at the pool from 11:30am - 3pm which is included with admission.

A. Council Bill No. 3033 - A Resolution Declaring the City of 13
Woodburn a Welcoming and Inclusive City that Respects and
Appreciates all Residents
Recommended Action: During the Global Advisory Inclusion
Committee's May 10, 2017 meeting, after committee discussion
and deliberation, the attached Resolution Declaring the City of
Woodburn a Welcoming and Inclusive City that Respects and
Appreciates All Residents was unanimously approved for
consideration and adoption by the City Council.
B. Award of Construction Contract for the 2017 Spring Pavement 22
Maintenance Project, BID #2017-03
Recommended Action: That the City Council, acting in its
capacity as the Local Contract Review Board, award the
construction contract for the 2017 Spring Pavement
Maintenance Project to the lowest responsible bidder, Knife
River Corporation - Northwest in the amount of $373,373.00.

Woodburn Fire District — Chief Paul Iverson, Woodburn Fire District, announced that the
Woodburn Fire District was awarded the seismic rehabilitation grant they applied for.

Mayor Figley read a resignation letter from City Councilor Veliz. Mayor Figley stated that
the City Charter is clear that the Mayor has the responsibility to appoint a replacement to fill
the vacant seat with the approval of the City Council. She added that the City will get the
word out to as many people as possible in Ward 1 and then go through an application and
interview process.

0:06 COUNCIL BILL NO. 3031 - A RESOLUTION INITIATING CONSIDERATION OF
LEGISLATIVE AMENDMENTS TO THE WOODBURN DEVELOPMENT
ORDINANCE
Lonergan introduced Council Bill No. 3031. Recorder Pierson read the bill by title only since
there were no objections from the Council. Community Development Director Kerr provided
a staff report. On roll call vote for final passage, the bill passed unanimously. Mayor Figley
declared Council Bill No. 3031 duly passed.

Lonergan introduced Council Bill No. 3032. Economic Development Director Johnk
provided a staff report. On roll call vote for final passage, the bill passed unanimously.

0:59 AWARD OF CONSTRUCTION CONTRACT FOR THE WEST HAYES STREET
SANITARY SEWER PIPELINE PROJECT, BID #2017-02
Interim Public Works Director Liljequist provided a staff report. Lonergan/Morris... that the
City Council, acting in its capacity as the Local Contract Review Board, award the
construction contract for the West Hayes Street Sanitary Sewer Pipeline Project to the lowest
responsible bidder, Pacific Excavation, Inc. in the amount of $985,000.00. The motion passed
unanimously.
1:04 COUNCILOR MORRIS' REQUEST TO ATTEND CONFERENCE
Lonergan/Ellsworth... approve Councilor Morris' request to attend the Echelon Front's
conference titled "Extreme Ownership" for costs not to exceed $4,000. Councilor Lonergan
stated that he is in favor of this. Councilor Schaub stated that she is in support of training but
does have concerns about the violent titles of some of the coursework. Councilor Carney stated
that he supports this and looks forward to Councilor Morris bringing this information back to
Council. Councilor Morris recused himself from voting. The motion passed unanimously with
Councilor Morris not voting.
1:11 CITY ADMINISTRATOR'S REPORT
The City Administrator had nothing to report.
MAYOR AND COUNCIL REPORTS
Councilor Lonergan stated that he has noticed that the Woodburn Police Department is
starting up its Good Neighbor Program in June and asked if Chief Ferraris could provide
information on that. Chief Ferraris stated that the program will begin June 1st and will start
with educating citizens on the ordinances and then enforcement if the problems persist.
Mayor Figley thanked Councilor Lonergan for filling in for her during the past two meetings.
Councilor Ellsworth stated that the new Welcome to Woodburn signs look great and they
make it look like we are taking care and pride in the City and thanked Jim Row for his work
on this. She also asked when the Council meeting picnic would take place and City
Administrator Derickson answered that it will take place during the second meeting in July.
Councilor Morris stated that he attended the Cinco de Mayo celebration on Friday night and
it was packed. He added that the parking lot behind the post office would be a good place for
food cart pods.

7 p.m. in the City Hall Council Chambers, with Chair Claudio Lima

Introduction
Acting Chair Piper opened the workshop/meeting at 7 pm, and led the
Commissioners in the flag salute.
Minutes
The November 10, 2016 minutes were unanimously approved after
Commissioner Corning revised her remarks for the record.

