Councilor Cox feels that this item requires additional discussion and is best addressed in an

extension be referred to an Executive Session at a future date. Motion passed 4 -2 with
Councilors McCallum and Morris and voting no.

0:49 PUBLIC RESTROOM AT THE DOWNTOWN PLAZA
Councilor McCallum introduced the discussion regarding the temporary public restroom
currently located in the downtown Plaza. Councilor Lonergan, who represents Ward 5
where the plaza is located, discussed his impressions of the public urination problem
historically and the usage statistics of the current portable restroom. He doesn't find the
restroom attractive but believes there is sufficient usage to warrant placement during the
summer event season.
Councilor Schmidt believes there should be a restroom downtown, but does not favor a
permanent facility. He recommends placement of a portable restroom at the transit facility
behind the Public Works Annex building. He also recommends encouraging use of existing
City buildings such as the Library & City Hall. Councilor Lonergan and McCallum are not
convinced using existing City buildings would fully address the problem due to limited
availability in the evening hours.
Councilor Cox does not favor the permanent placement of a portable restroom in the
downtown area. He believes they are not hygienic or aesthetic for the downtown area. He
believes there has to be a better solution. He also does not believe the City has an obligation
to provide a public restroom in this area, and furthermore does not have the funding to
construct and maintain a public restroom. He feels citizens should be responsible for finding
and utilizing appropriate restrooms. He suggests that signage directing the public to existing
public restrooms in the Library and City Hall be established.
City Administrator Derickson and Community Services Director Row discussed usage since
the placement of the restroom in late June -early July. There has been varying degrees of
usage, with high usage around events at the plaza, and there has been no reported vandalism.
Public Works Director Brown reported on downtown garbage cleanup activities performed
by Public Works staff, which includes occasional public defecation cleanup.
Councilor Pugh reiterated that there is no funding available to make a public restroom
available. He doesn't support the portable option either, partially because of aesthetics;
largely due to cost.
Councilor Moms has done his own informal polling and does not support the placement of a
portable restroom downtown.
Durrell Crays of 167 N. Settlemier testified that he surveyed members of the Downtown
Neighborhood Association and they are strongly opposed to the placement of a portable
restroom downtown except when associated with a specific event. He feels that the problem
could be addressed by downtown businesses as he feels the usage is by customers of the
downtown businesses. He encouraged Council to consider developing a long term plan for a
permanent restroom near the transit facility and not settle for a short term fix.

Councilor McCallum feels that there is a need for restroom facilities downtown outside the
plaza to ensure that the continued development and revitalization of downtown is not
hampered.
Mayor Figley stated that in a perfect world we would have permanent restroom facilities
with adequate staffing to maintain them in the downtown area. She believes the usage of the
existing portable restroom indicates a need for such facilities.
Lonergan/McCallum...authorize the City to make a restroom available in the downtown
area outside of the Plaza for approximately five months a year in the summertime. On a roll
call vote, Councilors Lonergan, McCallum, and Schmidt voted yes and Councilors Pugh,
Cox, and Morris voted no. Mayor Figley cast the deciding vote as yes. The motion passed
4 -3.

5. OLD BUSINESS
Downtown Plaza Restroonl
Jim refreshed the Board on the background of the downtown restroom discussions.
Consequently, a portable restroom was placed at the Downtown Plaza, as a test, prior
to pursuing a permanent solution, such as constructing a permanent portable restroom
enclosure. Over the five month trial period from mid July through mid December, the
restroom was found to be very well used and not subjected to graffiti or vandalism.
On December 12, the City Council considered many options, including the
construction of a decorative portable restroom enclosure and construction of a
permanent restroom, but ultimately directed staff to place an ADA portable restroom
somewhere downtown (but not in the Plaza) for a 5 -month period next year. The
location has not yet been established, but Jim expects the restroom to be in service
from May through October 2012.
Bruce asked if we had purchased the movie screen to show movies in the Library
Park this summer. Jim explained that after viewing the movie on the large white tarp,
he believes that the smaller screen they originally considered would not be as
effective. Jim shared that they were considering three movie nights next summer and
would solicit sponsors to offset the cost.

