The motion passed unanimously. 0:04 PRESENTATIONS West Hayes Street—Interim Public Works Director Liljequist provided a presentation on the options for West Hayes Street improvements. Council provided comments and questions periodically throughout the presentation. Mike Huarte, 612 N. Cascade, an owner of Driftwood Mobile Estates, stated that tenants are willing to work with the City and he wants to be sure that no homes are forced to be moved and that narrower is better. Maxine Fitzgerald, 612 N. Cascade Dr., stated that they have very little yard space right now and that if the arborvitae and fence go they will no longer have any privacy. She added that she takes great pride in her yard and would hate to see it go. She asked when the improvements will start. Mayor Figley stated that it wouldn't happen until next summer and wouldn't happen without getting community input. Frank Pinkal, 612 N. Cascade, stated that his house is right by the fence and that if the fence is removed he will get more garbage in his yard. Lee Elyea, 612 N. Cascade, stated that she wants these people protected and isn't concerned about the arborvitae being removed as much as the fence, however, if the fence was torn down requested a temporary fence to go up during the improvements. Councilor Lonergan stated that its part of the transportation plan. Steve Clark, states that he drives a street legal golf cart and would like to see the bike lanes take golf carts. There was a consensus of the Council to go with Option 41 in regards to width and Option 41 in regards to the intersection. RECESS Mayor Figley called for a short recess. 1:08 BUSINESS FROM THE PUBLIC Miguel Salinas, 2076 S Willamette, West Linn, provided a letter to City Council regarding the Fiesta Mexicana and its history. He stated that the website for Fiesta Mexicana looks good but has concerns about it being called the McDonald's Woodburn Fiesta Mexicana and that what that means may not be clear to people. If there are going to be sponsors it should be clear that they are sponsors. Elvira Arce, 5419 Windsor, stated that she was a member of the Woodburn Club Latino Americano which sponsored the Fiesta Mexicana. She added that the club is no longer around but it left a foundation for the Fiesta. She questions why the City of Woodburn has not given the club the credit it is due. 1:21 CONSENT AGENDA A. The motion passed unanimously. 1:22 COUNCIL BILL NO. 3036 - A RESOLUTION ADOPTING THE CITY OF WOODBURN REPRESENTATION IN THE UPDATES TO THE MARION COUNTY MULTI-JURISDICTIONAL HAZARD MITIGATION PLAN Lonergan introduced Council Bill No. 3036-Recorder Pierson read the bill by title only since there were no objections from the Council. Kathleen Silva, with Marion County Emergency Management, spoke on the importance of the Multi-Jurisdictional Hazard Mitigation Plan. On roll call vote for final passage,the bill passed unanimously.Mayor Figley declared Council Bill No. 3036 duly passed. 1:30 INTERGOVERNMENTAL AGREEMENT FOR SCHOOL RESOURCE OFFICERS Lonergan/Ellsworth... authorize the City Administrator to sign a new Intergovernmental Agreement (IGA) with the Woodburn School District for School Resource Officer services. She added that in this hot weather remember not to leave children or pets in vehicles and to check on vulnerable neighbors. Councilor Ellsworth announced that the July 41' Kiwanis chuck wagon breakfast will be at Legion Park and there will be fireworks at Centennial Park which will include music and vendors. She added that Relay for Life will take place at Centennial Park the weekend after the fourth and that there are new restaurants at the outlet mall. Councilor Schaub stated that the Father's Day event downtown was fantastic. She added that there were two accidents on Oregon Way and Country Club today and she would like to see if someone could contact ODOT in regards to accident data at that location. City Administrator Derickson stated that he will have Interim Public Works Director Liljequist contact ODOT about doing an assessment on this. BACKGROUND: The City Attorney and City Administrator's employment contracts allow their participation in the City's approved deferred compensation program, which is considered part of their overall compensation. Throughout their employment, contract amendments have been made changing the City's contribution for various reasons. For instance, in February 2012, the City Administrator and City Attorney each voluntarily modified their existing agreements in order to reduce the City's contribution during a period of General Fund shortfall. At other times, contract language was added so that the City's deferred compensation contribution was provided both as a match, and then as a "non-matched" contribution. The most recent example occurred when the City Council approved a contract amendment for the City Administrator on April 13, 2015, which included language that defined the City's contribution as a straight contribution, without any mention of an employee match. However, since 2015, a contract addendum has re-established the contribution as a match. Changes between match versus non-match contributions appear to be unintentional and inconsistent with contract and their addendums. Agenda Item Review: City Administrator_x_ City Attorney_x Finance_x- 7 Honorable Mayor and City Council