ORDINANCE N0. 1628
AN ORDINANCE RELATING TO THE IMPROVET~ENT OF LEASURE STREET FROM
THE INTERSECTION OF WEST HAYES STREET AND LEASURE STREET NORTHERLY
TO THE INTERSECTION OF WEST LINCOLN STREET AND LEASURE STREET IN
THE CITY OF WOODBURN; DIRECTING THE INVITATION AND RECEIPT OF
BIDS; PROVIDING FOR PAYMENT OF THE COSTS THEREOF BY GENERAL OB-
LIGATION CONSTRUCTION WARRANTS; PROVIDING THAT THE COSTS THEREOF
SHALL BE ASSESSED TO THE PROPERTIES BENEFITED; AND DECLARING AN
EMERGENCY.
WHEREAS, Leasure Street is now an unimproved street in
the City of Woodburn; and
WHEREAS, Resolution No. 659 was passed to improve such
street; and
WHEREAS, a public hearing was held on May l5, 19?8; and
WHEREAS, remonstrances sufficient in number to prevent
such improvement have not been received; now therefore,
THE PEOPLE OF THE CITY OF WOODBURN DO ORDAIN:
Section 1. That Leasure Street from the intersection of
West Hayes Street and Leasure Street northerly to the intersection
of West Lincoln Street and Leasure Street in the City of Woodburn,
be impxoved pursuant to Resolution No. 659 proposing such improve-
ment, by grading the same to the proper subgrade, by providing all
necessary and expedient drainage facilities, by placing upon said
subgrade sufficient gravel to provide a proper base, by con-
structing curbs and paving said street with an asphaltic surface
to an appropriate width, all in accordance with the plans, specif i-
cations and estimates of the City Engineer therefor, which said
plans, specifications and estimates are hereby incorporated herein
and made a part of this ordinance by reference.

Section 2. That the cost of said improvement shall be
done at the expense of the property specially and peculiarly
benefited by such improvement within the assessment district
established by Section 3 of this ordinance.
Section 3. That the property specially and peculiarly
benefited by such improvement and to be assessed therefor is
hereby declared to be the parcels of real property described in
the Marion County Record of Deeds as follows:

Section 4. That the City Engineer's estimate of the
probable cost of said improvement is the sum of $30,710.00.
Section 5. That the limit of time such improvement shall
be maintained by the City of Woodburn is hereby fixed at ten years.
Section 6. That the City Recorder be and he is hereby
directed to give notice of and invite bids for the construction of
said street in accordance with the plans, specifications and estimates
in the manner provided in the Charter of the City of Woodburn and
the laws of the State of Oregon.
Section 7. Bids for such improvement will be received
by the City in accordance with ORS Chapter 279 and Ordinance No.
x,498 pertaining to the Woodburn Contract Review Board and in
accordance with .its rules and regulations.
Section 8. That the Treasurer of the City of Woodburn
is hereby authorized and directed to issue to the contractor, and

to others furnishing services in connection with this improvement,
general obligation improvement warrants of the City of Woodburn in
payment of completed work on this improvement in accordance with
the estimates of completed work furnished monthly by the City
Engineer of the City of Woodburn.
Section 9. That such warrants shall be a general
obligation of the City of Woodburn as provided in ORS 287.502 to
ORS 287.510. The warrants shall draw interest from the date of
issue at the rate of lawful legal interest per annum until called
for payment. The warrants shall be callable as provided by law
and shall mature on or before two years after the date thereof.
Interest shall be paid annually if the warrant is presented to the
City Treasurer for such interest payment, otherwise the interest
shall be paid at the time of redemption.
Section 10. This ordinance being necessary for the im-
mediate preservation of the public peace, health and safety, an
emergency is declared to exist and this ordinance shall take effect
immediately upon passage by the Council and approval by the
Mayor.
