Woodburn City Council minutes of August 8, 2011 1 Recommended Action Approve the minutes. B. Crime Statistics through July 2011 Recommended Action: Receive the report. C. Liquor License Application for Change of Ownership / Change of Business Name and Full On- Premises Sales Recommended Action The Woodburn City Council recommends that the OLCC approve a Liquor License application for Change of Ownership / Change of Business Name and Full On- Premises Sales for La Fonda Guadalajara. 9. GENERAL BUSINESS - Members of the public wishing to comment on items of general business must complete and submit a speaker's card to the City Recorder prior to commencing this portion of the Council's agenda. Award of Bio- Solids Handling Services Contract Recommended Action Acting in the capacity of Woodburn's Contract Review Board, award the bio- solids handling services contract to Synagro West in the amount of $2,293,750 and authorize the City Administrator to enter into said contract in a form acceptable to the City Attorney. B. Award of Firearms Range Safety Upgrades Construction Contract Recommended Action Acting in the capacity of Woodburn's Contract Review Board, award the Firearms Range safety improvement design /build contract to Engineered Structures in the amount of $302,905 and authorize the City Administrator to enter into said contract in a form acceptable to the City Attorney. 5 tk' 11 14 August 22, 2011 Council Agenda Page ii 12. Woodburn Chamber of Commerce — Don Judson, Executive Director discussed the Fiesta and thanked sponsors, volunteers, and City staff for their efforts and support of the very successful event. B. Woodburn School District — David Bautista, Superintendent reported on the upcoming school year schedule. 0:14 PRESENTATIONS A. Captain Garrett of the Woodburn Police Department gave certificates of appreciation to Stone & Penelope Mitchell for their actions following the discovery of a gun. 0:17 BUSINESS FROM THE PUBLIC A. Rick Steinle, 2603 Citadel St had concerns regarding street trees in his neighborhood causing damage to streets and sidewalks. City Administrator Derickson responded that he would work with Mr. Steinle and Public Works to address the concern. Acknowlege staff's intent to file for the 2011 Byrne JAG Funding Grant. McCallum/Lonergan... adopt the Consent Agenda. The motion passed unanimously. 0:33 COUNCIL BILL NO. 2874 — A RESOLUTION AUTHORIZING THE EXECUTION OF AN AMENDMENT TO THE CABLE MANAGEMENT ACCESS AGREEMENT AND AUTHORIZING THE CITY ADMINISTRATOR TO SIGN SAID AGREEMENT Recorder Shearer read the bill by title only since there were no objections from the Council. On roll call vote for final passage, the bill passed unanimously. Mayor Figley declared Council Bill No 2874 duly passed. 0:36 CONSIDERATION OF FY 2011/12 FINANCIAL PLAN City Administrator Derickson presented the Financial Plan which has been revised based upon Council's input at the last meeting. Cox /Pugh... adopt the FY 2011/12 Financial Plan. Motion passed unanimously. 0:38 AWARD OF CONSTRUCTION CONTRACT — AQUATIC CENTER REPLASTERING AND REPAIR City Administrator Derickson commented that these repairs are long overdue and necessary in the forward progress of the Aquatic Center marketing plan and will protect the City's long term asset. Public Works Director Brown also answered questions regarding the project scope and cost. Cox/Pugh... award the construction contract for Aquatic Center Pool Replastering and Repair in the amount of $139,512 to Anderson Poolworks. Motion passed unanimously. 0:44 ACCEPTANCE OF PUBLIC UTILITY EASEMENT — DRIFTWOOD MOBILE HOME PARK Cox/McCallum... accept a Public Utility Easement for City water facilities granted by Western Sage Management Inc., property owners of 612 North Cascade Drive, Woodburn OR 97071, known as Driftwood Mobile Home Park (Tax Lots 052W 12DD00200, 052W 12DD00400, 052W 12DD00500 and 052W 12DD00600). Motion passed unanimously. Page 2 - Council Meeting Minutes, August 8, 2011 2 COUNCIL MEETING MINUTES AUGUST 8, 2011 0:45 AWARD OF CONTRACT FOR BIOSOLIDS HANDLING SERVICES City Administrator Derickson reported that this item was placed on the agenda to ensure that the contract award was made in a timely manner given Council's previous decision to cancel the August 22, 2011 meeting. The request for delegated authority was for this purpose only. Should Council prefer to make the award, the meeting can be restored to its scheduled date and awarded at that time. Councilor Cox expressed concern about delegating to the City Administrator an award of this magnitude and feels the decision is best handled by Council. He has no problem with the RFP method of procurement. Councilor Morris questioned whether selection and award to the low bidder required Council action, necessitating a meeting. Councilor McCallum doesn't mind meeting again, given the amount of the contract and the significance of