Communication
Chris Kerr is the new Community Development Director.
Public Hearing — 777 E. Lincoln Street; 839 & 845 E. Lincoln Street
(CU 2016-01; DR 2016-01; TREE 2016-01; VAR 2016-02 and PLA 2016-02)
The applicant requests combined reviews in order to remodel and expand the
Washington Elementary School site. The properties are zoned Public/Semi-
Public (P/ SP) and Medium Density Residential (RM). Abutting properties are
zoned P/SP, Residential Single -Family (RS) and RM.

Acting Chair Piper declared ex -parte contact, but stated that it would not conflict
with anything being presented.
The Washington Elementary remodel/addition will require removal of several
significant trees. Kate Foster, Associate Planner, clarified the Woodburn
Development Ordinance (WDO) regulation regarding significant trees. At present,
the WDO requires a 1:1 ratio in significant tree replacement, with the
replacement tree eventually growing to a comparable size.
In response to concerns that additional signage might be needed, Kate told the
Commission that the applicant will be providing directional marking on the ground
and signs indicating the bus drop-off area. Signage for access to Hardcastle
Ave. would be emergency access only. There is presently a speed direction sign
on Hardcastle Avenue as well as a crosswalk, though the crosswalk is not
utilized.
There is no requirement for the applicant put in a sidewalk on Hardcastle Ave„
Public Works will contribute to that a later date.
Applicant Discussion:
Marlene Gillis, Soderstom Architects, 3708 NE 1361h, Portland, noted that the
applicants plan to add a fire access loop and fire sprinklers to the building, which
will add to the safety and security of the site. They are also trying to maintain as
many of the significant trees as possible.
Commissioner Comer made a motion to approve the Washington Elementary
School project (Cu 201-01; DR 2016-01; TREE 2016-01; VAR 2016-02 and PLA
2016-02) and allow the Chair to sign the Final Order. Commissioner Corning
seconded the motion, which passed unanimously.
Business from the Commission:
Planning Commission elections were held and Vice -Chair Piper was nominated
to become Chair by Commissioner Corning. Commissioner Comer seconded the
nomination and it was unanimously approved.
Commissioner Comer nominated Commissioner Corning for Vice -Chair.
Commissioner Ramirez seconded the nomination and the motion was passed.
Claudio Lima announced his retirement at the last meeting on November 10,
2016. Director Hendryx presented a Certificate of Appreciation for the
Commissioners to sign and send to Claudio.
The next Planning Commission meeting has not been scheduled.

SUBJECT: Resolution Declaring the City of Woodburn a Welcoming and
Inclusive City that Respects and Appreciates All Residents
RECOMMENDATION:
During the Global Advisory Inclusion Committee's May 10, 2017 meeting, after
committee discussion and deliberation, the attached Resolution Declaring the
City of Woodburn a Welcoming and Inclusive City that Respects and Appreciates
All Residents was unanimously approved for consideration and adoption by the
City Council.
BACKGROUND:
In response to the national discussion on immigration, and by the urging of local
residents, City Councilors may be aware that numerous Oregon communities
have been deliberating and adopting "inclusive city resolutions." As a result, the
City Council has asked the Global Inclusion Advisory Committee to recommend
a resolution declaring the City of Woodburn an Inclusive City.
The purpose of the resolution is to reaffirm the City's commitment to providing
municipal services in a discrimination free, respectful, legal and safe manner to
all members of our community. In addition, the purpose of the resolution is to
encourage residents, regardless of their status or origin, to feel safe when using
local government services and interacting with members of the Woodburn Police
Department.
In terms of immigration, the Police Department has suggested that any inclusive
city resolution contain the City's commitment to comply with ORS 181 A.820 (see
attached Exhibit 1), which prohibits Oregon governments from using public
resources in the enforcement of federal immigration laws. From a public safety
standpoint, it is critical that our residents know that they can report crimes and
work with our police officers without fear of being deported simply because of
their skin color or language skills. To this point, Woodburn's Police Chief Jim Ferraris
has written a widely circulated article about ORS 181 A.820, and what it means in

terms of policing in Woodburn, which I have also included (See attached Exhibit
2) for your reference.