Annual Board Workshop
Jim took the opportunity to introduce Brent Glogau, our newest Board member, and
shared that Cheryl Shepherd, recently resigned her position. Brent shared that he
applied for the board position because of his interest in sports and recreation, and now
has the extra time to volunteer. Discussion took place on the annual workshop and
whether to wait for all Board positions to be filled before scheduling the date. In
consideration, of the time consuming process of recruiting an appointing new
members, the consensus was to tentatively schedule the workshop for January 10 at
5:30 PM. Since it is important for new members to attend the annual workshop, Jim
indicated that he would make sure that an appointment to our vacant position wasn't
eminent before confirming the date. Bruce pointed out that potential applicants could
certainly attend the workshop, since it is a public meeting. Jim shared that the
workshop is an important opportunity for the Board to discuss priorities and projects,
and establish goals for the coming year.
Bruce asked whether there was going to be excess money for capital projects in the
next fiscal year. Jim stated that the City's financial analysis projects continued tight
budgets, and that it is very unlikely that the General Fund will be in a position to
support capital projects next year.
7. DIVISION REPORTS
Aquatics — Kristin Graybeal
Finances — Kristin reported that expenditures in October totaled only $22,000, but
that revenues were also down as we tried to build our customer base back up
following the September closure. November is going to be a high expenditure month,
as we made our final payment to Swim Essentials and incurred cost to repair a
significant plumbing leak in the ceiling.
Community Support — Dutch Brothers chose the Aquatic Center to be the recipient of
their Buck for Kids Dav promotion on December 9. $1.00 for every beverage sold
will go to the Aquatic Center to be used for families that can't afford swim lessons.
She reported that 3,300 swim lesson scholarships were awarded this year. Kristin
also shared that she had received a mini -grant of $300 through Fiesta Mexicana Fund
to help offset the cost of 4th grade swim lessons.
Community Partnerships — Kristin has been working with Diesel Fitness, Curves and
Anytime Fitness to offer a discounted joint membership. They will be reviewing the
program in three months to see if any changes need to be made.
Woodburn Outdoor Program Lessons — Fifteen teenage members of the Woodburn
Outdoor Club, sponsored through the Boys & Girls Club have been taking swim
lessons at the Aquatic Center at a reduced price. Kristin shared that this week's
Independent will have an article on this program and the Aquatic Center.

Eauinment Room Update — A variable frequency drive has been installed on the main
pool pump. This will save electricity cost because they will be able to adjust it
according to the use of the pool.
Winter — Spring 2012 Program Guide — Kristin distributed a copy of the Aquatic
Center Winter/ Spring guide. Kristin said she focused on creating new programs to
take advantage of New Year's resolutions. The Center is going to begin opening at
9:00 PM Saturday mornings, offering dry-land classes; Zumba, Turbokick, PiYo and
Abs & Glutes Toning. All of these new dry-land classes will take place in the old
storage room which has been converted to a fitness/ party room. She has been busy
encouraging middle school kids to attend the Friday night teen swim from 7:00 — 9:00
PM and also started a swim lesson special with buy one — get one free for the same
child. Kristin showed the Board a "New Year's" promotion post card that was mailed
to 600 patrons.
Challenges — Kristin shared that building programs now that she expects to continue
increasing attendance and revenues.
Recreation — Stu Spence
Youth Sports — Stu shared that this season's Pee Wee Basketball program has 45
registered players - 10 more than last year. In this league, 3 -5 year olds play 3 -on -3
games on lowered hoops.
Adult Sports — We just completed a successful Men's Basketball season with 17
participating teams. Winter league promises to be our busiest season with potentially
over 24 teams. Stu is introducing an eight week outdoor men's basketball league
playing 5 -on -5 at Centennial Park this summer.
P.A.L. Mentoring - Mentor Coordinator, Andrea Oropeza just returned from the bi-
annual PAL conference in Seattle with lots of new ideas for the program to grow and
be successful. The current PAL grant ends March 31, 2011 but Stu has applied for
another PAL Mentoring Grant and if approved it would extend the program from
January — December 2012. Currently, there are 18 adult mentors and youth mentees.
Boys & Girls Club — The Woodburn Boys & Girls Club Unit Board has been busy
planning for the 2012 -2013 school year. The School District's 21s Century grant is
being reduced by 25% ($120,000) next year, so the Unit Board is working on
strategies to fund 4 staff people, 1 at each After School Club site serve 20 kids at each
school. The YMCA has also been invited to the table and it is uncertain what their
involvement will be at this time. The Boy Scouts have also shown interest. This is
slowly evolving into an umbrella organization, which will be managed by the School
District to create sustainability.

