the Mill Creek Pump Station Pumps #1 & #3 Removal & Replacement
Project to the lowest responsible bidder, Trench Line Excavation, in the
amount of $294,850.00.

BACKGROUND/DISCUSSION:
On August 22, 2017, the City was notified that City Attorney N. Robert Shields has
received the James Epps Award from the International Municipal Lawyers
Association (IMLA). This national award recognizes municipal attorneys who
have been active in IMLA during all or part of their career and have represented
the same community for at least 30 years. I have attached the nomination
letter, which details Bob's contribution to the community over his tenure, for your
review and general information. This award recognizes the significant
achievement of having the political and legal skills necessary to persevere
through changes in government over this extended period.

On behalf of the City of Woodburn, Oregon we are excited to nominate Woodburn City Attorney N.
Robert(Bob) Shields for the International Municipal Lawyers Association's (IMLA) 2017 James H. Epps III
Award for Longevity of Service to a Community. Bob is a member of IMLA in good standing.
There are many reasons why Bob should be recognized for his tenure as Woodburn's city attorney. Bob
became Woodburn's City Attorney in 1982 after having been an Assistant County Counsel for
Washington County, Oregon. Over the course of his career in Woodburn, Bob has served the community
in many important roles. For example, he has been Woodburn's city prosecutor, land use legal advisor,
client litigator, human resources counsel and its general counsel on wide ranging public policy issues
that have come before the City Council and City Hall. Bob has worked with every city department and
has developed an extensive amount of expertise in all aspects of government and municipal law.
Bob provides high level professional legal advice with both patience and humor, he is known for his
ability to provide complex legal analysis in an easy-to-understand style, even when his
recommendations may be contrary to his client's preferred course of action. Bob is seen as an integral
and trusted member of Woodburn's executive leadership team and distinguished professional in our
community.
As a departmental manager, Bob has successfully administered the City's legal services program
strategically, skillfully keeping an eye on the challenges that lay ahead thus ensuring the city attorney's
office continues to meet Woodburn's needs.Today, Bob manages a full range of in-house legal services
from supervising the assistant city attorney, to overseeing collective bargaining, personnel litigation,
land use planning, ordinance development, and advising the City on complex policing matters. In 2012,
Woodburn Mayor Kathy Figley awarded Bob the Mary Tennant Award for Excellence,the City's highest
recognition for public service.
Beyond his commitment to serving the City of Woodburn, Bob is an active member of Oregon's legal
community. He was a member of IMLA's Statewide Organizing Committee for its annual meeting in
2006, he served on the League of Oregon Cities Legal Advocacy Committee,the Oregon State Bar's
Government Law Section, the District Attorney's Association and the International Association of Chiefs
of Police (Legal Advisor Section). In 2003, Bob was awarded the Oregon State Bar's Leadership Award as

chair of the Government Law Section. As the above accomplishments illustrates, Bob is well regarded
among his peers and associates.
Finally, Bob has been instrumental in helping the City Council achieve some of its biggest goals, such as
the settlement of the City's Urban Growth Boundary expansion litigation, the City Council's
Comprehensive Code Update and Revision Project. Even more importantly, he managed the legal
aspects associated with the 2008 Woodburn bank bombing tragedy, a difficult undertaking for which he
was later recognized by Woodburn Proud Inc., a local community nonprofit organization.
It is worth pointing out that, in addition to his technical skills, Bob believes in the empowerment of
others and has been a mentor to the next generation of professionals seeking a government law
practice
Over the years, Bob has served the City of Woodburn with distinction, upholding the highest standards
of professional ethics,while helping our City navigate challenging legal issues as a means to
accomplishing its goals. It's for these reasons and more that we urge IMLA to award Bob with the 2017
James H. Epps III Award for Longevity of Service to a Community.

City Hall will be closed August 21, 2017 and the Library will be open from noon to 5:00 p.m.
Public Safety Services will still be available. Councilor Lonergan added that garbage service
will be on a holiday schedule due to the eclipse.
The City Council meeting scheduled for August 28, 2017 has been cancelled. The next
Council meeting will take place September 11, 2017.
City Hall, the Library and transit service will be closed September 4, 2017 in observance of
Labor Day. The Aquatic Center will be open normal hours.
0:04 BUSINESS FROM THE PUBLIC
Mayor Figley announced to the audience that if they are here to discuss Woodland Crossing
or other development applications that is not something the City can legally handle as a citizen
complaint. There will be a hearing on Woodland Crossing sometime in September or October
and it will be more appropriate to express your concerns during these hearings.
Shantelle Naeve,788 Ogle St., stated that she received a citation for her chicken pen not being
covered and that she was shocked by this because she has not had an issue before. She added
she now has a neighbor that does not like her chickens and it seems the ordinance is being
interpreted differently now than when she first got her chickens. She added that she was told
the citation was the wrong procedure for this issue and was given a letter stating that she was
in violation of Ordinance 2434 which says she needs to enclose and put a roof on her chickens.
City Attorney Shields stated that this is something that will be in front of the Municipal Court
Judge and not for the City Council to decide. Mayor Figley stated that there appears to be
some confusion about the document received and asked that after the meeting Police

Lieutenant Millican speak with Ms. Naeve so she can understand what the process is.
Kara Romero, 1340 W. Hayes, stated that she believes backyard food raising is a right and
that the regulations of how a chicken coop should be designed can be a financial burden to
some people which seems unfair. She added that the more we regulate down to the fine details
of how we are supposed to behave it prevents people talking to people.