Enforcement of federal immigration laws
(1) No law enforcement agency of the State of Oregon or of any political subdivision of
the state shall use agency moneys, equipment or personnel for the purpose of
detecting or apprehending persons whose only violation of law is that they are
persons of foreign citizenship present in the United States in violation of federal
immigration laws.
(2) Notwithstanding subsection (1) of this section, a law enforcement agency may
exchange information with the United States Bureau of Immigration and Customs
Enforcement, the United States Bureau of Citizenship and Immigration Services
and the United States Bureau of Customs and Border Protection in order to:
(a) Verify the immigration status of a person if the person is arrested for any
criminal offense; or
(b) Request criminal investigation information with reference to persons named in
records of the United States Bureau of Immigration and Customs
Enforcement, the United States Bureau of Citizenship and Immigration
Services or the United States Bureau of Customs and Border Protection.
(3) Notwithstanding subsection (1) of this section, a law enforcement agency may
arrest any person who:
(a) Is charged by the United States with a criminal violation of federal immigration
laws under Title II of the Immigration and Nationality Act or 18 U.S.C. 1015,
1422 to 1429 or 1505; and
(b) Is subject to arrest for the crime pursuant to a warrant of arrest issued by a
federal magistrate.
(4) For purposes of subsection (1) of this section, the Bureau of Labor and Industries
is not a law enforcement agency.
(5) As used in this section, "warrant of arrest' has the meaning given that term in ORS

INCLUSIVE CITY THAT RESPECTS AND APPRECIATES ALL RESIDENTS
WHEREAS, the Woodburn City Council has asked the Woodburn Global
Inclusion Advisory Committee to draft and present a statement of inclusivity that
will represent the City of Woodburn; and
WHEREAS, Woodburn serves as an example of the American Dream, where
people from around the world have located to enjoy freedom, entrepreneurship,
employment, safety and the right to participate in family and civic life, to be
valued and empowered both as private individuals and as community members;
and
WHEREAS, Woodburn's rich history of racial and cultural diversity,
acceptance of all people, and caring for others has enhanced and strengthened
our economy, educational systems, public safety, understanding, community
identity and quality of life; and
WHEREAS, Woodburn recognizes persons of all races, color, national origin,
immigration or refugee status, heritage, culture, religion, sex, gender, gender
identity, sexual orientation, marital status, mental, emotional, and/or physical
ability, age, or economic status collectively contribute to the health, well-being,

Section 1. The City of Woodburn is an inclusive City that has and will
continue to welcome the collective contributions of all persons, honoring and
respecting people of every race, color, national origin, immigration or refugee
status, heritage, culture, religion, sex, gender, gender identity, sexual orientation,
marital status, mental, emotional, and/or physical ability, age, or economic
status.
Section 2. Pursuant to Oregon state law, the City is prohibited from using
City funds, personnel, and/or equipment for the enforcement of federal
immigration laws. Nothing in this section shall be construed to prohibit City staff
from complying with a lawfully issued warrant.
Section 3. Pursuant to Oregon state law, City services shall be provided
regardless of immigration status. City staff will not inquire into an individual's
immigration status as a condition of providing City services.
Section 4. The City desires that all of its residents feel safe to utilize all City
owned or sponsored facilities, including parks, library, the Aquatic Center, and
Woodburn's Transit facilities without fear of discrimination.
Section 5. The Woodburn City Council encourages all Woodburn residents
to unite and work together to promote kindness and understanding in our
community, rejecting hatred, bigotry, and divisiveness, as this community strives
to protect the freedoms held dear and granted to all by the United States
Constitution.
Section 6. While this City Council may pass this inclusivity resolution in the
hope that it is inspirational, the only true measure of its success will be in how all
members of our community elect to treat each other day in and day out.

Maintenance Project, BID #2017-03
RECOMMENDATION:
That the City Council, acting in its capacity as the Local Contract Review Board,
award the construction contract for the 2017 Spring Pavement Maintenance
Project to the lowest responsible bidder, Knife River Corporation - Northwest in
the amount of $373,373.00.
BACKGROUND:
The subject Maintenance Project is identified in the approved budget for fiscal
year 2016/17. This project involves maintenance of existing pavement at various
locations throughout the City. This maintenance project includes the
replacement of deteriorated pavement and the construction of asphaltic
concrete overlays.
Bids were publically opened May 2, 2016. Six (6) bids were received as follows:

DISCUSSION:
This project is a continuing effort by the Public Works Department to maintain
and preserve existing pavement throughout the City transportation system. This

project includes pavement maintenance activities on Mt. Jefferson Avenue, N.
Cascade Drive, W. Lincoln Street, Wilson Street, Hawley Street and Park Avenue.
The contract award is in conformance with public contracting laws of the State
of Oregon as outlined in ORS Chapter 279C and the laws, regulations of the City
of Woodburn, therefore, staff is recommending the contract be awarded.
FINANCIAL IMPACT:
The subject project is identified in the adopted fiscal year 2016/17 Budget and
funded by the Street Maintenance Fund (Fund 140).
