Ord 1645COUNCIL BILL N0. 479 ORDINANCE N0. 1645 AN ORDINANCE PROVIDING FOR THE CALLING OF A CITY TAX BASE ELECTION IN THE CITY OF WOODBURN, MARION COUNTY, OREGON, ON NOVEMBER 7, 1978, FOR THE PURPOSE OF SUBMITTING TO THE LEGAL VOTERS OF THE CITY OF WOODBURN, OREGON, THE QUESTION OF ESTABLISHING A NEW TAX BASE FOR THE PURPOSE OF APPLYING THE LIMITATION ON TAXATION SET FORTH IN SECTION 11, ARTICLE XI, OREGON CONSTITUTION; AND DECLARING AN EMERGENCY. WHEREAS, the City Council of the City of Woodburn, Oregon, has determined that a new tax base should be established as authorized by Subsection 5, Section 11, Article XI, Oregon Con- stitution, in order to permit the proper operation of the City affairs within the limitation contained in Section 11, Article XI, Oregon Constitution; and WHEREAS, it is necessary to submit the question of establishing a new tax base to the legal voters of the City of Woodburn, Oregon; now therefore, THE PEOPLE OF THE CITY OF WOODBURN DO ORDAIN: Section 1. The proposition set forth in Section 2 of this ordinance shall be submitted in the manner prescribed by law to the legal voters of the City of Woodburn, Oregon, at a regular city election to be held on Tuesday, November 7, -1978, in con- junction with the regular statewide general election. Section 2. At the election, there shall be submitted to the legal voters of the City of Woodburn for their approval or rejection the following proposition: "Shall the City of Woodburn, Marion County, Oregon, establish a new tax base, raising it from $81,060.00 to $401,127.00?" The Marion County election boards and officials who are appointed to handle the regular statewide general election in the election precincts located within the City of Woodburn on Tuesday, November 7, 1978, are hereby designated to conduct the election for the City and to report the results to the City Recorder. Section ~. The polls for the City tax base election shall be opened i~n each of the City's voting precincts concurrent with the statewide general election that will be held on the same day. Section 5. Only those electors qualified to vote at the statewide general election and who reside within the boundaries of the City of Woodburn shall be permitted to vote on the question of establishing a new City tax base. Section 6. Notice of the election to establish a new tax base shall be given by publication twice in the Woodburn Independent, a newspaper of general circulation printed and published in the City of Woodburn, Marion County, Oregon, not more than thirty (30) or less than ten (107 days before the election. Notices of the Casty election shall be posted for not less than twenty (20) days before the election in three (3) public and conspicuous places within the City. The notice a.n the newspaper and that posted shall be in substantially the following form: On Tuesday, November 7, 1978, in the City of Woodburn, Marion County, Oregon, from 8:00 a.m. until 8:00 p.m. a City election will be held in conjunction with the statewide general election at which the following proposition will be submitted to the legal voters of the City of Woodburn for their approval or rejection: page 2 - COUNCIL BILL N0. 479 ORDINANCE NO. 1645 ESTABLISHING NEW CITY TAX BASE Shall the City of Woodburn, Marion County, Oregon, establish a new tax base, raising it from $81,060.00 to $401,127.00? This proposition if adopted will establish a new tax base for the City of Woodburn, Oregon, for the purpose of applying the limitation on taxation set forth in Section 11, Article XI, Oregon Constitution. The present tax base is $81,060.00, the new tax base if adopted will be $401,127.00, and the new tax base if adopted shall first apply to the fiscal year next following this election. The polling places in the City for the City election will be at the same places as provided by Marion County for the statewide general election to be held on the same day, Tuesday, November 7, 1978, and to such places as the election boards may legally adjourn. The Common Council by ordinance has appointed the identical officers appointed by the Marion County Election Department for the statewide general election to serve in each of the polling places in the respective precincts as the officials appointed to conduct the City election. The City Recorder shall advertise and post or cause to be posted the notices required by Section 6 of this ordinance. The notices of the City election on establishing a new tax base required to be given by Section 6 of this ordinance shall constitute the only notice necessary, and all Ordinances or Resolutions in conflict herewith shall not apply to the notices required to be given at this election. It shall be unnecessary for either the City of Woodburn or any official thereof to furnish the Page 3 - COUNCIL BILL N0. 479 ORDINANCE N0. 1645 legal voters at the City tax base election pamphlets containing either: (a) the text of the proposition or (b) arguments in support of or in opposition to the proposition. Section 8. The following is the number and form in which the question shall be printed upon the official ballots: CITY BALLOT Regular Municipal Election, November 7, 1978 City of Woodburn, Marion County, Oregon Vote YES or NO - Mark X or ~ in the Square for the Answer Voted For Submitted to the People by the Common Council 51 ESTABLISHING NEW CITY TAX BASE Question: Shall the City of Woodburn, Marion County, Oregon, increase its tax base from $81,060.00 to $401,127.00? YES [ J NO [ J Explanation: The current Woodburn property tax base for the City is $81,060.00. This is the base, along with limited sources other than property tax, which provides for general government. General government, which includes public safety, is a necessity. The 1977-78 Public Safety Serial levy, as approved by the voters in 1976, was $320,067.00 in excess of the current base of $81,060.00. The two sums equal $401,127.00 which the Common Council of the City of Woodburn places before the voters to be established as a new tax base for the purpose of general government. This ordinance being necessary for the im- mediate preservation of the public peace, health and safety, an emergency is declared to exist and this ordinance shall take effect immediately upon passage by the Council and approval by the Mayor.
