AN ORDINANCE PROPOSING AN AMENDMENT TO THE CHARTER OF THE CITY OF
WOODBURN TO BE KNOWN AS SECTION 32 OF CHAPTER X; AUTHORIZING THE
CONSTRUCTION AND EQUIPPING OF TWQ NEW WATER WELLS FOR THE CITY OF
WOODBURN TOGETHER WITH MAINS, CONNECTION SYSTEMS, NECESSARY
EQUIPMENT, MODIFICATIQN OF THE EXISTING WATER SYSTEM, ACQUIRING
AND PREPARATIpN OF NECESSARY REAL PROPERTY SITES AND RIGHTS-OF-
WAY; PROVIDING FOR THE NECESSARY ENGINEERING, LEGAL AND ADMINISTRATIVE
COSTS; PROVIDING FOR THE PAYMENT OF THE COST OF SUCH IMPROVEMENT
BY THE ISSUANCE OF BONDS OF THE CITY OF WOODBURN IN AN AMOUNT NOT
TO EXCEED $375,000.00; AUTHORIZING A LEVY OF A SPECIAL TAX TO PAY
THE PRINCIPAL AND INTEREST OF SUCH BONDS; REFERRING THE AMENDMENT
TO THE LEGAL ELECTORS OF THE CITY; CALLING FQR A SPECIAL ELECTION
TO BE HELD IN CONJUNCTION WITH THE GENERAL PRIMARY ELECTION OF
THE STATE OF OREGON; AND DECLARING AN EMERGENCY.
WHEREAS, the present water wells of the City of Woodburn
are inadequate, obsolete and totally inadequate for proper and
efficient water needs of the City of Woodburn; and
WHEREAS, the City Engineer of the City of Woodburn, to-
gether with engineering consultants employed by the City, have
determined that the cost of two new wells, together with necessary
water mains, equipment, site acquisition and preparation, including
rights-of-way from the water wells to the existing water system of
the City, modification of the present water system to incorporate
the use of such new wells, and the costs of engineering, administrative
and legal expenses will cost approximately $375,000.00; and
WHEREAS, the City of Woodburn is in dire need at the
present time of additional water wells to provide an adequate water
supply for of the City and its inhabitants; and
WHEREAS, it, would be to the best interest of the City to
take such immediate steps as are necessary to finance the installation

of two additional wells, to modify and reconstruct the water
system so as to use the water from the wells, and to pay for the
costs of engineering, administrative and legal expenses, and it
will, therefore, be necessary to borrow money and in evidence
thereof, issue bonds of the City of Woodburn, and before the bonds
can be issued, the question of issuing said bonds must be submitted
to the electors of said City and approved by a majority of the
electors voting on said question at the election called for that
purpose; now therefore,
THE PEOPLE OF THE CITY OF WOODBURN DO ORDAIN:
Section 1. That the Common Council of the City of Woodburn,
Marion County, Qregon, hereby proposes an amendment to the Charter
of said City amending the Charter by the addition of a section to
be known as Section 32 of Chapter X of said Charter to read as
follows:
"Section 32. That in addition to all other obligations
heretofore provided and authorized to be issued by the Common
Council of the City of Woodburn, the Common Council shall have
the. power and is hereby authorized to construct and utilize
two new water wells, together with acquisition and preparation
of real property for the sites, rights-of-way for water mains
and wells, modification of the present water system to utilize
the water flow from the new wells, to provide for the necessary
engineering, administrative and legal costs of the improvement
and this bond issue, and to do all things necessary, expedient
and incidental thereto; and in order to obtain funds to finance

such improvement and to perform all matters necessary, expedient
and incidental thereto, the Common Council shall have the
power and is hereby authorized to issue general obligation
bonds of said City in such principal sum as the Common Council
may hereafter by ordinance determine to be in the best interest
of the City, not exceeding, however, the principal sum of
$375,000.00; such bonds to be issued in such denominations,
payable or redeemable at such times, bearing such rate of
interest, and in such form as the Common Council may hereafter
by ordinance determine to be to the best interest of said
City. For the purpose of providing for the payment of the
interest upon said bonds and the retirement of the bonds,
the Common Council, is hereby authorized to include in its
budget and to levy against the taxable property within the
City an amount sufficient to pay the interest and retire the
bonds, or any part thereof, at their maturity."
Section 2. That the proposed amendment to the Charter of
the City of Woodburn, Marion County, Oregon, shall be submitted to
the legal electors of said City at a special municipal election
which shall be held in conjunction with the general primary election
of the State of Oregon to be held in the City of Woodburn in
accordance with the laws of the State of Oregon and the Charter and
Ordinances of the City on the 23rd day of May, 1978. Polls shall
be open between the hours of 8:00 a.m, and 8:00 p.m. on said date
and the election shall be held in the regular polling places far
the general and primary elections in each ward. The election

board, counting board and such other clerks and officials as may be
required for the proper conduct of the election shall be the same
as appointed by Marion County to conduct the general primary election
to be held within such wards.
Section 3. That the form in which said election shall be
submitted to the electors of said City and the official ballot at
such election shall be substantially as follows:

Purpose: To amend the Woodburn City Charter to authorize a
bond issue not to exceed $375,000.00 to construct
two new water wells, acquire sites and rights-of-
way, equipment to equip said wells and water system,
engineering, administrative and legal costs, and
to do all things necessary thereto.
Question: Shall the City of Woodburn, Marion County, State
of Oregon, amend its Charter to permit the con-
tracting of a general obligation bonded indebtedness
in the sum not to exceed $375,000.00 for the purpose
of providing funds to meet the cost of construction
of two new wells, acquisition of real property sites
and rights-of-way, acquiring of equipment and supplies
for such construction and installation to the Woodburn
City water system, ,and to provide funds to pay the cost
of engineering, administrative and legal costs of such
installation and this bond issue, to levy a tax as
necessary, and to do all things required to utilize the
additional two wells into the City of Woodburn water
system?

Section 4. That the Recorder shall post a typewritten
notice in a conspicuous place in the City Hall and in one public
place in each election ward of the City of Woodburn not less
than ten days prior to the date of the election, particularly
describing the time and places for said election, and stating the
ballot title and a statement of the measure to be voted upon at
said election as set forth in this ordinance.
Section 5. That the ballots for said election shall be
printed in accordance with this ordinance and the applicable pro-
visions of Ordinance No. 1173 and the State of Oregan election laws.
Section 6. This ordinance being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this ordinance shall take effect upon its
passage by the Council and approval by the Mayor.
