AN ORDII~IANCE A~~ENDING ORDII~IANCE N0. 1518 , ALSO KNOWN AS THE
WOODBURN SUBDIVISION ORDINANCE, PROVIDING FOR STAFF APPROVAL
OF PARTITIONINGS, AND PROVIDING FOR COI~~MISSION REVIEW OF STAFF
DECISIONS.
THE PEOPLE OF THE CITY OF WOODBURN DO ORDAIN:
Section 1. That Section 15 of Ordinance No. 1518, also
known as the Woodburn Subdivision Ordinance, be, and the same is
amended to read as follows:
Section 15. (a) An application to partition shall be
filed with the Secretary of the Woodburn Planning Commis-
sion. The application will include the following in-
formation and data:
1. Description of property.
2. Location.
3. Legal description.
4. Zoning.
5. Vacinity map.
6. Plot plan, one (1) inch equals 200' scale, or
larger.
7. Names of the property owner, petitioner and
engineer.
8. Names of all property owners within one hundred
(100) feet of the land in continguous ownership
of the person requesting the partitioning.
9. Utilities.
10. Intended uses.
11. Any information required by the Secretary.
(b) When an area or tract of land is to be partitioned
that does not include creation of a public road or street,
an application shall be filed with the Secretary of the
Woodburn Planning Commission. The Secretary shall decide
whether a minor partitioning will be allowed or denied.
This decision will not take effect until the day following
the next regularly scheduled meeting of the Planning Com-
rnission, or ten (10) days from the date of the decision
whichever is greater. The Commission shall review the
decisions of the Secretary, and may modify, amend or
reverse the decision of the Secretary as they deem fit.

(c) If the partitioning will create a public
road or street, then a public hearing shall be held and
the Commission shall r~lake a decision on the partitioning.
(d} Appeal. Fallowing action on the partitioning
application by the Secretary, any interested person may
appeal to the Commission no later than ten (10} days
after the decision of the Secretary is rendered. The
Commission shall hold a public hearing in conformance
with Section 4 of the Woodburn Subdivision Ordinance.
Appeals to the Council from the decision of the Commission
shall be in accordance with the procedures set forth
in Section 5 of this ordinance.
Section 2. That Section 4(b} of Ordinance No. 1518, as
amended by Ordinance No. 1575, be, and the same is amended to
read as follows:
Section 4. Planning Commission Approval Required.
(b} A public hearing shall be held on all sub-
division preliminary plans, and all partitionings which
create a public road or street. The hearing shall be
conducted and notice posted in accordance with Chapter 3
of the Woodburn Zoning Ordinance. The notification area
for a subdivision shall be the same as that for a zone
change, and the notification area for a partitioning
shall be the same as that for a variance request.

I, BARNEY 0. BURRIS, Recorder of the City Of Woodburn, do
hereby certify that I caused to be posted three copies of
Ordinance No. 1636, one of which said copies posted in the
City Hall on the bulletin board adjacent to the entrance to
the Recorder's Office, in full view of the traveling public;
a second one of said copies posted on the Woodburn Public
Library bulletin board at 280 Garfield Street, in full view
of the traveling public; a third one of said copies posted
on the Community Center bulletin board at 491 N. Third St.,
in full view of the traveling public; that all of said places
are public places within the corporate limits of the City
of Woodburn and all of said copies were posted on the
12th day of July `i, 1978.
