ORDINANCE N0. 1626
AN ORDINANCE RELATING TO THE IMPROVEMENT OF WEST CHURCH STREET FROM
THE INTERSECTION OF SETTLEMIER AVENUE AND WEST CHURCH STREET WESTERLY
TO THE INTERSECTION OF WEST CHURCH STREET AND LEASURE STREET IN THE
CITY OF WOODBURN; DIRECTING THE INVITATION AND RECEIPT OF BIDS;
PROVIDING FOR PAYMENT OF THE COSTS THEREOF BY GENERAL OBLIGATION
CONSTRUCTION WARRANTS; PROVIDING THAT THE COSTS THEREOF SHALL BE
ASSESSED TO THE PROPERTIES BENEFITED; AND DECLARING AN EMERGENCY.
WHEREAS, West Church Street is now an unimproved street
in the City of Woodburn; and
WHEREAS, Resolution No. 657 was passed to improve such
street; and
WHEREAS, a public hearing was held on May 15, 1978; and
WHEREAS, remonstrances sufficient in number to prevent
such improvement have not been received; now therefore,
THE PEOPLE OF THE CITY OF WOODBURN DO ORDAIN:
Section 1. That West Church Street from the intersection
of Settlemier Avenue and West Church Street westerly to the
intersection of West Church Street and Leasure Street in the City
of Woodburn, be improved pursuant to Resolution No. 657 proposing
such improvement, by grading the same to the proper subgrade, by
providing all necessary and expedient drainage facilities, by
placing upon said subgrade sufficient gravel to provide a proper
base, by constructing curbs and paving said street with an asphaltic
surface to an appropriate width, all in accordance with the plans,
specifications and estimates of the City Engineer therefor, which
said plans, specifications and estimates are hereby incorporated
herein and made a part of this ordinance by reference.

Section 2. That the cost of said improvement shall be
done at the expense of the property specially and peculiarly
benefited by such improvement within the assessment district
established by Section 3 of this ordinance.
Section 3. That the property specially and peculiarly
benefited by such improvement and to be assessed therefor is
hereby declared to be the parcels of real property described in
the Marion County Record of Deeds as follows:
The following property located in Ben Hall's Addition
to the City of Woodburn, Marion County, Oregon:
Block 1, Lots 1 & 18
Block 4, Lots 1 & 18
Block 5, Lots 3, 4 & 5
Plus the following described Marion County Tax
Lots Nos. 1774, 1775-211, & 1777
Section 4. That the City Engineer's estimate of the
probable cost of said improvement is the sum of $23,650.00.
Section 5. That the limit of time such improvement
shall be maintained by the City of Woodburn is hereby fixed at ten
years.
Section 6. That the City Recorder be and he is hereby
directed to give notice of and invite bids for the construction of
said street in accordance with the plans, specifications and
estimates in the manner provided in the Charter of the City of
Woodburn and the laws of the State of Oregon.
Section 7. Bids for such improvement will be received
by the City in accordance with ORS Chapter 279 and Ordinance No.
149$ pertaining to the Woodburn Contract Review Board and in
accordance with its rules and regulations.
Section 8. That the Treasurer of the City of Woodburn

is hereby authorized and directed to issue to the contractor, and
to others furnishing services in connection with this improvement,
general obligation improvement warrants of the City of Woodburn in
payment of completed work on this improvement in accordance with
the. estimates of completed work furnished monthly by the City
Engineer of the City of Woodburn.
Section 9. That such warrants shall be a general
obligation of the City of Woodburn as provided in ORS 287.502 to
ORS 2$7.510. The warrants shall draw interest from the date
of issue at the rate of lawful legal interest per annum until
called for payment. The warrants shall be callable as provided by
law and shall mature on or before two years after the date thereof.
Interest shall be paid annually if the warrant is presented to the
City Treasurer for such interest payment, otherwise the interest
shall be paid at the time of redemption.
Section 10. This ordinance being necessary for the im-
mediate preservation of the public peace, health and safety, an
emergency is declared to exist and this ordinance shall take effect
,immediately upon passage by the Council and ap, oval by the May

I, BARNEY 0. HUBRIS, Recorder of the City of Woodburn, do
hereby certify that I caused to be posted three copies of
Ordinance No. 1626, one of which said copies posted in the
City Hall on the bulletin board adjacent to the entranc to
the Recorder's Office, in full view of the traveling public;
a second one of said copies posted on the Woodburn Public
Library bulletin board at 280 Garfield Street, in full view
of the traveling public; a third one of said copies posted
on the Community Center bulletin board at 491 i~. Third St.,
in full view of the traveling public; that all of said places
are public places within the corporate limits of the City
of Woodburn and all of said copies were posted on the
28th day of June 1978.
