She added that Pete Lichte is one of the most honorable people she knows and hopes that the City of Woodburn takes heed into the claims of misconduct that have been brought forward. Terri Coleman, 192 Young Street, stated that she and her husband Doug Coleman owner of Industrial Machining Corp., are also here in support of the three officers and that they personally know Dan Kelly and that his character is of the upmost highest level. She added that they feel there is a level of corruption in the Woodburn Police Department that needs to be addressed. Merri Berlin, 167 N. Settlemier provided a handout to the City Council regarding cars parking in lawns and wanted to know if the request for a report on violations from the last meeting has been implemented. Jim Hendryx answered that he is working on getting information on this for a presentation at the next council meeting. City Administrator Derickson answered that it is complex because some of the codes are applicable to properties based on their age. Merri Berlin stated that these ordinances are in place, no parking on the lawns you need to be in front of your driveway, and doesn’t understand what type of research needs to go into this. City Administrator Derickson answered that they are researching the applicability of the codes based on age, and other rules such as ADA issues and they want to make sure they get the correct information out to the citizens which is why they are looking into it. Allen Lindberg, 1860 Jansen way, stated that he is employed by First Student as a school bus driver. He added that he also sees a lot of homes were there are cars parking on the lawns and that it would help improve neighborhoods if there was more enforcement. He also suggested that the Settlemier and Hayes Street intersection be widened where you turn right. NEW STREET NAME 0:31 Mayor Figley stated that the City is in the unusual situationwith a street to name and that Councilor Alonso Leon has been out in the community talking to students at Chemeketa and Latino community leaders in the City about possible names for the street. Councilor Alonso Leon stated that some of the suggested names were Bienvenidos- Welcome, Esperanza- Hope, and Benito Juarez and the favorite of those three is Bienvenidos. Mayor Figley stated that she likes that idea. Councilor Ellsworth stated that she would like to see something more like Tennant Way in honor of the officers since the memorial will be placed at the transit facility. Mayor Figley replied that another idea was to name the transit facility the officer memorial transit facility. Councilor Lonergan stated that he thought those were both good ideas. Councilor Morris asked if we pooled anyone else in the community and that he thought these are both good ideas. City Administrator Derickson stated that they could put the prospective name in the E-blast and if they don’t get any significant difference of opinion from the community on the suggested names he will bring a resolution to City Council. Legion Park Update Jim provided an update on the status of the Legion Park Master Plan. The Plan wasrecently presented to both Kiwanis Clubs and the City Council. The plan was also presented to the public through the E-Blast, along with an invitation to complete an electronic survey. The survey received 27 responses. The amenities that received the most support include the artificial turf soccer field, new bleacher seating, concession stand, paved pathways, and picnic areas. The items with the lowest level of support were the amphitheater and outdoor exercise stations. However, there wasn’t a strong opposition to any of the proposed amenities. Jim is going to update the plan to include the amenities he received support for during the community presentations, including a second basketball court, 2 more bleachers, and a parking lot between the police facility and the park (to be shared with PD). Community EdClasses Since our last meeting, three classes have taken place; “The Lost Art of Tatting” and OSU Master Gardener classes on “Gardening for Beginners” and “ Indoor Jump Starts.” Six people tatting and 3 – 5 people in the gardening classes. Daddy Daughter Our signature event had 103 in attendance this year. Event photos are posted on Facebook. Special thanks to Silverton Health for their generous sponsorship of the event. Youth Advisory Board The Youth Advisory Board has been active planning to participate in an upcoming health fair, volunteering at the school district’s STEM (Science, 8 Technology, Engineering, and Math) festival, Day of the Child, and helping the Woodburn Kiwanis club with some projects. Recreation Coordinator We had a transition in this position. Kyle Buse is the new Recreation Coordinator in charge of youth and adult sports leagues, community education classes, and the Youth Advisory Board. Nike Donation The local Nike store has donated several soccer balls, baseballs, and footballs to us to use in our youth sports programs. Some of the soccer balls are very high end. We appreciate that. Oregon Arts Grant We have applied for an Oregon Arts Commission Grant for Cultural Tourism. This is a marketing grant opportunity that would pay for increased exposure for the Woodburn Summer Nights events through social media and tv advertising and outreach to other surrounding communities. We expect to hear back soon after th the commission’s March 14meeting. WSN Planning is underway for Woodburn Summer Nights. Many of the bands are booked, we have advertisement sponsorships in place and now are preparing to solicit for additional sponsors. Robert Shields, City Attorney SUBJECT: Medical Marijuana Ordinance Amendment : RECOMMENDATION It is recommended that the City Council consider