the project. Councilor Pugh doesn't believe the authority should be delegated. Councilor Cox had questions regarding the proposed contract duration of 5 years. Public Works Director Brown answered that it was a function of the application portion of the contract that is controlled seasonally as well as by volume by the Department of Environmental Quality, necessitating the 5 year duration. Difficulty in negotiating with the landowner and DEQ make the timing of this contract & award critical. He also answered questions regarding the timing of the bid & award process. Lonergan /McCallum... reinstate the August 22, 2011 Council meeting. The motion passed 5 -1 with Councilor Morris voting no. 1:01 CITY ADMINISTRATOR'S REPORT The City Administrator did not have anything to report. 1:02 MAYOR AND COUNCIL REPORTS • Councilor McCallum is appreciative of all of the positive events in the community. He also wished to remind Council of the Woodburn Proud Community Picnic on the 18 of August. Finally, he congratulated Mayor Figley on receiving one of two "Mayor's Leadership Awards" at the Oregon Mayor's Association summer conference. • Mayor Figley congratulated Don Judson and the Woodburn Chamber on their efforts for a successful Fiesta, and thanked staff for their efforts as well. • Councilor Cox clarified actions taken at the earlier Urban Renewal Agency meeting that result in delegated authority to the Community Development Director and the review committee. • Councilor Morris thanked Councilor McCallum for his donation of Fiesta parade candy and the Fiesta Organizers for adhering to the scheduled quiet times. On July 28, 2011 the Woodburn Police Department received an application requesting approval for a Change of Ownership /Change of Business Name and Full On- Premises Sales for La Fonda Guadalajara (Currently La Taqueria Guadalajara Authentic Mexican Food) located at 966 N. Pacific Hwy, Woodburn, Oregon. The current business is licensed by OLCC. This establishment is a bar and grill restaurant which will also serve food along with alcohol. The business will be open 10:00 a.m. to 9:00 p.m. Monday through Thursday, 10:00 a.m. to 10:00 p.m. Friday and Saturday and 9:00 a.m. to 10:00 p.m. on Sunday. The application does not indicate that there will be any type of entertainment provided at the business. The Police Department has received no communication from the public or surrounding businesses in support of or against this establishment. DISCUSSION The Police Department has completed a background investigation, in connection with the OLCC, on the applicants and found nothing of a questionable nature, which would preclude the issuance of this license. FINANCIAL IMPACT None. 10 W OODBURN August 22, 2011 TO: Honorable Mayor and City Council through City Administrator In Capacity as Local Contract Review Board FROM: Dan Brown, Public Works Director SUBJECT: Award of Bio- Solids Handling Services Contract RECOMMENDATION Acting in the capacity of Woodburn's Contract Review Board; award the bio - solids handling services contract to Synagro West in the amount of $2,293,750 and authorize the City Administrator to enter into said contract in a form acceptable to the City Attorney. BACKGROUND Removal of bio- solids is a five -year project intended to annually remove 750 dry tons of "caked" bio- solids. The cost of removal and disposal of bio- solids has been planned for, and included, in the Council's adopted Wastewater Treatment Plant Capital Improvement Plan and the FY 2011/12 Budget. In total, the City received four proposals. It was found that all four proposals met the City's minimum requirements. After reviewing the proposals, the Selection Committee recommended that Synagro West be awarded the project on August 11, 2011. Their recommendation is based on criteria specific to all phases of the project. The Selection Committee ranked the firms in the following order based on their evaluation score: 1. Synagro West LLC 91 Points $2,293,750 2. American Progress Group 87 Points $1,772,890 3. JND Thomas 76 Points $2,763,413 4. Anderson Engineering Co. 46 Points $2,476.238 The Engineer's estimated cost was $2,500,000. The Section Committee found Synagro West's proposal to provide the greatest value in terms of cost and services provided. The Synagro West's contract will establish a unit cost of $585 per -dry ton of disposed bio- solids. The Selection Agenda Item Review: City Administrator _x City Attorney _x_ Finance _x- 11 Honorable Mayor and City Council August 22, 2011 Page 2 Committee found Synagro West provided the most comprehensive proposal for addressing the project tasks along with a price that most completely addressed the Scope of Work. Synagro West's proposal emphasized the need to sustain a strong working relationship with the involved agricultural property owners, which is critical to the success of this project. The identification