Lonergan introduced Council Bill No. 3038. Recorder Pierson read the bill by title only since
there were no objections from the Council. City Administrator Derickson thanked the
bargaining teams for their work during negotiations. On roll call vote for final passage, the
bill passed unanimously. Mayor Figley declared Council Bill No. 3038 duly passed.

City Administrator Derickson thanked everyone who worked at the Fiesta, thanked the
Council for their participation and announced that they had a record turnout. He added that
City Hall will be closed on August 21 due to the eclipse and that he will be working from the

Mayor Figley thanked Scott, staff and volunteers who helped make the Fiesta so special.
Councilor Carney complimented staff on the Fiesta and that it is a great event that we can all
be proud of and helps us understand each other in this community.
Councilor Ellsworth stated that she enjoyed the Fiesta and complimented the Parks
Department on how great the parks are looking. She added that she appreciates that the library
is being used as cooling stations. She also stated that with the eclipse coming up she wants to
make sure people have plenty of food and water on hand and that people check to make sure
their eclipse glasses are ANSI approved.
Councilor Morris concurred with Councilor Ellsworth on using the correct glasses during the
eclipse. He added that Fiesta was a good neighbor. He also stated that he plans on providing
the Council a full report on the leadership training he went to in July sometime in September.

License Type: Change of Ownership, Off-Premise Sales - Permits beer, wine,
cider sales and liquor for off-site consumption only.
On August 3, 2017, the Woodburn Police Department received a change of
ownership application for an Off-Premise Sales liquor license for Woodburn
Liquor Store. This is a currently licensed store selling food and beer.
The Woodburn Liquor Store is located at 1519 N. Pacific Hwy, Woodburn,
Oregon 97071 . The hours of operation are from 10:00 A.M. to 6:00 P.M. Sunday,
10:00 A.M. to 8:00 P.M. Monday through Thursday and 10:00 A.M. to 9:00 P.M.
Friday and Saturday. The market provides no entertainment nor does it have
seating inside or outside. The Police Department has not received any
communication from the public or surrounding businesses in support of or
against the proposed change.
DISCUSSION:
The Police Department has completed a background investigation in
connection with the OLCC on the applicants and found nothing of a
questionable nature to preclude the issuance of this license.

SUBJECT: Award of Construction Contract for the Mill Creek Pump Station
Pumps #1 & #3 Removal & Replacement, BID #2018-01
RECOMMENDATION:
That the City Council, acting in its capacity as the Local Contract Review Board,
award the construction contract for the Mill Creek Pump Station Pumps #1 & #3
Removal & Replacement Project to the lowest responsible bidder, Trench Line
Excavation, in the amount of $294,850.00.
BACKGROUND:
The subject Capital Improvement Project is identified in the approved budget
for fiscal year 2017/18. Two of the three main pumps at the Mill Creek Pump
Station are not working properly and need to be replaced. These pumps are
approximately 20 years old, and have been repaired periodically as parts have
worn out. It has reached the point where it is now much more cost-effective to
replace the pumps rather than try to keep repairing them as they break down.
The Mill Creek Pump station pumps approximately 98% of the City's Wastewater
to the Treatment Facility. This project involves all work required for the installation
of Mill Creek Pump Station Pump #1 & Pump #3.
Bids were publically opened on August 31, 2017. Three (3) responsive bids were
received as follows:
Trench Line Excavation $294,850.00
Stettler Supply Co. $315,785.00
DSL Builders $357,800.00
The Engineer's Estimate is: $220,150.00

DISCUSSION:
This is a critical project that will restore the Mill Creek Pump Station to its design
flow capacity. The three bids are significantly higher than the Engineer's
estimate due mainly to the costs associated with the sanitary sewer bypass
pumping that will be required to maintain wastewater flow throughout the
duration of this project.
The contract award is in conformance with public contracting laws of the State
of Oregon as outlined in ORS Chapter 279C and the laws, regulations of the City
of Woodburn, therefore, staff is recommending the contract be awarded.
FINANCIAL IMPACT:
The subject project is identified in the adopted fiscal year 2017/18 Budget and
funded by the Sewer Capital Construction Fund and the Equipment
Replacement Fund.