the attached ordinance, which strengthens the ordinance adopted at the February 24, 2014meeting (Ordinance 2514) creating a temporary prohibition on medical marijuana dispensaries and asking that the planning commission recommend appropriate zones and conditional permit requirements for the sitingof medical marijuana dispensaries. Specifically, Ordinance 2514 is strengthened by referencing the recently passed state law and incorporating a one year moratorium. BACKGROUND: Under HB 3469, signed by the Governor on August 14, 2013, the Oregon Health Authority was authorized to register medical marijuana facilities under its administrative rules beginning March 1, 2014.HB 3460 allows medical marijuana dispensaries to be sited under certain restrictions in commercial and agricultural zones and provides little direction to local governments on how to effectively manage community expectations for safety, security, and livability with the opening of these dispensaries. At the February 24, 2014 meeting, the City Council adopted Ordinance 2514 (attached), which temporarily prohibits the siting of medical marijuana facilities within the City of Woodburn and initiates amendment of the Woodburn Development Ordinance (the WDO) to establish appropriate zoning regulations for these facilities. : DISCUSSION In response to the uncertainly about the legal authority of cities and counties, the Oregon Legislature adopted Senate Bill 1531 (attached).This bill was approved by Agenda Item Review:City Administrator ___x___City Attorney __x____Finance _x___ 22 Honorable Mayor and City Council March24, 2014 Page 2 the Governoron March 19, 2014.This new legislation clarifies that local jurisdictions have the power impose a one year moratorium on the siting of medical marijuana facilities. Also, after the moratorium ends (which must be no later than May 1, 2015), local jurisdictions are given explicit authorityto impose “time, place and manner” restrictions. The League of Oregon Cities (LOC) has distributed a memorandum on the passage of Senate Bill 1531and prepared a draft ordinance (attached). Since, in Woodburn’s case, the City Council already acted to adopt Ordinance 2514, an Ordinance Amendment was drafted that referenced the new state law. Adoption of Ordinance Amendment before the City Councilwill legally strengthen Ordinance 2514 by converting its 120 day “temporary prohibition” intothe one year moratorium permitted by state law. In all other respects, Ordinance 2514 remains the same (i.e., the policy direction of the initiation of WDO amendments to establish appropriate zoning regulations for these facilities remains intact). Because of the time sensitivity of this issue, the proposed ordinance again contains an emergency clause. : FINANCIAL IMPACT None. Attachments: Ordinance 2514 Enrolled Senate Bill 1531 LOC memorandum 23 24 25 26 27 28 29 30 31 32 COUNCIL BILL NO. 2951 ORDINANCE NO. 2518 AN ORDINANCE AMENDING ORDINANCE 2514 (TEMPORARILY PROHIBITING THE LOCATION OF MEDICAL MARIJUANA FACILITIES)TO ADD THE IMPOSITION OF A MORATORIUM AS PROVIDED BY SENATE BILL 1531AND DECLARING AN EMERGENCY in the 2013 Special Session, the Oregon Legislature approved WHEREAS, House Bill 3460 which creates a medical marijuana registration system and allows for medicalmarijuana facilities to be located in areas zoned for commercial, industrial,or mixed use; and House Bill 3460 also includes specific restrictions on the WHEREAS, location of medical marijuana facilities related to proximity to schools attended by minors and to other medical marijuana facilitiesand ; on February 24, 2014, the City Council adopted Ordinance WHEREAS, 2514, which temporarily prohibited the location of medicalmarijuana facilities for a one hundred twenty (120) day period and also initiated, pursuant to Section 401.02 E of the Woodburn Development Ordinance (the WDO) the establishment of appropriate zoning regulations for medical marijuana facilities; and the Oregon Legislature recently passed Senate Bill 1531, WHEREAS, which was intended to clarify the authority of cities and counties regarding medical marijuana facilities; and more specifically, Senate Bill 1531provides that cities and WHEREAS, counties shall have the legal authority to enact a moratorium for a period of one (1) year on the operation of registered medical marijuana facilities; and the Woodburn City Council wants to amend Ordinance 2514 WHEREAS, to modify the temporary prohibition of one hundred twenty (120) days and impose a statutory moratorium one (1) year, as allowed bySenate Bill 1531; and the City Council believes that the imposition of the one (1) WHEREAS, year moratorium will allow the City the more necessary time to complete amendments to the WDO toadd zoning regulations for medical marijuana facilities; NOW, THEREFORE, Council Bill No. 2951 Page- 1 - Ordinance No. 2518 33 THE CITY OF WOODBURN ORDAINS AS FOLLOWS: Section 2 of Ordinance 2514 is amended to read as follows: Section 1. Pursuant to Senate Bill 1531, the City Council Section 2. imposes a moratoriumon the siting of medical marijuana facilities. This moratorium shall be in force from the effective date of this ordinance for a period of one (1) year, unlessit is rescinded earlier by action of theCity Council. SYNOPSIS: Recently, a new public street and Transit Center were constructed as a result of the I-5 Interchange Project.The Transit Center is an ODOT facility that will be maintained and operated by the City of Woodburn. ODOT hasbeen consulted on the City’s interest in naming the new Transit Center and believes ODOT supports this effort. ODOT has a processfor formalizing the names of public facilities, which can be initiated by the City at the City Council’s direction. Agenda Item