Tree Lighting — Stu showed a short PowerPoint presentation of the December 4`
Mayor's Tree Lighting event. Stu reported that approximately 50 people gathered at
the Settlemier House to listen to the Dickens Carolers and light the Settlemier House
tree. At 5:30 PM, Mayor Figley and the Dickens Carolers led the candlelight parade
down Garfield to the Plaza where a group of 200 people had assembled. Dance -
Dance- Dance, the local dance troupe, performed a variety of holiday themed routines
followed by the lighting of the Downtown Plaza tree. At the conclusion, Santa made
an appearance in a decorated 1927 Oldsmobile, handing out candy canes to all of the
children and listening to all their Christmas wishes. A special thanks to Mayor Figley
for her leadership and involvement in the event, Ray from Viesko Concrete in
providing Santa's car, to our volunteer, Tony, who played Santa, Loves Bakery for
providing snacks, Public Works for installing and decorating the tree, and to the
Youth Advisory board for decorating the Plaza gazebo and palm trees.
1785 Locomotive Park — Stu reported that he is currently working with Frank Scheer,
a Portland volunteer and member of the Oregon Historic Railways Association that
helped restore the 1785 locomotive on a PowerPoint to celebrate the 55 anniversary
of the Locomotive coming to Woodburn. Stu scanned 80 old pictures that Frank
supplied involving the locomotive. We are also working with the After School
program to put together a video tour of the locomotive as well on onsite interaction
with it.
Collaborative Sponsorship Program — Recreation & Parks along with Library is
working together on a comprehensive sponsorship program for our summer events.
We hope to increase leverage and sponsorships benefits by offering summer long
program sponsorships that would include Music, Movies and Market in the Park and
the 4 of July.
Parks and Facilities — Jim Row
Mill Creek Greenwav Project
Jim reported the project is complete; however, Public Works is still working to install
a couple remaining trail signs. There has been a desire from the neighborhood HOA
to connect a small grassy area located off Hermanson St, north end of the pond, to the
existing trail. Discussion has taken place on various solutions that would create a
way for people to cross the creek and have a better way to gain access to the existing
gravel path. Installing a bridge would be quite costly, so a culvert crossing option is
being considered.
Joseph asked if the culvert option was okay with the wetland issues and Jim answered
that he has been in contact with DSL and will have to modify the existing permit, but
it is possible.

Bruce mentioned that in the spring a grand opening needs to be planned for Mill
Creek Greenway. Discussion took place regarding the possibility of incorporating
activities into the dedication that might draw increased family attendance, such as a
fun run.

RECOMMENDATION:
It is recommended that the City Council extend the City Administrator's
Employment Agreement one (1) additional year.
BACKGROUND AND DISCUSSION:
On November 14, 2011 you evaluated the City Administrator's performance for
the period of October 2010 through October 2011. The Council is now being
asked to authorize Mayor Figley to extend the City Administrator's Employment
Agreement one year to be added onto the existing contract.

SUBJECT: Director's extension of the Planning Commission's Approval of DR
2008 -05 and EXCP 2008 -08, located at 1300 Second Street.
RECOMMENDATION:
No action is recommended. This item is placed before the Council for
information purposes in compliance with the Woodburn Development
Ordinance. The Council may call up this item for review if it desires.
BACKGROUND:
The applicant requested a design review for Nuevo Amanecer Phase IV, a 40-
unit affordable housing development and an exception to street right -of -way
and improvements on 2nd Street. The Planning Commission held a public hearing
on December 11, 2008 and approved the final order January 8, 2009 subject to
conditions. The applicant subsequently requested that the approval be
extended under the recently modified provisions of Section 4.102 of the
Woodburn Development Ordinance. The extension is an administrative decision
and is subject to appeal and Council call -up.
DISCUSSION:
None.
FINANCIAL IMPACT:
This decision is anticipated to have no public sector financial impact.

The City Council recently amended the provisions of the Woodburn Development Ordinance
that governed the expiration of development decisions. Under the new provisions, you have
requested that the approval for Design Review 2008 -05 and Exception to Street Right -of -Way
and Improvement Requirements 2008 -08 be extended for two years.
Your request is hereby approved. The approval for Design Review 2008 -05 and Exception to
Street Right -of -Way and Improvement Requirements 2008 -08 now expires on January 8, 2013.
Please note that this decision may be appealed within 12 days from the date this notice was
mailed. Additionally, the City Council may choose to call the matter up for a de novo hearing.