July 24, 2017 Page 2 DISCUSSION: Recently, it has come to my attention that, for both the City Attorney and the City Administrator, the City's deferred contribution is being provided for as a fixed contribution, which is inconsistent with current contract language but established in a past contract language. Unfortunately, this discrepancy was a result of an error and oversight on the part of the Human Resources Department in seeing that the last change was made. Neither the City Administrator nor the City Attorney had any role in the implementation of these agreements nor were they aware of the issue. There are instances where the City's contribution has been less and sometimes more than what the match amount would have been. Based on the City Council's discussion at the time, I believe the Council's decision was to provide a deferred compensation contribution, consistent with current practice, as a straight contribution for both of these two employees. However, due to HR's oversight, this change did not occur resulting in the need for the Council to authorize the Mayor's signature on a contract amendment to being their contracts in line with practice. By making this change, the City Council will simplify the administration of these contracts, making future errors far less likely. FINANCIAL IMPACT: There is no financial impact to the budget, as the recommendation does not bring a change to the current practice. 8 Iii♦ 4 B V' July 24, 2017 TO: Honorable Mayor and City Council through City Administrator FROM: Eric Liljequist, Interim Public Works Director SUBJECT: Mill Creek Pump Station - Pump #1 and #3 Replacements RECOMMENDATION: That City Council, acting as the Local Contract Review Board, adopt a Resolution and Findings awarding a sole source contract to Xylem Water Solutions USA, Inc. for the purchase of two Flygt pumps for the replacement of mill creek pump station pump #1 and pump #3, in the amount of $213,919.60. BACKGROUND: Two of the three main pumps at the Mill Creek Pump Station are not working properly and need to be replaced. These pumps are approximately 20 years old, and have been repaired periodically as parts have worn out. It has reached the point where it is now much more cost-effective to replace the pumps rather than try to keep repairing them as they break down. The Mill Creek Pump station pumps approximately 98% of the City's Wastewater to the Treatment Facility. This is a time sensitive repair and the lead time on these pumps are 12-13 weeks after the PO is received by the vendor. All three pumps must be operational for Wet Weather conditions beginning in late October historically. DISCUSSION: The Wastewater Section of the Public Works Department is requesting the purchase of two pumps that are only available from a single source. The Flygt Pumps will be purchased from Xylem Water Solutions USA, Inc., who is the exclusive owner and distributor of Flygt products. Public Works is replacing these pumps with a new model compatible with the complex configurations of the pump curves. The Flygt pumps manufactured by Xylem Water Solutions USA, Inc. incorporate numerous features that promote efficient operation and reduce regular maintenance, when compared with other products. The Mill Creek Pump Station is specifically designed for the operation of Flygt pumps, which are compatible with existing system configurations. No major modifications are needed for existing intake and discharge piping, electrical systems or existing pump bases. Flygt pumps have near-exclusive application at the Wastewater Treatment Facility. These Flygt pumps, used for Mill Creek Pump Station pump #2 and also used in various City lift stations, permit centralized service and maintenance. Public Works intends to follow the standard procurement process for the installation of these two pumps in the coming months. This construction project will be open to public bids, advertised in the Daily journal of Commerce, and brought to City Council for contract award under an upcoming Council agenda item. FINANCIAL IMPACT: The cost of two Flygt pumps is $213,919.60. Sufficient funding has been approved in the adopted 2017-18 Sewer Fund and Equipment Replacement Fund Budgets. 10 COUNCIL BILL NO.3037 RESOLUTION NO. 2099 A RESOLUTION AWARDING A SOLE SOURCE CONTRACT TO XYLEM WATER SOLUTIONS USA, INC. FOR THE PURCHASE OF TWO FLYGT PUMPS FOR THE REPLACEMENT OF MILL CREEK PUMP STATION PUMP #1 AND PUMP #3, AND ADOPTING FINDINGS WHEREAS, The City Council, acting as the Local Contract Review Board, has the authority under the City's public contracting rules, and consistent with State law, to award a public contract for goods and services available from only one source; and WHEREAS, the City needs to replace pump #1 and Pump #3 at the Mill Creek Pump Station; and WHEREAS, the Flygt pumps are only available from a single source and this is the only brand of pump that is completely compatible with the Mill Creek Pump Station; and WHEREAS, the City Council has determined that the purchase of the two pumps is a sole source procurement based on the findings attached to this resolution; NOW, THEREFORE, THE CITY OF WOODBURN RESOLVES AS FOLLOWS: Section 1. That the City Council, acting as the Local Contract Review Board, hereby award the sole source pump purchases to Xylem Water Solutions USA, Inc. in an amount of $213,919.60. Section 2. A sole source procurement is required for the replacement of the two mill creek pump station pumps for the following reasons: 1. Compatibility — The Mill Creek Pump Station is specifically designed for the operation of Flygt pumps, which are compatible with existing system configurations. Therefore, no major modifications to existing intake and discharge piping, electrical systems or existing pump bases are required. These Flygt pumps, used in various City lift stations and for Pump #2 at the Mill Creek Pump Station, permit centralized service and maintenance. Flygt pumps have near-exclusive application at the Wastewater Treatment Facility. 