council. City Administrator Derickson thanked the bargaining teams for their work during negotiations. On roll call vote for final passage, the bill passed unanimously. Mayor Figley declared Council Bill No. 3038 duly passed. 1:30 COUNCIL BILL NO.3039-A RESOLUTION GRANTING CONSENT OF THE CITY OF WOODBURN TO A CHANGE OF CONTROL TRANSACTION INVOLVING WAVEDIVISION VII, LLC Lonergan introduced Council Bill No. 3039, Recorder Pierson read the bill by title only since there were no objections from the Council. On roll call vote for final passage, the bill passed unanimously. Mayor Figley declared Council Bill No. 3039 duly passed. 1;31 PLANNING COMMISSION APPROVAL OF A MODIFICATION TO A CONDITION OF APPROVAL RELATED TO LANDSCAPING FOR THE WASHINGTON ELEMENTARY SCHOOL (CU 201.7-03) Council declined to call this item up for review. CITY ADMINISTRATOR'S REPORT City Administrator Derickson thanked everyone who worked at the Fiesta, thanked the Council for their participation and announced that they had a record turnout. He added that City Hall will be closed on August 21 due to the eclipse and that he will be working from the Page 2 - Council Meeting Minutes, August 14, 2017 COUNCIL MEETING MINUTES AUGUST 14, 2017 Police Department, 1:3,2 MAYOR AND COUNCIL REPORTS Mayor Figley thanked Scott, staff and volunteers who,helped make the Fiesta so special, Councilor Carney complimented staff on the Fiesta and that it is a great event that we can all be proud of and helps us understand each other in this community. Councilor Ellsworth stated that she enjoyed the Fiesta and complimented the Parks Department on how great the parks are looking. She added that she appreciates that the library is being used as cooling stations. She also stated that with the eclipse coming up she wants to make sure people have plenty of food and water on hand and that people: check to make sure their eclipse glasses are ANSI approved. Councilor Morris concurred with Councilor Ellsworth on using the correct glasses during the eclipse. He added that Fiesta was a good neighbor. He: also stated that he plans on providing the Council a full report on.the leadership training he went to in July sometime in September. 0:35 ADJOURNMENT Morris/Ellsworth... meeting be adjourned.