4.102.05 Extension of a Development Decision
The effective time period of a final decision may be extended for up to two years by the Director,
subject to a Type II application. The request shall be approved unless significant changes have
occurred to this ordinance or the use is no longer allowed as originally approved. In making a
decision to grant the extension, the Director shall consider if there is a need to modify the
decision or conditions of approval to meet standards in affect at the time of the extension request.
4.102.06 Interpretation
A. Interpretations, Generally
1. An ambiguous term in the Woodburn Development Ordinance may be interpreted in the
final decision of any Type II, III or IV application or by a request for a formal
interpretation by the City Council. A request for a formal interpretation may be
initiated by the Director when, in the administration of the Code, the Director deems it
appropriate that a question as to the intent of the Woodburn Development Ordinance be
formally rather than administratively resolved. Alternatively, any person, upon
application, may request a formal interpretation.
2. The purpose of a formal interpretation is to clarify the intent of the Woodburn
Development Ordinance and its application in particular circumstances. The Council
shall not, by interpretation, vary or modify any clear and unambiguous provisions of
this ordinance. Formal interpretations shall be processed as a Type IV application.
3. Formal interpretations made by the Council shall control future administration and
enforcement of the Woodburn Development Ordinance until vacated or superseded by
Council or incorporated as an amendment of the Woodburn Development Ordinance.
4. The Director shall keep a log of all formal interpretations.
B. Interpretation and Application of Code Language
1. The terms or words used in this Code shall be interpreted as follows where the context
demands: words in the present tense include the future; the singular number includes the
plural and the plural number includes the singular; the word "shall" is mandatory and
not discretionary; the word "may" is permissive; the term "should" is discretionary, the
masculine gender includes the feminine and neuter; the term "this Code" shall be
deemed to include the text of this Code, the accompanying Official Zoning Map and all
amendments made hereafter to either; the term "standard" indicates a mandatory
requirement; the term "guideline" indicates a norm that is accepted in the community
but which is not a mandatory requirement.
2. The Director shall have the initial authority and responsibility to interpret all terms,
provisions and requirements of this Code. The City Council shall have the final
authority to interpret all terms, provisions and requirements of this Code.
3. The Code shall be read literally. Regulations are not more or less strict than as stated.
4. Proposals for uses where the code is silent or where the rules of the Code do not provide
a basis for concluding that the use is allowed, are prohibited.

and transcript fee within the appeal period is a jurisdictional defect and will result
in an automatic rejection. If an appellant prevails at hearing or on appeal, the
transcript fee shall be refunded.
C. Notice of the Appeal Hearing: The Director shall issue notice of the appeal hearing to all
parties who signed in or participated, either orally or in writing, before the close of the
public record. Notice of the appeal hearing shall contain the following information:
1. The file number and date of the decision being appealed;
2. The time, date and location of the public hearing;
3. The name of the applicant, owner and appellant (if different);
4. The street address or other easily understood location of the subject property;
5. A description of the permit requested and the applicant's development proposal;
6. A brief summary of the decision being appealed and the grounds for appeal listed in the
notice of appeal;
7. A statement that the appeal hearing is confined to the issues raised in the notice of
appeal; and
8. A general explanation of the requirements for participation and the City's hearing
procedures.
- 4+ 4.102.02 Call - Up Review by the City Council: Type II and III Decisions
A. Authority: Whether or not an appeal is filed, the City Council may, by majority vote,
initiate a review of a Type II or III decision.
B. Procedures:
1. A summary of all Type II and III decisions shall be forwarded to the City Council as an
information item by the Director at the time the decision is mailed to the applicant.
2. Review under this Section shall be initiated before the adjournment of the first regular
City Council meeting, following the date the City Council receives notification of the
decision.
3. Review shall replace a filed appeal of the decision. The appellants of any appeal filed
before a City Council call for review, shall receive a full refund of the filing fee.
4. The City Recorder will set the hearing date for the City Council review, considering the
120 -day rule.
5. The notice, hearing and decision procedures for a City Council review shall follow the
provisions of the Woodburn Development Ordinance provided for appeals.
4.102.03 Enforcement
A. Inspection and Right of Entry: When necessary to investigate a suspected violation of the
Woodburn Development Ordinance, or an application for or revocation of any permit issued