2. Performance - The Manufacturer (Xylem Water Solutions USA, Inc.) has incorporated numerous features that promote efficient operation and reduce regular maintenance, when compared with other products. Flygt pumps are specifically designed to avoid plugging, and require less frequent regular attention than do other pumps. Flygt pumps are exclusively owned and distributed by Xylem Water Solutions USA, Inc. 3. Reliability — Flygt pumps exhibit long term pump reliability due to the unique features that are inherent in their pumps. This agreement represents the first step in updating the City's Transportation System Plan ("TSP"). BACKGROUND: Jurisdictions in Oregon are required to adopt a Comprehensive Plan that addresses 20 years of future growth. This Comprehensive Plan must comply with the statewide planning goals and guidelines and include numerous components that address things like public facilities, economic development, and transportation. A key component of the Comprehensive Plan is the Transportation System Plan ("TSP"), which identifies needed transportation improvements to accommodate projected growth. The TSP is a document that outlines projects, policies, and strategies to improve all modes of the transportation system within the City over the next 20 years. After several years of legal challenges, Woodburn's Comprehensive Plan was finally acknowledged in January of 2016. The resulting Plan modified land use allocations considerably, which now impacts the overall transportation system. The TSP needs to be updated to reflect the changes in anticipated growth. Additionally, it needs to recognize the several major transportation improvements that have been completed since the TSP was last updated, including reconstruction of the I-5 Interchange, major improvements to State Hwy 214 (Newberg Hwy), and completion of the I-5 Transit Center. The specific objectives of this TSP update and revision project are to: Agenda Item Review: City Administrator_x_ City Attorney_x_ Finance—x- 14 Honorable Mayor and City Council July 24, 2017 Page 2 • Adopt an Updated TSP that provides for a safe, efficient, well-connected multi-modal transportation network, based on the needs of existing and planned land uses; • Determine infrastructure plans to support walking and cycling to and from local schools, consistent with the Safe Routes to School Program; • Determine a prioritized list of needed transportation facilities and services considering likely future revenues; • Develop plan elements that guide pedestrian and bicycle facilities to achieve maximum connectivity between bicycle, pedestrian, transit, community destinations, and securing an intermodal network of safety and access for all types of users; • Preserve the function and capacity of state facilities; • Ensure consistency with applicable laws and adopted plans; and • Develop implementation policies which support a safe, convenient, and economical transportation system for all modes. In order to accomplish these goals and objectives, the City has looked to an ODOT-sponsored grant program that will provide the City with the resources and funds it needs to complete the TSP update and revision project. DISCUSSION: In May of 2016, the City Council approved Resolution 2079, authorizing the City's application for a transportation and growth management grant ("TGM") from the state of Oregon. The City of Woodburn was successful in obtaining this TGM grant to update the City Transportation System Plan. A condition of the receipt of funds for the TGM grant is a requirement that the City enter into an IGA with ODOT that governs the scope and terms of the parties' cooperative agreement in moving forward with this TSP project. The IGA sets out terms regarding the grant amount to be allocated for the TSP project, the City's financial matching obligations, as well as a comprehensive statement of work that will guide and regulate the parties' progression towards completing the TSP update. As they do for other TSP projects, ODOT designated a team of outside consultants to manage the project and provide all deliverables. The lead consultant, Kittleson & Associates, was chosen after a detailed selection process that involved key members of the City Staff. 15 Honorable Mayor and City Council July 24, 2017 Page 3 The entirety of this effort will take approximately 16 months to complete, leading to adoption of the TSP by the City Council. FINANCIAL IMPACT: The grant amount for the TSP update is $219,700. The City is required to provide 12% in matching funds ($29,959) of the total project costs, which will be provided by in-kind services by the City. 16