Review:City Administrator ___x___City Attorney __x____Finance __x___ 35 Honorable Mayor and City Council March 24, 2014 Page 2 During the City Council’s March 10, 2014 City Council meeting, discussion was had in regards to naming the City’s new street and the Transit Center. Councilor Teresa Alonso Leon suggestedthat, after hearing from constituents and community members,the new street be named “Bienvenidos”, a Spanishterm that translates in English to “welcome.”MayorKathy Figley also suggested naming the new Transit Center“Officers’ Memorial Transit Center.” Other names were suggestedand discussed by the City Council, including naming the facilities after Captain Tom Tennant. At the conclusion of this discussion, the City Administrator said that staff could bring action items related to the names Bienvenidos and Officers Memorial Transit Center, along with a summary of any public feedback received by the City, during the March 24, 2014 City Council meeting. The City Administrator also said that the City would feature the two proposed names in the City’s weekly e- blast community newsletter, which occurred in the Friday March 14, 2014 edition. INITIAL COMMUNITY FEEDBACK: As a result of the e-blast and local media coverage, the City has received several phone calls, e-mails and City Hall visits from people expressing their opinions. Feedback has ranged from support in naming the Transit Center and/or street “Tennant” after Captain Tom Tennant, to objections about a name that could be difficult to pronounce. Conversationally, the City Administrator has also heard from some who support the Officers Memorial Transit Center as being all inclusive of allthose involved in the bombing and Bienvenidos as reflective of the community. DISCUSSION – PROCESS/CRITERIA: Councilors should note that there is nodeadline for naming the street or the Transit Center and that City Council has discretion on how to proceed. The Council can make a decision tonight, or can forego a decision in lieu of additional outreach or process as the Council may determine. The new street is located off of Evergreen Road adjacent to the new Transit Center.Section 3.01.06 of the Woodburn Development Ordinance establishes the criteria for street naming. This section provides the following: 36 Honorable Mayor and City Council March 24, 2014 Page 3 3.01.06 Street Names A. All public streets and private manufactured dwelling park streets shall be named, after providing the Woodburn Fire District with an opportunity to review and comment. B. Public and private manufactured dwelling park streets shall be named as follows: 1. The street name shall not duplicate an existing street name, unless there is reasonable assurance the named streets will be connected in the future. 2. New streets shall be designated with the same names as existing streets only if they fall in the same grid line and there are reasonable assurances that the street will connect with another section of the numbered street. 3. Street names shall not sound like another street name or cause confusion. 4. Street names that are deliberately misspelled, frivolous, orreflect the name of the developer or family members shall not be allowed. C. Streets shall be further named with a suffix. 1. Except as indicated in the Woodburn Transportation System Plan, the following suffixes designations apply to new streets, as follows: a. North/South streets shall be designated as a “Street”, with the exception that major streets classified as an arterial in the Woodburn TSP may be designated as a “Road” or a “Highway”. b. East/West streets shall be designated as an “Avenue”, with the exception that major streets classified as an arterial in the Woodburn TSP may be designated as a “Road” or “Highway”. c.A skewed or meandering street shall be named a “Drive”. d. A street less than 1,000 feet in length may be designated asa “Place,” “Way,” or “Lane”. 37 Honorable Mayor and City Council March 24, 2014 Page 4 e. A cul-de-sac street with no cross-street shall be designated as a “Court”. f. A continuous loop street that has two intersections with the same street shall be segmented, in reference to its orientation to the overall North/South, East/West street grid, so that the each segment of the loop has a unique name. g. A street that runs in a circle with only one entrance/exit shall be designated as a “Circle”. h. A street with a continuously landscaped median shall be designated as a “Boulevard”. Although the new street right-of-way forms a loop to Evergreen Road, Councilors should note thedesign of the transit facility requires that one section of the loop be reserved for buses. Since the portion of the street opento the driving public will terminate in a cul-de-sac, it is appropriate to designate it as a court instead of a loop. FINANCIAL IMPACT: This decision is anticipated to have no public sector financial impact. 38 COUNCIL BILL NO. 2952 RESOLUTION NO. 2041 A RESOLUTION NAMING A NEW CITY STREET the Woodburn Development Ordinance (Section 3.01.06)requires WHEREAS, that public streets be named; and ,a new public street was created by the building of the transit facility WHEREAS and I-5 interchange; and ,the new street is located at the most visible and most highly-used WHEREAS entrance to the City, and provides access to the new transit facility; and ,after public input and discussion, the Council has determined the name WHEREAS ______________ is appropriate because __________________; , NOW, THEREFORE THE CITY OF WOODBURN RESOLVES AS FOLLOWS: The Council recognizes that street naming is normally an administrative Section 1. function.The Council finds that in this particular instance, it is appropriate to determine the street name through a Resolution.
