Res 2099 - Sole Source Contract for Flygt Pumps COUNCIL BILL NO. 3037 RESOLUTION NO.. 2099' A RESOLUTION AWARDING A SOLE SOURCE CONTRACT TO XYLEM WATER SOLUTIONS USA, INC. FOR THE PURCHASE OF TWO FLYGT PUMPS FOR THE REPLACEMENT OF MILL CREED PUMP STATION PUMP #1 AND PUMP 3, AND ADOPTING FINDINGS WHEREAS, The City Council, acting as the Local Contract Review Beard, has the authority under the City's public contracting rules, and consistent with State law, to award a public contract for goods and services available from only one source,. and WHEREAS, the City needs to replace pump #1 and Pump #3 at the Mill Creek Pump Station; and WHERE'AS, the Flygt pumps are only available from a single source and this is the only brand of pump that is completely compatible with the Mill Creek Pump Station; and WHEREAS, the City Council has determined that the purchose of the two pumps is a sole source procurement based on the findings attached to this resolution; NOW, THEREFORE, THE CITY OF WOODBURN RESOLVES AS FOLLOWS: Section 1. That the City Council, acting as the Local Contract Review Board, hereby award the sole source pump purchases to Xylem Water Solutions USA, Inc. in an amount of $213,919.60, Section 2. This sole source contract is approved based on the Findings affixed as Attachment "A''' and incorporated herein. Section 3. The City Administrator is authorized to execute a contract with the Xylem Water Solutions USA Corporation upon Council approval of this resolution. A sole source procurement is required for the replacement of the two mill creek pump station pumps for the following reasons: 1. Compatibility— The Mill Creek Pump Station is specifically designed far the operation of Flygt pumps, which are compatible with existing system configurations. Therefore, no major modifications to existing intake and discharge piping, electrical systems or existing pump bases are required. These Flygt pumps, used in various City lift stations and for Pump #2 at the Mill Creek Pump Station, permit centralized service and maintenance. Flygt pumps have near-exclusive application at the Wastewater Treatment Facility. 2. Performance - The Manufacturer (Xylem Water Solutions MSA, Inc) has incorporated numerous features that promote efficient operation and reduce regular maintenance, when compared with other products, Flygt pumps are specifically designed to avoid plugging, and require less frequent regular attention than do other pumps. Flygt pumps are exclusively owned and distributed by Xylem Water Solutions USA, Inc. 3. Reliability --Flygt pumps exhibit long term pump reliability due to the unique features that are inherent in their pumps. This is a critical factor in determining the brand of pump to be used in City pump stations because a breakdown of these pumps can lead to sewer overflows and costly bypass pumping until they are repaired or replaced. 13
