Ord 2518 - Amend to Ordinance 2514 Marijuana MoratoriumCOUNCIL BILL NO. 2951 ORDINANCE NO. 2518 AN ORDINANCE AMENDING ORDINANCE 2514 (TEMPORARILY PROHIBITING THE LOCATION OF MEDICAL MARIJUANA FACILITIES) TO ADD THE IMPOSITION OF A MORATORIUM AS PROVIDED BY SENATE BILL 1531 AND DECLARING AN EMERGENCY WHEREAS, in the 2013 Special Session, the Oregon Legislature approved House Bill 3460 which creates a medical marijuana registration system and allows for medical marijuana facilities to be located in areas zoned for commercial, industrial, or mixed use; and WHEREAS, House Bill 3460 also includes specific restrictions on the location of medical marijuana facilities related to proximity to schools attended by minors and to other medical marijuana facilities; and WHEREAS, on February 24, 2014, the City Council adopted Ordinance 2514, which temporarily prohibited the location of medical marijuana facilities for a one hundred twenty (120) day period and also initiated, pursuant to Section 401.02 E of the Woodburn Development Ordinance (the WDO) the establishment of appropriate zoning regulations for medical marijuana facilities; and WHEREAS, the Oregon Legislature recently passed Senate Bill 1531, which was intended to clarify the authority of cities and counties regarding medical marijuana facilities; and WHEREAS, more specifically, Senate Bill 1531 provides that cities and counties shall have the legal authority to enact a moratorium for a period of one (1) year on the operation of registered medical marijuana facilities; and WHEREAS, the Woodburn City Council wants to amend Ordinance 2514 to modify the temporary prohibition of one hundred twenty (120) days and impose a statutory moratorium one (1) year, as allowed by Senate Bill 1531; and WHEREAS, the City Council believes that the imposition of the one (1) year moratorium will allow the City the more necessary time to complete amendments to the WDO to add zoning regulations for medical marijuana facilities; NOW, THEREFORE, Page- 1 - Council Bill No. 2951 Ordinance No. 2518 THE CITY OF WOODBURN ORDAINS AS FOLLOWS: Section 1. Section 2 of Ordinance 2514 is amended to read as follows: Section 2. Pursuant to Senate Bill 1531, the City Council imposes a moratorium on the siting of medical marijuana facilities. This moratorium shall be in force from the effective date of this ordinance for a period of one (1) year, unless it is rescinded earlier by action of the City Council. Section 2. This ordinance being necessary for the immediate preservation of the public peace, health and safety, because it is in the City's interest to amend its ordinance to impose the moratorium allowed by state law at the earliest possible time, an emergency is declared to exist and this ordinance shall take effect immediately upon passage and approval by the Mayor.