and emphasis of this key element of the bio -solid handling distinguished Synagro West from the other responders. The second ranked firm, American Process Group (APG) provided a lower cost estimate. However, APL's unit price did not adequately address all tasks outlined in the proposed Scope of Work. Consequently, the committee believes APL's estimate is artificially low and would require significant adjustments over the contract period. Because APL's proposal did not address all tasks, their work would not have generated lowered project costs. The selection committee carefully considered APL's entire proposal in making their final recommendation. DISCUSSION The City currently operates two Facultative Sludge Lagoons (FSLs). Both lagoons are nearing their holding capacity. The City has accumulated the bio- solids material in the FSLs since 1999. Councilors may recall, a lagoon dredge was installed in 2009 to allow land application of liquid bio- solids from the south FSL onto the poplar reuse site. However, the current 80 acre poplar reuse site does not provide sufficient area for the volume accumulated in the FSL's, so contracted handling services are needed and being solicited. In preparation of this project, the City applied for and received all required DEQ sludge removal and land application permits, which are now in place. Under DEQ's rules, the annual seasonal construction window for sludge land application end effective October 1. DEQ has issued permits for the disposal of bio- solids on approximately 1000 acres of nearby agricultural land. These DEQ permits only allow for seasonal bio -solid land application between June and October of each year. FINANCIAL IMPACT The cost for the bio- solids handling over the five -year contract period is $585 per dry ton for an estimated $2,293,750. The contract includes future cost 12 Honorable Mayor and City Council August 22, 2011 Page 3 adjustments based on the Portland Consumer Price Index and an allowance for excessive fluctuation in diesel fuel prices. Therefore, the dollar amounts identified in the contract will be adjusted over the contract period. There are sufficient funds in the Sewer Construction Fund 465 to bridge the period of time from contract award until revenue bonds are issued. 13 W OODBURN August 22, 2011 TO: Honorable Mayor and City Council through City Administrator In Capacity as Local Contract Review Board FROM: Dan Brown, Public Works Director SUBJECT: Award of Firearms Range Safety Upgrades Construction Contract RECOMMENDATION Acting in the capacity of Woodburn's Contract Review Board; award the Firearms Range safety improvement design /build contract to Engineered Structures in the amount of $302,905 and authorize the City Administrator to enter into said contract in a form acceptable to the City Attorney. BACKGROUND Initially, the City solicited bids to construct safety improvements for Woodburn's Firearms Range but rejected the bids when they all came in above the project's allotted budget. Then, on June 13, 2011, the City Council approved an alternative design /build process intended to maximize redesign options, thus keeping the project within available resources. The design /build alternative method of construction provides the City with an opportunity to value engineer and negotiate construction costs. Since the Council's June 6 meeting, we have received proposals from two firms, they included: 1. Engineered Structures, Inc. (selected as most qualified to perform work) 2. TCB Construction, Inc. (not selected) DISCUSSION The range is a critical component of the Police Department's training programs. The benefits of having a local facility are many. Growth and expansion in the area have highlighted the need for safety improvements to ensure the facility can continue to meet its purpose in the safest and most efficient manner possible. For example, due to safety concerns, Wastewater Plant operations are interrupted when the range is in use, which often results in loss of productivity. Agenda Item Review: City Administrator _x_ City Attorney _x_ Finance —x- 14 Honorable Mayor and City Council August 22, 2011 Page 2 The proposed improvements will allow normal wastewater plant operations and keep ordinance from exiting the range. Improvements include baffles, earthen barriers and steel needed to enhance safety. Upon the identification of Engineered Structures, staff initiated preliminary value engineering that resulted in lowering the contract price from $407,415 to a recommended contact amount of $302,905. Changes in steel strength, in accordance with training procedures, resulted in initial costs savings. FINANCIAL IMPACT The Police Department Construction Fund 357 has an unobligated balance of $343,185, providing sufficient funds to complete the safety upgrades. If approved, the $302,905 contract will leave an unallocated balance of $40,280 in fund 357. 15
