ORDINANCE NO. 2508
AN ORDINANCE IMPOSING A GENERAL FUND RIGHT -OF -WAY CHARGE ON
CITY WATER AND SEWER UTILITIES EFFECTIVE WITH THE 2013 -2014 FISCAL
YEAR AND EXPIRING AT THE END OF THE 2017 -2018 FISCAL YEAR AND
DECLARING AN EMERGENCY
WHEREAS, the City Administrator, as Budget Officer, has prepared
and submitted the Fiscal Year 2013 -2014 Budget; and
WHEREAS, the imposition of a General Fund Right -of -Way Charge
on City Water and Sewer Utilities was mentioned in the Budget Message,
discussed at the Budget Committee hearing, and is included in the Fiscal
Year 2013 -2014 Budget, which is now before the City Council; and
WHEREAS, the General Fund Right -of -Way Charge on City Water
and Sewer Utilities will be used to support diminishing General Fund
resources; and
WHEREAS, under the terms of this Ordinance, the General Fund
Right -of -Way Charge on City Water and Sewer Utilities will be effective
with the 2013 -2014 Fiscal Year and will expire after the end of the 2017-
2018 Fiscal Year; NOW, THEREFORE,
THE CITY OF WOODBURN ORDAINS AS FOLLOWS:
Section 1. The City Council imposes a General Fund Right -of -Way Charge
on City Water and Sewer Utilities in the amount of five percent (5 %) of
water and sewer gross revenues.
Section 2. The General Fund Right -of -Way Charge on City Water and
Sewer Utilities imposed by this Ordinance shall be effective with Fiscal Year
2013 -2014 and shall continue through Fiscal Year 2017 -2018. After Fiscal
Year 2017 -2018, the General Fund Right -of -Way Charge on City Water
and Sewer Utilities shall no longer be imposed.
Section 3. This ordinance being necessary for the immediate preservation
of the public peace, health and safety so that the General Fund Right -of-
Way Charge can be imposed and included in the Fiscal Year 2013 -2014
Woodburn City Budget, an emergency is declared to exist and this
ordinance shall take effect immediately upon passage and approval by
the Mayor.
